DE AMBIENTE Y ENERGIA(*)\n\nEn el ejercicio de las facultades que les\nconfiere el artículo 140, inciso 3) de la Constitución Política y de\nconformidad con la Convención sobre el Comercio Internacional de Especies\nAmenazadas de Fauna y Flora Silvestre (CITES), Ley N° 5605 del 22 de octubre de\n1974 y lo establecido en los artículos 6, 7, 12, 14 y 18 de la Ley de Conservación\nde la Vida Silvestre N° 7317 de 30 de octubre de 1992.\n\nConsiderando:\n\n1°-Que la administración de los recursos de\nvida silvestre, así como el dictar medidas y establecer procedimientos\nnecesarios para asegurar la conservación de la diversidad biológica del país es\nfunción del Ministerio de Ambiente y Energía.\n\n2°-Que la destrucción del hábitat, la cacería\nfurtiva, la contaminación ambiental y el comercio ilegal de animales vivos o\nsus productos derivados han disminuido peligrosamente las poblaciones de\nalgunas especies de fauna silvestre, al tiempo que otras se encuentran en\ninminente peligro de extinción en el territorio nacional.\n\n3°-Que algunas especies de fauna silvestre\nson muy raras o endémicas de  áreas muy reducidas del territorio nacional\ny requieren estrictas medidas de control para asegurar su sobrevivencia.\n\n4°-Que el comercio nacional e internacional\npone en peligro la sobrevivencia de poblaciones naturales de varias especies de\nfauna silvestre.\n\n5°-Que el establecimiento de medidas de gestión\ny control de aprovechamiento de la fauna silvestre fortalecer  los valores\nculturales del país.\n\nPor\ntanto, Decretan:\n\nREGULACIONES PARA LA CAZA MENOR Y MAYOR Y\nPESCA CONTINENTAL E INSULAR\n\nCAPITULO I\n\nLa Caza en áreas protegidas\n\nArtículo 1°-(Derogado por el artículo 31 del Decreto Ejecutivo N° 30102 del 27 de\nnoviembre y Tecnología\", N° 9046 del 25 de junio de 2012)\n\nCAPITULO II\n\nProhibiciones\n\nArticulo 2°-Se prohibe la caza mayor y menor de todas las especies con poblaciones\nreducidas o en peligro de extincion con excepcion de lo que disponga tecnicamente el\nSistema Nacional de Areas de Conservacion.\n\nArticulo 3°-Se prohibe:\n\na) \"Calentar\" (exponer al sol) aves silvestres en jaulas con trampas o jaulas\ncogedoras durante los dias no autorizados para la caza.\n\nb) La caza de aves silvestres con luz artificial durante la noche, al igual que la\ncaptura de aves con pegamentos y redes de niebla\n\nc) El traslado dentro del pais de aves en jaulas con trampas o jaulas cogedoras en\ntemporadas no autorizadas para la caza.\n\nd) La caza de todas las especies de aves silvestres residentes y migratorias en todo el\nterritorio nacional, con excepcion de las que se indiquen en el presente Decreto\nEjecutivo.\n\ne) Transportar aves canoras o de plumaje sin los respectivos permisos del SINAC.\n\nArticulo 4°-Se prohibe la caza de las siguientes aves canoras y de plumaje, en los\nlugares que se indican a continuacion:\n\na) Aves silvestres canoras y de plumaje, en los distritos de Los Angeles, Piedades\nNorte y San Rafael del canton de San Ramon, el distrito de Monterrey de San Carlos; en la\nzona comprendida entre la carretera que conduce de San Ramon a la Fortuna entre los rios\nla Esperanza y Burro, margen izquierda hasta colindar con El Bosque Eterno de los Niños\nen los distritos de La Tigra de San Carlos y San Isidro de Peñas Blancas del canton de\nSan Ramon.\n\nb) Aves silvestres canoras y de plumaje en los cantones de Puriscal, Turrubares, Mora,\nDota y Tarraza de la provincia de San Jose\n\nc) Aves canoras y de plumaje en el canton de Aguirre, provincia de Puntarenas.\n\nd) La caza del jilguero (Myadestes melanops) en:\n\n1). el canton de Perez Zeledon y en la fila Cruces, partiendo del punto 1, ubicado en\nel puente sobre el rio Piedras Blancas la carretera interamericana sur hasta el punto 2 en\nCiudad Neily, continuando por la carretera que conduce hasta el punto 3 en San Vito de\nCoto Brus, siguiendo por la carretera hacia Paso Real, pasando por la Union hasta el punto\n4 ubicado en el cruce a San Gerardo, de este punto se sigue hacia el punto 5, en Paraiso,\ncontinuando con una l¡nea recta con rumbo suroeste hasta las nacientes del rio Piedras\nBlancas, punto 6; continuando por la margen izquierda aguas abajo hasta el puente sobre la\ncarretera interamericana sur, punto de inicio.\n\n2). El distrito central del canton de Turrialba y el canton de Jimenez, provincia de\nCartago.\n\n3). En la zona de amortiguamiento de un kilometro de ancho alrededor del Parque\nNacional Braulio Carrillo y la Reserva Forestal Cordillera Volcanica Central.\n\ne) Un kilometro en ambas margenes del rio Virilla, en la zona comprendida entre el\npuente sobre la autopista General Cañas y el puente de Piedras Negras en la carretera que\ncomunica Puriscal con Turrucares de Alajuela.