Que esto produce\nuna gran presión sobre la capacidad gubernamental para satisfacer los servicios e infraestructura\nnecesaria que permitan alcanzar una mejor calidad de vida;  conservando un ambiente saludable y\npropicio para un desarrollo sostenible.\n\nII.-Que la expansión\nurbana de tipo horizontal de la GAM ha \npropiciado una creciente demanda de transporte a través del vehículo\nparticular, lo que unido a las grandes limitaciones de la infraestructura,\nvial, está causando una grave saturación y mayores índices de\ncontaminación  atmosférica.\n\nIII.-Que el sistema\nde transporte público urbano está en proceso de \nreorganización y modernización y que adicionalmente su marco\njurídico  requiere actualización\npermitiendo su transformación y poder así dar \npronta respuesta a los rápidos cambios sociales, tecnológicos y urbanos.\n\nIV.-Que las emisiones\nprovocadas por vehículos con motores de combustión interna causan un impacto\nnegativo en la salud de los costarricenses y contribuyen al efecto invernadero.\n\nV.-Que es una\nnecesidad, la orientación del desarrollo urbano del GAM, como región, en\narmonía con sus recursos, el ambiente y su población.\n\nVI.-Que se ha\nreconocido la importancia de contar con políticas  claras sobre el uso del suelo a escala\nnacional y lógicamente éstas deben estar presentes en los planes de la GAM.\n\nVII.-Que el mejoramiento del transporte público, y  consecuentemente la utilización de tecnologías\nmenos contaminantes,  combustibles más limpios, el fortalecimiento de centros urbanos\nmultifuncionales que satisfagan las necesidades sociales localmente, reduciendo la demanda de viajes\ninterregionales, así como el  mejoramiento del paisaje urbano y la calidad del aire del GAM, son\nuna  actividad multidisciplinaria que demanda la acción coordinada de varias  instituciones y\nsectores del país.'\n\nVIII.-Que es\nnecesario contar con el apoyo por parte de los \nMinisterios e Instituciones firmantes, de los Gobiernos Locales y otros\nsectores de la sociedad civil, para asegurar el accionar y continuidad de\nlos  procesos de planificación y\nproyectos previstos para el mejoramiento de la \nGran Área Metropolitana (GAM).\n\nIX.-Que es necesario\nestablecer una coordinación en la adopción de políticas encausadas a dar una\npronta solución al crecimiento desordenado de la Gran Área Metropolitana y\nasegurar una buena calidad de vida. Por\ntanto,\n\nDECRETAN:\n\nCapítulo\n1 Reglamento Consejo de Planificación Urbana\n\nde la\nGran Área Metropolitana\n\nArtículo 1°-Créase el\nConsejo de Planificación Urbana de la Gran \nÁrea Metropolitana, cuyo objetivo principal, sin sustituir o invadir\nla  competencia de cualquier otro Ente\nPúblico creado para tales fines, es el \nde definir y coordinar las políticas, programas y proyectos en materia\nde  desarrollo urbano, el transporte y el\nmedio ambiente, así como evaluar, sugerir y recomendar las acciones técnicas de\nseguimiento que las  dependencias y entidades\nde la Administración Pública deban emprender en forma integral en favor de\ndichos objetivos.\n\nArtículo 2°-El Consejo de Planificación Urbana del GAM será  presidido por el Ministro de Obras\nPúblicas y Transportes, y estará  integrado además por los ministros del Ambiente y Energía, de\nVivienda y  Asentamientos Humanos, el Presidente Ejecutivo del Instituto Nacional  Vivienda y\nUrbanismo, el Presidente Ejecutivo del Instituto Costarricense  de Acueductos y Alcantarillados, el\nGerente de la Compañía Nacional de  Fuerza y Luz, y el Director de la Secretaría Técnica quien\nparticipará con  voz pero sin voto. El Consejo invitará a participar a los alcaldes del GAM  según\nlos proyectos y las áreas geográficas que se estudian. El Consejo  será convocado por el Ministro de\nObras Públicas y Transportes  bimestralmente y cada vez que sea necesario pedirá al Poder Ejecutivo \nemitir las directrices gubernamentales para ejecutar aquellos proyectos  definidos como\nprioritarios.\n\nArtículo 3°-Las\nfunciones principales del Consejo de Planificación  Urbana de la GAM serán:\n\n1. Definir políticas\nen materia de planificación urbana.\n\n2. Promover convenios\ncon las Municipalidades del GAM, para \nimplementar proyectos que coadyuven al logro de los objetivos.\n\n3. Aprobar con\nOrganismos Internacionales, la cooperación técnica y  financiera para elaborar los estudios y\nprogramas que sirvan de base  para la\nejecución de proyectos a través de las instituciones  responsables del Estado.