ejecutivo N° 37307 del 16 de julio del 2012)\n\n EL PRESIDENTE DE LA REPUBLICA\n\n Y EL MINISTRO DE AMBIENTE Y ENERGIA,\n\n     En uso de la facultades conferidas por los incisos 3) y 18) del\nartículo 140 de la Constitución Política, el artículo 25.1 de la Ley\nGeneral de la Administración Pública, la Ley Orgánica del Ambiente Nº\n7554, el artículo 15 de la Ley de Conservación de la Vida Silvestre Nº\n7317 y el artículo 1º de la Ley de Creación del Servicio de Parques\nNacionales Nº 6084.\n\n Considerando:\n\n     1º.- Que a efecto de dar fiel cumplimiento al deber de proteger los recursos sobre los que la\nlegislación nacional le ha dado competencia al Ministerio del Ambiente y Energía, es menester\nreforzar la actividad de control que sobre ellos debe ejercerse.\n\n     2º.- Que para tal fin, además de los funcionarios públicos regularmente asignados a ese\nquehacer, la Administración requiere de la desinteresada cooperación de aquellos particulares\ninteresados en coadyuvar en la protección de dichos recursos.\n\n     3º.- Que la actividad turística es realizada principalmente en las áreas protegidas y por lo\ntanto es necesario que el Estado se asegure de que aquellos particulares que se dedican a la\npromoción turística brinden el mejor servicio a los turistas, al mismo tiempo que procuren la\nprotección y vigilancia de los recursos naturales del área.\n\n     4º.- Que es necesario que el Ministerio del Ambiente y Energía lleve un Registro de Guías\nTurísticos especializados en Recursos Naturales y Areas de Conservación, que le permita a los\nturistas identificar con facilidad a aquellos guías que han sido evaluados y acreditados por el\nMinisterio del Ambiente y Energía. Por tanto,\n\n Decretan:\n\n El siguiente,\n\n REGLAMENTO PARA EL REGISTRO DE GUIAS TURISTICOS\n\n ESPECIALIZADOS EN RECURSOS NATURALES Y AREAS DE\n\n CONSERVACION\n\n        \nArtículo 1º.- Créase el Registro de Guías Turísticos especializados en\nRecursos Naturales y Areas de Conservación.\n\n Artículo 2º.- El guía turístico especializado en Recursos Naturales y\n\nAreas de Conservación, es aquella persona que desarrolla como función\n\nprincipal la de mostrarles a los turistas las riquezas naturales de las\n\náreas de conservación, acompañándolas y velando por su bienestar.\n\n Artículo 3º.- Son también funciones de los guías turísticos:\n\n a)Vigilar y proteger a los turistas de posibles abusos en cuanto a\n\n cobros, excesivos o cualquier otro derivado de su desconocimiento de\n\n las leyes y costumbres del país.\n\n b)Suministrarles información sobre el funcionamiento de los medios de\n\n transportes, servicios turísticos, realidad social y económica de la\n\n zona, tipo de cambio, espectáculos públicos, condiciones climáticas,\n\n sanitarias, medios de alojamiento y de otros asuntos de interés en\n\n forma precisa y veraz.\n\n c)Indicar a los turistas la dirección de los principales Centros\n\n Hospitalarios y de los profesionales médicos en general. Tener\n\n nociones de primeros auxilios para casos de emergencia.\n\n d)Rendir testimonio ante las autoridades que corresponda de los abusos\n\n de que puedan ser objeto los turistas.\n\n Artículo 4º.- Además de las funciones señaladas, los guías turísticos\n\nserán inspectores ad-honorem en la protección y vigilancia de los\n\nrecursos del área.\n\n Artículo 5º.- Previa convocatoria por parte del Ministerio del\n\nAmbiente y Energía, los interesados en formar parte de este Registro\n\ndeberán presentar ante las oficinas del Sistema Nacional de Areas de\n\nConservación del Ministerio o en las oficinas de las distintas áreas de\n\nconservación:\n\n a)Formulario de solicitud que al efecto facilitará el Ministerio del\n\n Ambiente y Energía, aportando todos los datos y atestados que se\n\n soliciten.\n\n b)Copia de la cédula de identidad o cédula de residencia vigente.\n\n c)Curriculum vitae donde se especifiquen entre otras cosas el grado\n\n académico y la experiencia que se posee en el campo del turismo,\n\n acompañado de las constancias respectivas para probarlo (copias para\n\n los respectivos títulos, cartas de recomendación, cursos, etc.)\n\n d)Ser persona de buena conducta, para lo cual el Registro Judicial de\n\n Delincuencia extenderá una certificación de sus antecedentes, a\n\n solicitud del Ministerio del Ambiente y Energía.\n\n Artículo 6º.- El Ministerio nombrará una comisión para revisar los\n\natestados y recomendar al Ministro la categoría o categorías que se deben\n\nacreditar al guía. La comisión cuenta con un plazo máximo de 30 días\n\nnaturales para hacer la recomendación.\n\n Articulo 7º.- Existirán cinco categorías de guías: principiantes,\n\nintermedios, avanzados, expertos y guías prácticos, los cuales serán\n\nidentificados mediante insignias que sólo podrán ser usadas por quien\n\nposee el respectivo grado.