  "body_es_text": "en la totalidad del texto\n\n                    -\n\nTexto Completo Norma 12\n\n                        Crea la Caja Préstamos y Descuentos de la Asociación Nacional de Educadores\n\nN°\n12\n\n \n\n(Nota:\nMediante el artículo 2° de la ley N° 6605 del 17 de setiembre de 1981, se\ninterpretó esta norma, en el sentido de que: \"...las asociaciones\ncooperativas y la Caja de Ahorro y Préstamos de la Asociación Nacional de\nEducadores son entes sin fines de lucro, las cuales no están obligadas al pago\ndel Impuesto sobre la Renta; por tanto, nunca les ha alcanzado el mandato legal\nde registrar las operaciones de crédito, que han hecho o hagan mediante pagarés,\nsegún la ley Nº 6450...\")\n\nEl\nCongreso Constitucional de\n\nla República\n de Costa Rica\n\nDecreta\n:\n\n(Nota de Sinalevi: Esta Ley fue reformada parcialmente y reproducido su texto en forma íntegra,\nmediante la ley N° 3012 del del 26 de julio de 1962 y publicado en  la Colección de Leyes y Decretos\ndel año 1962, Semestre II, Tomo II, por lo que se reproduce a continuación:)\n\nCAPITULO\nI\n\nConstitución,\nFines y Propósitos\n\n        Artículo\n1°-Créase\n\nla Caja\n\n de Ahorro y Préstamos de\n\nla Asociación Nacional\n\n de Educadores, la cual tendrá por objeto estimular el ahorro de sus\naccionistas y facilitarles préstamos en las condiciones y para los fines que se\ndeterminan en esta ley.\n\n(Así\n      reformado por el artículo 1° de la ley N° 4694 del 28 de diciembre de\n      1970)\n\nArtículo 2°-Serán socios o accionistas de\n\nla Caja\n\n todos los funcio­narios y empleados, en servicio o con licencia, del\nMinisterio de Educación Pública y los jubilados o pensionados de ese\nMinisterio. Los accionistas que estén en servicio o con licencia deberán\nadquirir acciones de\n\nla Caja\n\n , mediante el procedimiento establecido en el artículo 4°.\n\n  \n     Cuando se acojan a pensión o jubilación quedarán\nobligados a man­tener únicamente una acción de quinientos colones (^ 500.00)\na su nom­bre y podrán redimir las demás. Pero si al pensionarse no fueren dueños\nde una acción por ese valor, tendrán que seguir cotizando mensualmente hasta\ncompletarla.\n\n(Así\nreformado por el artículo 1° de la ley N° 4694 del 28 de diciembre de 1970)\n\n        Artículo\n3°-Las acciones serán nominativas y no podrán ser ven­didas ni traspasadas\nen ninguna forma. Son inembargables excepto por\n\nla Caja\n\n , a la cual responderán en todo tiempo por los créditos que haya concedido al\naccionista, en calidad de garantía adicional.\n\n  \n     Los accionistas deberán nombrar legatarios para sus\nacciones, a efecto de que a su muerte reciban de\n\nla Caja\n\n las sumas que se les legó, junto con los excedentes que les correspondan. Las\nsumas legadas a menores de edad serán depositadas en el Patronato Nacional de\n\nla Infancia. Si\n\n el accionista no hubiere nombrado legatarios, la suma total será depositada en\nel Juzgado que tramita la correspondiente mortual, para los fines legales que\ncorrespondan.\n\n  \n     Los funcionarios o empleados que dejen de servir en el\nMinisterio de Educación, podrán continuar como accionistas, siempre que sigan\npa­gando puntualmente las cuotas mensuales. Sin embargo, cuando no tuvie­ren\nobligaciones con\n\nla Caja\n\n como deudores o fiadores, podrán retirar el total de sus aportes, junto con\nlos correspondientes excedentes.\n\n(Así\n      reformado por el artículo 1° de la ley N° 4694 del 28 de diciembre de\n      1970)\n\n Artículo\n4°-Los aportes ordinarios de capital serán pagados por los socios\nmencionados en el artículo 2°, mediante deducciones mensuales mínimas\ncalculadas al 3% sobre el sueldo bruto mensual del socio. Los interesados podrán\nautorizar deducciones mayores. Los funcionarios o empleados que dejen de servir\nen el Ministerio de Educación Pública y deseen continuar como socios deberán\naportar mensualmente una cuota ordinaria igual a la del último mes servido.\n\n       \nLas referidas cuotas serán deducidas y depositadas a la orden de\n\nla Caja\n\n de Ahorro y Préstamos de\n\nla Asociación Nacional\n\n de Educadores por las oficinas de\n\nla Administración Pública\n\n encargadas de la confección y entrega de los giros de Gobierno. Las sumas\nacumuladas por estas deducciones serán registradas por\n\nla Caja\n\n individualmente, pudiéndose o no emitir títulos por los montos que decida\n\nla Junta Directiva.