La contratación de\nservicios profesionales podrá realizarse conforme se incremente el volumen de\ntrabajo o la especialidad del proyecto a evaluar.\n\nArticulo\n4°-Con el fin de facilitar al comité la realización de sus funciones, se le\nautoriza para gestionar por medio del Ministerio del Ambiente y Energía, el\napoyo de organizaciones nacionales e internacionales.\n\nArtículo\n5°-Rige a partir de su publicación.\n\nDado\nen\n\nla Presidencia\n de\n\nla República.-San\n José, a los dieciocho del mes de agosto del dos mil.", "body_en_text": "en la totalidad del texto\n\n -\n\n Full Text of Regulation 28932\n\n Creates the Executive Steering Committee for the Development of Productive Projects of the\nArenal Conservation Area\n\nNo.\n28932- MINAE\n\nTHE\nPRESIDENT OF\n\nTHE REPUBLIC\n\nAND\n\nTHE MINISTER OF\n ENVIRONMENT AND ENERGY\n\nIn\nuse of the powers conferred by subsections 3) and 18) of Article 140 of\n\nthe Political Constitution.\n\nConsidering:\n\n1°-That\nin accordance with\n\nthe Biodiversity Law, the country is divided into various Conservation Areas, which\nare responsible for the administration and management of protected wilderness areas\nand of forest and wildlife resources.\n\n2°-That\nthe Conservation Areas make up the National System of Conservation Areas, with the purpose of giving unity and coherence to the development\nof national policies and strategies on this matter.\n\n3°-That\nin accordance with\nthe Organic Law of the Environment and\nthe Biodiversity Law, the Ministry of Environment and Energy must seek the greatest\nparticipation of civil society in the development of these policies and\nstrategies, with the purpose of involving them in sustainable development processes.\n\n4°-That\nthe Arenal Conservation and Development Project, supported financially and technically\nby the Canadian International\nDevelopment Agency,\nexecuted a series of small ecologically viable demonstration productive projects\nwith low-income groups, in order to incorporate them into the national economy.\n\n5°-That\nthe Joint Management of the Arenal Conservation and Development Project and the Project Steering Committee (COP) at their regular meeting\nof June 29, 1999, approved the proposal\n\"Alternative for the Transfer of Responsibilities and Resources Related\nto the Credit Portfolio and Non-Refundable Fund for Small Productive Projects of the\nArenal Conservation and Development Project Stages I and II\" and authorized the\nformation of a committee called \"Committee for the Development of Small\nProductive Projects of the Arenal Conservation Area\", for the\nensurance of the continuity of the Environmental and Socio-productive Initiatives\nfor follow-up according to the Strategic Plan and Work Plans approved by the COP.\n\n6°-That\nthe primary objective of the formed Committee will be to promote the sustainable use and management\nof the Natural Resources of the ACA, having as its main function\nthe management and administration of the Trust \"Credit Portfolio and Non-Refundable\nFund for Small Productive Projects of the Arenal Conservation and Development Project\nStages I and II\". Therefore,\n\nTHEY DECREE:\n\nArticle\n1°-To create the Executive Steering Committee for the Development of Small\nProductive Projects of the Arenal Conservation Area in accordance with the\nprovisions of subsection 7), paragraph 3 of Article 116 of the Organic Law\n of the National Banking System, which will have the purpose of ensuring the\ncontinuity of the Environmental and Socio-productive Initiatives according to\nthe Strategic Plan and Work Plans approved by the COP.\n\nArticle\n2°-This committee shall be responsible for the management and administration of the\nTrust called \"Credit Portfolio and Non-Refundable Fund for Small\nProductive Projects of the Arenal Conservation and Development Project Stages I\nand II\".\n\nArticle\n3°-This committee shall meet in ordinary session once a month, and\nextraordinarily when required. It shall be composed of a representative\nfrom each of the following organizations: ACA-MINAE, Foundation for the\nDevelopment of Tenorio and Miravalles, Cooperative of Coffee Growers and Multiple Services\nof Dos de Tilarán, R. L., Café Forestal Foundation, Training and\nExperimentation Center for Sustainable Rural Development, Aranjuez Agroecological\nAssociation, Arenal Volcano Regional Association for Agroecological Development and Conservation. The indicated organizations must designate their\nrepresentative within fifteen days following the effective date of this\nDecree, otherwise the Management\n of the Arenal Conservation Area shall be responsible for proceeding with the designation. The designated\npersons shall elect every two years the president, treasurer, and secretary of the\nCommittee, and in general, the members shall only be replaced or removed\nfrom their positions by a justified decision of the committee in plenary. The Executive Steering\nCommittee shall be governed by the provisions of the Trust Agreement entered into\nbetween The Binational Committee of the Costa Rica-Canada Debt Swap Fund and INTERFIN\nS. A. Bank and must submit programs, plans, projects, and quarterly reports to the Binational Committee.\n\nThe\nExecutive Steering Committee shall be assisted, to expedite and facilitate the entrusted mandate,\nby an Executive Secretariat, whose function shall be to receive financing requests, recommend or not their approval, and provide technical-financial follow-up\nto the projects approved by the committee. Due to the advisory and auxiliary nature\nof the committee, the latter may contract the professional services it deems necessary and suitable\nfor the purpose of operating the Executive Secretariat.\n The term of the appointment shall be subject to the will of the parties and shall be incorporated into the\nprofessional services contract. The contracting of professional services may be carried out as the volume\nof work or the specialty of the project to be evaluated increases.\n\nArticle\n4°-In order to facilitate the committee's performance of its functions, it\nis authorized to manage, through the Ministry of Environment and Energy, the\nsupport of national and international organizations.\n\nArticle\n5°-Effective upon its publication.\n\nIssued\nin the Presidency\n of the Republic.-San\n José, on the eighteenth day of August of the year two thousand." }
