norma\n -\n\n Texto Completo Norma 7566\n\n Creación del Sistema de Emergencias 911\n\nTexto Completo acta: 34253\n1\n\n CREACION DEL SISTEMA DE EMERGENCIAS 9-1-1\n\n ARTICULO 1.- Creación\n\n Créase el Sistema de Emergencias 9-1-1, con cobertura en todo el\n\nterritorio nacional y adscrito al Instituto Costarricense de\n\nElectricidad. Su objetivo será participar, oportuna y eficientemente, en\n\nla atención de situaciones de emergencia para la vida, libertad,\n\nintegridad y seguridad de los ciudadanos o casos de peligro para sus\n\nbienes.\n\n El nivel de desconcentración será máximo, según el inciso 3) del\n\nartículo 83, de la Sección I, Capítulo III, Título III de la Ley General\n\nde la Administración Pública, respecto a las competencias que, de manera\n\nexclusiva, la presente ley asigna al Sistema.\n\n (Así reformado por el artículo único de la ley Nº 7663 de 21 de\n\nmarzo de 1997)\n\n Ficha articulo\n\n ARTICULO 2.- Regulación\n\n El Sistema tiene personalidad jurídica instrumental y su\n\norganización y actividad serán reguladas por el Derecho Público.\n\n El ejercicio de la personalidad jurídica instrumental se utilizará\n\nen los actos que el Sistema ejecute, para cumplir con los acuerdos de la\n\nComisión Coordinadora o desempeñar las funciones que la ley le asigne, en\n\nmateria de administración presupuestaria y recursos humanos,\n\ncapacitación, coordinación interinstitucional, manejo de emergencias y\n\notras no compatibles dentro del marco de competencia del Instituto\n\nCostarricense de Electricidad.\n\n Para estos fines, el Organo dispondrá de la potestad de ejecutar su\n\nasignación presupuestaria, según sus objetivos definidos de servicio y\n\ncoordinación interinstitucional, y sujeto al mandato de las leyes que\n\nregulan dicho ejercicio.\n\n (Así reformado por el artículo único de la ley Nº 7663 de 21 de\n\nmarzo de 1997)\n\n Ficha articulo\n\nARTICULO 3.- Funciones.\nSon funciones del Sistema de Emergencias 9-1-1:\n\na) Desarrollar y mantener un sistema de\nrecepción, atención y transferencia de las llamadas de auxilio\nrealizadas en situaciones de emergencia a las instituciones y los cuerpos de\nsocorro correspondientes. Realizará estas labores a través de una\nred de comunicación con una base de acceso única para los\nparticulares, que integre, con el más alto nivel técnico y\nóptima calidad, canales de comunicación entre órganos y\nentes del sector público o privado.\n\nb) Fusionar de manera progresiva en el 9-1-1, como único\nnúmero, todos los que atienden llamadas de auxilio en situaciones de\nemergencia.\n\n(Así\nreformado el inciso anterior por el artículo único de la ley\nN° 9547 del 25 de abril del 2018)\n\nc) Mantener un programa permanente de\ncapacitación para los funcionarios del Sistema. Para tal efecto,\nsuscribirá acuerdos de cooperación con entidades públicas\no privadas, dentro del país o fuera de él.\n\nd) Ejecutar los procedimientos y\ntrámites necesarios, dictados por la Comisión Coordinadora que se\ncrea en el artículo 4 de esta ley, para que las emergencias reportadas\nse atiendan con eficiencia y calidad.\n\ne) Desarrollar y mantener un sistema que permita la\nrecepción, atención, transferencia y canalización de las\ncomunicaciones, que deban por su naturaleza ser atendidas por el Centro\nOperativo de Atención a la Violencia Intrafamiliar y Violencia contra\nlas Mujeres (Coavifmu).\n\nAdemás, deben suministrar asesoramiento, soporte, asistencia, los enlaces necesarios, equipos de\ndatos y comunicaciones y cualquier otro recurso necesario que requiera el Centro Operativo de\nAtención a La Violencia Intrafamiliar y Violencia contra las mujeres (Coavifmu) del Instituto\nNacional de las Mujeres, para lograr su funcionamiento, objetivo y atender las situaciones\nencomendadas en la Ley 7801, Ley del Instituto Nacional de las Mujeres, de 30 de abril de 1998.