\n\n       \nLas sumas dedicadas a ahorro serán deducidas de los giros correspondientes y\ndepositadas a la orden de\n\nla Caja\n\n , en la misma forma que las deducciones para cubrir cuotas ordinarias. El socio\ninteresado en ahorrar deberá autorizar esas deducciones. Las sumas ahorradas\nganarán intereses al tipo que cada año señale\n\nla Junta Directiva\n\n y podrán ser retiradas total o parcialmente por el accionista, cuando éste lo\nestime conveniente.\n\n(Así\nreformado por el artículo 1° de la ley N° 5194 del 16 de abril de 1973)\n\n     Artículo 5°- El capital de\n\nla Caja\n\n será ilimitado y estará representado por el número de acciones que\ncorrespondan a su monto pagado.\n\n(Así reformado por el\nartículo 1° de la ley N° 4694 del 28 de diciembre de 1970)\n\nArtículo 6°-El domicilio de\nla Caja\n será la ciudad de San José, pero ella podrá establecer agencias o sucursales\nen cualquier población de\n\nla República\n cuando su Junta Directiva lo estime conveniente.\n\n        Artículo\n7°-El objeto y fines de\n\nla Caja\n\n serán :\n\n  \n     a) Otorgar préstamos a sus accionistas por las sumas\nque señale\n\nla Junta Directiva\n\n , de acuerdo con la capacidad económica de\n\nla Caja\n\n ;\n\n  \n     b) Administrar los ahorros que hagan los accionistas.\n\n(Así\nreformado pro el artículo 1° de la ley N° 4694 del 28 de diciembre de 1970)\n\nArtículo 8°-Para la realización de los propósitos indicados,\nla Caja\n podrá ejecutar además las siguientes operaciones:\n\n       \na) Descontar o traspasar en garantía, directamente o en calidad de cola­teral,\nlos documentos de crédito o las órdenes de retención otorgadas a su favor;\n\n       \nb) Realizar toda clase de operaciones de crédito con el Instituto Nacional de\nSeguros,\n\nla Caja\n de Seguro Social y las instituciones bancarias comerciales establecidas en el\npaís;\n\n       \nc) Cuando haya realizado las operaciones que autoriza el inciso c) del artículo\nanterior, emitir bonos hipotecarios de amortización lenta con garantía de las\nhipotecas de primer grado que hayan sido consti­tuidas a su favor; y \n,\n\n       \nd) Recibir en depósito los fondos que pertenezcan a las sociedades y a las\nasociaciones de educadores inscritas de conformidad con la ley, siempre que\nellas estén de acuerdo.\n\nCAPITULO II\n\nAdministración\n\nArtículo 9°-La Dirección de la\nCaja de Ahorro y Préstamos de la Asociación Nacional de Educadores (ANDE) está\na cargo de una junta  directiva integrada\npor siete miembros propietarios y cuatro suplente, nombrados en la siguiente\nforma:\n\na) Cuatro\npropietarios y un suplente por la Directiva Central de la Asociación Nacional\nde Educadores;\n\nb) Un\npropietario y un suplente por la Directiva Central de la Asociación de\nProfesores de Segunda Enseñanza; y\n\nc) Un\npropietario y un suplente por la Directiva Central de la Asociación de\nEducadores Pensionados.\n\nd) Un\npropietario y un suplente designado por el Consejo Nacional de representantes\ndel Sindicato de Trabajadores y Trabajadoras de la Educación Costarricense\n(SEC).\n\nLos propietarios y suplentes\ndesempeñarán sus cargos por períodos de cuatro años y podrán ser reelectos\nhasta por otro período consecutivo.\n\n        Los\nnombramientos serán hechos de manera que cada dos años hayan de ser renovados,\nde manera alterna, cuarto directores propietarios y dos suplentes en el primer\nperíodo, y tres directores propietarios y dos suplentes en el siguiente\nperíodo. Estos nombramientos deberán asegurar la representación paritaria de\nambos sexos, para que la integración de este órgano colegiado impar, la\ndiferencia entre el total de hombres y mujeres no sea superior a uno.         \n\nCuando se produzca una vacante\npor otra razón que no sea la ter­minación del período, la reposición se hará\npor el tiempo que le falte al director saliente.\n\n \n\n(Así\nreformado por el artículo único de la ley N° 9382 del 29 de julio de 2016)\n\n        Artículo\n10.-Para la administración y la representación judicial y extra judicial de\nla Caja\n , su Junta Directiva nombrará cada dos años un Gerente y un Subgerente que\ntendrán las facultades y las obligaciones que señala la ley N° 1644 de 26 de\nsetiembre de 1953.