Ratifica Comisión\nNacional sobre Incendios Forestales (CONIFOR) como instancia adscrita al MINAE\")\n\n EL PRESIDENTE DE LA REPUBLICA Y \n\n LA MINISTRA DEL AMBIENTE Y ENERGIA\n\n       \nEn uso de las facultades conferidas en los incisos 3), y 18) del articulo 140 de la\nConstitucion Politica.\n\n Considerando:\n\n       \n1-Que es deber del estado velar por la proteccion de los recursos naturales y\nestablecer las medidas preventivas que correspondan para evitar el deterioro de los\nmismos.\n\n        \n2-Que los incendios forestales provocan al pais cuantiosas perdidas e irreparables daños\nen sus recursos forestales, agricolas, suelo, aire, agua, belleza esc‚nica y en la\ncalidad de vida de sus habitantes.\n\n       \n3-Que el articulo 35 de la Ley Forestal N° 7575, señala que le corresponde a la\nAdministracion Forestal del Estado, por medio del Sistema Nacional de areas de Conservacion\n(SINAC), ordenar y encauzar las acciones tendientes a prevenir y extinguir los incendios\nforestales.\n\n       \n4-Que el citado art¡culo de la Ley Forestal declara de interes publico todas las\nacciones que se emprendan, siendo ‚stas medidas vinculantes para todas las\nautoridades del pais.\n\n        \n5-Que estas acciones requieren de una estrecha coordinacion y apoyo conjunto entre\ndiferentes instituciones, organizaciones publicas y privadas, asi como de la sociedad\ncivil; mediante una instancia operativa encargada de definir y orientar los lineamientos\nnacionales en materia de Manejo del Fuego.\n\n       \n6-Que el pais desde 1997 cuenta con una Estrategia Nacional de Manejo del Fuego,\nactualizada en el año 2000, y en la cual se definen los lineamientos generales para\nestablecer un Plan Nacional de Manejo del Fuego para el quinquenio 2000- 2005, que permita\nenfrentar de manera permanente la problematica de los incendios forestales y agricolas.\n\n       \nPor tanto, Decretan:\n\n       \nArticulo 1-Declarese la Estrategia Nacional Manejo del Fuego en Costa Rica 2000-2005,\ncomo el instrumento oficial de planificacion, control y seguimiento en esta materia, y en\nla que se establecen las directrices y lineamientos a desarrollar en el pais.\n\nArticulo 2-Crease la Comision Nacional sobre Incendios Forestales (CONIFOR), como una\ninstancia adscrita al Sistema Nacional de µreas de Conservacion (SINAC) y a la cual le\ncorresponde la formulacion, gestion, apoyo y seguimiento de las acciones\ninterinstitucionales definidas en la Estrategia Nacional y el Plan Nacional de Manejo del\nFuego.\n\nArticulo 3-La Comision Nacional sobre Incendios Forestales estar  integrada por\nlos siguientes miembros:\n\n       \na. Un representante del Sistema Nacional de areas de Conservacion del Ministerio del\nAmbiente y Energia, siendo este el coordinador de dicha Comision y al cual se le\nreconocer  como Coordinador Nacional de Manejo del Fuego.\n\n       \nb. Un representante del Instituto Nacional de Seguros, quien desempeñar  la\nsecretaria ejecutiva.\n\n        \nc. Un representante del Ministerio de Agricultura y Ganaderia.\n\n        \nd. Un representante del Ministerio de Educacion Publica.\n\n        \ne. Un representante de la Comision Nacional de Prevencion de Riesgos y Atencion de\nEmergencias.\n\n       \nf. Un representante del Ministerio de Seguridad Publica.\n\n       \ng. Un representante del Instituto de Desarrollo Agrario.\n\n        \nh. Un representante del Instituto Costarricense de Electricidad.\n\n       \ni. Un representante del Instituto Costarricense de Acueductos y Alcantarillados.\n\n       \nj. Un representante del Instituto Meteorologico Nacional.\n\n        \nk. Un representante de la Asociacion de Voluntarios para el Servicio en las areas\nProtegidas.\n\nArticulo 4-Las funciones de la CONIFOR seran las siguientes:\n\n       \na. Fomentar el desarrollo de programas institucionales sobre manejo del fuego.\n\n        \nb. Definir el rol y responsabilidades de cada una de las instituciones y\norganizaciones que integran la comision.