\n\nArticulo 5°-Se prohibe la caza menor de las siguientes aves canoras, de plumaje, y\notras especies silvestres en las zonas 1, 2, 3 y 4 (definidas en el articulo 8) en el periodo\nque a continuacion se indica:\n\nAves canoras\n\na) Solitario carinegro, jilguero, (Myadestes melanops) del 1° de marzo al 30 de\noctubre.\n\nb) Aguio coroniamarillo, monjito (Euphonia luteicapilla) del 1§ de enero al 30 de\nsetiembre.\n\nc) Aguio gorgiamarillo (Euphonia hirundinacea) del 1° de enero al 30 setiembre.\n\nd) Euphonia menuda, canaria (Euphonia minuta) del 1° de enero al 30 setiembre.\n\ne) Finito gargantinegra, finito (Euphonia affinis) del 1° de enero al 30 setiembre.\n\n f) Aguio olivaceo, culo rojo (Euphonia gouldi) del 1° de enero al 30 setiembre.\n\ng) Mongito vientrirojo, barranquillo (Euphonia imitans) del 1° de enero al 30\nsetiembre.\n\nh) Gallito, semillerito cariamarillo (Tiaris olivacea) del 1° de abril al 30 de\nsetiembre.\n\n i) Setillero collarejo (Sporophila torqueola) del 1° de abril al 30 de setiembre.\n\nj) Setillero garganta negra (Sporophila aurita) del 1° de abril al 30 de setiembre.\n\nAves de plumaje\n\na) Mielero patirrojo, picudo patas rojas (Cyanerpes lucidus) del 1° de marzo al 30 de\nnoviembre.\n\nb) Mielero luciente, picudo patas amarillas (Cyanerpes cyaneus) del 1 de marzo al 31 de\nnoviembre.\n\nc) Tangara moteada, zebra (Tangara guttata) del 1° de marzo al 30 de setiembre.\n\nd) Tangara dorada, Juanita (Tangara icterocephata) del 1° de marzo al 30 de setiembre.\n\ne) Tangara capuchidorada, siete colores, mariposa (Tangara larvata) del 1° de marzo al\n30 de setiembre.\n\nf) Tangara vientricastaña (Tangara dowii) del 1° de marzo al 30 de setiembre.\n\ng) Gorrion com£n, electrico (Passer domesticus) del 1° de mayo al 30 de setiembre.\n\nh) Tangara azuleja, viuda (Thraupis episcopus) del 1° de mayo al 30 setiembre.\n\nCaza menor de aves con arma de fuego\n\na) Paloma collareja (Columba fasciata) durante el periodo comprendido del 1° de\nFebrero al 31 de agosto.\n\nb) Paloma arrocera (Zenaida macroura), paloma alablanca (Zenaida asi tica), del 1°\nde abril al 31 de octubre.\n\nc) Piches alablanca (Dendrocygma autumnalis) y Cerceta aliazul (Anas discor) del 1° de\nabril al 31 de octubre.\n\nd) Codorniz com£n (Colinus leucopogon) del 1° de abril al 31 de setiembre.\n\ne) Paloma morada (Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba\nspeciosa, Columba nigrirostris) del 1 de marzo al 30 setiembre.\n\nCAPITULO III\n\nAutorizaciones Caza menor de aves\n\nArticulo 6°-Se podra  cazar aves silvestres canoras y de plumaje, en las\ncondiciones siguientes:\n\na) En tiempo autorizado y tenicamente con una jaula cogedora por persona.\n\nb) 2 machos adultos de cada especie por temporada de caza, en todo el territorio\nnacional.\n\nc) Unicamente durante los dias sabados, domingos y feriados por ley, con horario de 6\na.m. a 5 p.m.\n\nArticulo 7°-Se podran cazar con arma de fuego, en tiempo autorizado, las siguientes\nespecies de aves de caza menor, en un horario de 6:00 a. m. a 5:00 p.m., durante los dias\ns bado, domingo y feriados de ley con un limite maximo de piezas segun se indica a\ncontinuacion:\n\na) Codornis comun (Colinus leucopogon), 10 piezas por d¡a por temporada, en todo el\nterritorio nacional en el periodo comprendido entre el 1 de octubre y el 31 de marzo.\n\nb) Zanate (Quiscalus mexicanus), sin limite de piezas, en todo el territorio nacional,\nen fechas autorizados para la caza en cada zona (articulos 10, 11, 12, 13 del presente\ndecreto).\n\nc) Paloma arrocera (Zenaida macroura); paloma alablanca (Zenaida asiatica), 20 piezas\npor dia, en todo el territorio nacional, en el periodo comprendido entre el 1 de noviembre\ny el 31 de marzo.\n\nd) Piches alablanca (Dendrocygma autumnalis) y cerceta aliazul (Anas discor), 15 piezas\npor d¡a, en todo el territorio nacional, en el periodo comprendido entre el 1 de\nnoviembre y el 31 de marzo.\n\ne) Paloma morada (Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba\nspeciosa, Columba nigrirostris), 10 piezas por dia, en todo el territorio nacional, en el\nperiodo comprendido entre el 1 de octubre y el 29 de febrero.\n\ng) Paloma collareja (Columba fasciata), 15 piezas por dia, en el periodo comprendido\nentre el 1 de setiembre y el 31 de enero, en los siguientes lugares:\n\n1. En fincas privadas en las margenes de la Carretera Interamericana Sur, entre el Kilometro\n34 hasta el km 39, entre el km 41 y el km 47, entre el km 52 y el km 55, entre el Km 57 y\nel km 64 (sitio conocido como Madreselva). Unicamente a mas de 50 mts del limite de la\ncarretera y fuera de los limites de la Reserva Forestal Los Santos y El Parque Nacional\nTapanti Macizo de la Muerte. En las zonas no autorizadas (entre el kilometro 39 al km 40,\nentre el km 41 al km 46, entre el km 52 al km 54, y entre el km 55 al km 56) que incluye\npoblados a la orilla de la carretera solo se permitir  la caza en fincas particulares\nfuera de la Reservas Forestal Los Santos y El Parque Nacional Tapanti Macizo de la Muerte\nen sitios que se ubiquen a 1 km o mas de la carretera.