Ministerio de Recursos Naturales, Energía y Minas\n\npodrá suscribir convenios, por un plazo de diez años renovables, con\n\ninstituciones estatales, municipalidades, universidades y organismos sin\n\nfines de lucro, tales como asociaciones y fundaciones que posean\n\nexperiencia en el apoyo y el manejo de zoológicos, para que se encarguen\n\nde la administración, el manejo y el desarrollo del Zoológico Simón\n\nBolívar y del Zoológico de Santa Ana.\n\n En los citados convenios, se establecerán cláusulas que aseguren al\n\nEstado la eficiencia por parte del administrador del zoológico, así como\n\nlos mecanismos adecuados de supervisión, que el Ministerio considere\n\npertinentes; previa aprobación de la Contraloría General de la República.\n\nEl incumplimiento de una o más cláusulas del convenio respectivo, por\n\nparte del administrador, será causa justa para rescindir el convenio sin\n\nresponsabilidad alguna para el Estado.\n\n ARTICULO 2.- Los terrenos e infraestructura correspondientes al\n\nZoológico Simón Bolívar y al Zoológico de Santa Ana, así como los\n\nespecímenes de cualquier naturaleza, con que cuenten o lleguen a contar,\n\nformarán parte del patrimonio del Estado y no podrán salir, bajo ningún\n\nconcepto, de su dominio.\n\n ARTICULO 3.- Las tarifas de ingreso a los zoológicos estatales serán\n\nfijadas mediante decreto ejecutivo, tomando en cuenta los costos de\n\nmantenimiento del respectivo zoológico.\n\n ARTICULO 4.- La recaudación y la administración de las tarifas de\n\ningreso a los zoológicos estatales, así como cualquier otro ingreso\n\nderivado de su operación, estarán a cargo del administrador, el cual\n\ndeberá utilizarlos, exclusivamente, para fines propios de los zoológicos\n\nadministrados.\n\nArtículo\n 5.-\n La parte con quien se contrate la administración de los zoológicos, conforme\n a lo dispuesto en esta Ley, deberá presentar, semestralmente, un informe técnico\n y contable de su gestión al ministro de Ambiente, Energía y\n Telecomunicaciones.\n\nEn\n el contrato de administración deberán indicarse, entre otras cosas, los\n plazos de cumplimiento de las diferentes etapas del proyecto de administración\n y el Estado quedará en capacidad de hacer una rescisión parcial del contrato\n sobre las fases pendientes.\n\n(Así reformado por el\n artículo especial con que cuenta el Parque Zoológico Simón\n\nBolívar, según lo señala en el artículo 1 de esta Ley, serán administrados\n\npor la parte con la cual el Ministerio de Recursos Naturales, Energía y\n\nMinas celebre el convenio correspondiente.\n\n De igual manera se procederá con los recursos asignados a los\n\nzoológicos que se encuentren en el Ministerio de Cultura, Juventud y\n\nDeportes y Estos\n\nfuncionarios serán remunerados por el Estado y mantendrán todos sus\n\nactuales derechos laborales, además de los que se les conceda en el\n\nfuturo.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Law 7369\n\n Transfer of Administration of the Parque Bolívar and Santa Ana Zoos\n\nFull Text record: 21724\n1\n\n LAW THAT AUTHORIZES THE TRANSFER OF THE\n\n ADMINISTRATION OF THE SIMÓN BOLÍVAR PARK ZOOS\n\n AND THE SANTA ANA ZOO\n\n ARTICLE 1.- The Ministry of Natural Resources, Energy and Mines\n\nmay enter into agreements, for a renewable ten-year term, with\n\nstate institutions, municipalities, universities and non-profit\n\norganizations, such as associations and foundations that possess\n\nexperience in the support and management of zoos, for them to take charge\n\nof the administration, management and development of the Simón\n\nBolívar Zoo and of the Santa Ana Zoo.\n\n In the aforementioned agreements, clauses shall be established that ensure the\n\nState the efficiency on the part of the zoo administrator, as well as\n\nthe adequate supervision mechanisms, that the Ministry deems\n\npertinent; upon prior approval of the Comptroller General of the Republic.\n\nFailure to comply with one or more clauses of the respective agreement, on the\n\npart of the administrator, shall be just cause to rescind the agreement without\n\nany liability whatsoever for the State.\n\n ARTICLE 2.- The lands and infrastructure corresponding to the\n\nSimón Bolívar Zoo and the Santa Ana Zoo, as well as the\n\nspecimens of any nature, that they have or may come to have,\n\nshall form part of the State's patrimony and may not, under any\n\ncircumstance, leave its ownership.\n\n ARTICLE 3.- The entrance fees to the state zoos shall be\n\nset by means of an executive decree, taking into account the maintenance\n\ncosts of the respective zoo.\n\n ARTICLE 4.- The collection and administration of the entrance fees to\n\nthe state zoos, as well as any other income\n\nderived from their operation, shall be the responsibility of the administrator, who\n\nmust use them exclusively for the specific purposes of the\n\nadministered zoos.\n\nArticle\n 5.-\n The party with whom the administration of the zoos is contracted, in accordance\n with the provisions of this Law, must submit, semi-annually, a technical\n and accounting report of its management to the minister of Environment, Energy and\n Telecommunications.\n\nIn\n the administration contract, there must be indicated, among other things, the\n deadlines for the fulfillment of the different stages of the administration project\n and the State shall be able to make a partial rescission of the contract\n regarding the pending phases.\n\n(Thus amended by\n article 35° of law N° 8823 of May 5, 2010)\n\n ARTICLE 6.- Effective as of its publication.\n\n TRANSITORY I.- The monies accumulated, as of the date of the signing of the\n\nagreements, in the special fund available to the Simón\n\nBolívar Zoological Park, as indicated in article 1 of this Law, shall be administered\n\nby the party with which the Ministry of Natural Resources, Energy and\n\nMines enters into the corresponding agreement.\n\n In the same manner, the resources allocated to the\n\nzoos that are under the Ministry of Culture, Youth and\n\nSports and the Ministry of Natural Resources, Energy and Mines shall be handled.\n\n TRANSITORY II.- The public officials who currently work in\n\nthe zoos that are the subject of this authorization, shall continue to provide their\n\nservices to the entity with which the Ministry of Natural Resources,\n\nEnergy and Mines has entered into the administration agreements.