\n\n        \nc. Establecer mecanismos de coordinacion para aunar esfuerzos en la consecucion de\nrecursos para el desarrollo de acciones sobre prevencion y control de incendios forestales\ny agricolas.\n\n       \nd. Fortalecer acciones que permitan la incorporacion y participacion de la sociedad\ncivil.\n\n        \ne. Brindar apoyo y seguimiento, en materia de prevencion y atencion de emergencias, a\nlas acciones que realicen las comisiones regionales o locales existentes, o a las que para\ntales efectos establezcan el Ministerio del Ambiente y Energ¡a, debiendo incorporar a los\ngobiernos locales en estas comisiones.\n\n        \nf. Aprobar anualmente el Plan Nacional de Manejo del Fuego.\n\n        \ng. Establecer un reglamento interno de funcionamiento. Para efectos de cumplir con sus\nfunciones, la CONIFOR se reunir  al menos una vez al mes y podra  ser convocada\npor el Coordinador Nacional o por la Secretaria de dicha Comision.\n\nArticulo 5-Para los fines tecnicos y administrativos que corresponda, seran funciones\ndel Coordinador Nacional de Manejo del Fuego las siguientes:\n\n       \na. Coordinar la Comision Nacional y el Comite Tecnico Nacional sobre Incendios\nForestales.\n\n        \nb. Gestionar la ejecucion y seguimiento de la Estrategia Nacional Manejo del Fuego en\nCosta Rica.\n\n       \nc. Establecer lineamientos metodologicos para la elaboracion y supervision de los\nPlanes Anuales de Trabajo, en cumplimiento al Plan Nacional de Manejo del Fuego.\n\n        \nd. Apoyar, fortalecer y asesorar la gestion tecnica y toma de decisiones de la Comision\nNacional sobre Incendios Forestales, de la Direccion General del SINAC y de las\nautoridades superiores.\n\n       \ne. Brindar apoyo, seguimiento y supervision a las acciones que realicen las comisiones\nregionales y locales, asi como las areas de Conservacion, sobre la ejecucion y\ncumplimiento de los planes anuales y del Plan Nacional.\n\n       \nf. Apoyar, supervisar, relevar y transferir la toma de decisiones en la atencion de\nincendios forestales, segun los niveles respectivos y a los funcionarios que corresponda.\n\n        \ng. Fomentar el desarrollo de programas instituciones sobre manejo del fuego.\n\n       \nh. Coordinar la gestion de recursos naciones e internaciones.\n\n       \ni. Definir y apoyar las acciones que permitan la incorporacion y participacion de la\nsociedad civil.\n\n        \nj. Evaluar y proponer lineamiento para la creacion y organizacion de las brigadas\ncontra incendios.\n\n       \nk. Coordinar el desarrollo de un sistema nacional de informacion sobre incendios.\n\n       \nl. Promover campañas interinstitucionales sobre manejo del fuego.\n\n        \nm. Representar al pais en las comisiones o comites, nacionales e internacionales sobre\nincendios forestales.\n\nArticulo 6-Para el cumplimiento de las funciones, el SINAC y la CONIFOR tendran como\npol¡ticas principales las siguientes:\n\n       \na. Las acciones que se establezcan para atender la problematica de los incendios\nforestales y agricolas, se desarrollar n en el contexto de manejo del fuego, al\namparo de la estructura nacional y dentro del marco del desarrollo sostenible.\n\n       \nb. Busca y promueve la participacion y el compromiso de las instituciones y\norganizaciones, nacionales e internaciones, ademas se reconoce el espacio para la\nintegracion de la sociedad civil por medio del Bombero Forestal.\n\n        \nc. La toma de decisiones en materia de manejo del fuego se fundamentar  en la\ncoordinacion interinstitucional, mediante el conocimiento y la experiencia acumulada con\nrelacion a investigacion, capacitacion, educacion y comunicacion.\n\nArticulo 7-La Comision Nacional sobre Incendios Forestales estar  bajo la direccion\ny coordinacion de la Direccion General del Sistema Nacional de areas de Conservacion, del\nMinisterio del Ambiente y Energ¡a; quien aprobar , apoyar  y supervisar \nlas acciones que en materia de manejo del fuego sea necesario ejecutar.