\n\nCAPITULO\nIII\n\nOperaciones\n\n        Artículo\n11.-Con el objeto de ayudar a resolver el problema de vivienda que tienen los\neducadores,\n\nla Caja\n\n otorgará préstamos de \"Vi­vienda\" en las condiciones que al efecto\nseñale\n\nla Junta Directiva.\n\n(Así\nreformado por el artículo 1° de la ley N° 4694 del 28 de diciembre de 1970)\n\n       Artículo\n12.--La cancelación de los préstamos a que se refieren los artículos 7° y\n11 anteriores, se hará efectiva en el plazo que señale\n\nla Junta Directiva.\n\n  \n     El pago se hará por el sistema de cuotas mensuales\nfijas, que com­prenderán la amortización y los intereses y que serán\ndeducidas de los sueldos o pensiones de los deudores y depositadas a la orden de\n\nla Caja\n\n de Ahorro y Préstamo de\n\nla Asociación Nacional\n\n de Educadores por las ofi­cinas de\n\nla Administración Pública\n\n encargadas de la confección y entrega de los giros del Gobierno. Los préstamos\nestarán garantizados, durante todo el tiempo que dure el pago de la obligación,\npor los sueldos que deven­gue el deudor en cualquier dependencia de\n\nla Administración Pública\n\n , por su giro de pensión y por su póliza de vida de\n\nla Sociedad\n\n de Seguros de Vida del Magisterio Nacional, además de las garantías\nadicionales que\n\nla Junta Directiva\n\n estime conveniente y necesarias.\n\n(Así\nreformado por el artículo 1° de la ley N° 4694 del 28 de diciembre de 1970)\n\nArtículo 13.-Para asegurar el correcto trámite de las fórmulas de solicitud\nde préstamos, los funcionarios del Ministerio de Educación Pú­blica, de\n\nla Oficina Técnica\n\n Mecanizada, de\n\nla Sociedad\n\n de Seguros de Vida del Magisterio Nacional y de\n\nla Junta\n\n de Pensiones y Jubilaciones del Magisterio Nacional, deberán suministrar a\n\nla Caja\n\n los datos que se soliciten en ellas.\n\n(Así reformado pro el\nartículo 1° de la ley N° 4694 del 28 de diciembre de 1970)\n\nCAPITULO\nIV\n\nDisposiciones\nGenerales\n\n       \nArtículo 14.-Para los efectos legales, en todo lo que no esté precep­tuado\nen esta ley,\n\nla Caja\n se considerará como una unión cooperativa de crédito, y por consiguiente\ngozará de todos los privilegios que concede a las instituciones de esa índole\nel Código de Trabajo, particularmente el inciso f) del artículo 305.\n\n        Artículo\n15.-El Banco Nacional de Costa Rica y el Instituto Nacional de Seguros estarán\nexentos de las obligaciones que les imponen las leyes N°49 de 7 de agosto de\n1916 y N° 7 de 21 de setiembre de 1939, siempre que concedan a\n\nla Caja\n , que por esta ley se establece, en calidad de préstamo o por vía de\nredescuento, la suma necesaria para hacer la compra de giros que preceptúa el\ninciso a) del artículo 7°\n\nArtículo\n16.-\nLa Auditoría General\n de Bancos tendrá, en relación con\n\nla Caja\n y ésta con respecto de aquélla, todas las obligaciones que señala la ley N°\n1552 de 23 de abril de 1953 en su Título II, Capítulo IV.\n\n     Transitorio.-Las\nprimeras vacantes en cargos de propietario y de suplente, que ocurran en la\nJunta Directiva de la Caja por cualquier motivo, a partir de la vigencia de la\npresente ley, serán llenadas dentro de ternas que propondrá la Directiva\nCentral de la Asociación de Profesores de Segunda Enseñanza; las\ninmediatamente siguientes, lo serán dentro de ternas que propondrá Directiva\nCentral de la Asociación de Educadores Pensionados. Los nombramientos que sigan\nlos hará libremente la Directiva Central de la Asociación Nacional de\nEducadores, hasta que la Junta Directiva de la Caja quede integrada totalmente\nal tenor de la presente ley.\n\n(Nota:\nMediante el artículo 1° de la ley N° 4694 del 28 de diciembre de 1970, se\nordena reformar el transitorio de esta ley. No obstante; el texto del\ntransitorio que redacta la norma afectante, es diferente al texto del\ntransitorio exsistente, razón por la cual se transcriebe la reforma:\n\" ...Artículo 1°-Refórmanse los artículos ..., ..., ..., ...,\n..., ..., ..., ..., ..., ... y el transitorio de\n\nla Ley Constitutiva\n\n de\n\nla Caja\n\n de Préstamos y Descuentos de\n\nla Asociación Nacional\n\n de Educadores, N° 12 de 13 de octubre de 1944, y sus reformas posteriores, los\ncuales se leerán así:\n\nTransitorio.-Durante\nun lapso de dos años a partir de la vigencia de esta ley,\n\nla Caja\n\n de Ahorro y Préstamo de\n\nla Asociación Nacional\n\n de Educadores, podrá usar la papelería que actualmente se usa y que tiene el\nmembrete de\n\nla Caja\n\n de Préstamos y Descuentos de\n\nla Asociación Nacional\n\n de Educadores...\")",
