  "body_es_text": "en la totalidad del texto\n\n                    -\n\nTexto Completo Norma 22545\n\n                        Reglamento a la Ley de Conservación de la Vida Silvestre\n\nN° 22545-MIRENEM\n\n(Este Decreto fue Derogado por el artículo\n107 del decreto ejecutivo N° 26435 del 1 de octubre de 1997, y nuevamente es\nderogado por el artículo 178 del decreto ejecutivo N° 32633 del 10 de marzo del\n2005)\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY ELMISNISTRO DE RECURSOS NATURALES, ENERGÍA\nY MINAS,\n\nCon fundamento en las facultades que les\nconfiere el artículo 140, inciso 3 de la Constitución Política, y de\nconformidad con el artículo 12 de la Ley de Conservación de la Vida Silvestre\nnúmero 7317 del 7 de diciembre de 1992;\n\nDECRETAN:\n\nREGLAMENTO A LA LEY\nDE CONSERVACIÓN D LA VIDA SILVESTRE\n\nCAPÍTULO I\n\nDisposiciones generales\n\nArtículo 1°.- En el presente Reglamento se\nutilizarán las siguientes abreviaturas:\n\nCITES: Convención sobre el Comercio Internacional\nde Especies Amenazadas de Flora y Fauna Silvestre.\n\nDGF: Dirección General Forestal.\n\nDGVS: Dirección General de Vida Silvestre.\n\nFVS: Fondo de Vida Silvestre.\n\nLCVS: Ley de Conservación de la Vida\nSilvestre.\n\nMIRENEM: Ministerio de Recursos Naturales,\nEnergía y Minas.\n\nSPN: Servicio de Parques Nacionales.\n\nArtículo 2°.- Para los fines de la\naplicación de la LCVS se entenderá por:\n\nAREA DE MANEJO: El área\ngeográfica donde se desarrolla un proyecto para la instalación de\nun zoológico, zoocriadero, vivero o acuario.\n\nBOCA DE RÍO: Accidente\ngeográfico en donde un río descarga su caudal de aguas a otro\nmayor o al mar.\n\nCONTAMINANTE: Cualquier sustancia o material\nque modifique las características físicas y químicas del\nagua, aire o el suelo.\n\nCUERO: La piel procesada de un animal, con\nvalor agregado por el curtido, teñido y acabado.\n\nDESARROLLO TURÍSTICO: Todo proyecto de\ncarácter comercial que genere beneficios económicos y que\ncontemple más de un módulo ara fines recreativos.\n\nDESEMBOCADURA: Sitio o lugar en donde un\nrío o estero confluye al mar, extendiendo su área de influencia\nun kilómetro a cada lado de la boca de río, de forma que complete\nun semicírculo tomando como punto de partida el centro de dicha boca.\n\nESPECIE EN PELIGRO DE EXTINCIÓN:\nAquellas que debido a su escasez o por algún otro factor de su\nbiología particular, se encuentran gravemente amenazadas de desaparecer\ndel país, y cuya sobrevivencia es poco probable si los factores causales\nde su desaparición (entre otros, deforestación, cacería,\nintroducción en especies exóticas, contaminación)\ncontinúan actuando sobre ellas.\n\nESPECIES CON POBLACIONES REDUCIDAD: Son\nespecies o subespecies de fauna y flora silvestres, o sus poblaciones, que\ntienen probabilidades de convertirse en especies en peligro de extinción\nen el futuro previsible, en todas o parte de sus áreas de\ndistribución; si los factores que causan su disminución\nnumérica o la degradación de sus hábitats continúan\npresentándose; o que son raras porque se encuentran generalmente\nlocalizadas en áreas o hábitats geográficamente limitados,\no muy diseminadas en áreas de distribución más extensas, y\nestán en posibilidades reales o potenciales de verse sujetas a una\ndisminución y posible peligro de extinción o a la\nextinción de la misma.\n\nESTANQUE O PILETA: El depósito\nartificial de agua, de bajo volumen; utilizado para simular condiciones\nnaturales en el manejo del plantel reproductor de un zoocriadero,\nzoológico o acuario, o bien para desarrollar animales en cautiverio.\n\nESTERO: El depósito de agua salobre\nque penetra en el continente manteniendo comunicación con el mar, con 50\nmetros o menos de ancho en su desembocadura.\n\nHABITAT: El lugar en donde vive un animal o\nplanta, que posee determinadas condiciones físicas y naturales\nesenciales para su supervivencia y preservación.