\n\n(Así adicionado el inciso anterior por el\nartículo 4° de la ley N° 10158 del 8 de marzo del 2022,\n“Consolidación del Centro Operativo de atención a la\nViolencia Intrafamiliar y la Violencia contra las Mujeres (COAVIFMU) y\ndeclaratoria de los servicios de atención de la violencia contra las\nmujeres como servicio esencial”)\n\nf) En colaboración con el Ministerio de\nSalud, podrá proporcionar el personal, espacio físico para\nubicación, equipo de cómputo y tecnológico, conectividad e\ninsumos de operación, para el funcionamiento del Despacho de Apoyo\nPsicológico del Ministerio de Salud, para el abordaje de ideación\nsuicida o riesgo de comportamiento suicida que presenten las personas que\nllamen a la línea de Emergencias 9-1-1.\n\n(Así adicionado el\ninciso anterior por el artículo 1° de la Ley para garantizar la\natención psicológica de personas con ideación suicida por\nmedio del Sistema de Emergencia 9-1-1, N° 10725 del 13 de mayo del 2025)\n\n Ficha articulo\n\nARTICULO 4.- Comisión Coordinadora\n\nConstitúyase la Comisión Coordinadora del\nSistema de Emergencias 9-1-1, integrada por un representante de alto nivel,\nperteneciente en forma directa a la dependencia u órgano de cada institución involucrada,\ny su suplente, cuando corresponda, de cada uno de los siguientes organismos:\n\na) Comisión Nacional de Emergencias.\n\nb) Caja Costarricense de Seguro Social.\n\nc) Cuerpo de Bomberos del Instituto Nacional de\nSeguros.\n\nd) Ministerio de Seguridad Pública.\n\ne) Dirección General de Tránsito del Ministerio\nde Obras Públicas y Transportes.\n\nf) Organismo de Investigación Judicial de la\nCorte Suprema de Justicia.\n\ng) Instituto Costarricense de Electricidad.\n\nh) Cruz Roja Costarricense.\n\ni. Instituto Nacional de las Mujeres.\n\n(Así adicionado el inciso anterior por el artículo 3° de la\nley N° 10158 del 8 de marzo del 2022 \"Consolidación del Centro Operativo\nde atención a la Violencia Intrafamiliar y la Violencia contra las Mujeres\n(COAVIFMU) y declaratoria de los servicios de atención de la violencia contra\nlas mujeres como servicio esencial\")\n\nEl representante del Instituto Costarricense de\nElectricidad presidirá la Comisión, que funcionará según lo establecido en el\nCapítulo III del Título II de la Ley General de la Administración Pública. Sus\nmiembros no devengarán dietas.\n\nA juicio de la Comisión Coordinadora, podrán\nincorporarse y brindarle sus servicios, con las responsabilidades y\nprerrogativas que establezca el reglamento de esta ley, instituciones y\norganismos que posean o administren instalaciones o sistemas, cuyo\nfuncionamiento integrado al Sistema de Emergencias 9-1-1 se considere de\nutilidad para solventar emergencias.\n\n(Así reformado por el\nartículo único de la ley Nº 7663 de 21 de marzo de 1997)\n\n Ficha articulo\n\n ARTICULO 5.- Atribuciones de la Comisión\n\n Son atribuciones de la Comisión Coordinadora:\n\n a) Dictar las políticas de organización, establecer las áreas de\n\n cobertura y fijar los sistemas de trabajo y coordinación que\n\n deberán cumplir las instituciones y organizaciones integradas al\n\n Sistema de Emergencias 9-1-1.\n\n b) Coordinar con el Ministerio de Educación Pública para que incluya\n\n una unidad anual de aprendizaje sobre el uso y la importancia del\n\n Sistema.\n\n c) Propiciar, con los medios de comunicación colectiva, la\n\n realización de campañas sobre el uso del Sistema.\n\n d) Dictar los procedimientos y trámites necesarios y supervisarlos,\n\n para que el Sistema y los departamentos especializados de cada\n\n institución u organización integrante cooperen, con calidad y\n\n eficiencia, a atender las emergencias.\n\n e) Ejercer las demás funciones, facultades y deberes que le\n\n correspondan de acuerdo con las leyes.\n\n Ficha articulo\n\n ARTICULO 6.- Unidades de apoyo\n\n Créase, en cada institución integrante de la Comisión Coordinadora,\n\nuna unidad especializada de apoyo al Sistema de Emergencias 9-1-1. Las\n\nfunciones de estas unidades constituirán actividades ordinarias de la\n\ninstitución y su objetivo será atender, inmediata y eficientemente, las\n\nemergencias que se le reporten, conforme a las directrices emanadas por\n\nla Comisión Coordinadora.