  "body_es_text": "Recuerde que Control F es una opción que le permite buscar en la totalidad del texto\n\n\nIr al final del documento\n\n- Usted está en la última versión de la norma -\n\nConvenio de la Alianza para el Progreso con los Estados Unidos (AID)\n\n\nArtículo 1º.- Apruébase en todas y cada una de sus partes el\n\n\n\n\n\nConvenio General para la ayuda económica, técnica y para propósitos\n\n\n\n\n\nafines entre los Gobiernos de Costa Rica y los Estados Unidos de América,\n\n\n\n\n\nsuscrito en San José a los veintidós días del mes de diciembre de mil\n\n\n\n\n\nnovecientos sesenta y uno, cuyo texto es el siguiente:\n\n\n\n\n\nCONVENIO GENERAL PARA LA AYUDA ECONOMICA, TECNICA\n\n\n\n\n\nY PARA PROPOSITOS AFINES ENTRE EL GOBIERNO DE COSTA\n\n\n\n\n\nRICA Y EL GOBIERNO DE LOS ESTADOS UNIDOS DE AMERICA\n\n\n\n\n\nPor cuanto el Gobierno de Costa Rica y el Gobierno de los Estados\n\n\n\n\n\nUnidos de América desean concertar una Alianza para el Progreso basada en\n\n\n\n\n\nla ayuda propia, el esfuerzo mutuo y el sacrificio común, destinada a\n\n\n\n\n\nayudar a satisfacer las necesidades de mejores viviendas, trabajo, tierras,\n\n\n\n\n\nsalud y escuelas de los pueblos de la América Latina, y\n\n\n\n\n\nPor cuanto en el Acta de Bogotá se recomienda la implantación de un\n\n\n\n\n\nprograma interamericano de desarrollo social que tienda a la ejecución de\n\n\n\n\n\nmedidas para mejorar el bienestar rural, el uso de la tierra, la vivienda,\n\n\n\n\n\nlos servicios colectivos, los sistemas educativos, los servicios de\n\n\n\n\n\nadiestramiento, y la salubridad pública, y para la movilización de los\n\n\n\n\n\nrecursos locales, y\n\n\n\n\n\nPor cuanto el Gobierno de Costa Rica y el Gobierno de los Estados\n\n\n\n\n\nUnidos de América están de acuerdo en la necesidad de planes de acción\n\n\n\n\n\nespecíficos destinados a fomentar el progreso económico y el mejoramiento\n\n\n\n\n\ndel bienestar y nivel de vida de todos los pueblos de la América Latina, y\n\n\n\n\n\nPor cuanto el Gobierno de los Estados Unidos de América tiene la\n\n\n\n\n\nintención de suministrar a los países de la América Latina que participan\n\n\n\n\n\nen la Alinza para el Progreso, la ayuda económica, técnica y para\n\n\n\n\n\npropósitos afines que soliciten ellos y que apruebe el Gobierno de los\n\n\n\n\n\nEstados Unidos de América, a la luz de los reucursos disponibles para el\n\n\n\n\n\nobjeto y de los programas y medidas de ayuda propia contemplados en el Acta\n\n\n\n\n\nde Bogotá;\n\n\n\n\n\nPor lo tanto el Gobierno de Costa Rica y el Gobierno de los Estados\n\n\n\n\n\nUnidos de América por este medio acuerdan lo siguiente:\n\n\n\n\n\nARTICULO I\n\n\n\n\n\nA fin de ayudar al Gobierno de Costa Rica en lo que respecta al\n\n\n\n\n\ndesarrollo nacional y a sus esfuerzos por alcanzar el progreso social y\n\n\n\n\n\neconómico por medio de la utilización efectiva de sus propios recursos y\n\n\n\n\n\notras medidas de ayuda propia, el Gobierno del los Estados Unidos de América\n\n\n\n\n\nproporcionará la ayuda económica, técnica y para asuntos afines que en el\n\n\n\n\n\nfuturo soliciten los representantes de organismos competentes del\n\n\n\n\n\nGobierno de Costa Rica y que aprueben los representantes del organismo y\n\n\n\n\n\norganismos designados por el Gobierno de los Estados Unidos de América para\n\n\n\n\n\nla administración de sus compromisos según el presente Convenio. Dicha\n\n\n\n\n\nayuda se proporcionará conforme a acuerdos escritos y firmados entre los\n\n\n\n\n\nrepresentantes anteriormente indicados.