  "body_en_text": "in the entirety of the text\n\n                    -\n\nFull Text of Law 12\n\n                        Creates the Loan and Discount Fund of the National Association of Educators\n\nNo.\n12\n\n \n\n(Note:\nBy Article 2 of Law No. 6605 of September 17, 1981, this\nrule was interpreted to mean that: \"...cooperative\nassociations and the Savings and Loan Fund of the National Association of\nEducators are non-profit entities, which are not obligated to pay\nIncome Tax; therefore, they have never been subject to the legal mandate\nto register credit operations, which they have made or make by promissory notes,\naccording to Law No. 6450...\")\n\nThe\nConstitutional Congress of\n\nthe Republic\n of Costa Rica\n\nDecrees\n:\n\n(Sinalevi Note: This Law was partially reformed and its text reproduced in full,\nby Law No. 3012 of July 26, 1962 and published in the Colección de Leyes y Decretos\nof the year 1962, Semester II, Volume II, therefore it is reproduced below:)\n\nCHAPTER\nI\n\nConstitution,\nAims and Purposes\n\n        Article\n1°-The\n\nSavings and Loan Fund of\n\nthe National Association\n\n of Educators is hereby created, which shall have the purpose of stimulating savings among its shareholders and facilitating loans to them under the conditions and for the purposes set forth in this law.\n\n(Thus\n      amended by Article 1 of Law No. 4694 of December 28,\n      1970)\n\nArticle 2°-All officials and employees, in service or on leave, of the Ministry of Public Education and the retirees or pensioners of that Ministry shall be partners or shareholders of the Fund. Shareholders who are in service or on leave must acquire shares of the Fund, through the procedure established in Article 4°.\n\n  \n     When they avail themselves of a pension or retirement, they shall be obliged to maintain only one share of five hundred colones (^ 500.00) in their name and may redeem the others. But if upon pensioning they are not the owners of a share of that value, they must continue paying monthly installments until it is completed.\n\n(Thus amended by Article 1 of Law No. 4694 of December 28, 1970)\n\n        Article\n3°-The shares shall be registered and may not be sold or transferred in any manner. They are unseizable except by the Fund, to which they shall answer at all times for the credits it has granted to the shareholder, as additional guarantee.\n\n  \n     Shareholders must name legatees for their shares, so that upon their death they receive from the Fund the sums bequeathed to them, together with the corresponding surpluses. The sums bequeathed to minors shall be deposited with the Patronato Nacional de la Infancia. If the shareholder has not named legatees, the total sum shall be deposited with the Court handling the corresponding probate proceedings, for the pertinent legal purposes.\n\n  \n     Officials or employees who cease to serve in the Ministry of Education may continue as shareholders, provided they continue to pay the monthly installments punctually. However, when they have no obligations to the Fund as debtors or guarantors, they may withdraw the total of their contributions, together with the corresponding surpluses.\n\n(Thus\n      amended by Article 1 of Law No. 4694 of December 28,\n      1970)\n\n Article\n4°-The ordinary capital contributions shall be paid by the partners mentioned in Article 2°, by means of minimum monthly deductions calculated at 3% of the partner's gross monthly salary. The interested parties may authorize higher deductions. Officials or employees who cease to serve in the Ministry of Public Education and wish to continue as partners must contribute a monthly ordinary installment equal to that of the last month served.