  "body_es_text": "Recuerde que Control F es una opción que le permite buscar en la totalidad del texto\n\n\nIr al final del documento\n\n- Usted está en la última versión de la norma -\n\nLey del Patronato Nacional de Ciegos\n\n\nN° 2171\n\n\n\n\n\nLA ASAMBLEA LEGISLATIVA DE LA REPÚBLICA DE COSTA RICA\n\n\n\n\n\nDECRETA:\n\n\n\n\n\nLa siguiente\n\n\n\n\n\nLEY DEL PATRONATO NACIONAL DE CIEGOS\n\n\n\n\n\nDisposiciones Generales\n\n\n\n\n\nArtículo 1º.- Con el nombre de Patronato Nacional de Ciegos, créase un organismo cuya finalidad será\nla de brindar protección a todas las personas ciegas, por los medios y en la forma que esta ley\nseñala y coordinar la acción de todos aquellos organismos o asociaciones que tengan relación con los\nproblemas de las personas no videntes.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 2.- Para los efectos de esta Ley, considérase ciega a toda persona que con lentes\ncorrectivos no posea una agudeza visual de más de 20-200 o 6-60 en la gráfica de Snellen o cuyo\ncampo visual esté disminuido a menos de 20 grados y ciega total, a toda persona que no tiene\npercepción de luz.\n\n\n\n\n\n(Así reformado por el artículo 1° de la ley N° 7286 del 4 de febrero de 1992)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 3º.- El Patronato Nacional de Ciegos tendrá personería legal propia y gozará de\nindependencia administrativa y funcional.\n\n\n\n\n\nSus presupuestos serán aprobados por la Contraloría General de la República a cuya fiscalización\nquedará sometido.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 4º.- El Patronato Nacional de Ciegos tendrá su domicilio legal en la ciudad de San José y\nsus actividades y autoridad se extenderán en todo el territorio nacional.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 5º.- En lo sucesivo al hablarse del Patronato Nacional de Ciegos se dirá simplemente el\nPatronato.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nDel Patronato\n\n\n\n\n\nArtículo 6.- La Junta Directiva del Patronato Nacional de Ciegos estará integrada por:\n\n\n\n\n\n1.- Un representante del Ministerio de Educación Pública que se desempeñe en el campo de la\neducación especial.\n\n\n\n\n\n2.- Un representante de la Caja Costarricense de Seguro Social.\n\n\n\n\n\n3.- Un representante del Ministerio de Trabajo.\n\n\n\n\n\n4.- Un representante del Ministerio de Salud.\n\n\n\n\n\n5.- Un oftalmólogo representante del Colegio de Médicos y Cirujanos.\n\n\n\n\n\n6.- Dos representantes designados por las organizaciones de ciegos legalmente constituidas en\nnuestro país.\n\n\n\n\n\nPara esos efectos, gozarán de permiso con goce de salario de su respectivo patrono. Los\nrepresentantes de las entidades públicas y del Colegio de Médicos serán designados por su máximo\njerarca.\n\n\n\n\n\n(Así reformado por el artículo 1° de la ley N° 7286 del 4 de febrero de 1992)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 7º.- La Dirección del Patronato estará a cargo de una Junta Directiva que se integrará con\nlos representantes mencionados en el artículo anterior, quienes, por elección, designarán\nPresidente, Secretario General, Tesorero, Fiscal y Vocales.\n\n\n\n\n\nCorresponde al Presidente ejercer la representación judicial y extrajudicial del Patronato, en los\ntérminos de ley.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 8º.- Cada uno de los Ministerios designará a la persona que lo represente. El Ministerio de\nEducación, además, nombrará a los profesores ciegos, el Colegio de Médicos y Cirujanos al médico\noftalmólogo y la Escuela de Enseñanza Especial y las Instituciones de ayuda a los ciegos, a sus\nrespectivos representantes.\n\n\n\n\n\nEl Poder Ejecutivo, mediante Decreto, integrará el Patronato.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 9.- Los miembros que integren la Junta Directiva del Patronato, tendrán derecho al permiso\nrespectivo para realizar su labor, por parte de las instituciones y organizaciones que representen.\nEl cargo será desempeñado gratuitamente por los miembros electos.\n\n\n\n\n\n(Así reformado por el artículo 1° de la ley N° 7286 del 4 de febrero de 1992)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 10.- En caso de que un delegado, por cualquier razón, se separe del organismo que\nrepresenta, éste designará, inmediatamente, su sustituto.