\n\n2. En fincas privadas, en ambas margenes de la carretera entre Carrizal de Alajuela y\nPoasito, a mas de 50 metros de los limites de carretera.\n\n3. En fincas privadas en ambas margenes de las carreteras entre Tarbaca y Vuelta de\nJorco, a mas de 50 mts de los limites de carretera.\n\nCAPITULO IV\n\nZonas de caza\n\nArticulo 8°-Se declaran las siguientes zonas de caza:\n\nZona 1. Provincia de Guanacaste\n\nZona 2. Provincias de Alajuela y Heredia\n\nZona 3. Provincias de Puntarenas y San Jos‚\n\nZona 4. Provincias de Cartago y Limon\n\nCAPITULO V\n\nDe la caza menor y mayor con arco y flecha, armas de fuego, cuchillo y perros\n\nArticulo 9°-Se deber  de observar las regulaciones de este Capitulo para las\ntemporadas de caza, de acuerdo con las zonas declaradas en el articulo 8.\n\nArticulo 10.-Zona 1. (Guanacaste). Se prohibe la caza mayor y menor con arco y flecha,\narma de fuego, cuchillos o perros, como se detalla en los siguientes incisos:\n\na) Con excepcion de los siguientes dias: 7, 8, 21, 22 y 25 de julio; 2, 4, 5, 15, 18 y\n19 de agosto; 1, 2, 15, y 16 de setiembre; 6, 7, 12, 20 y 21 de octubre y 3, 4, 17 y 18 de\nnoviembre.\n\nb) En el area delimitada por la carretera y comprendida entre las siguientes\npoblaciones: Playa El Coco, Sardinal, San Blas, Paso Tempisque, Filadelfia, Bel‚n,\nSanta Ana, Coyolillo, Portegolpe, Huacas y Brasilito; siguiendo la l¡nea de la costa en\ndireccion norte hasta la Playa El Coco.\n\nc) En la zona comprendida entre el punto de las coordenadas 364,500 y 315,500 de la\nhoja cartografica Murcielago N° 3048-1 sobre la carretera interamericana norte, siguiendo\npor esta carretera hacia la ciudad de Liberia hasta el cruce de camino que conduce a la\nHacienda La Esperanza, desviandose por esta camino hasta la Finca Bejuco pasando por el\nsitio Dama, continuando por el camino que conduce a Papagayo hasta el cruce a Cabuyal\ndesviandose por este camino hasta Playa Cabuyal, continuando por la costa hasta el punto\nde coordenadas 354,500 y 302; Hoja Cartografica Ahogados N° 3048-2, en el Cerro Carbonal,\nlimite del Parque Nacional Santa Rosa, continuando por el limite sur de dicho parque hasta\nel sitio inicial en coordenadas 364,500 y 315,500 sobre la Carretera Interamericana.\n\nd) En el  rea comprendida entre los siguientes puntos: de Punta Coyote, en\ncoordenadas 193950 N - 396400 E, siguiendo al noreste al camino que inicia en Caletas, en\ncoordenadas 193950 N - 397150 E. Se continua al noreste por ese mismo camino hasta San\nFrancisco de Coyote, en coordenadas 198650 N - 399900 E. Se sigue al NE por el camino\nhasta Javillo, en coordenadas 205925 N - 401725 E. Sigue al NW por ese camino hasta el\ncruce que va hacia Quebrada Grande, en coordenadas 207375 N - 396425 E, continua luego al\nNW por el camino hasta el cruce que va hacia Los Angeles, en coordenadas 209525 N - 395675\nE, de este cruce se continua al NW por ese camino hasta el cruce con el camino a San Ramon\n(Rio Ora), en coordenadas 213150 N - 393650 E, continua al NW por el camino a San Ramon\nhasta la interseccion que va de Cangrejal a San Ramon en coordenadas 214275 N - 389850 E.\nSigue al NE por el camino a San Ramon hasta la interseccion de este con el rio Chiles en\ncoordenadas 214300 N - 389875 E, continua al SW aguas abajo del rio Chiles hasta su\nconfluencia con el Rio Ora, en coordenadas 213950 N - 389600 E, continua al SW aguas abajo\ndel rio Ora hasta su desembocadura en coordenadas 205300 N - 376950 E, sigue luego al SE\npor la orilla de la playa hasta el punto inicial en Punta Coyote coordenadas 193950 N -\n396400 E.\n\ne) En la zona comprendida en los cerros Caballlito y Quebrada Honda,  rea\ndelimitada por el camino que conduce de Quebrada Honda, caballito y Corralillo hasta\nencontrar el camino entre Puerto Humo y Nicoya, siguiendo por esta ruta hasta el cruce de\nSanta Ana, continuando por este camino pasando por los poblados de Santa Ana y Barra Honda\nhasta la carretera hacia Puerto Moreno, siguiendo hasta el poblado de Quebrada Honda,\npunto original de partida. Dicha  rea se encuentra ubicada en las hojas cartograficas\nTalolinga y Matambu, Provincia de Guanacaste.\n\nf) El cabro de monte (Mazama americana) en toda la provincia de Guanacaste.\n\nArticulo 11.-Zona 2. (Alajuela, Heredia) Se prohibe la caza mayor y menor con arco y\nflecha, arma de fuego, cuchillos o perros, segun se detalla en los siguientes incisos:\n\na) Con excepcion de los siguientes d¡as: 1, 6, 7, 20, y 21 de enero; 3, 4, 17 y 18 de\nfebrero; 3, 4, 17 y 18 de marzo; 7, 8, 11, 21 y 22 de abril, 1, 5, 6, 19 y 20 de mayo.