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO II\n\n\n\n\n\nPara fomentar el progreso social y económico del país, el Gobierno de\n\n\n\n\n\nCosta Rica contribuirá en la forma máxima que le permitan sus recursos y\n\n\n\n\n\ncondiciones económicas generales al programa de desarrollo y a los\n\n\n\n\n\nprogramas y actividades relacionados con el mismo, incluyendo aquellos que\n\n\n\n\n\nse efectúen de acuerdo con este Convenio, y suministrará la más amplia\n\n\n\n\n\ninformación al pueblo de Costa Rica en lo que concierne a los programas y\n\n\n\n\n\nactividades contemplados aquí. El Gobierno de Costa Rica tomará las\n\n\n\n\n\nmedidas del caso para asegurar el aprovechamiento efectivo de la ayuda\n\n\n\n\n\nproporcionada de acuerdo con este Convenio y dará todas las oportunidades y\n\n\n\n\n\nfacilidades a los representantes del Gobiernbo de los Estados Unidos de\n\n\n\n\n\nAmérica para que observen y revisen los programas y actividades que se\n\n\n\n\n\nconduzcan de acuerdo con este Convenio y suministrará cualquier\n\n\n\n\n\ninformación que ellos puedan necesitar para determinar la naturaleza y el\n\n\n\n\n\nalcance de las actividades planificadas o llevadas a cabo, y para hacer una\n\n\n\n\n\nevaluación de los reslutados.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO III\n\n\n\n\n\nEl Gobierno de Costa Rica recibirá una misión especial y el personal\n\n\n\n\n\ncorrespondiente para el desempeño de los deberes del Gobierno de los\n\n\n\n\n\nEstados Unidos de América de acuerdo con este Convenio y considerará a\n\n\n\n\n\ndicha misión especial y a su personal como parte de la misión Diplomática\n\n\n\n\n\ndel Gobierno de los Estados Unidos de América en Costa Rica, con el fin de\n\n\n\n\n\nconcederles los privilegios e inmunidades que se conceden a esta última y\n\n\n\n\n\na su personal de igual rango.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO IV\n\n\n\n\n\nA fin de asegurar para el pueblo de Costa Rica los beneficios máximos\n\n\n\n\n\nprovenientes de la ayuda que se proporcionará en virtud de este Convenio,\n\n\n\n\n\nse dispone:\n\n\n\n\n\na) Los bienes o fondos utilizados o que se utilizaren con relación a\n\n\n\n\n\neste Convenio por parte del Gobierno de los Estados Unidos de América o de\n\n\n\n\n\ncualquier contratista financiado por ese Gobierno, estarán exentos del\n\n\n\n\n\npago de todo impuesto sobre la propiedad o el uso y de cualquier otro\n\n\n\n\n\nimpuesto, de requisitos relacionados con inversiones o depósitos, y de\n\n\n\n\n\ncontroles cambiarios de Costa Rica; y la importación, exportación,\n\n\n\n\n\nadquisición, uso o disposición de dichos bienes o fondos relacionados con\n\n\n\n\n\neste Convenio estarán exentos del pago de cualquier arancel, derechos de\n\n\n\n\n\naduana, impuestos de importación y exportación, impuestos sobre compras o\n\n\n\n\n\ntraspasos y cualesquier otros impuestos o tasas similares que existan en\n\n\n\n\n\nCosta Rica.\n\n\n\n\n\nb) Todas las personas, excepto los residentes permanentes de Costa\n\n\n\n\n\nRica, que estén aquí presentes con el objeto de ejecutar trabajos\n\n\n\n\n\nrelacionados con este Convenio, estarán exentas del pago de impuestos sobre\n\n\n\n\n\nla renta y de Seguro Social que se pagan de acuerdo con las leyes de Costa\n\n\n\n\n\nRica, y de los impuestos sobre la compra, propiedad, uso o disposición de\n\n\n\n\n\nbienes muebles personales (incluyendo automóviles) para su propio uso.\n\n\n\n\n\nDichas personas y los miembros de sus familias recibirán el mismo trato\n\n\n\n\n\ncon respecto al pago de derechos de aduana y de importación y exportación\n\n\n\n\n\nsobre sus bienes muebles personales (incluyendo automóviles) que importen a\n\n\n\n\n\nCosta Rica para su uso personal, que el que otorga el Gobierno de Costa\n\n\n\n\n\nRica al personal diplomático de la Embajada Americana en Costa Rica.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO V\n\n\n\n\n\nLos fondos que se utilicen con el fin de proporcionar ayuda en virtud\n\n\n\n\n\nde este Convenio serán convertidos en moneda de Costa Rica al tipo de\n\n\n\n\n\ncambio que produzca el mayor número de unidades de dicha moneda por cada\n\n\n\n\n\ndólar de los Estados Unidos de América y que en el momento en que se haga\n\n\n\n\n\nla conversión, no sea ilegal en Costa Rica.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO VI\n\n\n\n\n\n1.