En lo fundamental se rige por la presente, la cual ( artículo 104 ) lo\ncrea y ( artículos 20 y 21 ) determina sus atribuciones.\"\n\n(*)(Modificada\nsu denominación por el artículo 11 de la Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al\nMinisterio de Ciencia y Tecnología, N° 9046 del 25 de junio de 2012)\n\nTITULO I\n\nPRINCIPIOS\n\nCAPITULO I\n\nObjetivos\n\nArtículo 1- Para los\npropósitos del desarrollo científico, tecnológico y de la innovación objeto de\nesta ley se fija como objetivo general facilitar la investigación\ncientífico-tecnológica y la innovación que conduzcan a un mayor avance\neconómico y social en el marco de una estrategia de desarrollo sostenible y\nproductividad del país, con el propósito de conservar, para las futuras\ngeneraciones, los recursos naturales del país y garantizarle al costarricense\nuna mejor calidad de vida y bienestar, así como un mejor conocimiento de sí\nmismo y de la sociedad.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, N° 9971 del 11 de\nmayo del 2021)\n\n ARTICULO 2.- El objetivo de largo plazo para el desarrollo\n\ncientífico y tecnológico será crear las condiciones para cumplir con una\n\npolítica en esa materia.\n\nArtículo 3- Son\nobjetivos específicos para el desarrollo científico y tecnológico:\n\na) Orientar la\ndefinición de las políticas específicas para la promoción y el estímulo del\ndesarrollo de la ciencia, la tecnología y la innovación en general, así como de\nlas telecomunicaciones.\n\nb) Apoyar la actividad\ncientífica, tecnológica y de innovación que realice cualquier entidad privada o\npública, nacional o extranjera, que contribuya a la productividad, al\nintercambio científico y tecnológico con otros países, o que esté vinculada con\nlos objetivos del desarrollo nacional. Asimismo, generar las políticas públicas\nque garanticen el derecho de los habitantes a obtener servicios de\ntelecomunicaciones, así como asegurar la aplicación de los principios de\nuniversalidad y solidaridad del servicio de telecomunicaciones y fortalecer los\nmecanismos de universalidad y solidaridad de las telecomunicaciones,\ngarantizando el acceso a los habitantes que lo requieran.\n\nc) Establecer estímulos\ne incentivos para los sectores privado y público y para las instituciones de\neducación pública y privada y otros centros de educación pública y privada, con\nla finalidad de que incremente la capacidad de generar ciencia y tecnología y\nde que estas puedan articularse entre sí y con el sector productivo, para\nmejorar la competitividad del país.\n\nch) Fomentar la\natracción y el aprovechamiento de las capacidades tecnológicas y de innovación,\ninvestigación y desarrollo de entes académicos, laboratorios de investigación,\ncentros de transferencia tecnológica internacionales al país, que promuevan el\ndesarrollo del ecosistema de innovación nacional y complementen o apoyen el\ndesarrollo de dichas capacidades en los sectores productivos, académicos y en\nel gobierno.\n\nd) Crear las\ncondiciones adecuadas para que la ciencia y la tecnología cumplan con su papel\ninstrumental de ser factores básicos para lograr mayor competitividad y\ncrecimiento del sector productivo nacional.\n\ne) Estimular la\ninnovación como elemento esencial para fortalecer la capacidad del país, para\nadaptarse a los cambios en el comercio y la economía internacional, para elevar\nlas capacidades de emprendimiento y empresariales de innovación y la calidad de\nvida de los costarricenses.\n\nf) Estimular la gestión\ntecnológica en el territorio nacional, para la reconversión del sector\nproductivo costarricense y el incremento de la capacidad competitiva, a fin de\nque sea capaz de satisfacer las necesidades básicas de la población y elevar la\nproductividad país.\n\ng) Fomentar todas las\nactividades de apoyo al desarrollo científico tecnológico sustantivo y de\ninnovación; los estudios técnicos, especializados y de posgrado y la\ncapacitación de recursos humanos, así como el mejoramiento de la enseñanza de\nlas ciencias, las matemáticas y la educación técnica, lo mismo que la\ndocumentación e información científica y tecnológica.\n\nh) Apoyar todas las\ngestiones que procuren el incremento de la creatividad y el pensamiento\ncientífico original de los costarricenses.\n\ni) Fomentar y apoyar\nlas investigaciones éticas, jurídicas, económicas, científico-sociales y de\ninnovación, en general, que tiendan a mejorar la comprensión de las relaciones\nentre la ciencia, la tecnología y la sociedad, la equidad e igualdad de género\nen la ciencia, la tecnología y la innovación; así como del régimen jurídico\naplicable en este campo. Todo esto con el fin de hacer más dinámico el papel de\nla ciencia y la tecnología en la cultura y en el bienestar social.\n\nj) Fomentar todas las\nactividades en que se apoye el proceso de innovación tecnológica: la\ntransferencia de tecnología, la consultoría e ingeniería, la normalización, la\nmetrología y el control de calidad y otros servicios científicos y\ntecnológicos.\n\nk) Promover el\ndesarrollo y uso de los servicios de telecomunicaciones dentro del marco de la\nsociedad de la información y el conocimiento, y como apoyo a sectores como\nsalud, seguridad ciudadana, educación, cultura, comercio y gobierno\nelectrónico, entre otros.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, N° 9971 del 11 de\nmayo del 2021)\n\nCAPITULO II\n\nDeberes y\nresponsabilidades del Estado\n\nArtículo 4- De conformidad con los objetivos\nseñalados en la presente ley, el Estado tiene los siguientes deberes,\npara fomentar la ciencia, la tecnología y la innovación.\n\na) Velar por que la ciencia, la tecnología y la\ninnovación estén al servicio de los costarricenses, les provea\nbienestar y les permita aumentar el conocimiento de sí mismos, de la\nnaturaleza y de la sociedad.\n\nb) A través de la coordinación del Ministerio\nde Ciencia, Innovación, Tecnología, y\n\nTelecomunicaciones formular, supervisar la ejecución\ny evaluar el impacto y los resultados\n\nde las políticas y planes nacionales, sobre ciencia,\ntecnología e innovación en consulta con las entidades y los\norganismos públicos y privados que integran el Sistema Nacional de\nCiencia, Tecnología e Innovación.\n\nc) Proporcionar los instrumentos específicos para\nincentivar y estimular las investigaciones, la transferencia del conocimiento,\nla ciencia, la tecnología e innovación, como condiciones\nfundamentales del desarrollo económico, social y productivo y como\nelementos de la cultura universal.\n\nch) Estimular, garantizar y promover la libertad\nconstitucional de la enseñanza y de la investigación\ncientífica y tecnológica.\n\nd) Coordinar, a través del Ministerio de Ciencia,\nInnovación, Tecnología y Telecomunicaciones, el trabajo conjunto\nde los sectores privado y público y los centros de investigación\ny de innovación de las instituciones académicas (públicas,\nprivadas, nacionales e internacionales) en todos los niveles, así como\norientar sobre la ejecución y el seguimiento de las políticas\nsobre ciencia, tecnología e innovación.\n\ne) Fomentar la capacidad creadora del costarricense,\nmediante el apoyo de los programas y las actividades científicas,\neducativas y culturales que tengan ese propósito, y mediante el\notorgamiento de premios y beneficios a aquellas personas que contribuyan con\nresultados positivos al desarrollo nacional en ciencia y tecnología.\n\nf) Presupuestar, en forma explícita, los recursos que\nlas instituciones y órganos del Estado destinarán y\nadministrarán para las actividades de investigación y desarrollo\ncientífico, tecnológico y de innovación.\n\ng) Estimular la capacidad de gestión\ntecnológica y de innovación de las empresas públicas y\nprivadas, del sector académico y los centros de investigación y\ndesarrollo e innovación, con el fin de lograr la modernización de\nlos sectores económicos del país e incrementar la productividad nacional.\n\nh) Utilizar el poder de adquisición de bienes y\nservicios, así como de negociación de las entidades del sector\npúblico, para impulsar el fortalecimiento empresarial de base\ntecnológica y de innovación, y la oportuna utilización de\nla capacidad de consultoría e ingeniería y de prestación\nde servicios técnicos y profesionales nacionales.\n\ni) Impulsar la incorporación selectiva de la\ntecnología moderna en la Administración Pública, a fin de\nagilizar y actualizar, permanentemente, los servicios públicos, en el\nmarco de una reforma administrativa, para lograr la modernización del\naparato estatal costarricense, en procura de mejores niveles de eficiencia.\n\nj) Facilitar el intercambio científico y\ntecnológico del país con la comunidad mundial e incentivar la\ncomercialización en el exterior de tecnologías desarrolladas en\nel país y la protección de su propiedad intelectual.\n\nk) Promover programas de incentivos y de\nacompañamiento institucional para propiciar los emprendimientos\ninnovadores y de base tecnológica.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación\nde la Promotora Costarricense de Innovación e Investigación, N°\n9971 del 11 de mayo del 2021)\n\nArtículo 5- Todas las entidades relacionadas con la\nciencia, la tecnología y la innovación, nacionales y extranjeras,\nasí como los órganos públicos estatales, podrán\ncolaborar en el cumplimiento de esta ley, de conformidad con su naturaleza y\ncompetencia.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nArtículo 6- De acuerdo con el Plan Nacional de\nCiencia, Tecnología e Innovación vigente, el Estado\nfomentará los estudios, las aplicaciones, el desarrollo y la\ncreación de empresas en las áreas de nuevas tecnologías\nnecesarias para el desarrollo del país.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nTITULO II\n\nMECANISMOS ORGANIZATIVOS PARA EL DESARROLLO\n\nCIENTIFICO Y TECNOLOGICO\n\nCAPÍTULO\nI\n\nSISTEMA\nNACIONAL DE CIENCIA, TECNOLOGÍA E INNOVACIÓN\n\nArtículo 7- Se crea el Sistema Nacional de Ciencia,\nTecnología e Innovación, dentro del marco de\nsectorialización del Estado. El Sistema está constituido por el\nconjunto de agentes, instituciones, entidades y órganos del sector\npúblico, del sector privado y de las instituciones de\ninvestigación y de educación superior, que en conjunto y de forma\nindividual interactúan en la producción, transferencia y\nutilización de conocimientos y tecnologías que influyen en el\nproceso de innovación.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nArtículo 8- Se declaran de interés\npúblico las actividades científicas, tecnológicas y de\ninnovación sin fines de lucro, realizadas por las entidades que forman\nparte del Sistema Nacional de Ciencia, Tecnología e Innovación.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 9- De conformidad con la Ley 5525, Ley de\nPlanificación Nacional, de 2 de mayo de 1974, el Sistema Nacional de\nCiencia, Tecnología e Innovación tendrá como objetivo\ngeneral coordinar y ejecutar todas aquellas disposiciones que sean establecidas\npor el Ministerio de Ciencia, Innovación, Tecnología y\nTelecomunicaciones (Micitt), lo mismo que integrar\nlas gestiones de los particulares para la coordinación del desarrollo\ncientífico y tecnológico, así como para la\naplicación del conocimiento de la ciencia y la tecnología, para\nel bienestar social y económico del país.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 10- Por medio del Sistema Nacional de\nCiencia, Tecnología e Innovación se pretende alcanzar la\nconcertación de intereses de los órganos y entidades de los\nsectores mencionados y su colaboración, a efectos de lograr la\ncoordinación nacional en materia de ciencia, tecnología e\ninnovación para el desarrollo integral del país. Con ello se\nestablecerán las directrices y las políticas que serán\nvinculantes para el sector público y orientadoras para el sector\nproductivo y el sector académico, ambos nacionales e internacionales.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 11- El Ministerio de Ciencia,\nInnovación, Tecnología y Telecomunicaciones (Micitt)\nserá el rector del Sistema Nacional de Ciencia, Tecnología e\nInnovación, que mantendrá la debida articulación con cada uno\nde los actores de este sistema, a fin de coordinar las acciones en los campos\nde desarrollo científico, tecnológico y de la innovación,\nde acuerdo con lo establecido en la presente ley y el reglamento. El Ministerio\nde Ciencia, Innovación, Tecnología y Telecomunicaciones\nestablecerá, vía reglamento, la estructura del Sistema, a fin de\ngarantizar el cumplimiento de los objetivos establecidos en esta ley.