  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29013\n\n                        De Utilidad Pública \"\"Asociación Organizaciones Corredor BiológicoTalamanca\nCaribe\"\"\n\nN°\n29013-J\n\nLA SEGUNDA VICEPRESIDENTA\n\nEN\nEJERCICIO DE\n\nLA PRESIDENCIA DE\n\nLA REPÚBLICA\n\nY\n\nLA MINISTRA DE\n JUSTICIA Y GRACIA\n\nCon\nfundamento en lo dispuesto en el artículo 140, inciso 18) de\nla Constitución Política\n, en el artículo 32 de\n\nla Ley\n de Asociaciones y en los artículos 28 y siguientes de su Reglamento.\n\nConsiderando:\n\nI.-Que\nel articulo 32 de\n\nla Ley\n de Asociaciones N° 218 de 8 de agosto de 1939 y sus reformas, confiere al\nPoder Ejecutivo la potestad de  declarar\nde utilidad pública a las asociaciones simples, federadas o confederadas cuyo\ndesarrollo y actividades sean particularmente útiles para los intereses del\nEstado, y que por ello contribuyan a solventar una necesidad social.\n\nII.-Que\n\nla Asociación\n de Organizaciones del Corredor Biológico Talamanca - Caribe, cédula de\npersona Jurídica No 3-002-182413, se encuentra inscrita en el Registro de\nAsociaciones, desde el día 15 de marzo de 1996, bajo el expediente N\"\n7522.\n\nIII.-Que\nalgunos de los fines que persigue\n\nla Asociación\n, son los siguientes:\n\n\"a)\nGestionar el mejoramiento social, cultural, educativo, organizativo y económico\nde sus afiliados, la creación de servicios sociales y comunales.\n\nb)\nFomentar entre sus afiliados el espíritu de ayuda mutua en el orden social,\ncultural y económico.\n\nc)\nSuministrar a los afiliados y sus familias rurales, los servicios que necesitan\npara su mejoramiento socio-organizativo y productivo.\n\nd)\nFomentar la producción agroforestal y sus derivados, así como el desarrollo de\nestrategias de comercialización e industrialización.\n\ne)\nFomentar la conservación y el mejor uso de los recursos naturales y el cuidado\ndel medio ambiente.\n\nf)\nPropiciar la igualdad de oportunidades a las familias rurales, a fin de que\nparticipen en el proceso de desarrollo forestal.\"\n\nIV.-Que\ntales fines solventan una necesidad social de primer orden, por lo que merecen\nel apoyo de Estado costarricense. Por tanto,\n\nDECRETAN:\n\nArtículo\n1°-Declárese bajo los condicionamientos que se enuncian en el articulo 2°,\nde utilidad pública para los intereses del Estado a\nla Asociación\n de Organizaciones del Corredor Biológico Talamanca - Caribe, cédula de\npersona jurídica No 3-002-182413.\n\nArticulo\n2°-Esta declaratoria estará sujeta a las siguientes condiciones:\n\na)\nQue de inmediato implemento el estado de flujo de efectivo de tal forma que en\nel auditoraje de año 2000 no se presenten 1as deficiencias que señaló\nCeciliano y Cía en su informe ya citado y sucesivamente hacia el futuro.\n\nb)\nQue adjunten al informe anual que deberán entregar a\nla Dirección Jurídica\n del Ministerio de Justicia y Gracia, copias certificadas de la confirmación de\ndonaciones solicitada a las empresas U.I.C.N. y Norcross Foundation Inc., que al\ndía treinta de setiembre de mil novecientos noventa y nueve no habían sido\nentregadas, según indica el informe de auditoria elaborado por Ceciliano y Cía.\n\nc)\nQue dado que dependiendo del contenido de estas certificaciones, podría ser\nnecesario realizar ajustes al periodo evaluado por Ceciliano y Cía, tal como se\nindica en el último párrafo de dicho informe, se entregue copia a\n\nla Dirección Jurídica\n del Ministerio de Justicia y Gracia de los ajustes realizados a ese informe.\n\nd)\nQue en el informe anual que deben presentar a\n\nla Dirección Jurídica\n del Ministerio de Justicia y Gracia deberá adjuntar copias certificadas del\nlibro auxiliar para registro de donaciones, en caso de que\n\nla Asociación\n no haya implementado el uso de ese libro debe hacerlo.\n\ne)\nQue al informe de labores anual deberá adjuntar copia de los auditorajes\nfinancieros externos realizados en cada periodo.\n\nArtículo\n3°-En virtud de esta declaratoria de utilidad pública, cada vez que dicha\nAsociación desee hacer uso de franquicias y concesiones de orden administrativo\ny económico, deberá contar con la aprobación del Ministerio de Hacienda.\n\nArtículo\n4°-Es deber de\n\nla Asociación\n rendir anualmente un informe ante el Ministerio de Justicia y Gracia, de\nconformidad con lo indicado en el artículo 31 del Reglamento a\n\nla Ley\n de Asociaciones.\n\nArticulo\n5°-Una vez publicado este decreto los interesados deberán protocolizar y\npresentar el respectivo testimonio ante el Registro de Asociaciones del Registro\nNacional, para su respectiva inscripción.\n\nArticulo\n6°-Rige a partir de su publicación.\n\nDado\nen\n\nla Presidencia\n de\n\nla República.-San\n José, a los cinco días del mes de setiembre del dos mil.",