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 11°- Los miembros del Patronato serán nombrados por periodos de dos años, y podrán ser\nreelectos. Los cargos de la Junta Directiva del Patronato durarán también dos años, y también podrán\nser reelectos.\n\n\n\n\n\n(Así reformado por el artículo 1° de la ley N° 2968 del 20 de diciembre de 1961)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 12.- El Patronato se reunirá ordinariamente dos veces al mes y extraordinariamente cuando\nsea necesario. En ambos casos la convocatoria deberá hacerla la Junta Directiva por medio del\nSecretario.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 13°- Para lograr una mayor especialización de los asuntos a su cargo, el Patronato\nintegrará las siguientes comisiones de estudio:\n\n\n\n\n\na) Educación,\n\n\n\n\n\nb) Servicio Social;\n\n\n\n\n\nc) Finanzas\n\n\n\n\n\nd) Legislación;\n\n\n\n\n\ne) Asuntos Especiales; y\n\n\n\n\n\nf) Asuntos Internacionales.\n\n\n\n\n\n(Así reformado por el artículo 1° de la ley N° 2968 del 20 de diciembre de 1961)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 14.- Para alcanzar sus finalidades el Patronato Nacional de Ciegos realizará las siguientes\nfunciones:\n\n\n\n\n\na) Unificar la causa social del ciego con miras a su protección, habilitación o rehabilitación;\n\n\n\n\n\nb) Levantar censos sobre la población ciego del país, de acuerdo con la Dirección General de\nEstadística y Censos;\n\n\n\n\n\nc) Velar porque los reglamentos y planes de estudio necesarios para la rehabilitación de los\ninvidentes, sean acordes con las necesidades reales de este grupo.\n\n\n\n\n\n(Así reformado el inciso anterior por el artículo 2° de la ley N° 7286 del 4 de febrero de 1992)\n\n\n\n\n\nd) Controlar todas las campañas tendientes a recoger fondos para los ciegos y velar por el correcto\ndestino de los mismos;\n\n\n\n\n\ne) Gestionar rebajas hasta de un 50% en las tarifas de transporte nacional e internacional para los\nciegos, en las empresas del Estado y en las particulares;\n\n\n\n\n\nf) Autorizar la realización de campañas en favor de los ciegos, de conformidad con los reglamentos\nque al efecto dicte;\n\n\n\n\n\ng) Actuar como asesor del Estado y de sus instituciones cuando algún organismo les solicite ayuda\npara los ciegos;\n\n\n\n\n\nh) Gestionar, ante las Instituciones Educativas del país o internacionales, los medios técnicos\nnecesarios para llevar a cabo los fines y medidas protectoras enumeradas en el artículo 16 de esta\nLey.\n\n\n\n\n\n(Así reformado el inciso anterior por el artículo 2° de la ley N° 7286 del 4 de febrero de 1992)\n\n\n\n\n\ni) Realizar campañas profilácticas y de prevención.\n\n\n\n\n\nj) Administrar los fondos destinados a asistencia social, para este efecto podrá instalar y mantener\nlos órganos administrativos necesarios.\n\n\n\n\n\n(Así adicionado el inciso anterior por el artículo 2° de la ley N° 2968 del 20 de diciembre de 1961)\n\n\n\n\n\nk) La Junta Directiva del Patronato Nacional de Ciegos elaborará anualmente, al Ministerio de\nHacienda, la lista de artículos necesarios para la rehabilitación del invidente, así como los\nmateriales indispensables para sus labores, los que estarán exentos de toda clase de impuestos,\ntimbres y tasas.\n\n\n\n\n\n(Así adicionado el inciso anterior por el artículo 3° de la ley N° 7286 del 4 de febrero de 1992)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 15.- El Patronato dictará su propio Reglamento Interno, que regirá sus actividades.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nMedidas Protectoras\n\n\n\n\n\nArtículo 16.- La protección, habilitación y rehabilitación de los ciegos se realizarán por los\nsiguientes medios:\n\n\n\n\n\n1.- Apoyo y estimulación de la educación de niños, adolescentes y adultos.\n\n\n\n\n\n2.- Capacitación en las áreas necesarias para el fomento de fuentes de empleo. En general, mediante\nprogramas de diferente índole, tendientes a mejorar las condiciones de vida del ciego.\n\n\n\n\n\n(Así reformado por el artículo 1° de la ley N° 7286 del 4 de febrero de 1992)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 17.- En igualdad de circunstancias, dará preferencia a los profesores nacionales y\nespecializados respecto de los extranjeros, a juicio del Patronato.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 18.- Toda persona ciega que desee obtener el título de Bachiller en Humanidades puede usar\ndel sistema Braille para realizar las pruebas de suficiencia, o llevar un lector para revisar lo\nescrito o mimeografiado.