Estos programas estarán\n\nbasados en las prioridades del Ministerio y la Caja y serán compatibles\n\ncon los objetivos expresados en el artículo 2º.\n\n b) Proporcionar personal debidamente calificado para poner estos\n\nprogramas en marcha en forma efectiva.\n\n c) Pagar todos los sueldos al personal de la Fundación.\n\n d) Comprometerse a que los miembros del personal de Fundación no\n\ncobren ningún honorario o remuneración a instituciones de Costa Rica o\n\nterceros durante el desarrollo de sus programas.\n\n e) Los miembros de la Fundación no podrán dedicarse a la práctica\n\nprivada de la medicina. La atención médica como parte de los programas de\n\nadiestramiento será prestada solamente a aquellos pacientes que no tengan\n\nrecursos para pagar los servicios médicos y que según criterio del\n\nMinisterio o la Caja se benefician con esa atención.\n\n f) Cumplir todas las leyes de Costa Rica al poner en marcha los\n\nprogramas de Fundación.\n\n g) Donación de equipos para los proyectos asumidos por este\n\nConvenio.\n\n Ficha articulo\n\n Artículo 4º.- Obligaciones del Ministerio y la Caja:\n\n a) Aceptar a la Fundación como una entidad privada, no lucrativa,\n\ncuyo único propósito en la República de Costa Rica es ayudar al\n\ndesarrollo y la expansión de los servicios de salud, y responder a la\n\nnecesidad de aumentar el número de personal calificado que presta sus\n\nservicios en este campo.\n\n b) Cuando sea apropiado, gestionar ante quien corresponda los\n\ntítulos o diplomas de profesores visitantes al cuerpo docente de la\n\nFundación, así los profesionales de la Fundación puedan desenvolverse\n\ndentro de las instituciones a las cuales se les asigne.\n\n c) Las personas en adiestramiento estarán bajo la responsabilidad\n\nfinanciera de las organizaciones respectivas o instituciones\n\ncostarricenses; el Ministerio y la Caja darán seguridad, dentro de sus\n\nposibilidades presupuestarias, de usar la experiencia adquirida por ellos\n\ndurante sus programas de adiestramiento, proporcionándoles la ubicación\n\nadecuada de acuerdo con sus conocimientos.\n\n ch) Mientras dure el programa de la Fundación, ésta tendrá a su cargo\n\nla administración y uso exclusivo de los bienes donados por ella.\n\n d) Proporcionar a la Fundación servicios de apoyo apropiados para\n\nel desenvolvimiento de las actividades. Estos servicios incluirán\n\nservicios de secretariado e impresión de papelería. Ocasionalmente,\n\ntambién el concurso de personal de apoyo, no especializado (ayudantes).\n\n e) Proporcionar el siguiente material relacionado con el programa:\n\n 1) Espacio apropiado y muebles para oficinas del personal de la\n\n Fundación.\n\n 2) Teléfonos para la oficina, instalados y funcionando.\n\n 3) Utilización de vehículos de la Caja y del Ministerio, conforme\n\n con los reglamentos respectivos.\n\n 4) Transporte y hospedaje para uso personal de la Fundación por\n\n parte de la Caja dentro de sus posibilidades y donde ella\n\n indique.\n\n f) Gestionar ante el Ministerio de Hacienda, la concesión de\n\nlicencias para que los bienes (e. g. vehículo, menaje de casa, efectos\n\npersonales, etc.) de los funcionarios de la Fundación entren al país con\n\npermiso de importación temporal; en el entendido que dichos bienes no\n\npodrán ser vendidos, o pignorados sin que antes los propietarios no\n\ncubran todos los impuestos que la ley señale.\n\n Asimismo gestionará ante el Ministerio de Hacienda que los\n\nvehículos suministrados, medicinas y otros equipos o materiales que la\n\nFundación destine al programa, entren al país bajo el amparo de\n\ntratamiento de importación temporal, en el entendido que todos los bienes\n\nserán donados al Ministerio de Salud Pública y la Caja al terminar el\n\nprograma.\n\n g) Gestionar el pago de desalmacenaje y transporte de los equipos de\n\nlos lugares de destino en el exterior hasta Costa Rica, esto estará a\n\ncargo de la Caja.\n\n h) Al estar firmado el presente convenio, el Ministerio gestionará\n\nante las autoridades respectivas, el otorgamiento de visas y permisos\n\npara el personal de Fundación, mientras estén trabajando en el programa\n\nobjeto de este acuerdo.