Que es el deber del Estado el orientar la protección y\n\n\n racional aprovechamiento de los Recursos Naturales en\n\n\n forma tal que se garantice su permanencia y calidad, en\n\n\n beneficio de los habitantes.\n\n\n II.- Que el Estado costarricense, a través de EL MINISTERIO ha\n\n\n definido claramente políticas de conservación y\n\n\n desarrollo sostenible, fundamentado tanto en la\n\n\n Estrategia de Conservación para el Desarrollo Sostenible\n\n\n de Costa Rica, como en la Declaración para el \"Nuevo\n\n\n Orden Ecológico Internacional\".\n\n\n III.-Que con fundamento en los artículos 1 y 3, de la Ley de\n\n\n Conservación de la Vida Silvestre, Ley Nº 7317 la Vida\n\n\n Silvestre está conformada por la fauna continental e\n\n\n insular que vive en condiciones naturales, temporales o\n\n\n permanentemente en el territorio nacional y la flora que\n\n\n vive en condiciones naturales en el país; y únicamente\n\n\n pueden ser objeto de apropiación particular y de comercio\n\n\n mediante las disposiciones contenidas en los tratados\n\n\n públicos, en los convenios internacionales y en la\n\n\n presente Ley y su reglamento, artículos 3 y 36 al 50.\n\n\n IV.- Que de conformidad con los artículos 6 y 7 de la Ley Nº\n\n\n 7317, el Ministerio de Recursos Naturales, Energía y\n\n\n Minas, a través de la Dirección General de Vida\n\n\n Silvestre, es el órgano competente en materia de\n\n\n planificación, desarrollo y control de la fauna silvestre\n\n\n y por lo tanto, tiene la responsabilidad de asegurar un\n\n\n manejo adecuado de la misma. Asimismo es el encargado de\n\n\n promover y ejecutar investigación en el campo de la\n\n\n protección y conservación de la vida silvestre.\n\n\n DECRETAN:\n\n\n REGLAMENTO PARA EL ESTABLECIMIENTO Y MANEJO DE\n\n\n CENTROS DE RESCATE DE FLORA Y FAUNA SILVESTRE\n\n\n Artículo 1º.- Establecer el presente Reglamento, mediante el cual se\n\n\nregirán todos aquellos organismos no gubernamentales que deseen\n\n\nestablecer Centros de Rescate de Flora y Fauna Silvestre.\n\n Artículo 2º.- Los Centros de Rescate de Flora y Fauna Silvestre se\n\n\nestablecerán en las Areas de Conservación creadas por el Ministerio de\n\n\nRecursos Naturales, Energía y Minas, con la finalidad de que las\n\n\nespecies, se mantengan en la misma área de su hábitat, para no alterar\n\n\nsus condiciones.\n\n Articulo 3º.- En caso de no contar con Centros de Rescate en alguna\n\n\nArea de Conservación, la Dirección General de Vida Silvestre, determinará\n\nel Centro de Rescate al cual deba ir la especie decomisada o que por\n\n\ncualquier motivo llegue a manos del Ministerio de Recursos Naturales,\n\n\nEnergía y Minas, atendiendo a criterios técnicos.\n\n Artículo 4º.- El CENTRO debe:\n\n\n 1.- Estar inscrito como zoocriadero, jardín botánico o vivero\n\n\n en la Dirección General de Vida Silvestre.\n\n\n 2.- Tener un biólogo regente y además implementar la visita\n\n\n de un veterinario mensualmente a fin de suministrar los\n\n\n cuidados veterinarios y nutricionales adecuados.\n\n\n 3.- Poseer contenido económico para el mantenimiento de los\n\n\n animales. Asimismo, debe construir y mantener jaulas,\n\n\n encierros y otros sitios adecuados para el mantenimiento\n\n\n y salud de cada especie allí depositada.\n\n\n 4.- Recibir, mantener y dar manejo adecuado a la flora y\n\n\n fauna allí depositados por EL MINISTERIO hasta que se\n\n\n considere necesario de acuerdo a criterios técnicos a\n\n\n definirse oportunamente.\n\n\n 5.- Marcar e identificar adecuadamente toda la flora y fauna\n\n\n depositada en él, la cual debe ser hecha por el personal\n\n\n capacitado del centro y registrados en los archivos de la\n\n\n Dirección General de Vida Silvestre de EL MINISTERIO.\n\n\n Estas especies de flora y fauna silvestre son propiedad\n\n\n del Estado, quien los deposita en el centro en calidad\n\n\n temporal.\n\n\n 6.