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 19.- Los estudiantes parcial o totalmente ciegos, cuyas calificaciones y conducta así lo\nameriten, tendrán derecho de ingresar a todas aquellas instituciones docentes no especializadas para\nciegos siempre que los cursos y estudios signifique en adelanto seguro en su habilitación o\nrehabilitación.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 20.- La Dirección General de Servicio Civil, así como otras dependencias del Poder\nEjecutivo destinadas a la selección o colocación de trabajadores, darán preferencia a las\nsolicitudes de personas ciegas en cuanto fueren idóneas para los cargos o puestos de que se trate.\nPara los efectos de este artículo, deberá indicarse en los reglamentos a las leyes que rigen las\nactividades de esas dependencias, la forma de hacer efectiva esta preferencia.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 21.- Las personas ciegas que deseen dedicarse al comercio, podrán instalar pequeños puestos\nen edificios del Estado o sitios públicos, para la venta de cigarrillos, periódicos, revistas y\notros artículos similares, previo permiso de la autoridad respectiva, sujetándose a que tales\ninstalaciones no desarmonicen con la estructura o presencia del lugar, ni alteren los servicios\npúblicos. El permiso podrá ser cancelado en cualquier momento por razones justificadas.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 22.- Todo aquel que se valga de un ciego para practicar la mendicidad o para incitar a su\npráctica, será sancionado de acuerdo con lo que establece el Código Penal.\n\n\n\n\n\n(Así reformado por el artículo 1° de la ley N 7286 del 4 de febrero de 1992)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 23.- Toda organización de ciegos, de videntes y de personas jurídicas, instituida para\nayudar a los ciegos y creada al amparo de las leyes costarricenses, está obligada a enviar al\nPatronato, un informe de su constitución, así como el nombre de sus personeros y los demás datos que\nse indiquen en la hoja de registro, que para tal efecto confeccionará el Patronato. Con esta\ninformación, esta última Institución elaborará un registro de esas organizaciones. Asimismo aquella\norganización estará obligada a enviar, al Patronato, cada seis meses, un balance de sus cuentas e\ninformes detallados de sus actividades, en enero y julio de cada año.\n\n\n\n\n\n(Así reformado por el artículo 1° de la ley N° 7286 del 4 de febrero de 1992)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 24.- Las asociaciones citadas en el artículo anterior o las personas dedicadas a\nactividades similares, rendirán cuentas e informaciones detalladas cada vez que el Patronato lo\nrequiera.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 25.- Los perros lazarillos, cuando acompañen a un ciego, tendrán libre acceso a toda clase\nde transportes y sitios públicos.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 26.- El Instituto Nacional de vivienda y Urbanismo, de acuerdo con sus leyes y reglamentos,\notorgará derecho de preferencia, en las adjudicaciones que haga de viviendas, a los padres o jefes\nde familia ciegos,previo el estudio de la necesidad en cada caso. Igualmente concederá las\nfacilidades que sean posibles en cuanto a plazos y monto de las cuotas.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 27.- Toda persona ciega tiene derecho y obligación de recibir educación formal o técnica\ndentro de sus posibilidades, por lo que deberá ser admitida en los diferentes centros educativos del\npaís, de acuerdo con el lugar de su residencia. The\nrepresentatives of public entities and of the Colegio de Médicos shall be designated by their highest\nauthority.\n\n\n\n\n\n(Thus amended by Article 1 of Law No. 7286 of February 4, 1992)\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 7.– The Direction of the Patronato shall be in charge of a Board of Directors composed of\nthe representatives mentioned in the previous article, who, by election, shall designate\nthe President, General Secretary, Treasurer, Oversight Officer (Fiscal), and Board Members (Vocales).\n\n\n\n\n\nThe President is responsible for exercising the judicial and extrajudicial representation of the Patronato, in\naccordance with the terms of the law.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 8.