\n\n Cada guía puede optar además, por el uso de la insignia de cada parque\n\no área protegida.\n\n Artículo 8º.- Las categorías se determinarán siguiendo como mínimo los\n\nsiguientes lineamientos básicos:\n\nGuía de Campo o Baquiano.Aquella persona que demuestre conocimientos\n\n ecológicos, históricos y específicos del área al\n\n que aplique.\n\nPrincipiante.Al menos con el grado de Bachiller de Colegio.\n\nIntermedio.Al menos dos años de carrera, de turismo, Biología, Historia,\n\n Geología y dominio básico de un idioma extranjero.\n\nAvanzado. Grado mínimo de Licenciado en cualquiera de las áreas Biología,\n\n Geología, Historia o Turismo. Dominio de un idioma extranjero.\n\nExperto. Grado mínimo de Licenciado en cualquiera de las áreas Biología,\n\n Geología, Historia o Turismo y que demuestre conocimientos de\n\n otras dos áreas, así como dominio de por lo menos dos idiomas,\n\n además de la lengua materna.\n\n Artículo 9º.- Los guías turísticos una vez que sean evaluados y para\n\npoder ingresar y permanecer inscritos en el Registro de Guías Turísticos\n\nespecializados en Recursos Naturales y Areas de Conservación, deberán\n\ncancelar anualmente, en las oficinas del Ministerio del Ambiente y\n\nEnergía y a favor del Fondo de Parques, la suma de ¢ 10.000,00 (diez mil\n\ncolones) por concepto de derechos de licencia y certificación. Dicho\n\nmonto tendrá un incremento anual de conformidad con el índice\n\ninflacionario establecido por el Banco Central, correspondiente al año\n\nanterior.\n\n Artículo 10.- El Ministerio divulgará entre los turistas nacionales y\n\nextranjeros mediante un panfleto el significado de las insignias que\n\nportan los guías.\n\n Articulo 11.- Se consideran infracciones graves cometidas por los\n\nguías, las siguientes:\n\n a)Agraviar públicamente a un turista, de palabra o de hecho.\n\n b)Asumir actitudes reñidas con las leyes vigentes, la moral y las\n\n buenas costumbres o inducir al turista a hacerlo.\n\n c)Cobrar en exceso al turista por sus servicios en relación con las\n\n tarifas que se establezcan así como permitir o inducir a terceros al\n\n cobrarle en exceso por objetos o servicios.\n\n d)Ejercer sus funciones, o pretender ejercerlas, bajo el influjo de\n\n bebidas alcohólicas, drogas o estimulantes.\n\n e)Emitir conceptos dañinos o negativos contra el país, sus habitantes o\n\n sus instituciones. San José, a las nueve horas\n\ndel día veintidós de abril de mil novecientos noventa y seis.\n\n.e", "body_en_text": "in the entirety of the text\n\n -\n\nFull Text of Regulation 25165\n\n Regulation for the Register of Tourist Guides Specialized in Natural Resources\n\nFull Text of record: EA328\n\n1\n\n No. 25165-MINAE\n\n(This decree was repealed by Article 1 of Executive Decree No. 37307 of July 16, 2012)\n\n THE PRESIDENT OF THE REPUBLIC\n\n AND THE MINISTER OF ENVIRONMENT AND ENERGY,\n\n In use of the powers conferred by subsections 3) and 18) of Article 140 of the Political Constitution, Article 25.1 of the General Public Administration Law, the Organic Environmental Law No. 7554, Article 15 of the Wildlife Conservation Law No. 7317, and Article 1 of the Law Creating the National Parks Service No. 6084.\n\n Considering:\n\n 1st.- That in order to faithfully fulfill the duty to protect the resources over which national legislation has granted competence to the Ministry of Environment and Energy, it is necessary to reinforce the control activity that must be exercised over them.\n\n 2nd.- That for this purpose, in addition to the public officials regularly assigned to that task, the Administration requires the disinterested cooperation of those private individuals interested in assisting in the protection of said resources.\n\n 3rd.- That tourist activity is carried out mainly in protected areas (áreas protegidas) and therefore it is necessary for the State to ensure that those private individuals engaged in tourism promotion provide the best service to tourists, while at the same time ensuring the protection and surveillance of the natural resources of the area.\n\n 4th.- That it is necessary for the Ministry of Environment and Energy to maintain a Register of Tourist Guides specialized in Natural Resources and Conservation Areas (Áreas de Conservación), which allows tourists to easily identify those guides who have been evaluated and accredited by the Ministry of Environment and Energy. Therefore,\n\n Decree:\n\n The following,\n\n REGULATION FOR THE REGISTER OF TOURIST GUIDES\n\n SPECIALIZED IN NATURAL RESOURCES AND\n\n CONSERVATION AREAS\n\nArticle 1.- The Register of Tourist Guides specialized in Natural Resources and Conservation Areas is hereby created.\n\n Article 2.