\n\nb) En el canton de Grecia y en los distritos de Piedades Norte, Los Angeles, Santiago,\nPiedades Sur, San Rafael y Zapotal del canton de San Ramon; el distrito de Monterrey del\ncanton de San Carlos.\n\nc) En la zona comprendida entre la carretera que conduce de San Ramon a la Fortuna\nentre los r¡os la Esperanza y Rio Burro, margen izquierda hasta colindar con El Bosque\nEterno de los Niños en los distritos de La Tigra de San Carlos y San Isidro de Peñas\nBlancas del Canton de San Ramon.\n\nd) 100 mts en ambas margenes del Rio San Rafael en Muelle de San Carlos, entre el\npuente sobre la carretera que comunica la comunidad de Muelle con Pital y la desembocadura\ndel Rio San Rafael en el rio San Carlos\n\ne) Un kilometro en la margen derecha aguas abajo del Rio Virilla, en la zona\ncomprendida entre el Puente sobre la autopista General Cañas y el Puente de Piedras\nNegras en la carretera que comunica Puriscal con Turrucares de Alajuela.\n\nArticulo 12.-Zona 3. (Puntarenas, San Jos‚) Se prohibe la caza mayor y menor con\narco y flecha, arma de fuego, cuchillos o perros: Con excepcion de los siguientes dias: 7,\n8, 21, 22, 25 de julio; 2, 4, 5, 15, 18 y 19 de agosto; 1, 2, 15, y 16 de setiembre; 6, 7,\n12, 20 y 21 de octubre. Ademas se prohibe la caza en los siguientes sitios:\n\na) En la Isla San Lucas.\n\nb) En la zona comprendida en el distrito tenico Parrita, del canton de Parrita,\npartiendo del poblado de Valle Vasconia entre el camino que conduce a la Fila Aguacate\nhasta intersectar el cauce del rio Negro, siguiendo a partir de este punto el cauce del\nmismo rio aguas abajo hasta su confluencia con el Rio Chires. A partir de este punto se\nsigue el cauce de este rio hasta intersectar la carretera Puriscal-Parrita a la altura del\npoblado de Vista de Mar; y de aqui se sigue la Carretera Costanera hasta intersectar el\nRio Pirris, aguas arriba hasta llegar al poblado de Valle Vasconia.\n\nc) En la zona comprendida entre Golfito de la provincia de Puntarenas, siguiendo por la\ncarretera que conduce hasta Rio Claro, continuando por la margen izquierda de la Carretera\nInteramericana Sur hasta el puente sobre el Rio Terraba, en Palmar Sur, de este punto\ncontinua por la margen derecha del rio hasta la Boca Coronado, para cerrar finalmente en\nGolfito, punto original, se exceptua de esta prohibicion la caza de patos y palomas que se\nrealice en lagunas y  reas sembradas de arroz ubicadas fuera de  reas\nprotegidas.\n\nd) Un kilometro en ambas margenes del Rio Maria Aguilar, en la zona comprendida entre\nel puente Los Anonos en la carretera vieja que comunica a San Jose‚ con Escazu y la\ndesembocadura en el Rio Virilla.\n\ne) Un kilometro en la margen izquierda del rio Virilla, aguas abajo, en la zona\ncomprendida entre el Puente sobre la autopista General Cañas y el puente de Piedras\nNegras en la carretera que comunica Puriscal con Turrucares de Alajuela.\n\nf) La caza de la paloma collareja en la carretera que conduce entre Vuelta de Jorco y\nPalmichal de Acosta, en ambas margenes y en el Cerro el Guabal ubicado en coordenadas\n205,500 latitud Norte y 51,800 longitud oeste, Lambert Norte, Hoja Caraigres.\n\nArticulo 13.-Zona 4. (Cartago, Limon). Se prohibe la caza mayor y menor con arco y\nflecha, arma de fuego, cuchillos o perros:\n\na) Con excepcion de los siguientes dias: 1, 6, 7, 20, y 21 de enero; 3, 4, 17 y 18 de\nfebrero; 3, 4, 17 y 18 de marzo; 7, 8, 11, 21 y 22 de abril y 1, 5, 6, 19 y 20 de mayo.\n\nb) Del tepescuintle (Agouti paca) en el distrito de Orosi, canton de Paraiso, los\ncantones de Jimenez y Turrialba, provincia de Cartago.\n\nc) De conejos silvestres en los cantones Central, Paraiso, La Union, Jimenez, Alvarado,\nOreamuno y El Guarco de la provincia de Cartago, con excepcion de las fechas 6, 7, 12, 20\ny 21 de octubre y 3, 4, 17 y 18 de noviembre.\n\nArticulo 14.-Se declaran como especies de caza mayor los mamiferos listados en este articulo;\nse podran cazar, de acuerdo a las fechas autorizadas para cada zona (articulo 8 del\npresente decreto):\n\na) Odocoileus virginianus: Venado cola blanca; 2 machos por año.\n\nb) Mazama americana: cabro de monte, 1 macho por año.\n\nb) Canis latrans: coyote; 6 animales por año, sujeto a temporada de caza autorizada\npor zona.\n\nc) Tayassu tajacu: sahino; 1 macho por año, solo en los distritos de Paquera, Cobano y\nLepanto, provincia de Puntarenas.\n\nArticulo 15.-Se declaran como especies de caza menor los animales listados en este artículo,\nse podran cazar de acuerdo a las fechas autorizadas para cada zona:\n\na) Didelphis marsupialis: zorro pelon; 5 piezas por año.\n\nb) Didelphis virginiana: zorro pelon; 5 piezas por año.\n\nc) Sylvilagus brasilensis: conejo de monte; 10 piezas por año.\n\nd) Sylvilagus floridanus: conejo de monte; 10 piezas por año.