  "body_en_text": " in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 29013\n\n                        Of Public Utility \"Association of Organizations of the Talamanca-Caribe Biological Corridor\"\n\nNo.\n29013-J\n\nTHE SECOND VICE PRESIDENT\n\nIN EXERCISE OF\n\nTHE PRESIDENCY OF\n\nTHE REPUBLIC\n\nAND\n\nTHE MINISTER OF\n JUSTICE AND GRACE\n\nBased on the provisions of article 140, subsection 18) of the Political Constitution, article 32 of the Associations Law, and articles 28 and following of its Regulations.\n\nConsidering:\n\nI.-That article 32 of the Associations Law No. 218 of August 8, 1939, and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated, or confederated associations whose development and activities are particularly useful for the interests of the State, and which thereby contribute to addressing a social need.\n\nII.-That the Association of Organizations of the Talamanca-Caribe Biological Corridor, legal entity identification number 3-002-182413, has been registered in the Registry of Associations since March 15, 1996, under file No. 7522.\n\nIII.-That some of the purposes pursued by the Association are the following:\n\n\"a) To manage the social, cultural, educational, organizational, and economic improvement of its members, and the creation of social and communal services.\n\nb) To foster among its members the spirit of mutual aid in the social, cultural, and economic order.\n\nc) To provide members and their rural families with the services they need for their socio-organizational and productive improvement.\n\nd) To promote agroforestry production and its derivatives, as well as the development of marketing and industrialization strategies.\n\ne) To promote the conservation and better use of natural resources and care for the environment.\n\nf) To foster equal opportunities for rural families, so that they may participate in the forestry development process.\"\n\nIV.-That such purposes address a social need of the highest order, and therefore merit the support of the Costa Rican State. Therefore,\n\nTHEY DECREE:\n\nArticle 1.-Under the conditions set forth in article 2, the Association of Organizations of the Talamanca-Caribe Biological Corridor, legal entity identification number 3-002-182413, is declared of public utility for the interests of the State.\n\nArticle 2.-This declaration shall be subject to the following conditions:\n\na) That it immediately implement a cash flow statement such that the deficiencies noted by Ceciliano y Cía in its aforementioned report, and successively into the future, are not present in the audit for the year 2000.\n\nb) That it attach to the annual report to be submitted to the Legal Directorate of the Ministry of Justice and Grace, certified copies of the confirmation of donations requested from the companies U.I.C.N. and Norcross Foundation Inc., which as of September thirtieth, nineteen ninety-nine, had not been delivered, as indicated in the audit report prepared by Ceciliano y Cía.\n\nc) That, given that depending on the content of these certifications, it may be necessary to make adjustments to the period evaluated by Ceciliano y Cía, as indicated in the last paragraph of said report, a copy of the adjustments made to that report be delivered to the Legal Directorate of the Ministry of Justice and Grace.\n\nd) That in the annual report to be submitted to the Legal Directorate of the Ministry of Justice and Grace, it must attach certified copies of the auxiliary book for recording donations; in the event that the Association has not implemented the use of such a book, it must do so.\n\ne) That it must attach to the annual work report a copy of the external financial audits conducted in each period.\n\nArticle 3.-By virtue of this declaration of public utility, whenever said Association wishes to make use of administrative and economic franchises and concessions, it must have the approval of the Ministry of Finance.\n\nArticle 4.-It is the duty of the Association to annually render a report before the Ministry of Justice and Grace, in accordance with what is indicated in article 31 of the Regulations to the Associations Law.\n\nArticle 5.-Once this decree is published, the interested parties must protocolize and present the respective testimony before the Registry of Associations of the National Registry, for its respective registration.\n\nArticle 6.-It is effective as of its publication.\n\nIssued at the Presidency of the Republic.-San José, on the fifth day of September of the year two thousand."
