las facultades\nestablecidas en los incisos 3) y 18) del artículo 140 de\nla Constitución\n Política, la\n Ley N°\n6227 del 2 de mayo de 1978, Ley General de\nla\n Administración Pública,\nla Ley N° reformas, Ley de Creación del Instituto Mixto de Ayuda\nSocial.\n\n \n\n \n\nConsiderando:\n\n \n\n \n\nl°-Que los fenómenos\natmosféricos que han afectado nuestro país desde el año\n1998 y que dieron lugar a las declaratorias de emergencias citadas en los Decretos\nEjecutivos números 2858-MP, 27402-MP­-MOPT, 8009-P-MOPT,\n28139-MP-MOPT y otros, han provocado la pérdida de las cosechas de gran\ncantidad de pequeños productores de palmito, aunado lo anterior a una\nfuerte disminución en los precios internacionales del palmito, como producto\nde una sobre oferta en los mercados internacionales.\n\n2°-Que debido a esta\nsituación muchos pequeños productores de palmito se han visto\nimposibilitados para honrar sus obligaciones con las entidades financieras y se\nencuentran en condiciones de pobreza.\n\n3°-Que el Programa de\nAtención Integral para\nla Superación de\nla Pobreza, con que cuenta el\nIMAS permite el otorgamiento de ayudas a las personas que se encuentren en\ncondiciones de pobreza, de conformidad con el Sistema de Población\nObjetivo de esa Institución.\n\n            4°-Que\neste Programa puede utilizarse para ayudar a los pequeños productores de\npalmito que se encuentran en la situación apuntada, a pagar los\nintereses generados por sus obligaciones con las entidades financieras.\n\n5°-Que esta\nAdministración ha considerado prudente destinar parte de los recursos\ncon que cuenta este Programa, para que los pequeños productores de\npalmito que se encuentran en la situación de pobreza mencionada,\ncancelen los intereses que deben a la fecha, así como los que se generen\nen los seis meses siguientes a la emisión de este Decreto. Por tanto,\n\n \n\n \n\nDECRETAN:\n\n \n\n \n\nArtículo 1°-Dentro del\ntérmino de los diez días hábiles posteriores, contados a\npartir de la conformación del expediente y cumplimiento de los\nrequisitos establecidos en el presente Decreto, el Ministerio de Agricultura y\nGanadería, a través de las Agencias Sectoriales de Servicios Agropecuarios,\nreferirá y remitirá al Instituto Mixto de Ayuda Social, los\nexpedientes de los pequeños productores de palmito que se encuentren en\nlas siguientes condiciones:\n\n \n\n \n\n1. Que\nsean pequeños productores con un área sembrada de palmito\nno mayor de diez hectáreas\nde extensión.\n\n \n\n \n\n(Así\nreformado el inciso anterior por el artículo 1° del decreto ejecutivo N°\n29032 del 27 de octubre de 2000)\n\n \n\n \n\n2. Que hayan realizado la respectiva\nsolicitud ante alguna de las Agencias Sectoriales de Servicios Agropecuarios.\n\n \n\n3. Que hayan sido afectados en sus\ncosechas por alguno de los fenómenos naturales mencionados en los Decretos\nEjecutivos números 28518-MP, 27402-MP-MOPT, 28009-P-MOPT, 28130­MP-MOPT, u otros.\n\n \n\n4.Que hubieren formalizado sus\noperaciones de crédito ante las entidades o instancias financieras hasta\nel mes de diciembre de 1999.\n\n \n\n5.Que posean deudas por concepto de la\nsiembra de palmito con alguna de las siguientes entidades:\n\n \n\na) Banco Nacional de Costa Rica.\n\n \n\nb) Banco de Costa Rica.\n\n \n\nc) Banco Crédito\nAgrícola de Cartago.\n\n \n\nd) Banco Popular y de Desarrollo\nComunal.\n\n \n\ne) Fideicomiso\nMAG-PIPA-BANCRÉDlTO.\n\n \n\nf) IDA-Caja Agraria.\n\n \n\ng) Programa de Pequeños\nProductores de la Zona Norte\n(PPZN).\n\n \n\nh) Fundación Campesina\n(FUNDECA).\n\ni) PRONAMYPE.\n\n \n\nj) ANPAIACU.\n\n \n\nk) FUNDECOCA.\n\n \n\nl) FINCA.\n\n \n\nm) COOCIQUE, R. Cuenten con\nla Ficha de información\nsocial debidamente aplicada.\n\nArtículo 2°-En el\nexpediente de cada productor que sea remitido al IMAS, deberá constar al\nmenos los siguientes documentos:\n\n \n\n           \n\n1. Certificación extendida\npor una Agencia Sectorial de Servicios Agropecuarios en donde se acredite las\nanteriores condiciones.\n\n \n\n2. Documento emitido por\nla Agencia Sectorial\nde Servicios Agropecuarios mencionada en el punto anterior, mediante la cual se\nrecomiende al productor ante el IMAS para el otorgamiento de un beneficio de\ndicha Institución, en razón de que cumple las condiciones que\nfundamentan el presente Decreto.\n\n \n\n3. Estado de la deuda emitida por la\nentidad acreedora en donde se detalle los intereses corrientes y moratorios\nadeudados y necesarios para poner al día la respectiva operación,\nmás un detalle de lo correspondiente a seis meses adicionales por\nconcepto de la misma operación, aportada por el interesado.\n\n \n\n4. (Este inciso fue Derogado por\nel artículo 2° del decreto ejecutivo N° 29032 del 27 de octubre de 2000)\n\n \n\n5.