\n\n4.Aprobar y promover proyectos, acuerdos, decretos y resoluciones  que sobre la planificación urbana\ndeban ser sometidos al Poder  Ejecutivo, quien definirá a través de las directrices, la \nimplementación de proyectos a ejecutarse.\n\n5. Orientar las\ndirectrices de trabajo de la Secretaría Técnica, a través  de su Director.\n\n6. Procurar fuentes\nde financiamiento para el logro de los objetivos.\n\nArtículo 4°-El Consejo de Planificación Urbana del GAM, contará  con una Secretaría Técnica,\nconformada por un equipo interinstitucional.  La Secretaría Técnica contará con un Director, quien\nla presidirá, el cual  será nombrado por el Presidente del Consejo. La Secretaría Técnica tendrá  un\nComité Asesor integrado por los directores y representantes de las  siguientes dependencias:\n\nLa Dirección de\nPlanificación del MOPT.\n\nLa Dirección de\nUrbanismo del INVU.\n\nLa Unidad de\nTransporte Eléctrico de CNFL.\n\nEl MIVAH.\n\nEl MINAE.\n\nEI ICAA.\n\nLa Dirección de\nPlaneamiento Urbano de la Municipalidad de San José.\n\nLa Secretaría Técnica\nse reunirá cada quince días, o de acuerdo al \nprograma de trabajo aprobado por el Consejo. El Comité Asesor de la\nSecretaria podrá ser ampliado de acuerdo a los temas que se estudien y\ndesarrollen, y podrán constituirse subgrupos de trabajo por proyectos, con\npresencia de otras instituciones o grupos interesados.\n\nArtículo 5°-La Secretaría Técnica del Consejo es una instancia  permanente, encargada de proponer,\nestudiar, analizar y coordinar  alternativas técnicas al Consejo, quien definirá los proyectos\nprioritarios  para su ejecución a través de la instancia correspondiente.\n\nArtículo 6°-Serán\nfunciones de la Secretaría Técnica:\n\n1. Definir y\ncoordinar un proyecto de carácter regional en materia de  desarrollo urbano que se fundamente\nprincipalmente en:\n\n1.1. Orientar a los centros\nurbanos existentes bajo el concepto de centros multifuncionales.\n\n1.2. Apoyar el\nproceso de reorganización y modernización del sistema de transporte remunerado\nde personas en coordinación  con el\nordenamiento vial y la construcción de nuevas \ninfraestructuras, tanto para los distintos modos de transporte  público, así como para el usuario.\n\n1.3. Coordinar\nproyectos para mejorar la calidad ambiental y disminuir la contaminación\natmosférica, sónica, del agua, del suelo y cualquier otro tipo de contaminación,\nasí como los  impactos de nuevos\nproyectos en el medio urbano.\n\n1.4. Orientar\npolíticas en el uso del suelo urbano a nivel regional, acorde a las\ncaracterísticas físico-geográficas de la región, a los centros multifuncionales\ny a los ejes principales del transporte masivo, así como a la eficiencia\nenergética y la protección ambiental, en clara coordinación con los planes\nreguladores  cantonales.\n\n2.Coordinar con el\nsector privado y la sociedad civil, las actividades que ayuden al logro de los\nobjetivos de orientación del desarrollo urbano de la GAM.\n\n3. Someter a la\naprobación del Consejo lo indicado en el artículo 3°.\n\n4. Ejecutar los\nacuerdos tomados por el Consejo y darles seguimiento.\n\nArtículo 7°-Para el\ndesempeño de la Secretaría Técnica, se nombrará un Director, quien tendrá las\nsiguientes funciones:\n\n1.  Estar presente en las reuniones del Consejo\ncon voz pero sin voto.\n\n2. Convocar las reuniones\npreparar las agendas y levantar las actas respectivas del Consejo y de la\nSecretaría Técnica.\n\n3. Elaborar y someter\na consideración y aprobación del Consejo, el programa anual de trabajo.\n\n4. Dar seguimiento a\nlos ·.acuerdos del Consejo e informar periódicamente de su cumplimiento.\n\n5. Coordinar las\nactividades que corresponda desarrollar a los grupos  de trabajo que al efecto decida constituir el\nConsejo y la Secretaría  Técnica.\n\n6. Coordinar cuando corresponda, los proyectos, convenios o  acciones con organismos gubernamentales\ny no gubernamentales,  nacionales o extranjeros, que tiendan a fortalecer las acciones del  Consejo.\n\n7. Promover y\ncoordinar programas de investigación, desarrollo  tecnológico, educación y capacitación.\n\n8. Promover diferentes\nmecanismos para la obtención de recursos, \npara el financiamiento de programas, proyectos, acciones y  medidas que le encargue el Consejo.\n\n9. Dar seguimiento\ntécnico y administrativo a los proyectos, \nconsultorías, convenios y acciones que se den a través del Consejo  y de sus instituciones miembros.\n\n10. Compilar y\nadministrar una base de datos, estudios e información  general del Gran Área Metropolitana.\n\n11. Las demás propias\nde su cargo y las que le asigne el Consejo.