- Este Convenio entrará en vigencia en la fecha de la comunicación\n\n\n\n\n\npor la cual el Gobierno de Costa Rica le notifique al Gobierno de los\n\n\n\n\n\nEstados Unidos de América que ha sido ratificado y permanecerá en vigencia\n\n\n\n\n\nhasta 90 días después de la fecha de la comunicación por la cual cualquiera\n\n\n\n\n\nde los dos Gobiernos le dé avioso por escrito al otro de su intención de dar\n\n\n\n\n\npor terminado el Convenio. En tal caso, las disposiciones de este Convenio\n\n\n\n\n\npermanecerán en plena vigencia y efectividad en cuanto a la ayuda\n\n\n\n\n\nproporcionada conforme a este Convenio antes de su terminación.\n\n\n\n\n\n2.- Todo o cualquier parte del programa de ayuda que se proporcione en\n\n\n\n\n\nvirtud de este Convenio, excepto cuando se estipulare de otra manera en\n\n\n\n\n\narreglos que se acuerden conforme al Artículo I del msimo, podrá\n\n\n\n\n\nterminarse a voluntad de cualquiera de los dos Gobiernos si ese Gobierno\n\n\n\n\n\ndeterminare que por motivos de un cambio en las condiciones, la continuación\n\n\n\n\n\nde dicha ayuda es innecesaria o indeseable. La terminación de dicha\n\n\n\n\n\nayuda de acuerdo con esta disposición puede incluir la cancelación de las\n\n\n\n\n\nentregas de cualesquier materiales o artículos que estén cubiertos por\n\n\n\n\n\neste Convenio, y que no se hayan efectuado.\n\n\n\n\n\n3.- El suministro de ayuda bajo este Convenio estará sujeto a las\n\n\n\n\n\nleyes y reglamentos del Gobierno de los Estados Unidos de América que sean\n\n\n\n\n\naplicables y el recibo de dicha ayuda por parte del Gobierno de Costa Rica\n\n\n\n\n\nestará sujeto a los reglamentos y leyes de este último que sean aplicables.\n\n\n\n\n\n4.- Los dos Gobiernos o sus representantes debidamente nombrados\n\n\n\n\n\ndeberán, a solicitud de cualquiera de los dos, llevar a cabo consultas\n\n\n\n\n\nrespecto a cualquier asunto relacionado con la aplicación, operación o\n\n\n\n\n\nenmmienda de este Convenio.\n\n\n\n\n\n5.- Una vez vigente, este Convenio reemplazará al Convenio General\n\n\n\n\n\npara Cooperación Técnica del Punto 4, entre el Gobierno de Costa Rica y los\n\n\n\n\n\nEstados Unidos de América que se firmó en San José, Costa Rica, el 11 de\n\n\n\n\n\nenero de 1951, prorrogado y enmendado por canje de notas en San José, el 19\n\n\n\n\n\ny 20 de diciembre de 1951.   "body_en_text": "Remember that Control F is an option that allows you to search the entire text\n\n\nGo to the end of the document\n\n- You are on the latest version of the regulation -\n\nAgreement of the Alliance for Progress with the United States (AID)\n\n\nArticle 1.- The following is approved in each and every one of its parts:\n\n\n\n\n\nGeneral Agreement for economic, technical, and related assistance\n\n\n\n\n\nbetween the Governments of Costa Rica and the United States of America,\n\n\n\n\n\nsigned in San José on the twenty-second day of December of\n\n\n\n\n\nnineteen hundred sixty-one, the text of which is as follows:\n\n\n\n\n\nGENERAL AGREEMENT FOR ECONOMIC, TECHNICAL\n\n\n\n\n\nAND RELATED ASSISTANCE BETWEEN THE GOVERNMENT OF COSTA\n\n\n\n\n\nRICA AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA\n\n\n\n\n\nWhereas the Government of Costa Rica and the Government of the United\n\n\n\n\n\nStates of America wish to forge an Alliance for Progress based on\n\n\n\n\n\nself-help, mutual effort, and common sacrifice, intended to\n\n\n\n\n\nhelp meet the needs for better housing, jobs, land,\n\n\n\n\n\nhealth, and schools of the peoples of Latin America, and\n\n\n\n\n\nWhereas the Act of Bogotá recommends the implementation of an\n\n\n\n\n\ninter-American social development program aimed at the execution of\n\n\n\n\n\nmeasures to improve rural welfare, land use (uso de la tierra), housing,\n\n\n\n\n\ncommunity services, educational systems, training\n\n\n\n\n\nservices, and public health, and for the mobilization of\n\n\n\n\n\nlocal resources, and\n\n\n\n\n\nWhereas the Government of Costa Rica and the Government of the United\n\n\n\n\n\nStates of America agree on the need for specific action\n\n\n\n\n\nplans aimed at promoting economic progress and improvement\n\n\n\n\n\nof