\nCertificación o informe registra! de los\nbienes inmuebles propiedad únicamente de la persona que aparezca como deudora\nante la entidad acreedora que originó el crédito.\n\nEn\nel caso de que no conste en dicho documento la existencia de un inmueble\ninscrito a nombre del eventual beneficiario,\n\nla Unidad Ejecutora\n utilizará como fuente de información la certificación establecida en el\ninciso 1) del presente artículo.\n\n \n\n(Así\nreformado el inciso anterior por el artículo 3° del decreto ejecutivo N°\n29032 del 27 de octubre de 2000)\n\nArtículo\n3°-Se autoriza al Instituto Mixto de Ayuda Social para que dentro de los\nbeneficios del Programa de Atención una\nUnidad Ejecutora Institucional a cargo de un funcionario de nivel profesional\nresponsable de su implementación, seguimiento y control de conformidad con las\nnormas y procedimientos establecidos al efecto, y a fin de garantizar eficacia,\neficiencia y transparencia en la selección y calificación de los referidos\nbeneficiarios y beneficios.\n\nCon\nel fin de que participe en las acciones de coordinación Interinstitucional\nnecesaria para la ejecución del presente Decreto, el MAG designará un\nfuncionario del Sector Agropecuario como su representante ante la respectiva\nUnidad Ejecutora.\n\nArtículo\n6°-Una vez que el Sistema de Información de\nla Población Objetivo\n (SIPO) determine los pequeños productores que califiquen como personas en\ncondiciones de pobreza o pobreza extrema, el IMAS realizará las siguientes\nacciones:\n\n \n\n1.La\nUnidad Ejecutora establecida en este Decreto, elaborará una resolución en\ndonde se recomiende el otorgamiento del respectivo beneficio para cada caso en\nparticular, en donde se determine el cumplimiento de los requisitos respectivos.\n\n \n\n2.\nSe comunicará al MAG, los beneficiarios calificados indicando los resultados\nobtenidos por el Sistema de Información de\nla Población Objetivo.\n\n \n\n3.\nCancelará en forma directa a las entidades acreedoras los montos\ncorrespondientes a los beneficiarios indicados.\n\n \n\n4.\nHará devolución al MAG de los expedientes de los productores que no califiquen\nsegún el Sistema de Información de\nla Población Objetivo\n, con el fin de que se identifiquen o Service Agencies, shall forward to the Joint Institute for Social Aid the files of small heart-of-palm producers who find themselves in conditions of poverty.\n\nNo. 28813-MAG-MTSS\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF AGRICULTURE AND LIVESTOCK\n\nAND OF LABOR AND SOCIAL SECURITY\n\nIn exercise of the powers established in subsections 3) and 18) of Article 140 of the Political Constitution, Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, and Law No. 4760 of May 4, 1971 and its amendments, Law for the Creation of the Joint Institute for Social Aid.\n\nWhereas:\n\nI.—That the atmospheric phenomena that have affected our country since 1998 and that gave rise to the emergency declarations cited in Executive Decrees No. 2858-MP, 27402-MP-MOPT, 8009-P-MOPT, 28139-MP-MOPT and others, have caused the loss of harvests for a large number of small heart-of-palm producers, coupled with a sharp decline in international heart-of-palm prices, as a result of an oversupply on international markets.\n\nII.—That due to this situation, many small heart-of-palm producers have found themselves unable to honor their obligations with financial institutions and find themselves in conditions of poverty.\n\nIII.—That the Comprehensive Care Program for Overcoming Poverty, available at IMAS, allows the granting of aid to persons who find themselves in conditions of poverty, in accordance with the Individual Target Population System (Sistema de Población Objetivo) of that Institution.\n\nIV.—That this Program can be used to help small heart-of-palm producers who find themselves in the indicated situation, to pay the interest generated by their obligations with financial institutions.\n\nV.—That this Administration has deemed it prudent to allocate part of the resources available to this Program, so that small heart-of-palm producers who find themselves in the mentioned situation of poverty, may pay off the interest they owe to date, as well as that which may be generated in the six months following the issuance of this Decree. Therefore,\n\nTHEY DECREE:\n\nArticle 1.—Within a term of ten business days thereafter, counted from the compilation of the file and fulfillment of the requirements established in this Decree, the Ministry of Agriculture and Livestock, through the Sectoral Agricultural Service Agencies, shall refer and forward to the Joint Institute for Social Aid, the files of small heart-of-palm producers who meet the following conditions:\n\n1. That they are small producers with a planted area of heart-of-palm no greater than ten hectares in extent.