\n\nArtículo 8°-En cada\ninstitución miembro del Consejo existirá una subcomisión técnica con su\nrespectivo coordinador, cuya función será coordinar los proyectos a lo interno\nde cada una, reuniendo la visión institucional y transmitirla a la Secretaria\nTécnica. Igualmente le corresponde a dicho coordinador, comunicar hacia su\ninstitución, la visión de la Secretaria Técnica para lo que correspondiere. El\nCoordinador de la Subcomisión será a la vez el representante de su institución\nante la Secretaria Técnica del Consejo. El Director de la Secretaria Técnica\npodrá asistir a las reuniones de cada subcomisión.\n\nArtículo\n9°-Corresponde al Consejo a través de la Secretaria Técnica, la ejecución de\nlos proyectos que ordene el Poder Ejecutivo, dentro de los procesos jurídicos y\nadministrativos de cada institución allí representada; así como efectuar los\nconvenios con los gobiernos municipales en forma individual, colectiva o a\ntravés de organismos que los agrupen en forma total o parcial; con las Cámaras\ndel sector privado según sea la materia de interés; con las Universidades y\nCentros de Enseñanza en general; con los Colegios Profesionales y con toda\nentidad pública o privada nacional o internacional, que contribuya a los\nobjetivos de este Decreto.\n\nArtículo 10.-Se\nautoriza a las Instituciones que integran el Consejo de Planificación Urbana de\nla GAM y su Secretaría Técnica para que de acuerdo a su disponibilidad\npresupuestaria, puedan destinar o aportar los recursos económicos, materiales y\nhumanos, necesarios para fortalecer el buen funcionamiento de esta iniciativa,\nasí como trasladar personal a su servicio con carácter temporal.\n\nArtículo\n11.-Deróganse los decreto N° 26291 y cualquier otro que se le\noponga.\n\nRige a partir de su\npublicación.\n\nDado en la\nPresidencia de la República.-San José, a los  veintinueve días del mes de mayo\ndel dos mil.", "body_en_text": "throughout the entire text\n\n -\n\n Complete Text of Regulation 28667\n\n Regulation of the Urban Planning Council of the Greater Metropolitan Area (Gran Area Metropolitana, GAM)\n\nN° 28667-MP-MOPT-H-MIVAH-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF THE PRESIDENCY,\n\nOF PUBLIC WORKS AND TRANSPORT, OF FINANCE,\n\nOF HOUSING AND HUMAN SETTLEMENTS\n\nAND OF ENVIRONMENT AND ENERGY\n\nExercising the powers conferred by subsections 3) and 18) of Article 140 of the Political Constitution, and General Public Administration Law No. 6227 of May 2, 1978, Urban Planning Law No. 4240 of November 15, 1968, Road Administration Law No. 6324 of May 24, 1979, Law Creating the Ministry of Public Works and Transport No. 4786 of July 5, 1971, and the Organic Law of the Ministry of Environment and Energy No. 7152 of June 5, 1990.\n\nConsidering:\n\nI.—That the continuous growth of the Greater Metropolitan Area (Gran Área Metropolitana) has generated a concentration of more than 50% of the country's total population in less than 4% of the national territory. That this produces great pressure on governmental capacity to satisfy the necessary services and infrastructure to achieve a better quality of life, while preserving a healthy environment conducive to sustainable development.\n\nII.—That the horizontal urban expansion of the GAM has fostered a growing demand for transport via private vehicles, which, combined with the significant limitations of the road infrastructure, is causing serious saturation and higher rates of atmospheric pollution.\n\nIII.—That the urban public transport system is in the process of reorganization and modernization and that, additionally, its legal framework requires updating to permit its transformation and thus be able to provide a prompt response to rapid social, technological, and urban changes.\n\nIV.—That emissions caused by vehicles with internal combustion engines cause a negative impact on the health of Costa Ricans and contribute to the greenhouse effect.\n\nV.—That orienting the urban development of the GAM, as a region, in harmony with its resources, the environment, and its population is a necessity.\n\nVI.—That the importance of having clear land-use policies on a national scale has been recognized, and logically these must be present in the plans for the GAM.\n\nVII.—That the improvement of public transport, and consequently the use of less polluting technologies, cleaner fuels, the strengthening of multifunctional urban centers that satisfy social needs locally, reducing the demand for interregional trips, as well as the improvement of the urban landscape and air quality of the GAM, are a multidisciplinary activity that demands the coordinated action of various institutions and sectors of the country.