the welfare and standard of living of all the peoples of Latin America, and\n\n\n\n\n\nWhereas the Government of the United States of America has the\n\n\n\n\n\nintention of providing to the Latin American countries that participate\n\n\n\n\n\nin the Alliance for Progress, the economic, technical, and\n\n\n\n\n\nrelated assistance that they request and that the Government of the\n\n\n\n\n\nUnited States of America approves, in light of the resources available for the\n\n\n\n\n\npurpose and the self-help programs and measures contemplated in the Act\n\n\n\n\n\nof Bogotá;\n\n\n\n\n\nTherefore, the Government of Costa Rica and the Government of the United\n\n\n\n\n\nStates of America hereby agree as follows:\n\n\n\n\n\nARTICLE I\n\n\n\n\n\nIn order to assist the Government of Costa Rica regarding its\n\n\n\n\n\nnational development and its efforts to achieve social and\n\n\n\n\n\neconomic progress through the effective utilization of its own resources and\n\n\n\n\n\nother self-help measures, the Government of the United States of America\n\n\n\n\n\nwill provide the economic, technical, and related assistance that is in the\n\n\n\n\n\nfuture requested by representatives of competent agencies of the\n\n\n\n\n\nGovernment of Costa Rica and approved by the representatives of the agency or\n\n\n\n\n\nagencies designated by the Government of the United States of America for\n\n\n\n\n\nthe administration of its commitments under this Agreement. Said\n\n\n\n\n\nassistance will be provided according to written agreements signed between the\n\n\n\n\n\nrepresentatives indicated above.\n\n\n\n\nArticle file\n\n\n\n\n\nARTICLE II\n\n\n\n\n\nTo promote the social and economic progress of the country, the Government of\n\n\n\n\n\nCosta Rica will contribute to the maximum extent permitted by its resources and\n\n\n\n\n\ngeneral economic conditions to the development program and to the\n\n\n\n\n\nprograms and activities related thereto, including those that\n\n\n\n\n\nare carried out in accordance with this Agreement, and will provide the broadest\n\n\n\n\n\ninformation to the people of Costa Rica concerning the programs and\n\n\n\n\n\nactivities contemplated herein. The Government of Costa Rica will take the\n\n\n\n\n\nappropriate measures to ensure the effective utilization of the assistance\n\n\n\n\n\nprovided in accordance with this Agreement and will give all opportunities and\n\n\n\n\n\nfacilities to the representatives of the Government of the United States of\n\n\n\n\n\nAmerica to observe and review the programs and activities that are\n\n\n\n\n\nconducted in accordance with this Agreement and will provide any\n\n\n\n\n\ninformation that they may need to determine the nature and the\n\n\n\n\n\nscope of the activities planned or carried out, and to make an\n\n\n\n\n\nevaluation of the results.\n\n\n\n\nArticle file\n\n\n\n\n\nARTICLE III\n\n\n\n\n\nThe Government of Costa Rica will receive a special mission and the corresponding\n\n\n\n\n\npersonnel for the performance of the duties of the Government of the\n\n\n\n\n\nUnited States of America in accordance with this Agreement and will consider\n\n\n\n\n\nsaid special mission and its personnel as part of the Diplomatic\n\n\n\n\n\nMission of the Government of the United States of America in Costa Rica, for the purpose of\n\n\n\n\n\ngranting them the privileges and immunities granted to the latter and\n\n\n\n\n\nto its personnel of equal rank.\n\n\n\n\nArticle file\n\n\n\n\n\nARTICLE IV\n\n\n\n\n\nIn order to ensure for the people of Costa Rica the maximum benefits\n\n\n\n\n\nderived from the assistance to be provided under this Agreement,\n\n\n\n\n\nit is provided:\n\n\n\n\n\na) The goods or funds used or that will be used in connection with\n\n\n\n\n\nthis Agreement by the Government of the United States of America or by\n\n\n\n\n\nany contractor financed by that Government, shall be exempt from the\n\n\n\n\n\npayment of all property or use taxes and any other\n\n\n\n\n\ntax, from requirements related to investments or deposits, and from\n\n\n\n\n\nexchange controls of Costa Rica; and the importation, exportation,\n\n\n\n\n\nacquisition, use, or disposition of such goods or funds related to\n\n\n\n\n\nthis Agreement shall be exempt from the payment of any tariff, customs\n\n\n\n\n\nduties, import and export taxes, purchase or\n\n\n\n\n\ntransfer taxes, and any other similar taxes or fees that exist in\n\n\n\n\n\nCosta Rica.