– Each of the Ministries shall designate the person who represents it. The Ministry of\nEducation shall, in addition, appoint the blind teachers; the Colegio de Médicos y Cirujanos, the medical\nophthalmologist; and the Special Education School and the Institutions for assistance to the blind, their\nrespective representatives.\n\n\n\n\n\nThe Executive Branch, by means of a Decree, shall integrate the Patronato.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 9.- The members comprising the Board of Directors of the Patronato shall have the right to the respective leave\nto perform their work, from the institutions and organizations they represent.\nThe position shall be performed without pay by the elected members.\n\n\n\n\n\n(Thus amended by Article 1 of Law No. 7286 of February 4, 1992)\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 10.- In the event that a delegate, for any reason, separates from the organization they\nrepresent, it shall immediately designate their substitute.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 11°- The members of the Patronato shall be appointed for terms of two years, and may be\nreelected. The positions on the Board of Directors of the Patronato shall also last two years, and they may also\nbe reelected.\n\n\n\n\n\n(Thus amended by Article 1 of Law No. 2968 of December 20, 1961)\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 12.- The Patronato shall meet ordinarily twice a month and extraordinarily when\nnecessary. In both cases, the call to meeting must be made by the Board of Directors through the\nSecretary.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 13°- To achieve greater specialization in the matters under its charge, the Patronato\nshall integrate the following study committees:\n\n\n\n\n\na) Education,\n\n\n\n\n\nb) Social Service;\n\n\n\n\n\nc) Finances;\n\n\n\n\n\nd) Legislation;\n\n\n\n\n\ne) Special Affairs; and\n\n\n\n\n\nf) International Affairs.\n\n\n\n\n\n(Thus amended by Article 1 of Law No. 2968 of December 20, 1961)\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 14.- To achieve its purposes, the Patronato Nacional de Ciegos shall perform the following\nfunctions:\n\n\n\n\n\na) Unify the social cause of the blind with a view to their protection, habilitation or rehabilitation;\n\n\n\n\n\nb) Conduct censuses on the blind population of the country, in agreement with the Dirección General de\nEstadística y Censos;\n\n\n\n\n\nc) Ensure that the regulations and study plans necessary for the rehabilitation of the\nblind are in accordance with the real needs of this group.\n\n\n\n\n\n(Thus amended the previous subsection by Article 2 of Law No. 7286 of February 4, 1992)\n\n\n\n\n\nd) Control all campaigns aimed at collecting funds for the blind and ensure the correct\nallocation of the same;\n\n\n\n\n\ne) Negotiate discounts of up to 50% on national and international transport fares for the\nblind, in State enterprises and in private ones;\n\n\n\n\n\nf) Authorize the undertaking of campaigns in favor of the blind, in accordance with the regulations\nit issues for that purpose;\n\n\n\n\n\ng) Act as an advisor to the State and its institutions when any agency requests help\nfor the blind;\n\n\n\n\n\nh) Negotiate, before the country's or international Educational Institutions, the technical means\nnecessary to carry out the protective purposes and measures enumerated in Article 16 of this\nLaw.\n\n\n\n\n\n(Thus amended the previous subsection by Article 2 of Law No. 7286 of February 4, 1992)\n\n\n\n\n\ni) Carry out prophylactic and prevention campaigns.\n\n\n\n\n\nj) Administer the funds allocated for social assistance; for this purpose, it may install and maintain\nthe necessary administrative bodies.\n\n\n\n\n\n(Thus the previous subsection was added by Article 2 of Law No. 2968 of December 20, 1961)\n\n\n\n\n\nk) The Board of Directors of the Patronato Nacional de Ciegos shall annually prepare, for the Ministry of\nFinance, the list of articles necessary for the rehabilitation of the blind, as well as the\nindispensable materials for their work, which shall be exempt from all kinds of taxes,\nstamps, and fees.\n\n\n\n\n\n(Thus the previous subsection was added by Article 3 of Law No. 7286 of February 4, 1992)\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 15.- The Patronato shall issue its own Internal Regulations, which shall govern its activities.\n\n\n\n\n\nArticle index\n\n\n\n\n\nProtective Measures\n\n\n\n\n\nArticle 16.