\n\nVIII.—That it is necessary to have the support of the signing Ministries and Institutions, the Local Governments, and other sectors of civil society to ensure the implementation and continuity of the planning processes and projects planned for the improvement of the Greater Metropolitan Area (GAM).\n\nIX.—That it is necessary to establish coordination in the adoption of policies aimed at providing a prompt solution to the disorderly growth of the Greater Metropolitan Area (GAM) and ensuring a good quality of life. Therefore,\n\nTHEY DECREE:\n\nChapter 1 Regulation of the Urban Planning Council\n\nof the Greater Metropolitan Area (GAM)\n\nArticle 1.—The Urban Planning Council of the Greater Metropolitan Area (Gran Área Metropolitana) is hereby created, whose main objective, without substituting or invading the competence of any other Public Entity created for such purposes, is to define and coordinate policies, programs, and projects in matters of urban development, transport, and the environment, as well as to evaluate, suggest, and recommend the technical follow-up actions that the dependencies and entities of the Public Administration must undertake integrally in favor of said objectives.\n\nArticle 2.—The Urban Planning Council of the GAM shall be chaired by the Minister of Public Works and Transport (MOPT), and shall also be composed of the Ministers of Environment and Energy (MINAE), of Housing and Human Settlements (MIVAH), the Executive President of the National Institute of Housing and Urbanism (INVU), the Executive President of the Costa Rican Institute of Aqueducts and Sewers (ICAA), the Manager of the National Power and Light Company (CNFL), and the Director of the Technical Secretariat, who shall participate with voice but no vote. The Council shall be convened by the Minister of Public Works and Transport (MOPT) bimonthly and, whenever necessary, shall request the Executive Branch to issue governmental directives to execute those projects defined as priorities.\n\nArticle 3.—The main functions of the Urban Planning Council of the GAM shall be:\n\n1. Defining policies in matters of urban planning.\n\n2. Promoting agreements with the Municipalities of the GAM to implement projects that contribute to the achievement of the objectives.\n\n3. Approving, with International Organizations, the technical and financial cooperation to prepare the studies and programs that serve as a basis for the execution of projects through the responsible State institutions.\n\n4. Approving and promoting projects, agreements, decrees, and resolutions regarding urban planning that must be submitted to the Executive Branch, which shall define, through directives, the implementation of projects to be executed.\n\n5. Guiding the work directives of the Technical Secretariat, through its Director.\n\n6. Seeking sources of financing for the achievement of the objectives.\n\nArticle 4.—The Urban Planning Council of the GAM shall have a Technical Secretariat, composed of an inter-institutional team. The Technical Secretariat shall have a Director, who shall chair it, who shall be appointed by the President of the Council. The Technical Secretariat shall have an Advisory Committee composed of the directors and representatives of the following dependencies:\n\nThe Planning Directorate of the MOPT.\n\nThe Urbanism Directorate of the INVU.\n\nThe Electric Transport Unit of CNFL.\n\nThe MIVAH.\n\nThe MINAE.\n\nThe ICAA.\n\nThe Urban Planning Directorate of the Municipality of San José.\n\nThe Technical Secretariat shall meet every two weeks, or according to the work program approved by the Council. The Advisory Committee of the Secretariat may be expanded according to the topics being studied and developed, and work subgroups may be formed for projects, with the presence of other institutions or interested groups.\n\nArticle 5.—The Technical Secretariat of the Council is a permanent body, responsible for proposing, studying, analyzing, and coordinating technical alternatives for the Council, which shall define the priority projects for their execution through the corresponding authority.\n\nArticle 6.—The functions of the Technical Secretariat shall be:\n\n1. Defining and coordinating a project of a regional nature in matters of urban development, based principally on:\n\n1.1. Guiding existing urban centers under the concept of multifunctional centers.