\n\nLABORATORIO: Instalación de\ncarácter científico en donde se experimenta, se estudian o analizan\nejemplares de flora o fauna silvestre.\n\nLAGUNA: El depósito natural de agua de\nbajo volumen. Puede ser de carácter estacional.\n\nMATERIAL GENETICO: Los tejidos, gametos y sernillas\nde plantas, o de anima1silvestres.\n\nMODULO: Conjunto de aposentos que componen\nuna vivienda.\n\nPIEL: El tejido epidérmico sin\nprocesar obtenido de un animal, y cuyo normal tratamiento es el salado.\n\nPLAZAS: Se refiere al número de\nhuéspedes que permite la unidad habitacional.\n\nPLANTA DE TRATAMIENTO: Sistema de manejo de\naguas negras, jabonosas, de deshecho o cualquier sustancia contaminante, en\ndonde usualmente se incorpora oxígeno y se precipitan sólidos\ndisueltos.\n\nPRODUCTO: Todo aquello generado directamente\npor la fauna y flora silvestres\n\nRAZA: El concepto de la sistemática\nbiológica para la descripción de subunidades de una especie. Es\nsimilar a variedad.\n\nREFUGIO DE FAUNA SILVESTRE: Categoría\nde manejo de áreas protegidas, en donde se preserva, conserva y maneja\nel hábitat, la flora y la fauna silvestre.\n\nRECURSOS NATURALES: El conjunto de elementos\nque componen la naturaleza, En su más generalizada acepción\nentiéndanse como tierra, agua, aire y vida silvestre.\n\nSUBPRODUCTO: Lo que se deriva de un producto\nde la fauna o flora silvestre mediante un proceso de producción.\n\nTAXIDERMIA: El arte de preparar y disecar los\nanimales, sus pieles o algunas de sus partes.\n\nUSO DE LOS RECURSOS NATURALES: La actividad\npor medio de la cual los seres humanos obtienen beneficios de una\npoblación animal, vegetal o de un ecosistema.\n\nVARIEDADES BOTANICAS: Las formas, razas o\nsubunidades taxonómicas de una especie vegetal.\n\nVIVERO: El sitio donde se reproducen plantas,\ntanto sexual como asexualmente, mediante métodos naturales o\nartificiales, se conservan, estudian o comercializan.\n\nVIVIENDA HABIT ACIONAL: Son aquellas\nconstrucciones formadas por un solo módulo y que es ocupada por sus\npropietarios permanentemente.\n\nVIVIENDA TURISTICA RECREATIVA: Establecimiento\nque brinda servicio de hospedaje por una tarifa diaria o mensual, con unidades\nindependientes de uno o más dormitorios, baño privado, cocina.\n\nZOOLOGICO: El establecimiento permanente y\norganizado que posee una colección de animales silvestres con\npropósitos recreativos, educativos, de investigación y de\nreproducción.\n\nZOOCRIADERO: El lugar en el que se trata de\npropagar o preservar animales fuera de su hábitat natural y donde se\ntrata de involucrar en el proceso el control humano en la selección y elección\nde los animales que se aparearán en esa población.\n\nZOOCRIADERO TIPO \"FARMING\": La\nexplotación comercial de animales silvestres que se realiza en una finca\nen la que se autoriza, por una única vez, la captura de un plantel\nfundador de reproductores, para desarrollar con ellos un plan de\nreproducción en ambientes cerrados que constituirá la\nproducción de la empresa.\n\nZOOCRIADERO TIPO \"RANCHING\": La\nexplotación comercial de animales silvestres en una finca, que implica\nel manejo sostenible de una población en su ambiente. Incluye la protección\nde la población, el mejoramiento del hábitat y la cosecha de\nhuevos en el campo.\n\nZOOCRIADERO DE OPERACION MIXTA (O): La\nexplotación comercial de animales silvestres que combina aspectos de\n\"FARMING\" y de \"RANCHING\". Incluye la recolección de\nhuevos y animales en ambientes naturales, la incubación artificial y el\ndesarrollo de los animales en ambientes cerrados.   "body_en_text": "in the entirety of the text\n\n                    -\n\nComplete Text of Regulation 22545\n\n                        Regulation to the Wildlife Conservation Law\n\nNo. 22545-MIRENEM\n\n(This Decree was repealed by Article\n107 of Executive Decree No. 26435 of 1 October 1997, and is again\nrepealed by Article 178 of Executive Decree No. 32633 of 10 March\n2005)\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF NATURAL RESOURCES, ENERGY\nAND MINES,\n\nBased on the powers conferred upon them by\nArticle 140, subsection 3 of the Political Constitution, and in\naccordance with Article 12 of the Wildlife Conservation Law\nNo. 7317 of 7 December 1992;\n\nDECREE:\n\nREGULATION TO THE LAW\nON WILDLIFE CONSERVATION\n\nCHAPTER I\n\nGeneral Provisions\n\nArticle 1.— In this Regulation the\nfollowing abbreviations shall be used:\n\nCITES: Convention on International Trade\nin Endangered Species of Wild Flora and Fauna.\n\nDGF: Dirección General Forestal.\n\nDGVS: Dirección General de Vida Silvestre.\n\nFVS: Fondo de Vida Silvestre.\n\nLCVS: Wildlife Conservation Law (Ley de Conservación de la Vida\nSilvestre).\n\nMIRENEM: Ministerio de Recursos Naturales,\nEnergía y Minas.\n\nSPN: Servicio de Parques Nacionales.\n\nArticle 2.— For the purposes of the\napplication of the LCVS, the following shall be understood by:\n\nMANAGEMENT AREA (ÁREA DE MANEJO): The geographical area\nwhere a project for the installation of a\nzoo, breeding farm (zoocriadero), nursery (vivero), or aquarium is developed.\n\nRIVER MOUTH (BOCA DE RÍO): Geographical feature\nwhere a river discharges its water flow into another\nlarger one or into the sea.\n\nPOLLUTANT (CONTAMINANTE): Any substance or material\nthat modifies the physical and chemical characteristics of the\nwater, air, or soil.\n\nLEATHER (CUERO): The processed skin of an animal, with\nvalue added by tanning, dyeing, and finishing.\n\nTOURISM DEVELOPMENT (DESARROLLO TURÍSTICO): Any project of a\ncommercial nature that generates economic benefits and that\nincludes more than one module for recreational purposes.\n\nOUTLET (DESEMBOCADURA): Site or place where a\nriver or estuary (estero) flows into the sea, extending its area of influence\none kilometer to each side of the river mouth (boca de río), so as to form\na semicircle taking the center of said mouth as the starting point.\n\nENDANGERED SPECIES (ESPECIE EN PELIGRO DE EXTINCIÓN):\nThose that, due to their scarcity or some other factor of their\nparticular biology, are seriously threatened with disappearing\nfrom the country, and whose survival is unlikely if the causal factors\nof their disappearance (among others, deforestation, hunting,\nintroduction of exotic species, pollution)\ncontinue to act upon them.\n\nSPECIES WITH REDUCED POPULATIONS (ESPECIES CON POBLACIONES REDUCIDAS): They are\nspecies or subspecies of wild fauna and flora, or their populations, that\nare likely to become endangered species\nin the foreseeable future, in all or part of their distribution\nareas; if the factors causing their numerical\ndecrease or the degradation of their habitats (hábitats) continue\nto occur; or that are rare because they are generally\nlocated in geographically limited areas or habitats (hábitats),\nor very scattered in larger distribution areas, and\nare in real or potential possibility of being subject to a\ndecrease and possible endangerment of extinction or to the\nextinction of the same.\n\nPOND OR POOL (ESTANQUE O PILETA): The artificial\ndeposit of water, of low volume; used to simulate natural\nconditions in the management of the reproductive stock of a breeding farm (zoocriadero),\nzoo or aquarium, or to raise animals in captivity.\n\nESTUARY (ESTERO): The deposit of brackish water\nthat penetrates the continent maintaining communication with the sea, with 50\nmeters or less in width at its outlet (desembocadura).\n\nHABITAT (HABITAT): The place where an animal or\nplant lives, which possesses certain physical and natural\nconditions essential for its survival and preservation.