\n\n(As amended by Article 1 of Executive Decree No. 29032 of October 27, 2000)\n\n2. That they have submitted the respective application before one of the Sectoral Agricultural Service Agencies.\n\n3. That their harvests have been affected by one of the natural phenomena mentioned in Executive Decrees No. 28518-MP, 27402-MP-MOPT, 28009-P-MOPT, 28130-MP-MOPT, or others.\n\n4. That they had formalized their credit operations with the financial bodies or institutions up to the month of December 1999.\n\n5. That they hold debts for heart-of-palm planting with any of the following entities:\n\na) Banco Nacional de Costa Rica.\n\nb) Banco de Costa Rica.\n\nc) Banco Crédito Agrícola de Cartago.\n\nd) Banco Popular y de Desarrollo Comunal.\n\ne) MAG-PIPA-BANCRÉDITO Trust (Fideicomiso).\n\nf) IDA-Caja Agraria.\n\ng) Northern Zone Small Producers Program (Programa de Pequeños Productores de la Zona Norte, PPZN).\n\nh) Fundación Campesina (FUNDECA).\n\ni) PRONAMYPE.\n\nj) ANPAIACU.\n\nk) FUNDECOCA.\n\nl) FINCA.\n\nm) COOCIQUE, R. L.\n\nn) AGROPAL.\n\no) Other financing bodies or entities.\n\n6. That they have a duly completed social information record (Ficha de información social).\n\nArticle 2.—The file of each producer that is forwarded to IMAS must include at least the following documents:\n\n1. A certification issued by a Sectoral Agricultural Service Agency attesting to the foregoing conditions.\n\n2. A document issued by the Sectoral Agricultural Service Agency mentioned in the preceding point, whereby the producer is recommended to IMAS for the granting of a benefit from said Institution, on the grounds that the producer meets the conditions underpinning this Decree.\n\n3. A statement of debt issued by the creditor entity detailing the current and default interest owed and necessary to bring the respective operation up to date, plus a detail of the amount corresponding to six additional months for the same operation, provided by the interested party.\n\n4. (This subsection was repealed by Article 2 of Executive Decree No. 29032 of October 27, 2000)\n\n5. A registry certification or report of real estate owned solely by the person who appears as the debtor before the creditor entity that originated the credit.\n\nIn the event that said document does not indicate the existence of a property registered in the name of the eventual beneficiary, the Executing Unit (Unidad Ejecutora) shall use the certification established in subsection 1) of this article as a source of information.\n\n(As amended by Article 3 of Executive Decree No. 29032 of October 27, 2000)\n\nArticle 3.—The Joint Institute for Social Aid is authorized, within the benefits of the Comprehensive Care Program for Overcoming Poverty for the year 2000, to proceed to grant a subsidy to each of the indicated debtors, who qualify according to the parameters of the Individual Target Population System (Sistema de Información de la Población Objetivo, SIPO), in accordance with the provisions of the Regulations for the Provision of Services and Granting of Benefits of IMAS.\n\nSaid benefit shall be delivered for the sole purpose of paying off to the creditor entities the interest owed plus six additional months of interest for this concept.\n\nArticle 4.—All Ministries, Decentralized Institutions, and Institutions that are part of the Agricultural Sector are empowered to provide IMAS with the material and human resources necessary to assist in the process of gathering and digitizing the indicated records within the shortest possible time.\n\nArticle 5.—For the execution of this Decree, IMAS must establish an Institutional Executing Unit (Unidad Ejecutora Institucional) under the charge of a professional-level official responsible for its implementation, monitoring, and control in accordance with the established norms and procedures for this purpose, and in order to guarantee effectiveness, efficiency, and transparency in the selection and qualification of said beneficiaries and benefits.\n\nIn order to participate in the inter-institutional coordination actions necessary for the execution of this Decree, the MAG shall designate an official from the Agricultural Sector as its representative before the respective Executing Unit.\n\nArticle 6.—Once the Individual Target Population System (SIPO) determines which small producers qualify as persons in conditions of poverty or extreme poverty, IMAS shall carry out the following actions:\n\n1. The Executing Unit established in this Decree shall draw up a resolution recommending the granting of the respective benefit for each individual case, determining that the respective requirements have been met.\n\n2. The qualified beneficiaries shall be communicated to the MAG, indicating the results obtained by the Individual Target Population System.\n\n3.