\n\ne) Sylvilagus dicei: conejo de altura; 10 piezas por año\n\nf) Sciurus variegatoides: ardilla comun; 10 piezas por año.\n\ng) Agouti paca: tepescuintle; 2 piezas por año.\n\nh) Dasyprocta punctata: guatusa; 2 piezas por año.\n\ni) Urocyon cineroargenteus: tigrillo, zorra gris; 2 piezas por año.\n\nj) Mustela frenata: comadreja; 3 piezas por año.\n\nk) Procyon lotor: mapache; 4 piezas por año. l) Nassua narica: pizote; 3 piezas por\naño.\n\nm) Ctenosaura similis: garrobo; 4 piezas por año.\n\nCAPITULO VI\n\nGeneralidades sobre la caza mayor y menor\n\nArticulo 16.-Tratandose de fincas privadas, los cazadores deberan obtener el\ncorrespondiente permiso del propietario, de conformidad con lo establecido en el articulo\n32 de la Ley de Conservacion de la Vida Silvestre.\n\nArticulo 17.-De conformidad con lo establecido en los articulos 12, 17, 30 y 63 de la\nley 7317, Ley de Conservacion de la Vida Silvestre, las Oficinas Subregionales, asi como\nlas oficinas de Administracion de los Refugios Nacionales de Fauna Silvestre en las\ndiferentes Areas de Conservacion, que conforman el Sistema Nacional de Areas de Conservacion,\nseran las encargadas de autorizar, emitir y suscribir las licencias de caza y pesca\ndeportiva continental y marina en aquellas  areas protegidas que incluyen extensiones\nmarinas, requeridas para el cumplimiento de los fines previstos en este Decreto.\n\nArticulo 18.-Se define como \"limite de piezas\" al maximo numero de animales\nde caza autorizada en el presente decreto. El limite de piezas podra  ser acumulativo\npor dias de caza en el caso de los patos, palomas y codornices, siempre y cuando el\ncazador reporte el numero de piezas cazado por dia, en la Delegacion de la Guardia de\nAsistencia Rural o a la oficina del SINAC, mas cercana a la zona de caza visitada.\n\nArticulo 19.-El Sistema Nacional de Areas de Conservacion (SINAC) a traves de sus\noficinas regionales podra  autorizar la realizacion de torneos de caza (Art. 24 del\nreglamento de la Ley de Conservacion de la Vida Silvestre), durante los periodos\nautorizados en cada zona de caza de acuerdo con el articulo 8, mediante resolucion\nadministrativa, solo cuando se trate de:\n\na) Rastreo de huellas preparadas para los efectos del torneo en un dia determinado;\npara lo cual no se autoriza el acoso, maltrato o muerte de animales silvestres.\n\nb) Torneos de caza menor de aves canoras y de plumaje y su liberacion en el mismo sitio\nde captura.\n\nc) Torneos de canto de aves canoras en sitios bajo techo o cerrados y acondicionados\npara tal efecto.\n\nEn todos los casos, los participantes deber n portar y mostrar si fuera requerido\nla correspondiente licencia de caza vigente. Los torneos de caza deberan ser fiscalizados\npor funcionarios del SINAC del Area de Conservacion correspondiente.\n\nCAPITULO VII\n\nDe la pesca continental\n\nArticulo 20.-Se prohibe la pesca:\n\na) De trucha Arco Iris (Salmo gardnieri) en todos los rios nacionales, entre el 1 de\nfebrero y el 30 de abril inclusive; fuera de ese plazo se podra  pescar con un limite\nde 5 piezas con un tamaño minimo de 25 cm. de longitud, por persona por dia. La pesca de\ntruchas cultivadas en estanques se pueda realizar durante todo el año.\n\nb) De la trucha en el rio Toro y sus afluentes en el distrito Toro Amarillo del canton\nde Valverde Vega.\n\nc) De guapote (Cichlasoma spp) robalo (Centropomus undecimalis), sabalo (Tarpon\natlanticus), gaspar (Atractosteus tropicus) y demas especies de peces, en los siguientes rios\ny sus afluentes: Frio, Zapote, Niño o Pizote, lagunas del Refugio de Fauna Silvestre de\nCaño Negro y el Refugio de Fauna Silvestre las Camelias, entre el 1 de abril y el 31 de\njulio inclusive . Fuera de este plazo, se podra  pescar con un limite de 5 peces con\nun tamaño minimo de 25 cm. de longitud, por persona por dia. La pesca de peces cultivados\nen estanques se puede realizar durante todo el año.\n\nd) De todas las especies de peces de agua dulce en todos los rios incluyendo sus\nafluentes, lagos y lagunas (exceptuando lo establecido en el inciso c) y el articulo 20 de\neste decreto), entre el 1 de setiembre y el 30 de noviembre inclusive. Fuera de ese plazo\nse podr  pescar con un l¡mite de 5 piezas con un tamaño minimo de 25 cm. de\nlongitud, por persona con licencia por dia. Se exceptua el tepemechin, para el cual no se\nestablece limite de longitud.\n\ne) Del langostino o camaron de rio (Macrobrachium spp.) en todos los rios nacionales\nentre el 15 de mayo y el 31 de diciembre, inclusive. Fuera de este plazo, se podra \npescar con un limite de 5 piezas por persona, por dia.\n\ne) La pesca deportiva en la Laguna de Hule, ubicada en el Refugio de Fauna Privado\nBosque Alegre, Cariblanco.\n\nf) En las Reservas Indigenas (excepto la pesca de subsistencia que realicen los\nind¡genas con permiso del SINAC)\n\nArticulo 21.