\n\n\n\n\n\nb) All persons, except permanent residents of Costa\n\n\n\n\n\nRica, who are present here for the purpose of performing work\n\n\n\n\n\nrelated to this Agreement, shall be exempt from the payment of income\n\n\n\n\n\nand Social Security taxes paid in accordance with the laws of Costa\n\n\n\n\n\nRica, and from taxes on the purchase, ownership, use, or disposition of\n\n\n\n\n\npersonal movable property (including automobiles) for their own use.\n\n\n\n\n\nSuch persons and their family members shall receive the same treatment\n\n\n\n\n\nwith respect to the payment of customs, import, and export duties\n\n\n\n\n\non their personal movable property (including automobiles) that they import into\n\n\n\n\n\nCosta Rica for their personal use, as that granted by the Government of Costa\n\n\n\n\n\nRica to diplomatic personnel of the American Embassy in Costa Rica.\n\n\n\n\nArticle file\n\n\n\n\n\nARTICLE V\n\n\n\n\n\nFunds used for the purpose of providing assistance under\n\n\n\n\n\nthis Agreement shall be converted into the currency of Costa Rica at the exchange\n\n\n\n\n\nrate that yields the greatest number of units of said currency per\n\n\n\n\n\ndollar of the United States of America and that, at the time the\n\n\n\n\n\nconversion is made, is not illegal in Costa Rica.\n\n\n\n\nArticle file\n\n\n\n\n\nARTICLE VI\n\n\n\n\n\n1.- This Agreement shall enter into force on the date of the communication\n\n\n\n\n\nby which the Government of Costa Rica notifies the Government of the\n\n\n\n\n\nUnited States of America that it has been ratified and shall remain in force\n\n\n\n\n\nuntil 90 days after the date of the communication by which either\n\n\n\n\n\nof the two Governments gives written notice to the other of its intention to\n\n\n\n\n\nterminate the Agreement. In such case, the provisions of this Agreement\n\n\n\n\n\nshall remain in full force and effect as to the assistance\n\n\n\n\n\nprovided under this Agreement prior to its termination.\n\n\n\n\n\n2.- All or any part of the assistance program provided under\n\n\n\n\n\nthis Agreement, except when stipulated otherwise in\n\n\n\n\n\narrangements agreed upon pursuant to Article I hereof, may\n\n\n\n\n\nbe terminated at will by either of the two Governments if that Government\n\n\n\n\n\ndetermines that due to a change in conditions, the continuation\n\n\n\n\n\nof such assistance is unnecessary or undesirable. The termination of such\n\n\n\n\n\nassistance in accordance with this provision may include the cancellation of\n\n\n\n\n\ndeliveries of any materials or items covered by\n\n\n\n\n\nthis Agreement that have not been made.\n\n\n\n\n\n3.- The provision of assistance under this Agreement shall be subject to the\n\n\n\n\n\napplicable laws and regulations of the Government of the United States of America\n\n\n\n\n\nand the receipt of such assistance by the Government of Costa Rica\n\n\n\n\n\nshall be subject to the applicable laws and regulations of the latter.\n\n\n\n\n\n4.- The two Governments or their duly appointed representatives\n\n\n\n\n\nshall, at the request of either, hold consultations\n\n\n\n\n\nregarding any matter related to the application, operation, or\n\n\n\n\n\namendment of this Agreement.\n\n\n\n\n\n5.- Once in force, this Agreement shall replace the General Agreement\n\n\n\n\n\nfor Technical Cooperation of Point 4, between the Government of Costa Rica and the\n\n\n\n\n\nUnited States of America, which was signed in San José, Costa Rica, on January 11,\n\n\n\n\n\n1951, extended and amended by exchange of notes in San José, on December 19\n\n\n\n\n\nand 20, 1951.