\n\n Ficha articulo\n\nArtículo 7- Tasa de financiamiento. Para garantizar una\noportuna y eficiente atención en las situaciones de emergencia para la vida, la\nlibertad, la integridad y la seguridad de los abonados y los usuarios de los servicios\nde telecomunicaciones disponibles al público, los costos que demande el Sistema\nde Emergencias 9-1-1 se financiarán con una tasa de un cero coma setenta y\ncinco por ciento (0,75%) sobre la facturación mensual de los ingresos totales\npor servicios de telecomunicaciones disponibles al público, entendidos estos\ncomo los ingresos de los servicios de telefonía móvil, telefonía tradicional,\ntelefonía VolP, internet (fijo y móvil) y líneas\ndedicadas, así como el desarrollo y el mejoramiento de las comunicaciones con\nlas instituciones adscritas al Sistema.\n\n(Así reformado el\npárrafo anterior por el artículo único de la ley N° 9629 del 19 de noviembre\ndel 2018)\n\nLos contribuyentes de esta tasa son los abonados y los usuarios de los\nservicios de telecomunicaciones disponibles al público, quienes se beneficiarán\ndel servicio y de la garantía de su permanencia y eficiente prestación.\n\nLos proveedores de los servicios de telecomunicaciones disponibles al\npúblico, en su condición de agente de percepción de esta tasa tributaria,\nincluirán en la facturación mensual de todos sus abonados y usuarios el monto\ncorrespondiente.\n\nAsimismo, deberán poner a disposición de la administración del Sistema\nde Emergencias 9-1-1 los fondos facturados a más tardar un mes posterior al\nperiodo de recaudación, mediante la presentación de una declaración jurada del\nperiodo fiscal mensual.\n\nDichos agentes de percepción asumirán responsabilidad solidaria por el\npago de esta tasa, en caso de no haber practicado la percepción efectiva. En\ncaso de mora, se aplicarán los intereses aplicables a deudas tributarias, de\nconformidad con el artículo 57 de la Ley N.° 4755, Código de Normas y\nProcedimientos Tributarios, de 3 de mayo de 1971, y la multa por concepto de\nmorosidad prevista en el artículo 80 bis del Código de Normas y Procedimientos\nTributarios.\n\nEl monto de los mencionados intereses y multas no podrá considerarse,\npor ningún concepto, como costo de operación.\n\nAdemás, el Sistema de Emergencias 9-1-1 se financiará con los aportes\neconómicos de las instituciones integrantes de la Comisión Coordinadora, para\nlo cual quedan autorizadas por esta norma; asimismo, con las transferencias\nglobales contenidas en los presupuestos de la República y las donaciones y\nlegados de cualquier naturaleza, que se reciban para utilizarse en ese Sistema.\n\n(Así\nreformado por el artículo único de la ley N° 9547 del 25 de abril del 2018)\n\n Ficha articulo\n\nArtículo 8- Dirección\n\nEl Sistema funcionará bajo la autoridad de un\ndirector, quien actuará como superior jerárquico y será nombrado por el\nInstituto Costarricense de Electricidad (ICE).\n\nEl director se encargará de ejecutar los\nacuerdos de la Comisión Coordinadora y de nombrar el personal necesario para el\nfuncionamiento y la administración eficiente del Sistema; procurará\nsalvaguardar el nivel de especialización y capacitación del personal.\n\nDictará las resoluciones que correspondan,\nconforme a la ley, al cobro por el uso indebido del Sistema de Emergencias\n9-1-1. Una vez firmes las resoluciones, serán enviadas al departamento de\nfacturación de los operadores de servicios de telecomunicaciones, para que las\nincluya en el recibo mensual correspondiente.\n\n(Así\nreformado por el artículo único de la ley N° 9547 del 25 de abril del 2018)\n\n Ficha articulo\n\n ARTICULO 9.- Prestación de servicios\n\n El Instituto Costarricense de Electricidad prestará el servicio al\n\nSistema, de acuerdo con sus propios reglamentos, en cuanto a sus\n\nresponsabilidades, según el artículo 10 de esta ley.\n\n (Así reformado por el artículo único de la ley Nº 7663 de 21 de\n\nmarzo de 1997)\n\n Ficha articulo\n\nArtículo 10- Responsabilidad de los\nproveedores de los servicios de telecomunicaciones disponibles al público.