\n\nArticulo 8-Las instituciones publicas, miembros de la Comision Nacional sobre Incendios\nForestales, deberan establecer anualmente, en concordancia con la Estrategia Nacional de\nManejo del Fuego, programas conjuntos orientados a contribuir con la prevencion y el\ncontrol de los incendios forestales y agricolas, minimizar el uso del fuego en los\nterrenos agricolas, dandole seguimiento a las politicas definidas en el articulo 5 de este\ndecreto.\n\nArticulo 9-Los Ministerios, entidades del Estado, Municipalidades y Organismos Privados\nNacionales o Internacionales, podran proporcionar a la Comision Nacional sobre Incendios\nForestales, en la medida de sus posibilidades, el apoyo que esta requiera para el\ncumplimiento de sus funciones.\n\nArticulo 10.-Con el proposito de atender la problem tica de los incendios en forma\nconjunta, se faculta a las instituciones que conforman la Comision Nacional sobre\nIncendios Forestales, para que en la medida de sus posibilidades y sus leyes les\nautoricen, designen los recursos economicos, tecnicos y materiales necesarios, para\ncoordinar, apoyar y ejecutar en conjunto con el Sistema Nacional de areas de Conservacion,\nlos programas preventivos y operativos tendientes a minimizar las causas y los efectos de\nlos incendios forestales.\n\nArticulo 11.-Los requerimientos que dicha Comision Nacional haga a los funcionarios publicos,\nen cuanto a prevencion y control de los incendios forestales, seran de acatamiento\nobligatorio.\n\nArticulo 12.-Para efectos operativos de manejo del fuego, se reconoce y establece la\nfigura del Bombero Forestal, como aquella persona que participa en la prevencion, mitigacion,\ncontrol y liquidacion de fuego, capacitada y entrenada para trabajar en forma segura y\neficiente.\n\nArticulo 13.-Deroguese el Decreto Ejecutivo N° 26399-MINAE, La Gaceta No. 206 de fecha\n27 de octubre de 1997.\n\nArticulo 14.-Rige a partir de su publicacion.\n\n       \nDado en la Presidencia de la República.- San José, a los trece días del mes\nde noviembre del año dos mil.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Standard 29149\n\n Declares the National Strategy for Fire Management in Costa Rica 2000-2005\n\nFull Text of record: EED4F\n\nN 29149-MINAE \n\n (This decree was repealed by article 11 of executive decree N° 33108 of February 7,\n2006, \"Declares the National Strategy for Fire Management in Costa Rica 2006-2010\nand the National Fire Management Plan 2006-2010 as official instruments. Ratifies the National Commission\non Forest Fires (CONIFOR) as an entity attached to MINAE\")\n\n THE PRESIDENT OF THE REPUBLIC AND \n\n THE MINISTER OF ENVIRONMENT AND ENERGY\n\n       \nIn exercise of the powers conferred in subsections 3) and 18) of article 140 of the\nPolitical Constitution.\n\n Considering:\n\n       \n1-That it is the duty of the state to ensure the protection of natural resources and\nto establish the corresponding preventive measures to avoid their deterioration.\n\n        \n2-That forest fires cause the country enormous losses and irreparable damage\nto its forest and agricultural resources, soil, air, water, scenic beauty, and the\nquality of life of its inhabitants.\n\n       \n3-That article 35 of the Forestry Law No. 7575, states that it is the responsibility of the\nState Forest Administration, through the National System of Conservation Areas\n(SINAC), to organize and channel actions aimed at preventing and extinguishing forest\nfires.\n\n       \n4-That the aforementioned article of the Forestry Law declares all actions\nundertaken to be of public interest, these measures being binding for all\nauthorities in the country.\n\n        \n5-That these actions require close coordination and joint support among\ndifferent institutions, public and private organizations, as well as civil\nsociety; through an operational body responsible for defining and guiding the national\nguidelines on Fire Management.