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nArtículo 12- Sin perjuicio de la autonomía que\nles otorga el artículo 84 de la Constitución Política, las\nuniversidades estatales forman parte del Sistema Nacional de Ciencia,\nTecnología e Innovación únicamente para que participen en sus\ndeliberaciones, con el objeto de que, por medio de los mecanismos legalmente\npertinentes, se pueda lograr la necesaria coordinación con ellas.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e Investigación,\nley N° 9971 del 11 de mayo del 2021)\n\nARTICULO 13.- (Derogado por el artículo 22 de la Ley de Creación de la\nPromotora Costarricense de Innovación e Investigación,  N° 9971 del 11 de mayo del 2021)\n\n ARTICULO 14.- Las instituciones privadas de educación superior que\n\nformen parte del Sistema, deberán atender las orientaciones y las\n\npóliticas generales de interés público en materia de formación\n\nprofesional, en los campos de la ciencia y la tecnología.\n\nArtículo 15- El Ministerio de Ciencia, Innovación,\nTecnología y Telecomunicaciones (Micitt) será el que\ndefina los mecanismos y los niveles de coordinación, asesoría y ejecución, para\nla concertación entre los sectores involucrados en la actividad científica y de\ninnovación nacional, así como para establecer su ámbito de competencia y su\nestructura organizativa.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, ley N° 9971 del 11 de\nmayo del 2021)\n\nCAPITULO II\n\nEl Programa Nacional de Ciencia y\nTecnología\n\nArtículo 16- El Plan Nacional de Ciencia,\nTecnología e Innovación es el instrumento de planificación\ndel desarrollo científico, tecnológico y de innovación que\npropone el gobierno de la República en el período de su\nadministración, tendrá una perspectiva de corto, mediano y largo\nplazos que permita dar continuidad y proyección a los esfuerzos de los\nsectores público, privado y el sistema educativo, en esta materia.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 17- Este Plan será parte integrante\ndel Plan Nacional de Desarrollo y, con fundamento en sus lineamientos de\ndesarrollo socioeconómico, contendrá los objetivos, las\npolíticas, las estrategias y los planes de acción traducidos en\nproyectos específicos para el período en cuestión.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 18- El Plan Nacional de Ciencia,\nTecnología e Innovación será vinculante para el sector\npúblico e indicativo para el sector privado y para las instituciones de\neducación, con respeto a la autonomía institucional que establece\nla Constitución Política, en el caso de las universidades\npúblicas.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 19- Para su elaboración, el Plan\nNacional de Ciencia, Tecnología e Innovación se someterá a\nlos diversos niveles de coordinación de los sectores integrantes del\nSistema Nacional de Ciencia, Tecnología e Innovación, con el\npropósito de obtener la armonización de los intereses e\niniciativas allí representados.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nCAPITULO III\n\nEl Ministerio de Ciencia,\nTecnología y Telecomunicaciones(*)\n\n(*)(Modificada su\ndenominación por el artículo 11 de la Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al Ministerio\nde Ciencia y Tecnología, N° 9046 del 25 de junio de 2012)\n\nArtículo 20- El Ministerio de Ciencia, Innovación, Tecnología y Telecomunicaciones (Micitt) es el\nórgano rector en materia de ciencia, innovación, tecnología y telecomunicaciones. Tendrá las\nsiguientes atribuciones:\n\na) Definir la política\nen materia de ciencia, tecnología e innovación a partir de procesos de consulta\nmediante el uso de los mecanismos de concertación que establece el Sistema\nNacional de Ciencia, Tecnología e Innovación, y contribuir a la integración de\nesa política con la política global de carácter económico y social del país, en\nlo cual servirá de enlace y como interlocutor directo ante los organismos de\ndecisión política superior del gobierno de la República.\n\nb) Coordinar la labor\ndel Sistema Nacional de Ciencia, Tecnología e Innovación por medio de la\nrectoría que ejerce el mismo ministro de Ciencia, Innovación, Tecnología y\nTelecomunicaciones.\n\nc) Elaborar la política\npública en materia de ciencia, innovación, tecnología y telecomunicaciones,\nasegurar el debido cumplimiento y dar seguimiento a su ejecución, de\nconformidad con lo que establece esta ley, y en el marco de coordinación del\nSistema Nacional de Ciencia, Tecnología e Innovación.\n\nd) En coordinación con\nlos ministros rectores de cada sector, sugerir el porcentaje del presupuesto\nque las instituciones indicadas en el artículo 97 de esta ley deberán asignar\npara ciencia, tecnología e innovación, de conformidad con las prioridades del\nPlan Nacional de Ciencia, Tecnología e Innovación.\n\ne) Promover la creación\ny el mejoramiento de los instrumentos jurídicos y administrativos necesarios\npara el desarrollo científico, tecnológico y de la innovación del país.\n\nf) Apoyar las funciones del Ministerio de Planificación Nacional y Política Económica (Mideplán) en\nel campo de la cooperación técnica internacional, con el estímulo del adecuado aprovechamiento de\nesta en las actividades científicas, tecnológicas y de innovación.\n\ng) Ejercer la rectoría\ndel sector telecomunicaciones generando políticas públicas que permitan el\ncumplimiento de los objetivos enumerados en el artículo 2 de la Ley 8642, Ley\nGeneral de Telecomunicaciones, de 4 de junio de 2008.\n\nh) Como rector del\nsector telecomunicaciones deberá observar y cumplir los principios rectores\nenumerados en el artículo 3 de la Ley 8642, Ley General de Telecomunicaciones.\n\ni) Apoyo y\nfinanciamiento de acciones de promoción de ciencia, tecnología e innovación que\nse consideren de interés nacional, incluyendo las realizadas por entidades\nprivadas, de todas aquellas que no sean realizadas por medio de Promotora.\n\nj) Promover la\ndemocratización y apropiación de la ciencia, la tecnología y la innovación, en\nel marco de los derechos humanos que hagan del conocimiento un instrumento para\nel desarrollo de las comunidades del país.\n\nk) Fomentar la\nparticipación de la población en procesos de acercamiento y apropiación social,\nasí como la generación de capacidades en ciencia, tecnología e innovación. l)\nFinanciamiento de premios para incentivar la difusión y generación de nuevo\nconocimiento científico, nuevas tecnologías, productos y servicios innovadores.\n\nm) Administración y organización del Sistema de Información Nacional de Ciencia y Tecnología\n(Sincyt), como medio para apoyar la cuantificación de los recursos destinados al quehacer de la\nciencia, la tecnología y la innovación, sean estos nacionales o extranjeros, públicos o privados,\npresupuestarios o extrapresupuestarios y como fuente de información para los interesados en la\nactividad científica, tecnológica y de innovación del país.\n\nn) Velar por el\ncumplimiento de esta ley.\n\no) Cualquier otra\nfunción que la legislación vigente y futura le asignen.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, ley N° 9971 del 11 de\nmayo del 2021)\n\nArtículo 21- Las\ncompetencias del Ministerio de Ciencia, Innovación, Tecnología y\nTelecomunicaciones (Micitt) serán ejercidas por su\nministro, salvo que sean delegadas por él mismo o por disposición del reglamento,\nsiempre que no sean las reservadas al Poder Ejecutivo, según la Constitución\nPolítica y los artículos 27 y 28 de la Ley 6227, Ley General de la\nAdministración Pública, de 2 de mayo de 1978.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, ley N° 9971 del 11 de\nmayo del 2021)\n\nCAPÍTULO\nIV\n\nPROMOTORA\nDE INVESTIGACIÓN E INNOVACIÓN\n\nArtículo 22- La Promotora estará regulada de\nacuerdo con lo establecido en su ley de creación y su reglamento.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nARTICULO 23.- (Derogado por el artículo 22 de la Ley de Costarricense de Innovación e Investigación, ley N°\n9971 del 11 de mayo del 2021)\n\nCAPÍTULO\nV\n\nSISTEMA\nDE INFORMACIÓN NACIONAL DE CIENCIA Y TECNOLOGÍA (SINCYT)\n\nArtículo 25- Para la colaboración en la toma\nde decisiones por parte de los entes y órganos que componen el Sistema\nNacional de Ciencia, Tecnología e Innovación, y para contribuir\nen la información de todos los interesados en materia de ciencia,\ntecnología e innovación se crea el Sistema de Información\nNacional de Ciencia y Tecnología (Sincyt), en\nel que se inscribirán:\n\na) Empresas de base tecnológica.\n\nb) Centros o unidades de investigación y desarrollo\nen el sector privado y público.\n\nc) Clasificación de recursos humanos especializados\nen ciencia y tecnología que incluya aquellas personas que hacen\ninvestigación.\n\nch)\nProyectos de investigación en ciencia y tecnología.\n\nd) Unidades de servicios científicos y\ntecnológicos.\n\ne) Información sobre convenios, tratados y proyectos\nde cooperación técnica en ciencia y tecnología.\n\nf) Información sobre el gasto público\ndestinado a la ciencia y la tecnología.\n\ng) Contratos de transferencia de tecnología que se\nsuscriban con empresas extranjeras.\n\nh) Centros de información y documentación en\nciencia y tecnología.\n\ni) Cualquier otro aspecto que por reglamento se indique.\n\nEl reglamento del Sincyt\ndefinirá su funcionamiento, organización y los beneficios que se\nreciben por la inscripción en Sincyt.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 26- Le corresponderá al Ministerio de\nCiencia, Innovación, Tecnología y Telecomunicaciones (Micitt) la administración y la organización\ndel citado sistema.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 27- Los objetivos del Sincyt\nson:\n\na) Cuantificar los recursos que se destinan al quehacer de\nla ciencia, la tecnología y la innovación, sean estos nacionales\no extranjeros, públicos o privados, presupuestarios o\nextrapresupuestarios.\n\nb) Ser fuente de información para los interesados en\nla actividad científica, tecnológica y de innovación del\npaís, incluyendo convocatorias para fondos y recursos disponibles.\n\nc) Generar acceso abierto y compartido a los datos de\ninvestigaciones con apego a la normativa aplicable a su protección y\nconfidencialidad, ofreciendo el conocimiento e información de ciencia y\ntecnología de proyectos nacionales de I+D.\n\nd) Integrar perfiles de investigadores que permiten vincular\na la comunidad científica y tecnológica, ofreciendo acceso\nabierto al recurso humano existente en temas de investigación y\ndesarrollo.\n\ne) Recopilar datos de centros, laboratorios y equipos\ntecnológicos de investigación y desarrollo existentes a nivel\nnacional, permitiendo el uso adecuado a los equipos tecnológicos\nubicados en las diferentes infraestructuras de investigación del\npaís.\n\ng) Compilar y centralizar información referente a la\nproducción académica como lo son las publicaciones, patentes,\nartículos, reportes, tesis de grado, maestría y doctorado,\ninformes de investigación, entre otros, así como otros productos\nderivados de proyectos de investigación.\n\nh) Generar y centralizar estadísticas básicas\nen ciencia y tecnología, permitiendo a la población acceso\nabierto a datos relevantes para la toma eficiente de decisiones.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 28- El sector privado y las instituciones y\nlos órganos de la Administración Pública deberán\nrecopilar y sistematizar la información que dentro de sus actividades\nordinarias deban ser utilizadas en este sistema.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 29- Se crea el régimen de\npromoción del investigador nacional o extranjero, denominado\ntambién régimen de promoción, que consiste en un\nescalafón de méritos y desempeño para impulsar la\nformación y la integración en el país de un equipo altamente\ncalificado de investigadores, dedicados a la realización de actividades\ny proyectos sobre ciencia, tecnología e innovación. El\nfuncionamiento del registro, los requisitos de ingreso permanencia, el\nescalafón y los beneficios serán normados vía reglamento.\nLos beneficios podrán ser financiados por el fondo de incentivos a\ntravés de la Promotora.