El texto es el siguiente:\n\nArtículo 31 bis- Obligación de garantizar la implementación de pasos de fauna de medidas para el paso seguro de la fauna silvestre en los sitios donde se evidencie, bajo criterio de experto, que la infraestructura vial cantonal y nacional sea esta existente u obra nueva, interrumpe la conectividad natural fragmentando hábitats acuáticos y terrestres.\n\nToda infraestructura pública que, por su locación o funcionamiento y según se demuestre mediante los estudios y evidencias correspondientes, afecte directa o indirectamente el desplazamiento natural de fauna silvestre de cualquier especie (terrestre o acuática), en cualquier parte del país, en especial en áreas de protección, áreas silvestres protegidas, parques nacionales, reservas forestales, bosques, patrimonio natural del Estado o cualquier punto frágil que se identifique como cruce natural de fauna silvestre, deberá contar con las estructuras adecuadas que faciliten el libre paso de esta de un lado al otro de la infraestructura para todos los sitios en los que los estudios así lo determinen. De tal forma que permita el movimiento de vida silvestre dentro de su rango de hábitat, el flujo genético y un ecosistema ecológicamente equilibrado.\n\nEl Ministerio de Obras Públicas y Transportes (MOPT), las municipalidades, así como cualquier otra entidad estatal, deberá coordinar con el Sistema Nacional de Áreas de Conservación para incluir la implementación de los pasos de fauna en proyectos nuevos; o bien, descartar la necesidad de estas.\n\nPara las vías existentes y en operación, donde se apliquen actividades de sustitución de elementos, rehabilitación, mejoramiento, ampliación y mantenimiento, de igual forma debe garantizarse la implementación de las medidas necesarias para mitigar la fragmentación de hábitats y procurar el paso seguro de las especies de fauna silvestre. Dichos sitios deberán ser identificados mediante criterio técnico-científico y en consenso con el Sinac.\n\nLa identificación de medidas dirigidas a fauna silvestre debe ser parte integral de la formulación de cualquier proyecto de infraestructura pública, desde la etapa de identificación y pre-inversión, de manera que los costos de su implementación y mantenimiento sean considerados en el presupuesto requerido para realizar el proyecto. La Secretaría Técnica Nacional Ambiental deberá verificar la inclusión del compromiso de implementar las medidas ambientales dirigidas a la fauna silvestre en la ejecución de proyectos de infraestructura, como parte del otorgamiento de la viabilidad ambiental, lo anterior según las recomendaciones de los estudios biológicos y técnicos correspondientes.\n\nLos proyectos de obra vial categorizados como de muy bajo impacto, pero que por su ubicación se identifique el impacto sobre la fragmentación de la conectividad ecológica y que afecte el desplazamiento de la fauna silvestre (acuática y terrestre), deben implementar medidas ambientales de mitigación como parte de la aplicación del Código de Buenas Prácticas Ambientales.\n\nLas medidas ambientales a implementar, así como el diseño de estas, serán producto del estudio técnico-científico por medio del cual se identificarán los puntos calientes donde se requiera la implementación de estas medidas. Dicho estudio debe ser realizado por el desarrollador y avalado por el Sinac. El desarrollador debe considerar los sitios de alta mortalidad donde hay evidencia de accidentes mediante el reporte al Sistema de Trámite de Denuncias Ambientales o investigaciones que así lo demuestran.\n\nLa empresa responsable de la obra deberá instalar los pasos de fauna en las condiciones adecuadas y respetando los diseños que se indique en el plan de gestión ambiental o en la declaración jurada de compromisos ambientales.\n\n Ficha Artículo 1\n\nTRANSITORIO I- El Poder Ejecutivo, con la asesoría técnica del Sistema Nacional de Áreas de Conservación (Sinac) y Ministerio de Obras Públicas y Transportes (MOPT), deberá reglamentar la presente ley. El reglamento debe incorporar criterios de diseño, monitoreo de la efectividad de las medidas implementadas y el abordaje de las necesidades para las mejoras y mantenimiento de estas. De igual forma, debe incluir de manera clara las competencias y alcances de cada institución involucrada.\n\n Ficha Artículo 1 Transitorio\n\nTRANSITORIO II- En un plazo no mayor a veinticuatro meses posterior a la entrada en vigencia de la reglamentación que indica el transitorio I de esta ley, el Sistema Nacional de Áreas de Conservación (Sinac), en el ámbito de su competencia, deberá iniciar de manera urgente y prioritaria la identificación de los cruces naturales de fauna y puntos frágiles en infraestructura lineal existente, a fin de que solicite y coordine con las instituciones concernientes la implementación de las medidas ambientales para garantizar la protección y conservación de la fauna silvestre. The text reads as follows:\n\nArticle 31 bis—Obligation to ensure the implementation of wildlife crossings, meaning measures for the safe passage of wild fauna at sites where, in an expert’s judgment, existing or new cantonal and national road infrastructure interrupts natural connectivity by fragmenting aquatic and terrestrial habitats.