\n\nSon responsabilidades exclusivas de los\nproveedores de servicios de telecomunicaciones disponibles al público: diseñar,\nadquirir, instalar, mantener, reponer y operar, técnica y administrativamente,\nun sistema de telecomunicaciones ágil, moderno y de alta calidad tecnológica,\nque permita atender y transferir las llamadas, según los requerimientos de los\nusuarios del Sistema.\n\nLos proveedores de servicios de\ntelecomunicaciones disponibles al público, que operen en el país, deberán poner\na disposición los recursos de infraestructura que el Sistema de Emergencias\n9-1-1 requiera para el cumplimiento eficiente y oportuno de sus servicios, en\naspectos que garanticen que las llamadas realizadas por la población deberán\nser recibidas por los centros de atención que el Sistema habilite, y se\nbrindarán los datos de localización del usuario que disponga el acceso al\nservicio.\n\n(Así\nreformado por el artículo único de la ley N° 9547 del 25 de abril del 2018)\n\n Ficha articulo\n\n ARTICULO 11.- Autorización para donar\n\n Autorízase a las instituciones estatales para donar al órgano\n\ncreado, los bienes asignados al servicio actual del Sistema 9-1-1.\n\n (Así reformado por el artículo 2º de la ley No.7740 de 19 de\n\ndiciembre de 1997)\n\n Ficha articulo\n\n ARTICULO 12.- Confidencialidad de la información\n\n Por las características de la información generada al operar el\n\nSistema, los funcionarios de las instituciones involucradas deberán\n\nmanejarla con la confidencialidad necesaria para salvaguardar la\n\nseguridad de los usuarios.\n\n Ficha articulo\n\nArtículo 13- Uso limitado del equipo\n\nEl Sistema de Emergencias 9-1-1 no\npodrá utilizar ningún equipo para intervenir las comunicaciones\nni violar la privacidad de los ciudadanos, excepto si lo usa únicamente\npara identificar el número telefónico o aplicación de la\ncual se llama al Sistema.\n\n(Así\nreformado por el artículo único de la ley N° 9547 del 25 de\nabril del 2018)\n\n Ficha articulo\n\nArtículo\n14- Leyes aplicables\n\nEn cuanto\nal recurso humano exclusivamente, al Sistema de Emergencias 9-1-1 se le\naplicará lo dispuesto en la Ley N.° 8660, Fortalecimiento y Modernización de\nlas Entidades Públicas del Sector Telecomunicaciones, de 8 de agosto de 2008,\ntoda vez que es un órgano adscrito al Instituto Costarricense de Electricidad\n(ICE).\n\n (Así adicionado por el artículo 1º de la ley\nNo.7740 de 19 de diciembre de 1997. Its objective shall be to participate, timely and efficiently, in attending to emergency situations involving the life, liberty, integrity, and security of citizens or cases of danger to their property.\n\nThe level of deconcentration shall be maximum, in accordance with subsection 3) of article 83, Section I, Chapter III, Title III of the Ley General de la Administración Pública, with respect to the competencies that, exclusively, this law assigns to the System.\n\n(Thus amended by the sole article of Law No. 7663 of March 21, 1997)\n\nArticle record\n\nARTICLE 2.- Regulation\n\nThe System has instrumental legal personality (personalidad jurídica instrumental) and its organization and activity shall be regulated by Public Law.\n\nThe exercise of instrumental legal personality shall be used in the acts that the System executes, to comply with the agreements of the Coordinating Commission (Comisión Coordinadora) or to perform the functions that the law assigns to it, in matters of budgetary administration and human resources, training, inter-institutional coordination, emergency management, and others not compatible within the framework of competence of the Instituto Costarricense de Electricidad.\n\nFor these purposes, the Body shall have the power to execute its budgetary allocation, according to its defined service objectives and inter-institutional coordination, and subject to the mandate of the laws that regulate said exercise.\n\n(Thus amended by the sole article of Law No. 7663 of March 21, 1997)\n\nArticle record\n\nARTICLE 3.- Functions.\nThe functions of the 9-1-1 Emergency System are:\n\na) To develop and maintain a system for receiving, attending to, and transferring calls for help made in emergency situations to the corresponding institutions and emergency response bodies (cuerpos de socorro). It shall carry out these tasks through a communication network with a single access base for individuals, which integrates, with the highest technical level and optimal quality, communication channels between organs and entities of the public or private sector.