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación,  ley N°\n9971 del 11 de mayo del 2021)\n\nTÍTULO\nIII\n\nRECURSOS\nY MECANISMOS PARA INCENTIVAR EL DESARROLLO CIENTÍFICO,\n\nTECNOLÓGICO\nY DE INNOVACIÓN\n\nCAPÍTULO\nI\n\nOTORGAMIENTO\nDE INCENTIVOS PARA LA CIENCIA,\n\nLA\nTECNOLOGÍA Y LA INNOVACIÓN\n\nArtículo 30- La\nJunta Directiva de la Promotora creará comisiones para seleccionar a\naquellas personas físicas o jurídicas que cumplan con los\nrequisitos establecidos al efecto.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de la\nPromotora Costarricense de Innovación e Investigación, ley N°\n9971 del 11 de mayo del 2021. Anteriormente este numeral  había sido derogado por el\nartículo 22 de la misma ley afectante)\n\nARTICULO 31.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nARTICULO 32.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nArtículo 33- Las\ncomisiones estarán integradas por personal técnico especializado\nde la Promotora y, de ser necesario, por expertos externos a la\ninstitución.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de la\nPromotora Costarricense de Innovación e Investigación, ley N°\n9971 del 11 de mayo del 2021)\n\nARTICULO 34.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nARTICULO 35.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nCAPÍTULO\nII\n\nCONTRATO\nDE INCENTIVOS PARA LA PROMOCIÓN Y EL DESARROLLO\n\nDE LA CIENCIA, LA TECNOLOGÍA\nY LA INNOVACIÓN\n\nArtículo 36- Se crea el contrato de incentivos para\nla promoción y desarrollo de la ciencia, la tecnología y la\ninnovación, en adelante denominado contrato, como el instrumento por\nmedio del cual la Promotora otorgará los beneficios que su ley y\nreglamento disponen para las empresas productivas, de bienes y servicios,\npúblicas y privadas.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, aprobada mediante ley N° 9971 del 11 de mayo del\n2021)\n\nArtículo 37- En el contrato de incentivos se\nindicarán los incentivos y estímulos que el Estado otorga a la\npersona física o jurídica que se haga merecedora de los\nbeneficios que la ley y el reglamento de la Promotora establecen. En él\nse definirán los derechos y las obligaciones de ambas partes, de\nconformidad con lo que dispone el reglamento de la ley de la Promotora.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nARTICULO 38.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nCAPÍTULO\nIII\n\nFONDO\nDE INCENTIVOS PARA LA PROMOCIÓN Y EL DESARROLLO DE LA\n\nCIENCIA,\nLA TECNOLOGÍA Y LA INNOVACIÓN\n\nArtículo 39- Se crea el Fondo de Incentivos para\nel Desarrollo Científico, Tecnológico y de la Innovación.\n\nLos recursos del Fondo serán administrados en el\nSistema de Cuentas del Sector Público, con una contabilidad separada\n.\n\nEl Fondo de Incentivos obtendrá su\nfinanciamiento de las siguientes fuentes de ingresos:\n\na) Una transferencia del gobierno de la República\nno inferior a mil millones de colones (?1 000 000 000), indexada anualmente de\nacuerdo con la meta de inflación anual estimada por el Banco Central en su\nPrograma Macroeconómico, vigente al momento de la aprobación presupuestaria.\n\nb) Las donaciones, las transferencias, las\ncontribuciones y los aportes, a título gratuito, que realicen las personas\nfísicas y las entidades públicas o privadas, nacionales o extranjeras.\n\nQuedan autorizadas las instituciones del sector\npúblico y las empresas privadas para incluir aportes en sus presupuestos para\neste Fondo, además del presupuesto específico que destinen para ciencia,\ntecnología e innovación, conforme al artículo 97 de esta ley\n.\n\n(Así reformado por\nel artículo 40 inciso g) de la ley Manejo\neficiente de la liquidez del sector público, N° 10495\ndel 17 de junio del 2024)\n\nCAPITULO IV\n\nUso de los Recursos para Incentivar la\n\nCiencia y la Tecnología\n\nArtículo 40- Los recursos a que se refiere el\nartículo anterior se destinarán a la implementación de la\npolítica pública para el fomento a la investigación, el\ndesarrollo científico, tecnológico y la innovación,\nasí como para el desarrollo de nuevas empresas innovadoras y de base\ntecnológica. La Promotora establecerá, vía reglamento, los\nrubros específicos a los que se destinará dicho fondo, conforme a\nlas disposiciones que rigen esa materia y su disposición queda sujeta al\ncontrol a posteriori bajo el principio de protección de la Hacienda\nPública que ejercerán los órganos competentes.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nARTICULO\n41.- (Derogado por el artículo 22 de la Ley\nde Creación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nARTICULO 42.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nTITULO IV\n\nINCENTIVOS PARA LA INVESTIGACION, LA FORMACION\n\nDE RECURSOS HUMANOS Y EL DESARROLLO\n\nCIENTIFICO Y TECNOLOGICO\n\nCAPITULO I\n\nPromoción Profesional e Incentivos para\nInvestigador\n\nARTICULO 43.- (Derogado por el artículo 22 de la Ley de Creación de la Promotora\nCostarricense de Innovación e Investigación, N° 9971 del 11\nde mayo del 2021)\n\nARTICULO 44.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nARTICULO 45.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\nARTICULO 46.- (Derogado por el artículo 22 de la Ley de Creación de la\nPromotora Costarricense de Innovación e Investigación, N° 9971 del 11 de mayo\ndel 2021)\n\nArtículo 47.- (Derogado por el artículo 22 de la Ley de Creación de la Promotora\nCostarricense de Innovación e Investigación, N° 9971 del 11 de mayo del 2021)\n\nARTICULO 48.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\n ARTICULO 49.- Se extienden los beneficios del artículo 46, inciso c)\n\na los científicos y técnicos nacionales o extranjeros con probada\n\ntrayectoria en el exterior en el campo científico o tecnológico, cuyo\n\ningreso al país se estime conveniente, a juicio del Consejo Nacional para\n\nla Investigación Científica y Tecnológica (CONICIT), según lo que al\n\nrespecto indique el reglamento, siempre y cuando a su ingreso se dediquen\n\na la investigación, o se comprometan a prestar sus servicios en una\n\ninstitución de educación superior y firmen un contrato, conforme lo\n\nindica el reglamento.\n\n( DEROGADO TACITAMENTE por el artículo 1º de Ley Nº 7293 de 31 de marzo\n\nde 1992 ).\n\n ARTICULO 50.- Las exoneraciones a que se refiere el artículo 46,\n\ninciso c), se perderán si se varía el uso del objeto exonerado, en cuyo\n\ncaso deberán pagarse los impuestos respectivos, sin perjuicio de la\n\naplicación de las penas establecidas en el Código Tributario para los\n\ncasos de evasión fiscal. Le corresponde al Consejo Nacional para la\n\nInvestigación Científica y Tecnológica (CONICIT) colaborar con el\n\nMinisterio de Hacienda para la correcta utilización de las exoneraciones.\n\n( DEROGADO TACITAMENTE por el artículo 1º de Ley Nº 7293 de 31 de marzo\n\nde 1992 ).\n\nCAPITULO II\n\nFormación Científica y\nTecnológica\n\nARTICULO 51.- (Derogado por el artículo 22 de la Ley de Creación de la\nPromotora Costarricense de Innovación e Investigación, N°\n9971 del 11 de mayo del 2021)\n\nArtículo 52- El Ministerio de Ciencia,\nInnovación, Tecnología y Telecomunicaciones (Micitt),\na través de procesos de prospectiva y según las prioridades\nestablecidas en el Plan Nacional de Ciencia, Tecnología e\nInnovación, presentará a las instituciones de educación\nlos requerimientos de recursos humanos para impulsar el desarrollo\ncientífico, tecnológico y de innovación, con el fin de\ncrear y actualizar programas de formación técnica, especializada\ny de posgrado en áreas científicas y tecnológicas, para\nmejorar la empleabilidad y el desarrollo productivo.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 53- El Ministerio de Ciencia, Innovación,\nTecnología y Telecomunicaciones (Micitt), en\ncoordinación con el Consejo Nacional de Rectores (Conare),\npropondrán al Ministerio de Educación Pública (MEP) programas y proyectos para el\nmejoramiento de la enseñanza de las ciencias naturales y exactas y de la\neducación técnica, así como los programas anuales para el fortalecimiento de\nactividades en áreas de interés científico y tecnológico nacional.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, ley N° 9971 del 11 de\nmayo del 2021)\n\nArtículo 54- Con el objeto de difundir y participar a la\npoblación costarricense de los avances científicos y tecnológicos, así como\npara estimular la vocación y el sentido investigativo en niños, jóvenes y adultos,\nse crea el Centro Nacional de la Ciencia y la Tecnología.\n\nEl Ministerio de Ciencia, Innovación, Tecnología y\nTelecomunicaciones (Micitt), la Promotora y las\ninstituciones de educación y cualquier otra entidad pública y privada quedan\nautorizados para hacer transferencias y donaciones, y facilitar los recursos\nhumanos capacitados que requiera la entidad a cuyo cargo estarán la\nadministración y la dirección del centro.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, ley N° 9971 del 11 de\nmayo del 2021)\n\nArtículo 55- Con el propósito de promover y estimular el desarrollo intelectual de la población\nestudiantil como instrumento para la formación de nuevas habilidades y capacidades, para un cambio\ncultural a favor de la ciencia la tecnología y la innovación, se organizará anualmente el Programa\nNacional de Ferias de Ciencia, Tecnología e Innovación para todo el estudiantado de Educación\nPreescolar, Primero, Segundo, Tercer Ciclos y Educación Diversificada. La organización de este\nPrograma estará a cargo del Ministerio de Ciencia, Innovación, Tecnología, y Telecomunicaciones\n(Micitt) y el Ministerio de Educación Pública (MEP), con la colaboración de las instituciones de\neducación superior.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, ley N° 9971 del 11 de\nmayo del 2021)\n\nCAPITULO III\n\nColegios Científicos(*)\n\n(*) (Así\nmodificada su denominación por el artículo 23 de la Ley de Creación de la Promotora Costarricense de\nInnovación e Investigación, ley N° 9971 del 11 de mayo del\n2021)\n\nARTICULO 56.- Se autoriza al Ministerio de\nEducación Pública para que suscriba convenios con las\ninstituciones de educación superior universitaria estatal y otras\nentidades de reconocida excelencia académica o de investigación\ncientífica, para el establecimiento de los colegios científicos\nde Costa Rica, los que contribuirán al logro de los propósitos de\nla educación diversificada con énfasis en la educación\ncientífica.\n\n ARTICULO 57.- El objetivo de los colegios científicos es la\n\nformación integral de sus estudiantes, considerando los más altos valores\n\ncostarricenses en el marco de un proceso educativo, con énfasis en la\n\nadquisición de conocimientos sólidos y habilidades en los fundamentos de\n\nla matemática, la física, la química, la biología y la informática.\n\n Estos colegios se impulsarán con una opción eficaz para el\n\nmejoramiento de la enseñanza de las ciencias, sin menoscabo de otras\n\nalternativas que puedan desarrollarse.\n\n ARTICULO 58.- Le corresponderá al Consejo Superior de Educación la\n\naprobación de planes de estudio, sus respectivos programas y las normas\n\nrelativas a la evaluación y la promoción, sin perjuicio de las\n\ndisposiciones específicas que, dentro del marco legal, pueda adoptar cada\n\ncolegio, de conformidad con la presente ley y el reglamento respectivo.\n\n ARTICULO 59.- Para el cumplimiento de los objetivos de los colegios\n\ncientíficos, las pautas generales serán definidas por un Consejo Nacional\n\nde Colegios Científicos adscrito al Ministerio de Educación Pública, al\n\ncual le corresponderá:\n\n a) Promover la coordinación y la articulación de los colegios.\n\n b) Propiciar el análisis de los programas y planes de estudio, con\n\nel propósito de lograr el más alto nivel académico.\n\n c) Proponerle al Consejo Superior de Educación las modificaciones\n\npertinentes a los planes y programas de los colegios científicos.\n\n ch) Dictaminar, previamente a su suscripción, sobre los convenios\n\nconducentes al establecimiento de los colegios científicos.\n\n d) Establecer los criterios y normas de selección y admisión de los\n\nestudiantes de los colegios científicos.\n\n e) Nombrar y remover al director ejecutivo del Consejo Nacional de\n\nColegios Científicos.\n\n f) Ratificar el nombramiento del ejecutivo institucional que\n\npropondrá el Consejo Académico de cada colegio.\n\n g) Elaborar y proponerle al Ministerio de Educación Pública el\n\nreglamento y las disposiciones para regular el funcionamiento de los\n\ncolegios científicos y del propio Consejo.