- The tourist guide specialized in Natural Resources and Conservation Areas is that person whose main function is to show tourists the natural riches of the conservation areas, accompanying them and ensuring their well-being.\n\n Article 3.- The functions of tourist guides also include:\n\n a) Monitoring and protecting tourists from possible abuses regarding excessive charges, or any other derived from their lack of knowledge of the country's laws and customs.\n\n b) Providing them with information about the operation of transportation methods, tourist services, the social and economic reality of the area, the exchange rate, public shows, climatic and sanitary conditions, lodging options, and other matters of interest in a precise and truthful manner.\n\n c) Informing tourists of the location of the main Hospital Centers and medical professionals in general. Having knowledge of first aid for emergency cases.\n\n d) Providing testimony before the corresponding authorities of the abuses to which tourists may be subjected.\n\n Article 4.- In addition to the functions mentioned, tourist guides shall be honorary (ad-honorem) inspectors in the protection and surveillance of the area's resources.\n\n Article 5.- Upon a call by the Ministry of Environment and Energy, those interested in becoming part of this Register must submit to the offices of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) of the Ministry or to the offices of the different conservation areas:\n\n a) The application form that the Ministry of Environment and Energy will provide for this purpose, supplying all the data and credentials requested.\n\n b) A copy of the national identity card (cédula de identidad) or valid residency card (cédula de residencia).\n\n c) A curriculum vitae specifying, among other things, the academic degree and experience held in the field of tourism, accompanied by the respective supporting documents to prove it (copies of the respective degrees, letters of recommendation, courses, etc.)\n\n d) Being a person of good conduct, for which the Judicial Registry of Delinquency will issue a certification of their background, at the request of the Ministry of Environment and Energy.\n\n Article 6.- The Ministry shall appoint a commission to review the credentials and recommend to the Minister the category or categories that should be accredited to the guide. The commission has a maximum period of 30 calendar days to make the recommendation.\n\n Article 7.- There shall be five categories of guides: beginners (principiantes), intermediate (intermedios), advanced (avanzados), expert (expertos), and practical guides (guías prácticos), which will be identified by insignia that may only be used by the person holding the respective rank.\n\n Each guide may also opt to use the insignia of each park or protected area.\n\n Article 8.- Categories will be determined following at least these basic guidelines:\n\nField Guide or Baquiano (Guía de Campo o Baquiano). A person who demonstrates ecological, historical, and specific knowledge of the area to which they apply.\n\nBeginner (Principiante). At least with a High School Diploma (Bachiller de Colegio).\n\nIntermediate (Intermedio). At least two years of a degree program in Tourism, Biology, History, Geology, and basic command of a foreign language.\n\nAdvanced (Avanzado). A minimum degree of Licentiate (Licenciado) in any of the areas of Biology, Geology, History, or Tourism. Command of one foreign language.\n\nExpert (Experto). A minimum degree of Licentiate in any of the areas of Biology, Geology, History, or Tourism, and who demonstrates knowledge of two other areas, as well as a command of at least two languages, in addition to their mother tongue.\n\n Article 9.- Once evaluated, and in order to be able to enter and remain registered in the Register of Tourist Guides specialized in Natural Resources and Conservation Areas, tourist guides must pay annually, at the offices of the Ministry of Environment and Energy and in favor of the Parks Fund (Fondo de Parques), the sum of ¢10,000.00 (ten thousand colones) for licensing and certification fee (derechos de licencia y certificación) purposes. In the event that the Ministry receives a complaint in this regard, an administrative investigation will be opened, and if the complaint is verified, the person will lose their credential as a guide specialized in natural resources and conservation areas, and the Costa Rican Tourism Institute (Instituto Costarricense de Turismo) will be immediately notified to proceed accordingly.\n\n Article 12.- In order for the guide to carry out their work within a natural area, they must carry identification; otherwise, they will be considered just another tourist and must pay the entrance fee.\n\n Article 13.- This regulation shall take effect upon its publication.\n\n Issued at the Presidency of the Republic.