\n\nb) To progressively merge into 9-1-1, as the sole number, all numbers that attend to calls for help in emergency situations.\n\n(Thus amended the previous subsection by the sole article of Law No. 9547 of April 25, 2018)\n\nc) To maintain a permanent training program for the System's officials. For this purpose, it shall enter into cooperation agreements with public or private entities, within the country or abroad.\n\nd) To execute the necessary procedures and formalities, dictated by the Coordinating Commission created in Article 4 of this law, so that reported emergencies are attended to with efficiency and quality.\n\ne) To develop and maintain a system that allows the reception, attention, transfer, and channeling of communications, which by their nature must be attended to by the Operational Center for Attention to Intrafamily Violence and Violence against Women (Centro Operativo de Atención a la Violencia Intrafamiliar y Violencia contra las Mujeres, Coavifmu).\n\nFurthermore, they must provide advice, support, assistance, the necessary links, data and communications equipment, and any other necessary resource required by the Operational Center for Attention to Intrafamily Violence and Violence against Women (Coavifmu) of the Instituto Nacional de las Mujeres, to achieve its operation, objective, and attend to the situations entrusted in Law 7801, Ley del Instituto Nacional de las Mujeres, of April 30, 1998.\n\n(Thus added the previous subsection by Article 4 of Law No. 10158 of March 8, 2022, \"Consolidation of the Operational Center for Attention to Intrafamily Violence and Violence against Women (COAVIFMU) and declaration of attention services for violence against women as an essential service\")\n\nf) In collaboration with the Ministry of Health, it may provide personnel, physical space for location, computer and technological equipment, connectivity, and operational inputs, for the operation of the Psychological Support Dispatch (Despacho de Apoyo Psicológico) of the Ministry of Health, for addressing suicidal ideation or risk of suicidal behavior presented by persons calling the 9-1-1 Emergency line.\n\n(Thus added the previous subsection by Article 1 of the Law to guarantee psychological care for persons with suicidal ideation through the 9-1-1 Emergency System, No. 10725 of May 13, 2025)\n\nArticle record\n\nARTICLE 4.- Coordinating Commission\n\nThe Coordinating Commission of the 9-1-1 Emergency System is hereby constituted, composed of a high-level representative, belonging directly to the unit or organ of each involved institution, and their alternate, when applicable, from each of the following bodies:\n\na) Comisión Nacional de Emergencias.\n\nb) Caja Costarricense de Seguro Social.\n\nc) Cuerpo de Bomberos of the Instituto Nacional de Seguros.\n\nd) Ministry of Public Security.\n\ne) Dirección General de Tránsito of the Ministerio de Obras Públicas y Transportes.\n\nf) Organismo de Investigación Judicial of the Corte Suprema de Justicia.\n\ng) Instituto Costarricense de Electricidad.\n\nh) Cruz Roja Costarricense.\n\ni. Its members shall not receive per diem payments (dietas).\n\nAt the discretion of the Coordinating Commission, institutions and bodies that own or manage installations or systems, whose operation integrated into the 9-1-1 Emergency System is considered useful for resolving emergencies, may be incorporated and provide their services, with the responsibilities and prerogatives established by the regulations of this law.\n\n(Thus amended by the sole article of Law No. 7663 of March 21, 1997)\n\nArticle record\n\nARTICLE 5.- Powers of the Commission\n\nThe powers of the Coordinating Commission are:\n\na) To dictate the organizational policies, establish the coverage areas, and set the work and coordination systems that the institutions and organizations integrated into the 9-1-1 Emergency System must comply with.