\n\n       \nThe referred installments shall be deducted and deposited to the order of the Savings and Loan Fund of the National Association of Educators by the offices of the Public Administration in charge of preparing and delivering Government warrants. The sums accumulated by these deductions shall be registered by the Fund individually, and titles may or may not be issued for the amounts decided by the Board of Directors.\n\n       \nThe sums dedicated to savings shall be deducted from the corresponding warrants and deposited to the order of the Fund, in the same manner as the deductions to cover ordinary installments. The partner interested in saving must authorize these deductions. The saved sums shall earn interest at the rate set each year by the Board of Directors and may be withdrawn totally or partially by the shareholder, when the latter deems it convenient.\n\n(Thus amended by Article 1 of Law No. 5194 of April 16, 1973)\n\n     Article 5°- The capital of the Fund shall be unlimited and shall be represented by the number of shares that correspond to its paid-up amount.\n\n(Thus amended by\nArticle 1 of Law No. 4694 of December 28, 1970)\n\nArticle 6°-The domicile of the Fund shall be the city of San José, but it may establish agencies or branches in any town of the Republic when its Board of Directors deems it convenient.\n\n        Article\n7°-The purpose and aims of the Fund shall be:\n\n  \n     a) To grant loans to its shareholders for the sums indicated by the Board of Directors, in accordance with the economic capacity of the Fund;\n\n  \n     b) To administer the savings made by the shareholders.\n\n(Thus amended by Article 1 of Law No. 4694 of December 28, 1970)\n\nArticle 8°-For the realization of the indicated purposes, the Fund may also carry out the following operations:\n\n       \na) To discount or transfer as guarantee, directly or as collateral, the credit documents or withholding orders granted in its favor;\n\n       \nb) To carry out all kinds of credit operations with the Instituto Nacional de Seguros, the Caja de Seguro Social, and the commercial banking institutions established in the country;\n\n       \nc) When it has carried out the operations authorized by subsection c) of the preceding article, to issue slow-amortization mortgage bonds guaranteed by the first-degree mortgages that have been constituted in its favor; and \n,\n\n       \nd) To receive on deposit the funds belonging to the societies and associations of educators registered in accordance with the law, provided they are in agreement.\n\nCHAPTER II\n\nAdministration\n\nArticle 9°-The Direction of the Savings and Loan Fund of the National Association of Educators (ANDE) is in charge of a board of directors composed of seven full members and four substitutes, appointed in the following manner:\n\na) Four full members and one substitute by the Central Board of Directors of the National Association of Educators;\n\nb) One full member and one substitute by the Central Board of Directors of the Secondary Education Teachers Association; and\n\nc) One full member and one substitute by the Central Board of Directors of the Association of Pensioned Educators.\n\nd) One full member and one substitute designated by the National Council of Representatives of the Union of Workers of Costa Rican Education (SEC).\n\nThe full members and substitutes shall hold their positions for periods of four years and may be reelected for one additional consecutive period.\n\n        The\nappointments shall be made in such a way that every two years, four full directors and two substitutes must be renewed in the first period, and three full directors and two substitutes in the following period, in an alternating manner. These appointments must ensure equal representation of both sexes, so that the composition of this odd-numbered collegial body, the difference between the total number of men and women is not greater than one.         \n\nWhen a vacancy occurs for a reason other than the expiration of the term, the replacement shall be made for the time remaining to the outgoing director.\n\n \n\n(Thus\namended by the sole article of Law No. 9382 of July 29, 2016)\n\n        Article\n10.-For the administration and the judicial and extrajudicial representation of the Fund, its Board of Directors shall appoint every two years a Manager and an Assistant Manager who shall have the powers and obligations established by Law No. 1644 of September 26, 1953.