\n\n1.2. Supporting the process of reorganization and modernization of the paid public transport system in coordination with road planning and the construction of new infrastructure, both for the different modes of public transport and for the user.\n\n1.3. Coordinating projects to improve environmental quality and reduce atmospheric, noise, water, soil, and any other type of pollution, as well as the impacts of new projects on the urban environment.\n\n1.4. Guiding policies on regional urban land use, in accordance with the physical-geographic characteristics of the region, the multifunctional centers, and the main mass transport axes, as well as energy efficiency and environmental protection, in clear coordination with cantonal regulatory plans.\n\n2. Coordinating with the private sector and civil society the activities that help achieve the objectives of guiding the urban development of the GAM.\n\n3. Submitting to the Council's approval what is indicated in Article 3.\n\n4. Executing the agreements made by the Council and following up on them.\n\nArticle 7.—For the performance of the Technical Secretariat, a Director shall be appointed, who shall have the following functions:\n\n1. Being present at the Council meetings with voice but no vote.\n\n2. Convening the meetings, preparing the agendas, and drafting the respective minutes of the Council and the Technical Secretariat.\n\n3. Preparing and submitting the annual work program for the Council's consideration and approval.\n\n4. Following up on the Council's agreements and periodically reporting on their fulfillment.\n\n5. Coordinating the activities that the working groups that the Council and the Technical Secretariat decide to form must carry out.\n\n6. Coordinating, when applicable, the projects, agreements, or actions with governmental and non-governmental organizations, national or foreign, that tend to strengthen the Council's actions.\n\n7. Promoting and coordinating research, technological development, education, and training programs.\n\n8. Promoting different mechanisms for obtaining resources for the financing of programs, projects, actions, and measures entrusted to it by the Council.\n\n9. Providing technical and administrative follow-up for the projects, consultancies, agreements, and actions carried out through the Council and its member institutions.\n\n10. Compiling and administering a database, studies, and general information on the Greater Metropolitan Area.\n\n11. Any other functions inherent to the position and those assigned by the Council.\n\nArticle 8.—In each member institution of the Council, there shall be a technical sub-commission with its respective coordinator, whose function shall be to coordinate projects within each institution, gathering the institutional vision and transmitting it to the Technical Secretariat. Equally, said coordinator is responsible for communicating to their institution the vision of the Technical Secretariat for what is applicable. The Coordinator of the Sub-commission shall also be the representative of their institution before the Technical Secretariat of the Council. The Director of the Technical Secretariat may attend the meetings of each sub-commission.\n\nArticle 9.—The Council, through the Technical Secretariat, is responsible for the execution of the projects ordered by the Executive Branch, within the legal and administrative processes of each institution represented therein; as well as for entering into agreements with municipal governments individually, collectively, or through organizations that group them totally or partially; with the Chambers of the private sector depending on the subject matter of interest; with Universities and Teaching Centers in general; with Professional Associations; and with any national or international public or private entity that contributes to the objectives of this Decree.\n\nArticle 10.—The Institutions that make up the Urban Planning Council of the GAM and its Technical Secretariat are authorized, in accordance with their budgetary availability, to allocate or contribute the economic, material, and human resources necessary to strengthen the proper functioning of this initiative, as well as to transfer personnel to its service on a temporary basis.\n\nArticle 11.—Decree No. 26291 and any other decree in opposition to this one are hereby repealed.\n\nIt shall become effective upon its publication.\n\nIssued at the Presidency of the Republic.—San José, on the twenty-ninth day of May of the year two thousand." }