\n\nb) To coordinate with the Ministry of Public Education so that it includes an annual learning unit on the use and importance of the System.\n\nc) To promote, with the mass media, the implementation of campaigns on the use of the System.\n\nd) To dictate the necessary procedures and formalities and supervise them, so that the System and the specialized departments of each member institution or organization cooperate, with quality and efficiency, to attend to emergencies.\n\ne) To exercise the other functions, powers, and duties that correspond to them in accordance with the laws.\n\nArticle record\n\nARTICLE 6.- Support Units\n\nA specialized support unit for the 9-1-1 Emergency System is hereby created in each institution that is a member of the Coordinating Commission. The functions of these units shall constitute ordinary activities of the institution and their objective shall be to attend, immediately and efficiently, to the emergencies reported to them, in accordance with the guidelines issued by the Coordinating Commission.\n\nArticle record\n\nArticle 7- Financing rate. To guarantee a timely and efficient response in emergency situations involving the life, liberty, integrity, and security of subscribers and users of publicly available telecommunications services, the costs demanded by the 9-1-1 Emergency System shall be financed with a rate of zero point seventy-five percent (0.75%) on the monthly billing of the total income from publicly available telecommunications services, understood as the income from mobile telephony services, traditional telephony, VoIP telephony, internet (fixed and mobile), and dedicated lines, as well as the development and improvement of communications with the institutions attached to the System.\n\n(Thus amended the previous paragraph by the sole article of Law No. 9629 of November 19, 2018)\n\nThe taxpayers of this rate are the subscribers and users of the publicly available telecommunications services, who will benefit from the service and the guarantee of its permanence and efficient provision.\n\nThe providers of publicly available telecommunications services, in their capacity as withholding agent (agente de percepción) of this tax rate, shall include the corresponding amount in the monthly billing of all their subscribers and users.\n\nLikewise, they must make the billed funds available to the administration of the 9-1-1 Emergency System no later than one month after the collection period, by filing a sworn statement for the monthly fiscal period.\n\nSaid withholding agents shall assume joint and several liability (responsabilidad solidaria) for the payment of this rate, in the event of not having made the effective withholding. In case of default, the interest applicable to tax debts shall be applied, in accordance with Article 57 of Law No. 4755, Código de Normas y Procedimientos Tributarios, of May 3, 1971, and the fine for default provided in Article 80 bis of the Código de Normas y Procedimientos Tributarios.\n\nThe amount of the mentioned interest and fines may not be considered, under any concept, as an operating cost.\n\nIn addition, the 9-1-1 Emergency System shall be financed with the economic contributions of the member institutions of the Coordinating Commission, for which they are hereby authorized by this rule; likewise, with the global transfers contained in the Republic's budgets and the donations and bequests of any nature, received for use in that System.\n\n(Thus amended by the sole article of Law No. 9547 of April 25, 2018)\n\nArticle record\n\nArticle 8- Directorate\n\nThe System shall function under the authority of a director, who shall act as the hierarchical superior and shall be appointed by the Instituto Costarricense de Electricidad (ICE).\n\nThe director shall be responsible for executing the agreements of the Coordinating Commission and appointing the necessary personnel for the operation and efficient administration of the System; they shall endeavor to safeguard the level of specialization and training of the personnel.