Por tanto,\n\nDecretan:\n\n       \nArtículo 1º.El presente reglamento regula los procedimientos necesarios para el\notorgamiento y entrega del Premio \"GUAYACAN\".\n\n\tArtículo 2º.El Premio \"GUAYACAN\" consistirá en una medalla de oro\n\ncon un guayacán grabado, como símbolo de la lucha persistente por el\n\nmejoramiento del medio.\n\n\tArtículo 3º.Podrá ser acreedora de este premio cualquier persona\n\nfísica o jurídica, nacional o extranjera, cuya labor empresarial,\n\nindustrial, científica, técnica o de cualquier otra índole haya\n\ncontribuido en forma efectiva al mejoramiento del ambiente.\n\n\tArtículo 4º.Se entregará un Premio \"GUAYACAN\" para el sector\n\nrecursos naturales renovables y otro para el sector energía.\n\n\tArtículo 5º.La postulación de los candidatos deberá hacerse por\n\nmedio de los Colegios Profesionales, Asociaciones, Cámaras, Cooperativas,\n\nCorporaciones o Grupo Organizados; cuya labor esté ubicada en los límites\n\ntrazados en el artículo 4.\n\n\tArtículo 6º.El pedimento se hará directamente al Despacho del\n\nMinisterio del Ambiente y Energía, presentándose toda la documentación\n\nque se considere pertinente para acreditar las calidades del aspirante\n\npara esa designación.\n\n\tArtículo 7º.El Despacho del Ministerio del Ambiente y Energía\n\nrecibirá toda la documentación antes del día 15 de abril de cada año. El\n\nMinistro del Ambiente y Energía nombrará una comisión ad-hoc, de tres\n\nmiembros, para que estudie las propuestas y seleccione a los favorecidos.\n\n\tArtículo 8º.Las funciones de la Comisión serán las siguientes:\n\n\ta) Examinar los antecedentes de los aspirantes para verificar sus\n\n           méritos.\n\n\tb) Hacer un análisis exhaustivo de las calidades morales y técnicas\n\n           de los aspirantes para determinar si sus actividades ameritan\n\n           ser reconocidas públicamente.\n\n\tc) Seleccionar a los dos candidatos de cada sector y proponérselos\n\n           al Ministro del Ambiente y Energía antes del día 15 de mayo.\n\n\td) Proponer al Ministro del Ambiente y Energía que declare desierto\n\n           el premio \"GUAYACAN\".\n\n\tArtículo 9º.Los elegidos deberán recibir comunicación oficial dentro\n\nde los diez días siguientes al otorgamiento.   "body_en_text": "in the entirety of the text\n\n                    -\n\nFull Text of Regulation 25083\n\n                        Regulates Procedures for the Granting and Awarding of the Guayacán Prize\n\nText not available\n\nNº 25083-MINAE\n\n(This executive decree was repealed by\narticle 16 of the Regulation that regulates the Procedure for awarding the Guayacán\nPrize, approved by executive decree N° 39552 of January 26,\n2016)\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF THE ENVIRONMENT AND ENERGY,\n\n       \nIn exercise of the powers conferred by article 140, subsections 3) and 18) of the\nPolitical Constitution and articles 27 and 28 of the General Law of Public\nAdministration, in relation to article 114 of the Organic Law of the Environment, and\n\nConsidering:\n\n       \n1º That article 114 of the Organic Law of the Environment creates the annual\n\"GUAYACAN\" prize, to publicly recognize meritorious efforts in the\npersistent struggle for the improvement of the environment.\n\n       \n2º That the necessary procedures must be established to regulate the\ngranting and awarding of this prize. Therefore,\n\nDecree:\n\n       \nArticle 1. This regulation governs the necessary procedures for the\ngranting and awarding of the \"GUAYACAN\" Prize.\n\n\tArticle 2. The \"GUAYACAN\" Prize shall consist of a gold medal\n\nengraved with a guayacán, as a symbol of the persistent struggle for the\n\nimprovement of the environment.\n\n\tArticle 3. Any natural or legal person, national or foreign, whose\n\nentrepreneurial, industrial, scientific, technical, or other type of activity has\n\neffectively contributed to the improvement of the environment may be eligible for this prize.\n\n\tArticle 4. One \"GUAYACAN\" Prize shall be awarded for the\n\nrenewable natural resources sector and another for the energy sector.\n\n\tArticle 5. The nomination of candidates must be made\n\nthrough Professional Associations, Associations, Chambers, Cooperatives,\n\nCorporations, or Organized Groups, whose work falls within the boundaries\n\nset forth in Article 4.\n\n\tArticle 6. The petition shall be made directly to the Office of the\n\nMinister of the Environment and Energy, submitting all documentation\n\ndeemed pertinent to substantiate the candidate's qualifications\n\nfor that designation.\n\n\tArticle 7. The Office of the Minister of the Environment and Energy\n\nshall receive all documentation before April 15 of each year. The\n\nMinister of the Environment and Energy shall appoint an ad-hoc commission of three\n\nmembers to study the proposals and select the awardees.\n\n\tArticle 8. The functions of the Commission shall be the following:\n\n\ta) To examine the backgrounds of the candidates to verify their\n\n           merits.\n\n\tb) To conduct an exhaustive analysis of the moral and technical\n\n           qualifications of the candidates to determine if their activities merit\n\n           public recognition.\n\n\tc) To select the two candidates from each sector and propose them\n\n           to the Minister of the Environment and Energy before May 15.\n\n\td) To propose to the Minister of the Environment and Energy that the\n\n           \"GUAYACAN\" prize be declared void.\n\n\tArticle 9. The selected candidates shall receive official communication\n\nwithin ten days following the award. The names and qualifications of\n\nthe candidates not selected shall remain confidential and\n\n\tArticle 10. The President of the Republic shall officially award the\n\n\"GUAYACAN\" Prize on June 5, World Environment Day. For this purpose,\n\nthe distinguished individuals shall receive the gold medal with an engraved\n\nguayacán.\n\n\tArticle 11. The Public Relations Office of the Ministry of the\n\nEnvironment and Energy shall publicize the awardee, as well as the official\n\naward ceremony.\n\n\tArticle 12. The Ministry of the Environment and Energy shall incorporate\n\ninto its budget the expenses required by the prize.\n\n\tArticle 13. It shall be effective upon publication.\n\n   ."