\n\n i) El Ministerio y la Caja se comprometen a gestionar ante la\n\nAsamblea Legislativa la exoneración de toda clase de impuestos para\n\npersonal técnico extranjero de la Fundación, con base en acuerdos\n\nsimilares anteriores. The need to expand health coverage (cobertura de salud) and to prepare qualified personnel to meet\nhealth needs immediately and in the long term is recognized. To help\nmeet this need, the Foundation joins the Ministry to\ncollaborate in the retraining of existing health personnel,\nthrough the Continuing Education Program, and for the training of\nnew technical and auxiliary personnel necessary to meet the immediate\ndemand of the Ministry and the Caja.\n\nArticle Record\n\nArticle 3.—Obligations of the Foundation:\n\na) Provide technical assistance in the development and implementation of\ntraining programs in the health field that are mutually agreed upon and\ndefined with the Ministry and the Caja. Medical care as part of the training\nprograms will be provided only to those patients who do not have\nthe resources to pay for medical services and who, in the judgment of the\nMinistry or the Caja, benefit from such care.\n\nf) Comply with all laws of Costa Rica when implementing the\nFoundation's programs.\n\ng) Donation of equipment for the projects undertaken under this\nAgreement.\n\nArticle Record\n\nArticle 4.—Obligations of the Ministry and the Caja:\n\na) Accept the Foundation as a private, non-profit entity,\nwhose sole purpose in the Republic of Costa Rica is to assist in the\ndevelopment and expansion of health services, and to respond to the\nneed to increase the number of qualified personnel providing\nservices in this field.\n\nb) When appropriate, process with the relevant authorities the\ntitles or diplomas for visiting professors to the Foundation's teaching staff, so that the Foundation's professionals can function\nwithin the institutions to which they are assigned.\n\nc) Persons in training will be under the financial\nresponsibility of the respective Costa Rican organizations or\ninstitutions; the Ministry and the Caja will provide assurance, within their\nbudgetary possibilities, to use the experience acquired by them\nduring their training programs, providing them with\nadequate placement according to their knowledge.\n\nch) For the duration of the Foundation's program, the Foundation will be in charge of\nthe administration and exclusive use of the goods donated by it.\n\nd) Provide the Foundation with appropriate support services for\nthe development of activities. These services will include\nsecretarial services and stationery printing. Occasionally,\nalso the assistance of non-specialized support personnel (assistants).\n\ne) Provide the following program-related material:\n\n1) Appropriate space and furniture for the offices of the\nFoundation's personnel.\n\n2) Telephones for the office, installed and functioning.\n\n3) Use of vehicles from the Caja and the Ministry, in accordance\nwith the respective regulations.\n\n4) Transportation and lodging for the personal use of the Foundation\nby the Caja within its means and where it\nindicates.\n\nf) Process with the Ministry of Finance the granting of\nlicenses so that the goods (e.g., vehicle, household effects, personal\neffects, etc.) of the Foundation's officials enter the country with\ntemporary import permits; on the understanding that said goods may not\nbe sold or pledged without the owners first\ncovering all the taxes stipulated by law.\n\nLikewise, it will process with the Ministry of Finance so that the\nsupplied vehicles, medicines, and other equipment or materials that the\nFoundation allocates to the program enter the country under the\nprotection of temporary import treatment, on the understanding that all goods\nwill be donated to the Ministry of Public Health and the Caja upon termination of the program.\n\ng) Process the payment of customs clearance and transportation fees for equipment from\ntheir points of destination abroad to Costa Rica; this will be the\nresponsibility of the Caja.\n\nh) Upon the signing of this agreement, the Ministry will process\nwith the respective authorities the granting of visas and permits\nfor the Foundation's personnel while they are working on the program\nthat is the subject of this agreement.\n\ni) The Ministry and the Caja undertake to process with the\nLegislative Assembly the exoneration of all types of taxes for\nthe Foundation's foreign technical personnel, based on similar previous\nagreements.