\n\nThey shall issue the corresponding resolutions, in accordance with the law, for the charge for the improper use of the 9-1-1 Emergency System. Once the resolutions are final, they shall be sent to the billing department of the telecommunications service operators, so that they are included in the corresponding monthly receipt.\n\n(Thus amended by the sole article of Law No. 9547 of April 25, 2018)\n\nArticle record\n\nARTICLE 9.- Provision of services\n\nThe Instituto Costarricense de Electricidad shall provide the service to the System, in accordance with its own regulations, regarding its responsibilities, pursuant to Article 10 of this law.\n\n(Thus amended by the sole article of Law No. 7663 of March 21, 1997)\n\nArticle record\n\nArticle 10- Responsibility of providers of publicly available telecommunications services.\n\nThe exclusive responsibilities of the providers of publicly available telecommunications services are: to design, acquire, install, maintain, replace, and operate, technically and administratively, an agile, modern, and high-quality telecommunications system, that allows receiving and transferring calls, according to the requirements of the System's users.\n\nThe providers of publicly available telecommunications services, operating in the country, must make available the infrastructure resources that the 9-1-1 Emergency System requires for the efficient and timely fulfillment of its services, in aspects that guarantee that calls made by the population must be received by the call centers (centros de atención) that the System enables, and the location data of the user accessing the service shall be provided.\n\n(Thus amended by the sole article of Law No. 9547 of April 25, 2018)\n\nArticle record\n\nARTICLE 11.- Authorization to donate\n\nState institutions are hereby authorized to donate to the created organ the goods assigned to the current service of the 9-1-1 System.\n\n(Thus amended by Article 2 of Law No. 7740 of December 19, 1997)\n\nArticle record\n\nARTICLE 12.- Confidentiality of information\n\nDue to the characteristics of the information generated when operating the System, the officials of the involved institutions must handle it with the confidentiality necessary to safeguard the security of the users.\n\nArticle record\n\nArticle 13- Limited use of equipment\n\nThe 9-1-1 Emergency System may not use any equipment to intercept communications or violate the privacy of citizens, except if used solely to identify the telephone number or application from which the System is called.\n\n(Thus amended by the sole article of Law No. 9547 of April 25, 2018)\n\nArticle record\n\nArticle 14- Applicable laws\n\nRegarding human resources exclusively, the provisions of Law No. 8660, Fortalecimiento y Modernización de las Entidades Públicas del Sector Telecomunicaciones, of August 8, 2008, shall apply to the 9-1-1 Emergency System, given that it is an organ attached to the Instituto Costarricense de Electricidad (ICE).\n\n(Thus added by Article 1 of Law No. 7740 of December 19, 1997. The fine shall be applied to the holder of the telecommunications service, in their condition as directly responsible for the good use of the service they have requested.\n\nExcluded from the application of the previously prescribed fines are improper calls or reports made by persons with mental disabilities, regardless of their age.\n\n(Thus added by Article 1 of Law No. 7949 of November 30, 1999)\n\n(Thus amended by the sole article of Law No. 9547 of April 25, 2018)\n\nArticle record\n\nArticle 18.- Due process and evidence\n\nBefore issuing the resolution that sets the fine for the improper use of the 9-1-1 Emergency System, the directing body of the procedure shall grant a hearing to the holder of the telephone service, for a term of five business days, so that they may formulate their arguments and present their exculpatory evidence. After said period has elapsed, the matter shall be ready for the final act to be issued, which the competent body must do within the non-extendable period of three business days.