- The protection, habilitation, and rehabilitation of the blind shall be carried out by the\nfollowing means:\n\n\n\n\n\n1.- Support and stimulation of the education of children, adolescents, and adults.\n\n\n\n\n\n2.- Training in the areas necessary for the promotion of employment sources. In general, by means\nof programs of different kinds, aimed at improving the living conditions of the blind.\n\n\n\n\n\n(Thus amended by Article 1 of Law No. 7286 of February 4, 1992)\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 17.- Under equal circumstances, preference shall be given to national and\nspecialized teachers over foreign ones, in the judgment of the Patronato.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 18.- Any blind person who wishes to obtain the title of High School Graduate in Humanities may use\nthe Braille system to take proficiency tests, or bring a reader to review what is\nwritten or mimeographed.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 19.- Partially or totally blind students, whose grades and conduct so\nwarrant it, shall have the right to enter all those educational institutions not specialized for\nthe blind, provided that the courses and studies mean a sure advancement in their habilitation or\nrehabilitation.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 20.- The Dirección General de Servicio Civil, as well as other dependencies of the Executive\nBranch intended for the selection or placement of workers, shall give preference to the\napplications of blind persons insofar as they are suitable for the positions or posts in question.\nFor the purposes of this article, the regulations to the laws that govern the\nactivities of those dependencies must indicate how to make this preference effective.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 21.- Blind persons who wish to engage in commerce may install small stands\nin State buildings or public places for the sale of cigarettes, newspapers, magazines, and\nother similar articles, with prior permission from the respective authority, subject to such\ninstallations not being disharmonious with the structure or appearance of the place, nor disrupting\npublic services. The permit may be canceled at any time for justified reasons.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 22.- Anyone who uses a blind person to practice begging or to incite its\npractice shall be sanctioned in accordance with the provisions of the Penal Code.\n\n\n\n\n\n(Thus amended by Article 1 of Law No. 7286 of February 4, 1992)\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 23.- Every organization of the blind, of sighted persons, and of legal entities, established to\nhelp the blind and created under the protection of Costa Rican laws, is obligated to send to the\nPatronato a report of its constitution, as well as the name of its representatives and the other data\nindicated on the registration form that the Patronato shall prepare for that purpose. With this\ninformation, the latter Institution shall compile a registry of those organizations. Likewise, that\norganization shall be obligated to send to the Patronato, every six months, a balance sheet of its accounts and\ndetailed reports of its activities, in January and July of each year.\n\n\n\n\n\n(Thus amended by Article 1 of Law No. 7286 of February 4, 1992)\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 24.- The associations cited in the previous article or persons dedicated to\nsimilar activities shall render detailed accounts and information whenever the Patronato\nrequires it.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 25.- Guide dogs (perros lazarillos), when accompanying a blind person, shall have free access to all types\nof transport and public places.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 26.- The Instituto Nacional de Vivienda y Urbanismo, in accordance with its laws and regulations,\nshall grant a right of preference, in the awards of housing it makes, to blind\nparents or heads of family, following a study of the need in each case. It shall likewise grant\nwhatever facilities are possible regarding terms and the amount of the installments.\n\n\n\n\n\nArticle index\n\n\n\n\n\nArticle 27.- Every blind person has the right and obligation to receive formal or technical education\nwithin their means, for which reason they must be admitted into the different educational centers of the\ncountry, according to their place of residence.