\n\nArtículo\n60.- El Consejo Nacional de Colegios Científicos estará integrado por:\n\na)\nEl Ministro de Educación Pública, quien lo presidirá.\n\nb)\nDos representantes del Ministerio de Ciencia, Tecnología y\nTelecomunicaciones(*).\n\n(*)(Modificada su denominación por el artículo 11 de la Ley\n\"Traslado del sector Telecomunicaciones del Ministerio de Ambiente,\nEnergía y Telecomunicaciones al Ministerio de Ciencia y Tecnología, N° 9046 del\n25 de junio de 2012)\n\nc) Un representante de la Promotora de Investigación e\nInnovación.\n\n(Así reformado el inciso anterior por el artículo 23 de la Ley de Creación de la Promotora\nCostarricense de Innovación e Investigación, ley N° 9971 del 11 de mayo del 2021)\n\nch)\nCuatro representantes de las universidades nombrados por el Consejo Nacional de\nRectores (CONARE).\n\nd)\nUn representante de la Cámara Nacional de Agricultura y Agroindustria.\n\ne)\nUn representante de la Cámara de Industrias de Costa Rica.\n\nf)\nUn representante seleccionado por el Ministro de Educación, de una terna que le\npresentará la Unión Nacional de Cámaras y Asociaciones de la Empresa Privada.\n\nArtículo 61- La organización de los colegios\ncientíficos deberá contar con una estructura mínima que\nincluya un consejo académico, una junta administrativa y un ejecutivo\ninstitucional, cuyas funciones específicas se definan mediante reglamento.\nLes corresponderá a estos colegios la escogencia y el nombramiento del\npersonal docente y administrativo, el cual estará excluido del\nRégimen de Servicio Civil. El financiamiento de estos colegios es\nmediante recursos del presupuesto nacional y gestionado a través del\nMinisterio de Educación Pública (MEP). Los colegios\ncientíficos tendrán personalidad jurídica propia y se\nregirán por las disposiciones de este capítulo, por el reglamento\nque al efecto dicte el Ministerio de Educación Pública y por el\nconvenio de creación respectivo.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nCAPITULO IV\n\nIncentivos para la Difusión de la\nCiencia y la Tecnología\n\nArtículo 62- Con una periodicidad de cuatro\naños, el Ministerio de Ciencia, Innovación, Tecnología y\nTelecomunicaciones premiará a la empresa editorial o afín que haya\ncumplido mejor los objetivos de difusión de obras de interés\ncientífico y tecnológico. En el reglamento se establecerá\nel monto del premio. Este premio podrá ser declarado desierto, a\ncriterio del Micitt.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nArtículo 63- Cada dos años, el Ministerio de\nCiencia, Innovación, Tecnología y Telecomunicaciones podrá\notorgar un reconocimiento especial para los promotores y organizadores de la\nmejor actividad o iniciativa de divulgación científica y\ntecnológica, conforme se disponga en el reglamento.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\n ARTICULO 64.- Los premios establecidos por esta ley se otorgarán sin\n\nperjuicio de otros premios nacionales en ciencia y tecnología existentes\n\no que se creen con posterioridad.\n\nCAPITULO V\n\nIncentivos para el Fortalecimiento de las\nUnidades y\n\nCentros de Investigación y\nExtensión\n\nARTICULO 65.- (Derogado por el artículo 22 de la Ley de Creación de la\nPromotora Costarricense de Innovación e Investigación N° 9971\ndel 11 de mayo del 2021)\n\nCAPITULO VI\n\nOrganización de la Comunidad Científica\n\nArtículo 66- Con los recursos creados en esta ley y otros de\nque dispongan la Promotora y el Ministerio de Ciencia, Innovación, Tecnología y\nTelecomunicaciones (Micitt), se contribuirá con el desarrollo\nde la Academia Nacional de Ciencias.\n\nSu funcionamiento y administración será independiente de la\nPromotora y el Micitt y tendrán representación en el\nSistema Nacional de Ciencia, Tecnología e Innovación.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, ley N° 9971 del 11 de\nmayo del 2021)\n\n TITULO V\n\n INCENTIVOS PARA LA INVESTIGACION Y EL DESARROLLO\n\n TECNOLOGICO DE LAS EMPRESAS\n\n CAPITULO I\n\n Incentivos para la Investigación y\n\n el Desarrollo Tecnológico de las Empresas\n\n y las Entidades Científicas Privadas\n\n ARTICULO 67.- El Estado exonerará de todo tributo y sobretasa,\n\nprevio estudio y aprobación de la Comisión de Incentivos, los equipos o\n\nmateriales que defina el reglamento de esta ley, para que sean exportados\n\n(sic)* y utilizados exclusivamente en el desarrollo de actividades y\n\nproyectos de investigación científica y tecnológica, en sus diversas\n\netapas.\n\n Transcurridos cinco años contados a partir de la fecha de aceptación\n\nde la póliza de importación, la Dirección General de Hacienda autorizará\n\nla liberación de los bienes importados.\n\n* Debe entenderse \"importados\".\n\n( DEROGADO TACITAMENTE por el artículo 1º de Ley Nº 7293 de 31 de marzo\n\nde 1992 ).\n\n ARTICULO 68.- Se exonerarán de todo tributo los bienes comprados en\n\nel mercado local, cuando sean destinados a proyectos de investigación o\n\ndesarrollo científico y tecnológico que favorezcan la producción\n\nnacional, previa calificación y estudio de la Comisión de Incentivos.\n\nPara efectos de la liberación de los bienes adquiridos al amparo de este\n\nartículo, deberá transcurrir un plazo de cinco años contado a partir de\n\nla fecha de emisión de la factura correspondiente.\n\n( DEROGADO TACITAMENTE por el artículo 1º de Ley Nº 7293 de 31 de marzo\n\nde 1992 ).\n\n ARTICULO 69.- En el reglamento se definirán los criterios de\n\nselección para el otorgamiento de los incentivos de los artículos 67 y\n\n68, con preferencia de:\n\n a) Las empresas proveedoras del Estado, de bienes y servicios con\n\nalto contenido tecnológico.\n\n b) Las empresas en las que el resultado de los proyectos de\n\ninnovación tecnológica incrementen las exportaciones.\n\n c) Las empresas que en sus proyectos de innovación tecnológica se\n\nvinculen con los centros de investigación de las instituciones estatales\n\nde educación superior.\n\n ch) Las entidades o asociaciones científicas y tecnológicas privadas.\n\n( DEROGADO TACITAMENTE por el artículo 1º de Ley Nº 7293 de 31 de marzo\n\nde 1992 ).\n\n ARTICULO 70.- Las exoneraciones las autorizará el Ministerio de\n\nHacienda, previa recomendación de la Comisión de Incentivos, la\n\nsuscripción del respectivo contrato de incentivos y según la\n\nreglamentación correspondiente.\n\n( DEROGADO TACITAMENTE por el artículo 1º de Ley Nº 7293 de 31 de marzo\n\nde 1992 ).\n\n ARTICULO 71.- El Ministerio de Hacienda tendrá la obligación de\n\ndarle un trámite preferencial, rápido y eficiente, a las gestiones\n\naduaneras necesarias para el ingreso y la salida del país de mercancías\n\nde interés científico y tecnológico. Para ello dedicará y entrenará\n\npersonal a fin de que, específicamente, se encargue de estos trámites.\n\nTambién asignará un espacio físico apropiado en las aduanas para ese fin.\n\n El régimen de admisión temporal será aplicable en el ingreso de\n\naquellas mercancías de interés científico que el reglamento defina.\n\n ARTICULO 72.- En la aplicación de las respectivas leyes y cláusulas\n\ncontractuales y reglamentarias se especificarán los controles estrictos\n\nque garanticen el uso exclusivo de cada uno de los incentivos, para el\n\ndesarrollo de actividades y proyectos de investigación científica y\n\ntecnológica, sin perjuicio de las potestades de control, vigilancia y\n\nfiscalización que competen a la Contraloría General de la República y a\n\nlas autoridades tributarias.\n\nArtículo 73- El Ministerio de Ciencia, Innovación,\nTecnología y Telecomunicaciones (Micitt) otorgará\npremios periódicamente a las empresas que operen en el país, cuya adaptación,\nasimilación o innovación tecnológica se haya distinguido por su alcance o beneficio\neconómico y social para el país, de acuerdo con lo que dicte el reglamento.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, ley N° 9971 del 11 de\nmayo del 2021)\n\nCAPITULO II\n\nFinanciamiento de la Innovación Tecnológica\n\n(El capítulo II anterior fue derogado por el artículo 22 de\nla Ley de Creación de la Promotora Costarricense de Innovación e Investigación\nley N° 9971 del 11 de mayo del 2021)\n\nArtículo 74.- (Derogado por el artículo 22 de la Ley de Creación de la Promotora\nCostarricense de Innovación e Investigación ley N° 9971 del 11 de mayo del\n2021)\n\nARTICULO 75.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\n CAPITULO III\n\n Financiamiento de la Gestión Tecnológica para\n\n la Reconversión Industrial\n\n ARTICULO 76.- El Estado promoverá la gestión tecnológica nacional en\n\napoyo al proceso de reconversión industrial del país, con el objeto de\n\npropiciar desarrollo y transferencia de tecnología, aplicados a procesos\n\nde manufacturas, productos, equipos, materias primas y otras actividades\n\nde valor para las empresas del sector industrial nacional que tengan\n\nimpacto, por su competitividad, en el crecimiento y la supervivencia de\n\nlos mercados nacional e internacional.\n\nARTICULO 77.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación N° 9971 del 11 de mayo del 2021)\n\nCAPITULO IV\n\nAdquisiciones Estatales de Bienes y Servicios\n\npara el Fomento de Empresas Nacionales\n\nArtículo 78- El Estado, sus empresas y las entidades\npúblicas emplearán la capacidad de contratación de bienes\ny servicios, según lo permita el objeto de ella, en cada caso, para\nfomentar e incentivar la formación y la promoción de empresas\nnacionales de base tecnológica, así como las innovaciones\ntecnológicas en empresas existentes, además de la\nconsultoría y la ingeniería nacional, de conformidad con el Plan\nNacional de Ciencia, Tecnología e Innovación.\n\n(Así\nreformado por el artículo 23 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, ley N° 9971 del 11 de mayo del 2021)\n\nARTICULO 79.- (Derogado por el artículo 22 de la Ley de\nCreación de la Promotora Costarricense de Innovación e\nInvestigación, N° 9971 del 11 de mayo del 2021)\n\n CAPITULO V\n\n Incentivos para las Empresas de Base Tecnológica\n\n ARTICULO 80.- Para efectos de esta ley, son empresas de base\n\ntecnológica aquellas para las cuales la dinámica de la innovación\n\ntecnológica representa un factor característico y prioritario para el\n\nmantenimiento y la mejora de su competitividad en los mercados en que\n\nactúa, siempre que reúna los requisitos que indica el reglamento.\n\nARTICULO 81.- DEROGADO  por el inciso i) del artículo 22 de la Ley N° 8114,\n\nLey de Simplificación y Eficiencia Tributaria de 4 de julio del 2001.\n\n ARTICULO 82.- De conformidad con el artículo 81 de esta ley, las\n\nempresas de base tecnológica gozarán de las exoneraciones a que se\n\nrefieren los artículos 67 y 68, durante los primeros tres años participación accionaria de terceros. El\n\ncrédito fiscal será hasta por un veinticinco por ciento (25%) del valor\n\nde las acciones nominativas que se adquieran.\n\n Las empresas de base tecnológica que permitan la participación\n\naccionaria tendrán derecho a un crédito fiscal del veinticinco por ciento\n\n(25%) del valor de las acciones vendidas.\n\n En ambos casos, las acciones deben ser adquiridas en la Bolsa\n\nNacional de Valores y deberán corresponder a nuevas emisiones.\n\nCAPITULO VI\n\nIncentivos para el Establecimiento de\n\nParques Tecnológicos y Apoyo a Nuevas\nTecnologías\n\nArtículo 88- El Estado, por medio del Ministerio de\nCiencia, Innovación, Tecnología y Telecomunicaciones (Micitt) fomentará la creación de parques\ntecnológicos, en colaboración con la empresa privada y con las\ninstituciones estatales de educación superior. Para ambos efectos, las\n\ninstituciones podrán utilizar los procedimientos de contratación directa\n\nque establece la Ley de la Administración Financiera de la República.\n\n ARTICULO 94.- Las instituciones de educación superior universitaria\n\nestatal quedan habilitadas y autorizadas para la venta de bienes y\n\nservicios ligados a los proyectos de investigación, desarrollo\n\ntecnológico, consultorías y cursos especiales. Para mejorar y agilizar la\n\nventa de bienes y servicios, dichas instituciones también quedan\n\nhabilitadas y autorizadas para crear fundaciones y empresas auxiliares.\n\n ARTICULO 95.- Se deberá establecer un procedimiento para que los\n\nrecursos recaudados por venta de servicios sean trasladados en forma ágil\n\ny efectiva a los propios entes de investigación que los generaron, con el\n\npropósito de asegurar la disponibilidad oportuna de estos fondos y la\n\ncontinuidad de las actividades científicas y tecnológicas.