\n\nLABORATORY (LABORATORIO): Installation of a\nscientific nature where specimens of wild flora or fauna are experimented on, studied or analyzed.\n\nLAGOON (LAGUNA): The natural deposit of water of\nlow volume. It may be seasonal in nature.\n\nGENETIC MATERIAL (MATERIAL GENETICO): The tissues, gametes, and seeds\nof wild plants or animals.\n\nMODULE (MODULO): Set of rooms that make up\na dwelling.\n\nSKIN (PIEL): The unprocessed epidermal tissue\nobtained from an animal, whose normal treatment is salting.\n\nPLACES (PLAZAS): Refers to the number of\nguests that the housing unit allows.\n\nTREATMENT PLANT (PLANTA DE TRATAMIENTO): System for managing black,\nsoapy, waste waters, or any polluting substance, where\noxygen is usually incorporated and dissolved solids\nare precipitated.\n\nPRODUCT (PRODUCTO): Everything generated directly\nby wild fauna and flora.\n\nRACE (RAZA): The concept of biological\nsystematics for the description of subunits of a species. It is\nsimilar to variety.\n\nWILDLIFE REFUGE (REFUGIO DE FAUNA SILVESTRE): Management\ncategory of protected areas, where the\nhabitat (hábitat), flora, and wild fauna are preserved, conserved, and managed.\n\nNATURAL RESOURCES (RECURSOS NATURALES): The set of elements\nthat compose nature. In its most generalized meaning\nthey are understood as land, water, air, and wildlife.\n\nBY-PRODUCT (SUBPRODUCTO): What is derived from a product\nof wild fauna or flora through a production process.\n\nTAXIDERMY (TAXIDERMIA): The art of preparing and dissecting\nanimals, their skins, or some of their parts.\n\nUSE OF NATURAL RESOURCES (USO DE LOS RECURSOS NATURALES): The activity\nthrough which humans obtain benefits from an\nanimal or plant population or from an ecosystem.\n\nBOTANICAL VARIETIES (VARIEDADES BOTANICAS): The forms, races, or\ntaxonomic subunits of a plant species.\n\nNURSERY (VIVERO): The site where plants are reproduced,\nboth sexually and asexually, by natural or\nartificial methods, and are conserved, studied, or commercialized.\n\nRESIDENTIAL HOUSING (VIVIENDA HABITACIONAL): Those\nconstructions consisting of a single module (módulo) and permanently occupied by their\nowners.\n\nRECREATIONAL TOURIST HOUSING (VIVIENDA TURISTICA RECREATIVA): Establishment\nthat provides lodging service for a daily or monthly rate, with independent\nunits of one or more bedrooms, private bath, kitchen.\n\nZOO (ZOOLOGICO): The permanent and organized\nestablishment that possesses a collection of wild animals for\nrecreational, educational, research, and\nreproduction purposes.\n\nBREEDING FARM (ZOOCRIADERO): The place where one tries to\npropagate or preserve animals outside their natural habitat (hábitat) and where\nhuman control is sought to be involved in the process of selection and choice\nof the animals that will mate in that population.\n\n\"FARMING\" TYPE BREEDING FARM (ZOOCRIADERO TIPO \"FARMING\"): The\ncommercial exploitation of wild animals carried out on a farm\nwhere, on a one-time basis, the capture of a founder\nstock of breeders is authorized, to develop with them a\nreproduction plan in closed environments that will constitute the\nproduction of the enterprise.\n\n\"RANCHING\" TYPE BREEDING FARM (ZOOCRIADERO TIPO \"RANCHING\"): The\ncommercial exploitation of wild animals on a farm, which implies\nthe sustainable management (manejo sostenible) of a population in its environment. It includes the protection\nof the population, habitat improvement, and the harvest of\neggs in the field.\n\nMIXED OPERATION BREEDING FARM (ZOOCRIADERO DE OPERACION MIXTA): The\ncommercial exploitation of wild animals that combines aspects of\n\"FARMING\" and \"RANCHING\". Includes the collection of\neggs and animals in natural environments, artificial incubation, and the\ndevelopment of animals in closed environments.
