Artículo que a su vez la Sala Constitucional anuló por\nconexidad, mediante resolución N° 1056 del 28 de enero del 2009, únicamente en tanto no excluyó,\nademás, al artículo 6 de este cuerpo legal).\n\nEL PRESIDENTE DE\nLA REPÚBLICA\n\nY EL MINISTRO DE AGRICULTURA Y GANADERÍA,\n\n \n\n    En\nejercicio de las facultades que les confiere\nel artículo 140, inciso 3) de\nla Constitución Política,\nde conformidad con el artículo 2°, inciso\nh) de\nla Ley Forestal N° 4465 del 25 de noviembre de 1969 y artículo 18 de\nla Ley de Conservación de\nla Fauna Silvestre N° 6919 del 17 de noviembre de 1983,\n\n \n\nConsiderando:\n\n   \n1°-.Que la zona litoral Atlántica de Talamanca posee recursos tales como:\nManglares, pantanos, bosques y arrecifes de valor único.\n\n    2°-Que dentro de la zona se encuentra la única asociación de yolillo y orey (Raphia sp y\nCampnosperma panamense) que existe en nuestro país.\n\n    3°-Que la zona mantiene poblaciones de especies en vías de extinción como: El manatí (Trichechus\nmanatus), el cocodrilo y el caimán (Crocodilus acutus y Caimán crocodilus), la danta (Tapirus\nbardil) y diversas especies de monos y felinos.\n\n    4°-Que en la franja litoral y en la zona de arrecifes existe el único banco natural de ostión de\nmangle (Crassastraea rhizophorae), uno de los pocos criaderos de sábalo (Megalops atlanticus) y\npoblaciones residentes y únicas de langosta (Panilururs argus)\n\n   \n5°-Que la zona posee playas de gran potencial turístico bajo un manejo\nregulado.\n\n   \n6°-Que es función del Estado velar por la conservación de los recursos\nnaturales renovables, especialmente aquellos que impliquen el mejor bienestar y\ndesarrollo social, económico, político y ecológico de los pobladores de la\nregión.\n\nPor\ntanto,\n\n \n\nDecretan :\n\n \n\n    Artículo 1°-Declarar Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, el área comprendida\ndentro de los siguientes linderos: según el mapa básico Sixaola 3644 I, escala 1:50000 del Instituto\nGeográfico Nacional. Partiendo de un punto situado 100 metros al noreste de la desembocadura del río\nCocles sobre la línea de marea. Continúa de ese punto y siempre paralelo 100 metros al río Cocles\ncon rumbo suroeste hasta alcanzar la carretera actual entre Puerto Viejo y Manzanillo. Sigue por esa\ncarretera con rumbo este hasta 100 metros antes del puente sobre la quebrada Ernesto en donde toma\nuna línea paralela de 100 metros a dicha quebrada aguas arriba, hasta su nacimiento. En su\nnacimiento toma la curva del nivel de los 40 metros y se va por dicha curva hasta alcanzar la\nintersección entre las coordenadas 609.000 E y 395.000 N. De ese punto sigue una línea de 300\nmetros, con este franco para buscar posteriormente otra línea que se ubique 100 metros antes del\nnacimiento de la quebrada Milla. De ese punto sigue aguas abajo una línea paralela de 100 metros a\ndicha quebrada hasta llegar a un punto situado en la costa a 200 metros antes de la línea de marea.\nLuego continúa con rumbo sureste paralelo 200 metros a la costa hasta un punto situado a 300  metros\nantes de la primera boca de la laguna Gandoca (hoy cerrada) y toma esa línea paralela 300 metros al\nrío Gandoca aguas arriba, hasta un punto situado entre la coordenada 617.000 E y la coordenada\n391.400 N. De ese punto toma rumbo sur franco hasta el río Sixaola, en donde luego toma aguas abajo\npor la margen izquierda hasta su desembocadura. De ese punto de la desembocadura, se toma una línea\nperpendicular a la playa de 2.500  metros y continúa bordeando la costa con rumbo noreste y en forma\nparalela a ésta a una distancia de 2.500  metros hasta una línea imaginaria perpendicular 2.500\nmetros al punto inicial de la presente descripción situado 100 metros al noreste de la desembocadura\ndel río Cocles. An article that the Constitutional Chamber subsequently annulled by\nassociation, through Resolution No. 1056 of January 28, 2009, only insofar as it did not also exclude\nArticle 6 of this legal body).