\n\n Cuando se trate de la venta de servicios en los centros\n\nuniversitarios, los fondos se invertirán según el criterio de las\n\nautoridades universitarias, sin detrimento alguno de la autonomía que los\n\ncaracteriza.\n\nCAPITULO II\n\nIncentivos para la Innovación, Desarrollo y\nTransferencia de Tecnología en las Comunidades Urbanas y Rurales\n\nArtículo 96- Los centros de investigación, las instituciones\npúblicas y privadas, así como los grupos organizados de las comunidades urbanas\ny rurales que desarrollen programas de innovación, desarrollo y transferencia\nde tecnología, con proyectos apropiados para el desarrollo de las diferentes\nregiones del país, recibirán apoyo financiero mediante los recursos de esta\nley, según el artículo 39, o de cualquier otra fuente que la Promotora disponga\npara este propósito y para facilitar ese proceso, previa selección y aprobación\nde acuerdo con los procedimientos que establezca el reglamento de la Promotora.\n\n(Así\nreformado por el artículo 23 de la Ley de Creación de\nla Promotora Costarricense de Innovación e Investigación, ley N° 9971 del 11 de\nmayo del 2021)\n\n CAPITULO III\n\n Racionalización de los Recursos para\n\n la Ciencia y la Tecnología en la Administración Pública\n\n ARTICULO 97.- Todas las instituciones, entes y órganos de la\n\nAdministración Pública que desarrollen o ejecuten acciones en materia de\n\nciencia y tecnología, como parte de su competencia institucional,\n\nenmarcados dentro de los lineamientos de la política definida en el\n\nPrograma Nacional de Ciencia y Tecnología, quedan autorizadas a destinar\n\nun porcentaje de su presupuesto ordinario anual a la promoción, el\n\nincentivo, la protección y el desarrollo de proyectos de investigación en\n\nciencia y tecnología, y otras actividades relativas a estas materias, que\n\ncoadyuven al cambio tecnológico y al desarrollo nacional desde su esfera\n\nde acción.\n\nArtículo 98.- Las directrices sobre la fijación, el incremento y la orientación del porcentaje\npresupuestario destinado para los efectos citados la hará el Poder Ejecutivo por medio del\nMinisterio de Hacienda y del Ministerio de Ciencia, Tecnología y Telecomunicaciones(*), en consulta\ncon cada una de las instituciones, entes y órganos de la Administración Pública que desarrollen o\nejecuten acciones en materia de ciencia y tecnología, tomando en cuenta la naturaleza de la\ninstitución u órgano público, las prioridades presupuestarias, el monto del presupuesto anual\nordinario, su ligamen con el campo de la ciencia y la tecnología, y el interés público por\ndesarrollar los programas y actividades de investigación propuestos por la institución.\n\n(*)(Modificada su denominación\npor el artículo 11 de la Ley \"Traslado del sector Telecomunicaciones del\nMinisterio de Ambiente, Energía y Telecomunicaciones al Ministerio de Ciencia y\nTecnología, N° 9046 del 25 de junio de 2012)\n\n ARTICULO 99.- Los órganos e instituciones públicas a que se refieren\n\nlos dos artículos anteriores, están obligados a informar al Ministerio de\n\nCiencia y Tecnología sobre sus respectivos presupuestos específicos que\n\nincluyan las actividades científicas y tecnológicas, con indicación de la\n\nnaturaleza y de los objetivos de los programas en que serán utilizados\n\nesos recursos.\n\n ARTICULO 100.- El Estado costarricense promoverá la modernización y\n\nel aprovechamiento de los recursos tecnológicos que utilice el sector\n\npúblico nacional, y procurará un aumento de la eficiencia de los entes\n\nque forman este sector, por medio de una mayor racionalización de las\n\ndecisiones tecnológicas sobre transferencia, adaptación, asimilación y\n\ngeneración de tecnología.\n\n TITULO VII\n\n SANCIONES\n\n CAPITULO UNICO\n\n Sanciones\n\n ARTICULO 101.- Las personas que hagan uso indebido de los incentivos\n\nque esta ley establece serán sancionadas con la pérdida del beneficio\n\notorgado. Likewise, to generate public policies that guarantee the right of inhabitants to obtain telecommunications services, as well as to ensure the application of the principles of universality and solidarity of the telecommunications service and to strengthen the mechanisms of universality and solidarity of telecommunications, guaranteeing access to inhabitants who require it.\n\nc) To establish stimuli and incentives for the private and public sectors and for public and private educational institutions and other public and private education centers, in order to increase the capacity to generate science and technology and so that these can be articulated among themselves and with the productive sector, to improve the country's competitiveness.\n\nch) To promote the attraction and utilization of technological and innovation, research and development capacities of academic entities, research laboratories, and international technology transfer centers to the country, that promote the development of the national innovation ecosystem and complement or support the development of such capacities in the productive, academic, and government sectors.\n\nd) To create the appropriate conditions so that science and technology fulfill their instrumental role as basic factors to achieve greater competitiveness and growth of the national productive sector.\n\ne) To encourage innovation as an essential element to strengthen the country's capacity to adapt to changes in international trade and the economy, to elevate entrepreneurial and business innovation capacities and the quality of life of Costa Ricans.\n\nf) To encourage technology management throughout the national territory, for the reconversion of the Costa Rican productive sector and the increase of competitive capacity, so that it is capable of satisfying the basic needs of the population and raising the country's productivity.\n\ng) To promote all support activities for substantive scientific and technological development and innovation; technical, specialized, and postgraduate studies and the training of human resources, as well as the improvement of the teaching of sciences, mathematics, and technical education, as well as scientific and technological documentation and information.\n\nh) To support all efforts that seek to increase the creativity and original scientific thought of Costa Ricans.\n\ni) To promote and support ethical, legal, economic, social-scientific, and innovation research, in general, aimed at improving the understanding of the relationships between science, technology, and society, equity and gender equality in science, technology, and innovation; as well as the applicable legal regime in this field. All this in order to make the role of science and technology in culture and social welfare more dynamic.\n\nj) To promote all activities supporting the process of technological innovation: technology transfer, consulting and engineering, standardization, metrology and quality control, and other scientific and technological services.\n\nk) To promote the development and use of telecommunications services within the framework of the information and knowledge society, and as support for sectors such as health, citizen security, education, culture, commerce, and electronic government, among of the State\n\nArticle 4- In accordance with the objectives set forth in this law, the State has the following duties to foster science, technology, and innovation.\n\na) To ensure that science, I\n\nNATIONAL SYSTEM OF SCIENCE, TECHNOLOGY AND INNOVATION\n\nArticle 7- The National System of Science, Technology and Innovation is created, within the framework of the sectorization of the State. The System is constituted by the set of agents, institutions, entities, and bodies of the public sector, the private sector, and research and higher education institutions, which together and individually interact in the production, transfer, and utilization of knowledge and technologies that influence the innovation process.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nArticle 8- Non-profit scientific, technological, and innovation activities carried out by entities forming part of the National System of Science, Technology and Innovation are declared to be of public interest.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 9- In accordance with Law 5525, National Planning Law, of May 2, 1974, the National System of Science, Technology and Innovation shall have as its general objective to coordinate and execute all those provisions established by the Ministry of Science, Innovation, Technology and Telecommunications (Micitt), as well as to integrate the efforts of private parties for the coordination of scientific and technological development and for the application of scientific and technological knowledge for the social and economic welfare of the country.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 10- Through the National System of Science, Technology and Innovation, the aim is to achieve the harmonization of interests of the bodies and entities of the mentioned sectors and their collaboration, for the purpose of achieving national coordination in matters of science, technology, and innovation for the integral development of the country. Through this, the directives and policies shall be established that will be binding for the public sector and guiding for the productive sector and the academic sector, both national and international.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 11- The Ministry of Science, Innovation, Technology and Telecommunications (Micitt) shall be the governing body of the National System of Science, Technology and Innovation, which shall maintain proper linkage with each of the actors in this system, in order to coordinate actions in the fields of scientific, technological, and innovation development, in accordance with the provisions of this law and its regulations. It shall have the following powers:\n\na) To define policy on science, technology, and innovation based on consultative processes through the use of the harmonization mechanisms established by the National System of Science, Technology and Innovation, and to contribute to the integration of this policy with the overall economic and social policy of the country, in which it shall serve as a liaison and direct interlocutor before the higher political decision-making bodies of the government of the Republic.\n\nb) To coordinate the work of the National System of Science, Technology and Innovation through the governing role exercised by the Minister of Science, Innovation, Technology and Telecommunications.\n\nc) To prepare public policy regarding science, innovation, technology, and telecommunications, ensure due compliance, and monitor its execution, in accordance with what is established in this law, and within the coordination framework of the National System of Science, Technology and Innovation.\n\nd) In coordination with the governing ministers of each sector, to suggest the percentage of the budget that the institutions indicated in Article 97 of this law must allocate for science, technology, and innovation, in accordance with the priorities of the National Plan for Science, Technology and Innovation.\n\ne) To promote the creation and improvement of the legal and administrative instruments necessary for the scientific, technological, and innovation development of the country.\n\nf) To support the functions of the Ministry of National Planning and Economic Policy (Mideplán) in the field of international technical cooperation, by encouraging the adequate utilization of this in scientific, technological, and innovation activities.\n\ng) To exercise the governing role over the telecommunications sector by generating public policies that allow for the fulfillment of the objectives listed in Article 2 of Law 8642, General Telecommunications Law, of June 4, 2008.\n\nh) As the governing body of the telecommunications sector, it must observe and comply with the guiding principles listed in Article 3 of Law 8642, General Telecommunications Law.\n\ni) Support and financing of promotional actions for science, technology, and innovation considered to be of national interest, including those carried out by private entities, of all those not carried out through the Promotora.