- Suministrar a la Dirección General de Vida Silvestre\n\n\n informes trimestrales sobre la cantidad, identificación,\n\n\n condición o estado de salud de la flora y fauna allí\n\n depositada.\n\n\n 7.- Entregar a los representantes autorizados de la Dirección\n\n\n General de Vida Silvestre o el Ministerio de Recursos\n\n\n Naturales, Energía y Minas, un recibo apropiado por cada\n\n\n espécimen de flora y fauna que le sea entregada en\n\n\n depósito.\n\n\n 8.- Presentar planes y estudios científicos al Departamento\n\n\n de Evaluación de Recursos Biológicos para su aprobación\n\n\n sobre la liberación o reintroducción de animales\n\n\n silvestres y solicitar la debida autorización a la\n\n\n Dirección General de Vida Silvestre de toda\n\n\n liberalización o reintroducción.\n\n\n 9.- Notificar a la Dirección General de Vida Silvestre la\n\n\n fecha en que se realizará la liberación o reintroducción\n\n\n de los animales silvestres a fin de que se presente en la\n\n\n misma uno de los representantes autorizados de esta\n\n\n Dirección.\n\n\n 10.- Informar a la Dirección General de Vida Silvestre en\n\n\n forma inmediata y por escrito la defunción de animales,\n\n\n certificada por el veterinario.\n\n\n 11.- EL CENTRO podrá implementar programas de reproducción con\n\n\n los animales allí depositados de común acuerdo con la\n\n\n Dirección General de Vida Silvestre, previa presentación\n\n\n de un Plan de Manejo a la Dirección General de Vida\n\n\n Silvestre.\n\n\n 12.- EL CENTRO permitirá el ingreso de funcionarios del\n\n\n Ministerio de Recursos Naturales, Energía y Minas al\n\n\n Centro, incluyendo a las áreas donde se mantienen los\n\n\n animales siempre y cuando no afecte la salud o\n\n\n comportamiento de los animales o a las investigaciones en\n\n\n progreso.\n\n\n 13.- EL CENTRO contratará los servicios del personal necesario\n\n\n para el eficiente manejo y desarrollo de las actividades\n\n\n como parte de los objetivos del mismo.\n\n Artículo 5º.- EL CENTRO construirá y mantendrá jaulas, encierros y\n\n\notros sitios adecuados para el mantenimiento y salud de cada especie allí\n\ndepositada, de conformidad a las siguientes recomendaciones:\n\n\n TAMAÑO Y CONDICIONES ESPECIALES PARA JAULAS SEGUN ESPECIES\n\n\n I AVES DE CANTO Y PLUMAJE:\n\n\n COTORRAS Y PERICOS: En aviarios para 4 individuos de una especie,\n\n\npara un total de 16 individuos:\n\n\nLargo Ancho Altura clase de cedazo\n\n\n4.00 m 2 m 2 m malla 1/2 pulg. x 1/2 pulg.\n\n\n Aratinga canicularis\n\n\n Brotogeris jugularis\n\n\n Aratina finschi\n\n\n Pionus senilis, Pionus menstrus, Amazona albifrons\n\n\n LORAS: dos individuos por especie por jaula, hasta un máximo de 8\n\n\nindividuos excepto (Amazona auropalliata v Amazona farinosa).\n\n\nLargo Ancho Altura clase de cedazo\n\n\n2.50 m 2.00 m 2.00 m 1 pulg x 1/2 pulg\n\n\n PEQUENOS TUCANES: dos individuos por especie por jaula, hasta un\n\n\nmáximo de 8 individuos.\n\n\nLargo Ancho Altura clase de millo blanco, avena,\n\n\n trigo, maíz, sorgo.\n\n\n Vitaminas: A, D, E, C.\n\n\n Minerales: Calcio y Sal.\n\n\n No se recomiendan dar sobrantes de comida.\n\n\n AVES RAPACES\n\n\n (lechuzas y THE REPUBLIC\n\n\n AND THE MINISTER OF NATURAL RESOURCES, ENERGY AND MINES,\n\n\n Based on the powers conferred by Article 140,\n\n\nsubsection 3 of the Political Constitution, and in accordance with Articles\n\n\n7, 12 and 17 of the Wildlife Conservation Law No. 7317 of December 7\n\n\nof 1992,\n\n\n Considering:\n\n\n I-. It is also responsible for\n\n\n promoting and carrying out research in the field of the\n\n\n protection and conservation of wildlife.\n\n\n DECREE:\n\n\n REGULATION FOR THE ESTABLISHMENT AND MANAGEMENT OF\n\n\n WILD FLORA AND FAUNA RESCUE CENTERS\n\n\n Article 1.- Establish this Regulation, through which\n\n\nall those non-governmental organizations wishing to\n\n\nestablish Wild Flora and Fauna Rescue Centers shall be governed.\n\n Article 2.