\n\nTHE PRESIDENT OF\nTHE REPUBLIC\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK,\n\n \n\n    In\nexercise of the powers conferred upon them by\nArticle 140, subsection 3) of\nthe Political Constitution,\nin accordance with Article 2, subsection\nh) of\nForestry Law (Ley Forestal) No. 4465 of November 25, 1969 and Article 18 of\nthe Wildlife Conservation Law (Ley de Conservación de\nla Fauna Silvestre) No. 6919 of November 17, 1983,\n\n \n\nConsidering:\n\n   \n1°—That the Atlantic coastal zone of Talamanca possesses resources such as:\nmangroves, swamps, forests, and reefs of unique value.\n\n    2°—That within the zone is found the only association of yolillo and orey (Raphia sp and\nCampnosperma panamense) that exists in our country.\n\n    3°—That the zone maintains populations of endangered species such as: the manatee (Trichechus\nmanatus), the crocodile and the caiman (Crocodilus acutus and Caimán crocodilus), the tapir (Tapirus\nbardil), and diverse species of monkeys and felines.\n\n    4°—That in the coastal strip and in the reef zone exists the only natural bank of mangrove oyster (Crassostrea rhizophorae), one of the few hatcheries for tarpon (Megalops atlanticus), and unique resident populations of lobster (Panulirus argus).\n\n   \n5°—That the zone possesses beaches of great tourism potential under regulated\nmanagement.\n\n   \n6°—That it is the duty of the State to ensure the conservation of renewable\nnatural resources, especially those that imply the greatest well-being and\nsocial, economic, political, and ecological development of the inhabitants of the\nregion.\n\nTherefore,\n\n \n\nThey Decree:\n\n \n\n    Article 1—To declare the Gandoca-Manzanillo National Wildlife Refuge (Refugio Nacional de Vida Silvestre Gandoca-Manzanillo), the area comprised within the following boundaries: according to the basic map Sixaola 3644 I, scale 1:50000 of the National Geographic Institute (IGN). Starting from a point located 100 meters northeast of the mouth of the Cocles River on the high-tide line. It continues from that point and always parallel, 100 meters to the Cocles River heading southwest until reaching the current road between Puerto Viejo and Manzanillo. It follows that road heading east up to 100 meters before the bridge over the Ernesto stream (quebrada) where it takes a line parallel, 100 meters to said stream upstream, up to its headwaters (naciente). At its headwaters, it takes the 40-meter elevation contour curve and proceeds along said curve until reaching the intersection between coordinates 609,000 E and 395,000 N. From that point, it follows a line of 300 meters, due south, to subsequently find another line located 100 meters before the headwaters of the Milla stream. From that point, it follows downstream a line parallel, 100 meters to said stream until reaching a point located on the coast 200 meters before the high-tide line. It then continues heading southeast, parallel, 200 meters to the coast to a point located 300 meters before the first mouth of the Gandoca Lagoon (laguna Gandoca) (currently closed) and takes that line parallel, 300 meters to the Gandoca River upstream, to a point located between coordinate 617,000 E and coordinate 391,400 N. From that point, it takes a heading due south to the Sixaola River, where it then proceeds downstream along the left bank to its mouth. From that point at the mouth, a line is taken perpendicular to the beach of 2,500 meters and continues bordering the coast heading northeast and parallel to it at a distance of 2,500 meters to an imaginary line perpendicular, 2,500 meters to the initial point of this description, located 100 meters northeast of the mouth of the Cocles River.