\n\nj) To promote the democratization and appropriation of science, technology, and innovation, within the framework of human rights, making knowledge an instrument for the development of the country's communities.\n\nk) To encourage the participation of the population in processes of approach and social appropriation, as well as the generation of capacities in science, technology, and innovation. l) Financing of awards to incentivize the dissemination and generation of new scientific knowledge, new technologies, and innovative products and services.\n\nm) Administration and organization of the National Information System for Science and Technology (Sincyt), as a means to support the quantification of resources allocated to the work of science, technology, and innovation, whether national or foreign, public or private, budgetary or extra-budgetary, and as a source of information for those interested in the country's scientific, technological, and innovation activity.\n\nn) To ensure compliance with this law.\n\no) Any other function assigned by current and future legislation.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 21- The powers of the Ministry of Science, Innovation, Technology and Telecommunications (Micitt) shall be exercised by its minister, unless delegated by the minister or by provision of the regulations, provided they are not those reserved to the Executive Branch, according to the Political Constitution and articles 27 and 28 of Law 6227, General Law of Public Administration, of May 2, 1978.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nCHAPTER IV\n\nPROMOTORA DE INVESTIGACIÓN E INNOVACIÓN\n\nArticle 22- The Promotora shall be regulated in accordance with the provisions of its enabling legislation and its regulations.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 23.- (Repealed by article 22 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 24.- (Repealed by article 22 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nCHAPTER V\n\nNATIONAL INFORMATION SYSTEM FOR SCIENCE AND TECHNOLOGY (SINCYT)\n\nArticle 25- For collaboration in decision-making by the entities and bodies that compose the National System of Science, Technology and Innovation, and to contribute to the information of all those interested in science, technology, and innovation, the National Information System for Science and Technology (Sincyt) is created, in which the following shall be registered:\n\na) Technology-based companies.\n\nb) Research and development centers or units in the private and public sector.\n\nc) Classification of human resources specialized in science and technology that includes those persons who conduct research.\n\nch) Research projects in science and technology.\n\nd) Scientific and technological service units.\n\ne) Information on agreements, treaties, and technical cooperation projects in science and technology.\n\nf) Information on public spending allocated to science and technology.\n\ng) Technology transfer contracts entered into with foreign companies.\n\nh) Information and documentation centers in science and technology.\n\ni) Any other aspect indicated by regulation.\n\nThe Sincyt regulations shall define its operation, organization, and the benefits received for registration in Sincyt.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 26- The Ministry of Science, Innovation, Technology and Telecommunications (Micitt) shall be responsible for the administration and organization of the aforementioned system.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 27- The objectives of the Sincyt are:\n\na) To quantify the resources allocated to the work of science, technology, and innovation, whether national or foreign, public or private, budgetary or extra-budgetary.\n\nb) To be a source of information for those interested in the country's scientific, technological, and innovation activity, including calls for funds and available resources.\n\nc) To generate open and shared access to research data in accordance with the regulations applicable to its protection and confidentiality, offering scientific and technological knowledge and information from national R&D projects.\n\nd) To integrate profiles of researchers that allow linking the scientific and technological community, offering open access to existing human resources in research and development topics.\n\ne) To collect data on existing research and development centers, laboratories, and technological equipment at the national level, allowing the appropriate use of technological equipment located in the different research infrastructures of the country.\n\ng) To compile and centralize information regarding academic production such as publications, patents, articles, reports, bachelor's, master's, and doctoral theses, research reports, among others, as well as other products derived from research projects.\n\nh) To generate and centralize basic statistics in science and technology, allowing the population open access to relevant data for efficient decision-making.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 28- The private sector and the institutions and bodies of the Public Administration must collect and systematize the information that, within their ordinary activities, must be used in this system.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 29- The national or foreign researcher promotion regime, also called the promotion regime, is created, which consists of a scale of merits and performance to promote the training and integration within the country of a highly qualified team of researchers, dedicated to carrying out activities and projects on science, technology, and innovation. The operation of the registry, the entry and permanence requirements, the scale, and the benefits shall be regulated via regulation. The benefits may be financed by the incentive fund through the Promotora.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nTITLE III\n\nRESOURCES AND MECHANISMS TO INCENTIVIZE SCIENTIFIC,\n\nTECHNOLOGICAL AND INNOVATION DEVELOPMENT\n\nCHAPTER I\n\nGRANTING OF INCENTIVES FOR SCIENCE,\n\nTECHNOLOGY AND INNOVATION\n\nArticle 30- The Board of Directors of the Promotora shall create commissions to select those natural or legal persons who meet the requirements established for this purpose.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021. Previously this numeral had been repealed by article 22 of the same affecting law)\n\nARTICLE 31.- (Repealed by article 22 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 32.- (Repealed by article 22 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nArticle 33- The commissions shall be composed of specialized technical personnel from the Promotora and, if necessary, by external experts to the institution.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 34.- (Repealed by article 22 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 35.- (Repealed by article 22 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nCHAPTER II\n\nINCENTIVE CONTRACT FOR THE PROMOTION AND DEVELOPMENT\n\nOF SCIENCE, TECHNOLOGY AND INNOVATION\n\nArticle 36- The incentive contract for the promotion and development of science, technology, and innovation, hereinafter referred to as the contract, is created as the instrument through which the Promotora shall grant the benefits that its law and regulations provide for productive companies, of goods and services, both public and private.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, approved by Law No. 9971 of May 11, 2021)\n\nArticle 37- The incentive contract shall indicate the incentives and stimuli that the State grants to the natural or legal person who merits the benefits established by the law and the regulations of the Promotora. It shall define the rights and obligations of both parties, in accordance with the provisions of the regulations of the Promotora's law.\n\n(Thus amended by article 23 of the Law for the Creation of the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 38.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nCHAPTER III\n\nFUND FOR INCENTIVES FOR THE PROMOTION AND DEVELOPMENT OF SCIENCE, TECHNOLOGY, AND INNOVATION\n\nArticle 39- The Fund for Incentives for Scientific, Technological, and Innovation Development (Fondo de Incentivos para el Desarrollo Científico, Tecnológico y de la Innovación) is hereby created.\n\nThe Fund's resources shall be administered within the Public Sector Accounts System (Sistema de Cuentas del Sector Público), with separate accounting.\n\nThe Fund for Incentives shall obtain its financing from the following sources of income:\n\na) A transfer from the government of the Republic of no less than one billion colones (₡1,000,000,000), indexed annually in accordance with the annual inflation target estimated by the Central Bank in its Macroeconomic Program, in effect at the time of budget approval.\n\nb) Donations, transfers, contributions, and gratuitous contributions made by individuals and public or private entities, national or foreign.\n\nPublic sector institutions and private companies are hereby authorized to include contributions in their budgets for this Fund, in addition to the specific budget they allocate for science, technology, and innovation, pursuant to article 97 of this law.\n\n(Thus amended by article 40, subsection g) of the Law on Efficient Management of Public Sector Liquidity, No. 10495 of June 17, 2024)\n\nCHAPTER IV\n\nUse of Resources to Incentivize Science and Technology\n\nArticle 40- The resources referred to in the preceding article shall be allocated to the implementation of public policy for the promotion of research, scientific and technological development, and innovation, as well as for the development of new innovative and technology-based enterprises. The Promotora shall establish, via regulation, the specific line items to which said fund shall be allocated, in accordance with the provisions governing this matter, and its allocation is subject to subsequent control (control a posteriori) under the principle of protection of the Public Treasury (Hacienda Pública) to be exercised by the competent bodies.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 41.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 42.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nTITLE IV\n\nINCENTIVES FOR RESEARCH, HUMAN RESOURCE TRAINING, AND SCIENTIFIC AND TECHNOLOGICAL DEVELOPMENT\n\nCHAPTER I\n\nProfessional Promotion and Incentives for Researchers\n\nARTICLE 43.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 44.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 45.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 46.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nArticle 47.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 48.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 49.- The benefits of article 46, subsection c) are extended to national or foreign scientists and technicians with a proven track record abroad in the scientific or technological field, whose entry into the country is deemed advisable, in the judgment of the National Council for Scientific and Technological Research (Consejo Nacional para la Investigación Científica y Tecnológica, CONICIT), as specified in the regulation, provided that upon their entry they dedicate themselves to research, or commit to providing their services in a higher education institution and sign a contract, as indicated in the regulation.\n\n(TACITLY REPEALED by article 1 of Law No. 7293 of March 31, 1992).\n\nARTICLE 50.- The exemptions referred to in article 46, subsection c), shall be forfeited if the use of the exempted object is changed, in which case the respective taxes must be paid, without prejudice to the application of the penalties established in the Tax Code (Código Tributario) for cases of tax evasion. The National Council for Scientific and Technological Research (CONICIT) is responsible for collaborating with the Ministry of Finance (Ministerio de Hacienda) for the correct utilization of the exemptions.\n\n(TACITLY REPEALED by article 1 of Law No. 7293 of March 31, 1992).\n\nCHAPTER II\n\nScientific and Technological Training\n\nARTICLE 51.