-Se autoriza:\n\na) La pesca deportiva, con caña y carrete, asi como cuerdas de mano, en un horario de\n6:00 a. m. a 5:00 p. m.\n\nb) La pesca todos los dias del año en:\n\n1. En el rio Reventazon desde Palomo de Orosi hasta su desembocadura, con excepcion de\nsus afluentes. El limite de piezas se establece en 5 peces por pescador con licencia por dia.\n\n2. La que se realice con cuerda de mano o caña y carrete en el Embalse de Arenal. Se\nestablece el limite de piezas en 10 peces por pescador con licencia por dia.\n\n3. En las Barras de Colorado, Parismina, Tortuguero y Matina. El limite de piezas en\nlas barras citadas ser  de 5 peces por pescador por dia. Se entendera  por barra\nde un rio como el cauce comprendido hasta un kilometro aguas arriba, partiendo de su boca.\n\nc) La pesca de subsistencia que realicen los Indigenas en las Reservas Indigenas con\npermiso del SINAC.\n\nd) La pesca en Refugios de Fauna Silvestre y Parques Nacionales cuando la actividad esta‚\ncontemplada en el Plan de Manejo.\n\nCAPITULO VIII\n\nDe la tenencia de animales silvestres en cautiverio\n\nArticulo 22.-De conformidad con el articulo 19 de la Ley N° 7317 del 7 de diciembre de\n1992, los administrados que capturen animales silvestres autorizados por el presente\ndecreto y al amparo de la licencia correspondiente, deberan inscribir dichos animales ante\nla oficina regional del Sistema Nacional de Areas de Conservacion del MINAE que\ncorresponda dentro del mes siguiente a la captura.\n\nEn el caso de tenencia de aves de plumaje y canoras en cautiverio en aviarios\nadecuadamente acondicionados, se establece un limite de 15 aves en total, por\npermisionario con licencia.\n\nArticulo 23.-Se prohibe por tiempo indefinido, la caza o captura de las especies que no\naparezcan contempladas en las listas de especies autorizadas para la THE\n\nMINISTER OF ENVIRONMENT AND ENERGY(*)\n\nIn exercise of the powers conferred upon them by Article 140, subsection 3) of the Political Constitution and in accordance with the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), Law N° 5605 of October 22, 1974, and the provisions set forth in Articles 6, 7, 12, 14, and 18 of the Wildlife Conservation Law N° 7317 of October 30, 1992.\n\nConsidering:\n\n1°—That the administration of wildlife resources, as well as issuing measures and establishing procedures necessary to ensure the conservation of the country's biological diversity, is a function of the Ministry of Environment and Energy.\n\n2°—That habitat destruction, poaching, environmental pollution, and the illegal trade of live animals or their derived products have dangerously reduced the populations of some species of wild fauna, while others are in imminent danger of extinction within the national territory.\n\n3°—That some species of wild fauna are very rare or endemic to very reduced areas of the national territory and require strict control measures to ensure their survival.\n\n4°—That national and international trade endangers the survival of natural populations of several species of wild fauna.\n\n5°—That the establishment of management and control measures for the use of wild fauna will strengthen the country's cultural values.\n\nTherefore, They Decree:\n\nREGULATIONS FOR MINOR AND MAJOR HUNTING AND CONTINENTAL AND INSULAR FISHING\n\nCHAPTER I\n\nHunting in Protected Areas\n\nArticle 1—(Repealed by Article 31 of Executive Decree N° 30102 of November 27, 2001.)\n\n(*)(Its name modified by Article 11 of the Law \"Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology\", N° 9046 of June 25, 2012)\n\nCHAPTER II\n\nProhibitions\n\nArticle 2—Major and minor hunting of all species with reduced populations or in the area comprised between the road leading from San Ramon to La Fortuna between the La Esperanza and Burro rivers, left bank up to adjoining the Bosque Eterno de los Niños in the districts of La Tigra of San Carlos and San Isidro de Peñas Blancas of the canton of San Ramon.\n\nb) Wild songbirds and plumage birds in the cantons of Puriscal, Turrubares, Mora, Dota, and Tarrazu of the province The canton of Perez Zeledon and in the Fila Cruces, starting from point 1, located at the bridge over the Rio Piedras Blancas on the Carretera Interamericana Sur up to point 2 in Ciudad Neily, continuing along the road leading to point 3 in San Vito de Coto Brus, following the road towards Paso Real, passing through La Union up to point 4 located at the crossroads to San Gerardo, from this point continuing towards point 5, in Paraiso, continuing with a straight line heading southwest to the headwaters (nacientes) of the Rio Piedras Blancas, point 6; continuing along the left bank downstream to the bridge on the Carretera Interamericana Sur, starting point.