\n\nAll public infrastructure that, because of its location or operation and as demonstrated by the relevant studies and evidence, directly or indirectly affects the natural movement of wild fauna of any species (terrestrial or aquatic), anywhere in the country—especially in protection areas, protected wild areas, national parks, forest reserves, forests, State Natural Heritage, or any fragile point identified as a natural wildlife crossing—must have appropriate structures to facilitate the free passage of wildlife from one side of the infrastructure to the other at all sites where the studies so determine. These structures must allow wildlife to move within its habitat range, support gene flow, and maintain an ecologically balanced ecosystem.\n\nThe Ministry of Public Works and Transport (MOPT), municipalities, and any other state entity must coordinate with the National System of Conservation Areas to include the implementation of wildlife crossings in new projects, or to rule out the need for them.\n\nFor existing roads in operation where activities are carried out to replace components, rehabilitate, improve, widen, or maintain them, the necessary measures must likewise be implemented to mitigate habitat fragmentation and facilitate the safe passage of wild fauna species. Those sites must be identified through technical and scientific assessment and by consensus with Sinac.\n\nThe identification of measures directed at wild fauna must be an integral part of formulating any public infrastructure project, from the identification and pre-investment stage, so that the costs of implementing and maintaining those measures are included in the budget required to carry out the project. The National Environmental Technical Secretariat must verify that the commitment to implement environmental measures directed at wild fauna is included in the execution of infrastructure projects, as part of granting environmental viability, based on the recommendations of the relevant biological and technical studies.\n\nRoad construction projects categorized as having very low impact, but whose location is found to affect ecological connectivity fragmentation and the movement of wild fauna (aquatic and terrestrial), must implement environmental mitigation measures as part of applying the Code of Good Environmental Practices.\n\nThe environmental measures to be implemented, as well as their design, shall result from the technical and scientific study identifying the hot spots where these measures are required. That study must be conducted by the developer and approved by Sinac. The developer must consider high-mortality sites where accidents are evidenced by reports to the Environmental Complaint Processing System or by investigations demonstrating such accidents.\n\nThe company responsible for the work must install the wildlife crossings under appropriate conditions and in accordance with the designs specified in the environmental management plan or sworn statement of environmental commitments.\n\nArticle 1 Record\n\nTRANSITIONAL PROVISION I—The Executive Branch, with technical advice from the National System of Conservation Areas (Sinac) and the Ministry of Public Works and Transport (MOPT), must issue regulations for this law. The regulations must incorporate design criteria, monitoring of the effectiveness of implemented measures, and procedures for addressing the need to improve and maintain them. They must also clearly specify the powers and scope of each institution involved.\n\nTransitional Provision Article 1 Record\n\nTRANSITIONAL PROVISION II—Within no more than twenty-four months after the regulations referred to in Transitional Provision I of this law enter into force, the National System of Conservation Areas (Sinac), within its area of competence, must urgently and as a priority begin identifying natural wildlife crossings and fragile points along existing linear infrastructure, so that it can request and coordinate with the relevant institutions the implementation of environmental measures to ensure the protection and conservation of wild fauna. The obligations arising under this article shall be implemented in accordance with budget availability, institutional planning, and the principles of reasonableness and proportionality, without prejudice to the obligation to prevent environmental harm.\n\nThis law shall enter into force upon its publication.\n\nGiven at the Presidency of the Republic, San José, on the twenty-sixth day of August in the year two thousand twenty-six.\n\nLET IT BE EXECUTED AND PUBLISHED.\n\nTransitional Provision Article 2 Record"