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nArticle 52- The Ministry of Science, Innovation, Technology and Telecommunications (Ministerio de Ciencia, Innovación, Tecnología y Telecomunicaciones, Micitt), through foresight processes and according to the priorities established in the National Plan for Science, Technology and Innovation (Plan Nacional de Ciencia, Tecnología e Innovación), shall present to education institutions the human resource requirements to promote scientific, technological, and innovation development, in order to create and update technical, specialized, and postgraduate training programs in scientific and technological areas, to improve employability and productive development.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 53- The Ministry of Science, Innovation, Technology and Telecommunications (Micitt), in coordination with the National Council of Rectors (Consejo Nacional de Rectores, CONARE), shall propose to the Ministry of Public Education (Ministerio de Educación Pública, MEP) programs and projects for the improvement of the teaching of natural and exact sciences and technical education, as well as the annual programs for the strengthening of activities in areas of national scientific and technological interest.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 54- With the purpose of disseminating and involving the Costa Rican population in scientific and technological advances, as well as to stimulate vocation and a sense of inquiry in children, youth, and adults, the National Center for Science and Technology (Centro Nacional de la Ciencia y la Tecnología) is hereby created.\n\nThe Ministry of Science, Innovation, Technology and Telecommunications (Micitt), the Promotora, and education institutions and any other public and private entity are hereby authorized to make transfers and donations, and to provide the trained human resources required by the entity in charge of the administration and direction of the center.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 55- With the purpose of promoting and stimulating the intellectual development of the student population as an instrument for the formation of new skills and capacities, for a cultural change in favor of science, technology, and innovation, the National Program of Science, Technology, and Innovation Fairs (Programa Nacional de Ferias de Ciencia, Tecnología e Innovación) shall be organized annually for all students of Preschool, First, Second, and Third Cycles of Basic General Education, and Diversified Education. The organization of this Program shall be the responsibility of the Ministry of Science, Innovation, Technology, and Telecommunications (Micitt) and the Ministry of Public Education (MEP), with the collaboration of higher education institutions.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nCHAPTER III\n\nScientific High Schools (Colegios Científicos)(*)\n\n(*) (Its denomination thus modified by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 56.- The Ministry of Public Education is authorized to enter into agreements with state university higher education institutions and other entities of recognized academic excellence or scientific research, for the establishment of the scientific high schools (colegios científicos) of Costa Rica, which shall contribute to achieving the purposes of diversified education with emphasis on scientific education.\n\nARTICLE 57.- The objective of the scientific high schools is the comprehensive education of their students, considering the highest Costa Rican values within the framework of an educational process, with emphasis on the acquisition of solid knowledge and skills in the fundamentals of mathematics, physics, chemistry, biology, and computer science.\n\nThese high schools shall be promoted as an effective option for the improvement of science teaching, without detriment to other alternatives that may be developed.\n\nARTICLE 58.- The Superior Council of Education (Consejo Superior de Educación) shall be responsible for the approval of curricula, their respective programs, and the rules regarding evaluation and promotion, without prejudice to the specific provisions that, within the legal framework, each high school may adopt, in accordance with this law and the respective regulation.\n\nARTICLE 59.- For the fulfillment of the objectives of the scientific high schools, the general guidelines shall be defined by a National Council of Scientific High Schools (Consejo Nacional de Colegios Científicos) attached to the Ministry of Public Education, which shall be responsible for:\n\na) Promoting the coordination and articulation of the high schools.\n\nb) Fostering the analysis of the programs and curricula, with the purpose of achieving the highest academic level.\n\nc) Proposing to the Superior Council of Education the relevant modifications to the plans and programs of the scientific high schools.\n\nd) Issuing an opinion, prior to their subscription, on the agreements leading to the establishment of the scientific high schools.\n\ne) Establishing the criteria and standards for the selection and admission of students to the scientific high schools.\n\nf) Appointing and removing the executive director of the National Council of Scientific High Schools.\n\ng) Ratifying the appointment of the institutional executive to be proposed by the Academic Council of each high school.\n\nh) Developing and proposing to the Ministry of Public Education the regulation and provisions to govern the operation of the scientific high schools and the Council itself.\n\nArticle 60.- The National Council of Scientific High Schools shall be composed of:\n\na) The Minister of Public Education, who shall preside over it.\n\nb) Two representatives of the Ministry of Science, Technology and Telecommunications(*).\n\n(*) (Its denomination modified by article 11 of the Law \"Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology, No. 9046 of June 25, 2012)\n\nc) One representative of the Promotora de Investigación e Innovación.\n\n(Thus amended the preceding subsection by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nd) Four representatives of the universities appointed by the National Council of Rectors (CONARE).\n\ne) One representative of the National Chamber of Agriculture and Agroindustry (Cámara Nacional de Agricultura y Agroindustria).\n\nf) One representative of the Chamber of Industries of Costa Rica (Cámara de Industrias de Costa Rica).\n\ng) One representative selected by the Minister of Education, from a shortlist of three candidates submitted by the National Union of Chambers and Associations of Private Enterprise (Unión Nacional de Cámaras y Asociaciones de la Empresa Privada).\n\nArticle 61- The organization of scientific high schools must have a minimum structure that includes an academic council, an administrative board, and an institutional executive, whose specific functions shall be defined by regulation. These high schools shall be responsible for the selection and appointment of teaching and administrative staff, who shall be excluded from the Civil Service Regime (Régimen de Servicio Civil). The financing of these high schools is through resources from the national budget and managed through the Ministry of Public Education (MEP). The scientific high schools shall have their own legal personality and shall be governed by the provisions of this chapter, by the regulation issued for this purpose by the Ministry of Public Education, and by the respective creation agreement.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nCHAPTER IV\n\nIncentives for the Dissemination of Science and Technology\n\nArticle 62- Every four years, the Ministry of Science, Innovation, Technology and Telecommunications shall award a prize to the publishing or related company that has best fulfilled the objectives of disseminating works of scientific and technological interest. The amount of the prize shall be established in the regulation. This prize may be declared void, at the discretion of the Micitt.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 63- Every two years, the Ministry of Science, Innovation, Technology and Telecommunications may grant special recognition to the promoters and organizers of the best scientific and technological dissemination activity or initiative, as provided in the regulation.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 64.- The prizes established by this law shall be awarded without prejudice to other existing national prizes in science and technology or those created subsequently.\n\nCHAPTER V\n\nIncentives for the Strengthening of Research and Extension Units and Centers\n\nARTICLE 65.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación No. 9971 of May 11, 2021)\n\nCHAPTER VI\n\nOrganization of the Scientific Community\n\nArticle 66- With the resources created in this law and others available to the Promotora and the Ministry of Science, Innovation, Technology and Telecommunications (Micitt), support shall be provided for the development of the National Academy of Sciences (Academia Nacional de Ciencias).\n\nIts operation and administration shall be independent of the Promotora and the Micitt and they shall have representation in the National System of Science, Technology and Innovation (Sistema Nacional de Ciencia, Tecnología e Innovación).\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nTITLE V\n\nINCENTIVES FOR RESEARCH AND TECHNOLOGICAL DEVELOPMENT OF COMPANIES\n\nCHAPTER I\n\nIncentives for Research and Technological Development of Companies and Private Scientific Entities\n\nARTICLE 67.- The State shall exempt from all taxes and surcharges, upon prior study and approval of the Incentives Commission (Comisión de Incentivos), the equipment or materials defined by the regulation of this law, so that they may be exported (sic)* and used exclusively in the development of scientific and technological research activities and projects, in their various stages.\n\nAfter five years have elapsed from the date of acceptance of the import customs declaration form (póliza de importación), the General Directorate of Finance (Dirección General de Hacienda) shall authorize the release of the imported goods.\n\n* Should be understood as \"imported.\"\n\n(TACITLY REPEALED by article 1 of Law No. 7293 of March 31, 1992).\n\nARTICLE 68.- All goods purchased in the local market shall be exempted from all taxes, when they are destined for scientific and technological research or development projects that favor national production, upon prior qualification and study by the Incentives Commission. For the purposes of the release of the goods acquired under this article, a period of five years must elapse from the date of issuance of the corresponding invoice.\n\n(TACITLY REPEALED by article 1 of Law No. 7293 of March 31, 1992).\n\nARTICLE 69.- The regulation shall define the selection criteria for granting the incentives of articles 67 and 68, with preference given to:\n\na) Companies that supply the State with goods and services having high technological content.\n\nb) Companies in which the results of technological innovation projects increase exports.\n\nc) Companies that, in their technological innovation projects, link up with the research centers of state higher education institutions.\n\nd) Private scientific and technological entities or associations.\n\n(TACITLY REPEALED by article 1 of Law No. 7293 of March 31, 1992).\n\nARTICLE 70.- The exemptions shall be authorized by the Ministry of Finance, upon prior recommendation of the Incentives Commission, the signing of the respective incentive contract, and according to the corresponding regulations.\n\n(TACITLY REPEALED by article 1 of Law No. 7293 of March 31, 1992).\n\nARTICLE 71.- The Ministry of Finance shall have the obligation to give preferential, rapid, and efficient processing to the customs procedures necessary for the entry into and exit from the country of goods of scientific and technological interest. For this purpose, it shall dedicate and train personnel specifically to handle these procedures. It shall also assign appropriate physical space in customs offices for that purpose.\n\nThe temporary admission regime (régimen de admisión temporal) shall be applicable to the entry of those goods of scientific interest that the regulation defines.\n\nARTICLE 72.- In the application of the respective laws and contractual and regulatory clauses, strict controls shall be specified to guarantee the exclusive use of each of the incentives for the development of scientific and technological research activities and projects, without prejudice to the powers of control, supervision, and oversight vested in the Comptroller General of the Republic (Contraloría General de la República) and the tax authorities.