\n\n       \n6-That since 1997, the country has had a National Fire Management Strategy,\nupdated in the year 2000, and in which the general guidelines are defined to\nestablish a National Fire Management Plan for the 2000-2005 five-year period, which allows\nfor permanently addressing the problem of forest and agricultural fires.\n\n       \nTherefore, They Decree:\n\n       \nArticle 1.-The National Strategy for Fire Management in Costa Rica 2000-2005 is hereby declared\nas the official instrument for planning, control, and monitoring in this matter, and in\nwhich the policies and guidelines to develop in the country are established.\n\nArticle 2.-The National Commission on Forest Fires (CONIFOR) is hereby created, as an\nentity attached to the National System of Conservation Areas (SINAC) and to which\ncorresponds the formulation, management, support, and monitoring of the inter-institutional\nactions defined in the National Strategy and the National Fire Management Plan.\n\nArticle 3.-The National Commission on Forest Fires shall be composed of\nthe following members:\n\n       \na. A representative of the National System of Conservation Areas of the Ministry of\nEnvironment and Energy, who shall be the coordinator of said Commission and who shall be\nrecognized as the National Fire Management Coordinator.\n\n       \nb. A representative of the National Insurance Institute, who shall serve as the\nexecutive secretary.\n\n        \nc. A representative of the Ministry of Agriculture and Livestock.\n\n        \nd. A representative of the Ministry of Public Education.\n\n        \ne. A representative of the National Commission for Risk Prevention and Emergency\nAttention.\n\n       \nf. A representative of the Ministry of Public Security.\n\n       \ng. A representative of the Institute of Agrarian Development.\n\n        \nh. A representative of the Costa Rican Electricity Institute.\n\n       \ni. A representative of the Costa Rican Institute of Aqueducts and Sewers.\n\n       \nj. A representative of the National Meteorological Institute.\n\n        \nk. A representative of the Association of Volunteers for Service in Protected\nAreas.\n\nArticle 4.-The functions of CONIFOR shall be the following:\n\n       \na. Promote the development of institutional programs on fire management.\n\n        \nb. Define the role and responsibilities of each of the institutions and\norganizations that make up the commission.\n\n        \nc. Establish coordination mechanisms to join efforts in obtaining\nresources for the development of actions on prevention and control of forest\nand agricultural fires.\n\n       \nd. Strengthen actions that allow the incorporation and participation of civil\nsociety.\n\n        \ne. Provide support and follow-up, in matters of emergency prevention and response, to\nthe actions carried out by existing regional or local commissions, or those established\nfor such purposes by the Ministry of Environment and Energy, having to incorporate local\ngovernments into these commissions.\n\n        \nf. Annually approve the National Fire Management Plan.\n\n        \ng. Establish internal operating regulations. For the purpose of fulfilling its\nfunctions, CONIFOR shall meet at least once a month and may be convened\nby the National Coordinator or by the Secretary of said Commission.\n\nArticle 5.-For the corresponding technical and administrative purposes, the functions\nof the National Fire Management Coordinator shall be the following:\n\n       \na. Coordinate the National Commission and the National Technical Committee on Forest\nFires.\n\n        \nb. Manage the execution and monitoring of the National Strategy for Fire Management in\nCosta Rica.\n\n       \nc. Establish methodological guidelines for the preparation and supervision of the\nAnnual Work Plans, in compliance with the National Fire Management Plan.\n\n        \nd. Support, strengthen, and advise the technical management and decision-making of the\nNational Commission on Forest Fires, the General Directorate of SINAC, and the\nhigher authorities.