- Wild Flora and Fauna Rescue Centers shall be\n\n\nestablished in the Conservation Areas created by the Ministry of\n\n\nNatural Resources, Energy and Mines, with the purpose that the\n\n\nspecies remain in the same area of their habitat, so as not to alter\n\n\ntheir conditions.\n\n Article 3.- In the event that there are no Rescue Centers in a given\n\n\nConservation Area, the Dirección General de Vida Silvestre shall determine\n\nthe Rescue Center to which the confiscated species or one that\n\n\nfor any reason comes into the hands of the Ministry of Natural Resources,\n\n\nEnergy and Mines must go, based on technical criteria.\n\n Article 4.- THE CENTER must:\n\n\n 1.- Be registered as a wildlife breeding farm (zoocriadero), botanical garden, or nursery\n\n\n with the Dirección General de Vida Silvestre.\n\n\n 2.- Have a managing biologist and also implement the visit\n\n\n of a veterinarian monthly in order to provide\n\n\n adequate veterinary and nutritional care.\n\n\n 3.- Possess economic resources for the maintenance of the\n\n\n animals. Likewise, it must build and maintain cages,\n\n\n enclosures, and other suitable sites for the maintenance\n\n\n and health of each species deposited there.\n\n\n 4.- Receive, maintain, and provide adequate management to the flora and\n\n\n fauna deposited there by THE MINISTRY until it is\n\n\n deemed necessary according to technical criteria to be\n\n\n defined in due course.\n\n\n 5.- Properly mark and identify all the flora and fauna\n\n\n deposited in it, which must be done by the trained\n\n\n personnel of the center and registered in the files of the\n\n\n Dirección General de Vida Silvestre of THE MINISTRY.\n\n\n These wild flora and fauna species are the property\n\n\n of the State, which deposits them in the center on a\n\n\n temporary basis.\n\n\n 6.- Provide the Dirección General de Vida Silvestre\n\n\n with quarterly reports on the quantity, identification,\n\n\n condition, or health status of the flora and fauna\n\n deposited there.\n\n\n 7.- Deliver to the authorized representatives of the Dirección\n\n\n General de Vida Silvestre or the Ministry of Natural\n\n\n Resources, Energy and Mines, an appropriate receipt for each\n\n\n specimen of flora and fauna delivered to it in\n\n\n deposit.\n\n\n 8.- Present scientific plans and studies to the Departamento\n\n\n de Evaluación de Recursos Biológicos for its approval\n\n\n on the release or reintroduction of wild\n\n\n animals and request the due authorization from the\n\n\n Dirección General de Vida Silvestre for any\n\n\n release or reintroduction.\n\n\n 9.- Notify the Dirección General de Vida Silvestre of the\n\n\n date on which the release or reintroduction\n\n\n of the wild animals will take place so that one of the authorized\n\n\n representatives of this Dirección may be present at it.\n\n\n 10.- Inform the Dirección General de Vida Silvestre\n\n\n immediately and in writing of the death of animals,\n\n\n certified by the veterinarian.\n\n\n 11.- THE CENTER may implement reproduction programs with\n\n\n the animals deposited there by mutual agreement with the\n\n\n Dirección General de Vida Silvestre, upon prior presentation\n\n\n of a Management Plan to the Dirección General de Vida\n\n\n Silvestre.\n\n\n 12.- THE CENTER shall permit the entry of officials from the\n\n\n Ministry of Natural Resources, Energy and Mines into the\n\n\n Center, including the areas where the animals are kept,\n\n\n provided it does not affect the health or\n\n\n behavior of the animals or ongoing research.\n\n\n 13.- THE CENTER shall contract the services of the personnel necessary\n\n\n for the efficient management and development of activities\n\n\n as part of its objectives.\n\n Article 5.- THE CENTER shall build and maintain cages, enclosures, and\n\n\nother suitable sites for the maintenance and health of each species deposited\n\nthere, in accordance with the following recommendations:\n\n\n SIZE AND SPECIAL CONDITIONS FOR CAGES ACCORDING TO SPECIES\n\n\n I.