\n\n2). The central district of the canton of Turrialba and the canton of Jimenez, province of Cartago.\n\n3). On private farms on the margins of the Carretera Interamericana Sur, between Kilometer 34 and km 39, between km 41 and km 47, between km 52 and km 55, between Km 57 and km 64 (site known as Madreselva). Only more than 50 m from the road boundary and outside the boundaries of the Los Santos Forest Reserve (Reserva Forestal Los Santos) and the Tapanti Macizo de la Muerte National Park. In unauthorized areas (between kilometer 39 and km 40, between km 41 and km 46, between km 52 and km 54, and between km 55 and km 56) that include villages at the roadside, hunting will only be permitted on private farms outside the Los Santos Forest Reserve and the Tapanti Macizo de la Muerte National Park in sites located 1 km or more from the road.\n\n2. On private farms, on both margins of the road between Carrizal de Alajuela and Poasito, more than 50 meters from the road boundaries.\n\n3. On private farms on both margins of the roads between Tarbaca and Vuelta de Jorco, more than 50 m from the road boundaries.\n\nCHAPTER IV\n\nHunting Zones\n\nArticle 8—The following hunting zones are declared:\n\nZone 1. Province of Guanacaste\n\nZone 2. Provinces of Alajuela and Heredia\n\nZone 3. Provinces of Puntarenas and San Jose\n\nZone 4. Provinces of Cartago and Limon\n\nCHAPTER V\n\nOn Minor and Major Hunting with Bow and Arrow, Firearms, Knife, and Dogs\n\nArticle 9—The regulations of this Chapter must be observed for the hunting seasons, in accordance with the zones declared in Article 8.\n\nArticle 10.—Zone 1. (Guanacaste). Major and minor hunting with bow and arrow, firearm, knives, or dogs is prohibited, as detailed in the following subsections:\n\na) With the exception of the following days: July 7, 8, 21, 22, and 25; August 2, 4, 5, 15, 18, and 19; September 1, 2, 15, and 16; October 6, 7, 12, 20, and 21; and November 3, 4, 17, and 18.\n\nb) In the area delimited by the road and comprised between the following towns: Playa El Coco, Sardinal, San Blas, Paso Tempisque, Filadelfia, Belen, Santa Ana, Coyolillo, Portegolpe, Huacas, and Brasilito; following the coastline northwards to Playa El Coco.\n\nc) In the area comprised from the point of coordinates 364,500 and 315,500 on the cartographic sheet Murcielago N° 3048-1 on the Carretera Interamericana Norte, following this highway towards the city of Liberia up to the road junction leading to Hacienda La Esperanza, turning off along this road to Finca Bejuco passing through the site Dama, continuing along the road leading to Papagayo up to the crossroads to Cabuyal, turning off along this road to Playa Cabuyal, continuing along the coast to the point of coordinates 354,500 and 302; Cartographic Sheet Ahogados N° 3048-2, at Cerro Carbonal, boundary of the Santa Rosa National Park, continuing along the southern boundary of said park to the initial site at coordinates 364,500 and 315,500 on the Carretera Interamericana.\n\nd) In the area comprised between the following points: from Punta Coyote, at coordinates 193950 N - 396400 E, going northeast to the road that begins in Caletas, at coordinates 193950 N - 397150 E. Continue northeast along that same road to San Francisco de Coyote, at coordinates 198650 N - 399900 E. Continue northeast along the road to Javillo, at coordinates 205925 N - 401725 E. Continue northwest along that road to the crossroads going to Quebrada Grande, at coordinates 207375 N - 396425 E, then continue northwest along the road to the crossroads going to Los Angeles, at coordinates 209525 N - 395675 E, from this crossroads continue northwest along that road to the junction with the road to San Ramon (Rio Ora), at coordinates 213150 N - 393650 E, continue northwest along the road to San Ramon up to the intersection going from Cangrejal to San Ramon at coordinates 214275 N - 389850 E. Continue northeast along the road to San Ramon to its intersection with the Rio Chiles at coordinates 214300 N - 389875 E, continue southwest downstream along the Rio Chiles to its confluence with the Rio Ora, at coordinates 213950 N - 389600 E, continue southwest downstream along the Rio Ora to its mouth at coordinates 205300 N - 376950 E, then continue southeast along the shore to the initial point at Punta Coyote coordinates 193950 N - 396400 E.\n\ne) In the area comprised in the Cerros Caballito and Quebrada Honda, area delimited by the road leading from Quebrada Honda, Caballito, and Corralillo until reaching the road between Puerto Humo and Nicoya, following this route to the Santa Ana junction, continuing along this road passing through the towns of Santa Ana and Barra Honda to the road to Puerto Moreno, continuing to the town of Quebrada Honda, original point of departure. Said area is located on the cartographic sheets Talolinga and Matambu, Province of Guanacaste.