\n\n       \ne. Provide support, follow-up, and supervision to the actions carried out by regional\nand local commissions, as well as the Conservation Areas, on the execution and\nfulfillment of the annual plans and the National Plan.\n\n       \nf. Support, supervise, relieve, and transfer decision-making in the response to\nforest fires, according to the respective levels and to the corresponding officials.\n\n        \ng. Promote the development of institutional programs on fire management.\n\n       \nh. Coordinate the management of national and international resources.\n\n       \ni. Define and support actions that allow the incorporation and participation of civil\nsociety.\n\n        \nj. Evaluate and propose guidelines for the creation and organization of firefighting\nbrigades.\n\n       \nk. Coordinate the development of a national fire information system.\n\n       \nl. Promote inter-institutional campaigns on fire management.\n\n        \nm. Represent the country in national and international commissions or committees on\nforest fires.\n\nArticle 6.-For the fulfillment of the functions, SINAC and CONIFOR shall have as\nmain policies the following:\n\n       \na. The actions established to address the problem of forest\nand agricultural fires shall be developed in the context of fire management, under\nthe protection of the national structure, and within the framework of sustainable development.\n\n       \nb. Seek and promote the participation and commitment of national and international institutions\nand organizations; furthermore, space is recognized for the\nintegration of civil society through the Forest Firefighter.\n\n        \nc. Decision-making in fire management matters shall be based on inter-institutional\ncoordination, through knowledge and accumulated experience related\nto research, training, education, and communication.\n\nArticle 7.-The National Commission on Forest Fires shall be under the direction\nand coordination of the General Directorate of the National System of Conservation Areas, of the\nMinistry of Environment and Energy; which shall approve, support, and supervise\nthe actions that must be executed in fire management matters.\n\nArticle 8.-The public institutions that are members of the National Commission on Forest\nFires shall annually establish, in accordance with the National Fire Management\nStrategy, joint programs aimed at contributing to the prevention and\ncontrol of forest and agricultural fires, minimizing the use of fire on\nagricultural lands, following up on the policies defined in article 5 of this\ndecree.\n\nArticle 9.-The Ministries, State entities, Municipalities, and National or International Private\nOrganizations may provide the National Commission on Forest\nFires, to the extent of their possibilities, with the support it requires for the\nfulfillment of its functions.\n\nArticle 10.-With the purpose of jointly addressing the problem of fires,\nthe institutions that make up the National Commission on Forest Fires are authorized, to the\nextent of their possibilities and as their laws\nauthorize them, to designate the necessary economic, technical, and material resources to\ncoordinate, support, and execute, jointly with the National System of Conservation Areas,\nthe preventive and operational programs aimed at minimizing the causes and effects of\nforest fires.\n\nArticle 11.-The requirements that said National Commission makes of public officials,\nregarding the prevention and control of forest fires, shall be mandatory.\n\nArticle 12.-For operational purposes of fire management, the figure of the\nForest Firefighter is recognized and established, as that person who participates in the prevention, mitigation,\ncontrol, and suppression of fire, trained and instructed to work safely and\nefficiently.\n\nArticle 13.-Executive Decree No. 26399-MINAE, La Gaceta No. 206 dated\nOctober 27, 1997, is hereby repealed.\n\nArticle 14.-It shall enter into force upon its publication.\n\n       \nGiven at the Presidency of the Republic.- San José, on the thirteenth day of the month\nof November of the year two thousand." }