\n\nCHAPTER\nIII\n\nOperations\n\n        Article\n11.-In order to help solve the housing problem affecting educators, the Fund shall grant \"Housing\" loans under the conditions indicated for that purpose by the Board of Directors.\n\n(Thus\namended by Article 1 of Law No. 4694 of December 28, 1970)\n\n       Article\n12.--The cancellation of the loans referred to in Articles 7° and 11 above shall be made effective within the period indicated by the Board of Directors.\n\n  \n     Payment shall be made by the system of fixed monthly installments, which shall comprise amortization and interest and which shall be deducted from the salaries or pensions of the debtors and deposited to the order of the Savings and Loan Fund of the National Association of Educators by the offices of the Public Administration in charge of preparing and delivering Government warrants. The loans shall be guaranteed, for the entire duration of the payment of the obligation, by the salaries earned by the debtor in any dependency of the Public Administration, by their pension warrant, and by their life insurance policy from the Sociedad de Seguros de Vida del Magisterio Nacional, in addition to the additional guarantees that the Board of Directors deems convenient and necessary.\n\n(Thus\namended by Article 1 of Law No. 4694 of December 28, 1970)\n\nArticle 13.-To ensure the correct processing of loan application forms, the officials of the Ministry of Public Education, of the Oficina Técnica Mecanizada, of the Sociedad de Seguros de Vida del Magisterio Nacional, and of the Junta de Pensiones y Jubilaciones del Magisterio Nacional, must supply the Fund with the data requested in them.\n\n(Thus amended by\nArticle 1 of Law No. 4694 of December 28, 1970)\n\nCHAPTER\nIV\n\nGeneral\nProvisions\n\n       \nArticle 14.-For legal purposes, in everything not stipulated in this law, the Fund shall be considered as a credit union, and consequently shall enjoy all the privileges that the Labor Code grants to institutions of that nature, particularly subsection f) of Article 305.\n\n        Article\n15.-The Banco Nacional de Costa Rica and the Instituto Nacional de Seguros shall be exempt from the obligations imposed on them by Laws No. 49 of August 7, 1916 and No. 7 of September 21, 1939, provided they grant to the Fund, established by this law, as a loan or by way of rediscount, the necessary sum to make the purchase of warrants prescribed by subsection a) of Article 7°.\n\nArticle\n16.-\nThe Auditoría General de Bancos shall have, in relation to the Fund, and the latter with respect to the former, all the obligations set forth in Law No. 1552 of April 23, 1953 in its Title II, Chapter IV.\n\n     Transitory.-The\nfirst vacancies in positions of full member and substitute that occur on the Board of Directors of the Fund for any reason, from the effective date of this law, shall be filled from shortlists proposed by the Central Board of Directors of the Secondary Education Teachers Association; the ones immediately following shall be filled from shortlists proposed by the Central Board of Directors of the Association of Pensioned Educators. The subsequent appointments shall be freely made by the Central Board of Directors of the National Association of Educators, until the Board of Directors of the Fund is fully integrated in accordance with this law.\n\n(Note:\nBy Article 1 of Law No. 4694 of December 28, 1970, the transitory article of this law is ordered to be amended. However, the text of the transitory article drafted by the affecting rule is different from the existing transitory article text, for which reason the amendment is transcribed:\n\" ...Article 1°-Articles ..., ..., ..., ..., ..., ..., ..., ..., ..., ... and the transitory article of the Ley Constitutiva of the Loan and Discount Fund of the National Association of Educators, No. 12 of October 13, 1944, and its subsequent amendments, are hereby amended, which shall read as follows:\n\nTransitory.-During\na period of two years from the effective date of this law, the Savings and Loan Fund of the National Association of Educators may use the stationery currently used and which bears the letterhead of the Loan and Discount Fund of the National Association of Educators...\")"