\n\nArticle 73- The Ministry of Science, Innovation, Technology and Telecommunications (Micitt) shall periodically award prizes to companies operating in the country whose technological adaptation, assimilation, or innovation has distinguished itself by its scope or economic and social benefit for the country, in accordance with what the regulation dictates.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nCHAPTER II\n\nFinancing of Technological Innovation\n\n(Previous Chapter II was repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nArticle 74.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 75.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nCHAPTER III\n\nFinancing of Technological Management for Industrial Reconversion (Reconversión Industrial)\n\nARTICLE 76.- The State shall promote national technological management in support of the country's industrial reconversion process, with the aim of fostering development and technology transfer, applied to manufacturing processes, products, equipment, raw materials, and other activities of value for companies in the national industrial sector that have an impact, due to their competitiveness, on the growth and survival of national and international markets.\n\nARTICLE 77.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación No. 9971 of May 11, 2021)\n\nCHAPTER IV\n\nState Procurement of Goods and Services for the Promotion of National Companies\n\nArticle 78- The State, its companies, and public entities shall use the capacity for contracting goods and services, as permitted by its purpose, in each case, to foster and incentivize the formation and promotion of national technology-based enterprises (empresas de base tecnológica), as well as technological innovations in existing companies, in addition to national consulting and engineering, in accordance with the National Plan for Science, Technology and Innovation.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 79.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nCHAPTER V\n\nIncentives for Technology-Based Enterprises\n\nARTICLE 80.- For the purposes of this law, technology-based enterprises (empresas de base tecnológica) are those for which the dynamics of technological innovation represent a characteristic and priority factor for maintaining and improving their competitiveness in the markets in which they operate, provided they meet the requirements indicated in the regulation.\n\nARTICLE 81.- REPEALED by subsection i) of article 22 of Law No. 8114, Tax Simplification and Efficiency Law of July 4, 2001.\n\nARTICLE 82.- In accordance with article 81 of this law, technology-based enterprises shall enjoy the exemptions referred to in articles 67 and 68, during the first three years of their operation, once registered.\n\n(TACITLY REPEALED by article 1 of Law No. 7293 of March 31, 1992).\n\nARTICLE 83.- Technology-based enterprises established in a technology park (parque tecnológico) shall enjoy the incentives established by this law, for a period of five years.\n\nARTICLE 84.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación No. 9971 of May 11, 2021)\n\nARTICLE 85.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación No. 9971 of May 11, 2021)\n\nARTICLE 86.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 87.- A tax credit (crédito fiscal) shall be granted to third-party individuals or legal entities that acquire shares of technology-based enterprises that allow third-party equity participation. The tax credit shall be up to twenty-five percent (25%) of the value of the registered shares acquired.\n\nTechnology-based enterprises that allow equity participation shall be entitled to a tax credit of twenty-five percent (25%) of the value of the shares sold.\n\nIn both cases, the shares must be acquired on the National Stock Exchange (Bolsa Nacional de Valores) and must correspond to new issuances.\n\nCHAPTER VI\n\nIncentives for the Establishment of Technology Parks and Support for New Technologies\n\nArticle 88- The State, through the Ministry of Science, Innovation, Technology and Telecommunications (Micitt), shall promote the creation of technology parks, in collaboration with the private sector and state higher education institutions. Its institutions and bodies are hereby authorized to contribute all kinds of resources, with the purpose of establishing and developing this type of technological-industrial cluster to support the creation of new technology-based enterprises.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 89.- In accordance with articles 6, 80, and 88 of this law, the formation of technology parks, where technology-based enterprises are located, shall be incentivized, with the purpose of promoting the growth of the national business sector with high technological content and which, based on an effective articulation with the science and technology infrastructure of the universities, is projected as a modernizing axis for the country.\n\nArticle 90- The formation of technology parks must fit within the objectives of the National Plan for Science, Technology and Innovation, so as to allow the utilization of new knowledge and the availability of trained human resources to face the challenges of future development.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nARTICLE 91.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nARTICLE 92.- (Repealed by article 22 of the Law Creating the Promotora Costarricense de Innovación e Investigación, No. 9971 of May 11, 2021)\n\nTITLE VI\n\nINCENTIVES TO FACILITATE THE USE OF PUBLIC SECTOR RESOURCES IN SCIENCE AND TECHNOLOGY\n\nCHAPTER I\n\nIncentives for the Provision of Services in the Public Sector\n\nARTICLE 93.- For all legal purposes, research and the provision of services in science and technology, carried out by public entities, including state university higher education institutions, are established as \"ordinary activity\" (actividad ordinaria). These entities, in turn, may sell technical services and technology transfer services to third parties. For both purposes, the institutions may use the direct contracting procedures established by the Law of the Financial Administration of the Republic (Ley de la Administración Financiera de la República).\n\nARTICLE 94.- State university higher education institutions are hereby enabled and authorized to sell goods and services linked to research projects, technological development, consultancies, and special courses. To improve and expedite the sale of goods and services, said institutions are also hereby enabled and authorized to create foundations and auxiliary companies.\n\nARTICLE 95.- A procedure must be established so that resources collected from the sale of services are transferred in an agile and effective manner to the very research entities that generated them, with the purpose of ensuring the timely availability of these funds and the continuity of scientific and technological activities.\n\nIn the case of the sale of services at university centers, the funds shall be invested according to the criteria of the university authorities, without any detriment to the autonomy that characterizes them.\n\nCHAPTER II\n\nIncentives for Innovation, Development, and Transfer of Technology in Urban and Rural Communities\n\nArticle 96- Research centers, public and private institutions, as well as organized groups from urban and rural communities that develop innovation, development, and technology transfer programs, with projects appropriate for the development of the different regions of the country, shall receive financial support through the resources of this law, pursuant to article 39, or from any other source that the Promotora has for this purpose and to facilitate that process, upon prior selection and approval in accordance with the procedures established by the Promotora's regulation.\n\n(Thus amended by article 23 of the Law Creating the Promotora Costarricense de Innovación e Investigación, Law No. 9971 of May 11, 2021)\n\nCHAPTER III\n\nRationalization of Resources for Science and Technology in the Public Administration\n\nARTICLE 97.- All institutions, entities, and bodies of the Public Administration that develop or execute actions in the field of science and technology, as part of their institutional competence, framed within the policy guidelines defined in the National Program for Science and Technology (Programa Nacional de Ciencia y Tecnología), are hereby authorized to allocate a percentage of their ordinary annual budget to the promotion, incentivization, protection, and development of research projects in science and technology, and other activities related to these matters, that contribute to technological change and national development from their sphere of action.\n\nArticle 98.- The guidelines regarding the establishment, increase, and direction of the budgetary percentage allocated for the cited purposes shall be made by the Executive Branch through the Ministry of Finance and the Ministry of Science, Technology, and Telecommunications(*), in consultation with each of the institutions, entities, and bodies of the Public Administration that develop or execute actions in the field of science and technology, taking into account the nature of the public institution or body, budgetary priorities, the amount of the ordinary annual budget, its connection to the field of science and technology, and the public interest in developing the research programs and activities proposed by the institution.\n\n(*)(Name modified by Article 11 of Law \"Transfer of the Telecommunications sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology, No. 9046 of June 25, 2012)\n\n ARTICLE 99.- The public bodies and institutions referred to in the two preceding articles are obligated to inform the Ministry of Science and Technology of their respective specific budgets that include scientific and technological activities, indicating the nature and objectives of the programs in which these resources will be used.\n\n ARTICLE 100.- The Costa Rican State shall promote the modernization and utilization of the technological resources used by the national public sector, and shall seek an increase in the efficiency of the entities that form this sector, through greater rationalization of technological decisions regarding technology transfer, adaptation, assimilation, and generation.\n\n TITLE VII\n\n SANCTIONS\n\n SOLE CHAPTER\n\n Sanctions\n\n ARTICLE 101.- Persons who make improper use of the incentives established by this law shall be sanctioned with the loss of the granted benefit. When the incentive refers to a tax exemption or deduction, they must pay the amount of taxes they would have owed without the enjoyment of the benefit.\n\n ARTICLE 102.- When fraud, deceit, or any other form of inducement into error has been used to enjoy the incentive, the person irregularly benefited, in addition to the sanctions established in Article 102, must pay a fine equivalent to twice the value of the incentive received.\n\n ARTICLE 103.- The foregoing administrative sanctions shall be executed by the pertinent public authorities, as the case may be, in accordance with the current legal system and without prejudice to any criminal and civil liabilities that may be pursued.\n\n TITLE VIII\n\n GENERAL PROVISIONS\n\n SOLE CHAPTER\n\n General provisions\n\n ARTICLE 104.- A new subsection, which shall be ñ), is added to Article 23 of the General Law of Public Administration, No. 6227 of May 2, 1978, which shall read as follows:\n\n \"Article 23.-\n\n ...\n\n 1) The ministerial portfolios shall be:\n\n a)...\n\n ñ) Science and Technology.\"\n\n ARTICLE 105.- This law is a matter of public order and repeals any other general or special provisions that conflict with it or are incompatible with its application.\n\n ARTICLE 106.- It shall take effect upon its publication.\n\n SOLE TRANSITORY PROVISION.- This law shall be regulated by the Executive Branch within six months of its publication, but the lack of regulation shall not affect its application. Likewise, the specific regulations referred to in this law must be enacted within the same period. The regulation shall be made in consultation with the involved sectors." }