\n\nf) The brocket deer (cabro de monte) (Mazama americana) in the entire province of Guanacaste.\n\nArticle 11.—Zone 2. (Alajuela, Heredia) Major and minor hunting with bow and arrow, firearm, knives, or dogs is prohibited, as detailed in the following subsections:\n\na) With the exception of the following days: January 1, 6, 7, 20, and 21; February 3, 4, 17, and 18; March 3, 4, 17, and 18; April 7, 8, 11, 21, and 22; and May 1, 5, 6, 19, and 20.\n\nb) In the canton of Grecia and in the districts of Piedades Norte, Los Angeles, Santiago, Piedades Sur, San Rafael, and Zapotal of the canton of San Ramon; the district of Monterrey of the canton of San Carlos.\n\nc) In the area comprised between the road leading from San Ramon to La Fortuna between the La Esperanza and Rio Burro rivers, left bank up to adjoining the Bosque Eterno de los Niños in the districts of La Tigra of San Carlos and San Isidro de Peñas Blancas of the Canton of San Ramon.\n\nd) 100 m on both banks of the Rio San Rafael in Muelle de San Carlos, between the bridge on the road connecting the community of Muelle with Pital and the mouth of the Rio San Rafael into the Rio San Carlos.\n\ne) One kilometer on the right bank downstream of the Rio Virilla, in the area between the Bridge on the Autopista General Cañas and the Puente de Piedras Negras on the road connecting Puriscal with Turrucares de Alajuela.\n\nArticle 12.—Zone 3. (Puntarenas, San Jose) Major and minor hunting with bow and arrow, firearm, knives, or dogs is prohibited: With the exception of the following days: July 7, 8, 21, 22, 25; August 2, 4, 5, 15, 18, and 19; September 1, 2, 15, and 16; October 6, 7, 12, 20, and 21. In addition, hunting is prohibited in the following sites:\n\na) On Isla San Lucas.\n\nb) In the area included in the district of Parrita, canton of Parrita, starting from the town of Valle Vasconia along the road leading to the Fila Aguacate until intersecting the bed of the Rio Negro, following from this point the bed of the same river downstream to its confluence with the Rio Chires. From this point, follow the bed of this river until intersecting the Puriscal-Parrita road at the town of Vista de Mar; and from here follow the Carretera Costanera until intersecting the Rio Pirris, upstream until reaching the town of Valle Vasconia.\n\nc) In the area comprised from Golfito of the province of Puntarenas, following the road leading to Rio Claro, continuing along the left margin of the Carretera Interamericana Sur to the bridge over the Rio Terraba, in Palmar Sur, from this point continuing along the right bank of the river to Boca Coronado, to finally close in Golfito, original point; exempt from this prohibition is the hunting of ducks and pigeons conducted in lagoons and areas planted with rice located outside protected areas.\n\nd) One kilometer on both banks of the Rio Maria Aguilar, in the area between the Puente Los Anonos on the old road connecting San Jose with Escazu and the mouth at the Rio Virilla.\n\ne) One kilometer on the left bank of the Rio Virilla, downstream, in the area between the Bridge on the Autopista General Cañas and the Puente de Piedras Negras on the road connecting Puriscal with Turrucares de Alajuela.\n\nf) The hunting of the band-tailed pigeon on the road leading between Vuelta de Jorco and Palmichal de Acosta, on both margins, and on Cerro el Guabal located at coordinates 205,500 North latitude and 51,800 West longitude, Lambert North, Sheet Caraigres.\n\nArticle 13.—Zone 4. (Cartago, Limon). Major and minor hunting with bow and arrow, firearm, knives, or dogs is prohibited:\n\na) With the exception of the following days: January 1, 6, 7, 20, and 21; February 3, 4, 17, and 18; March 3, 4, 17, and 18; April 7, 8, 11, 21, and 22; and May 1, 5, 6, 19, and 20.\n\nb) Of the tepescuintle (Agouti paca) in the district of Orosi, canton of Paraiso, the cantons of Jimenez and Turrialba, province of Cartago.\n\nc) Of wild rabbits in the cantons Central, Paraiso, La Union, Jimenez, Alvarado, Oreamuno, and El Guarco of the province of Cartago, with the exception of the dates October 6, 7, 12, 20, and 21 and November 3, 4, 17, and 18.\n\nArticle 14.—The mammals listed in this article are declared major game (caza mayor) species; they may be hunted, according to the authorized dates for each zone (Article 8 of this decree):\n\na) Odocoileus virginianus: White-tailed deer (Venado cola blanca); 2 males per year.\n\nb) Mazama americana: Brocket deer (cabro de monte), 1 male per year.\n\nb) Canis latrans: Coyote; 6 animals per year, subject to the authorized hunting season by zone.\n\nc) Tayassu tajacu: Collared peccary (sahino); 1 male per year, only in the districts of Paquera, Cobano, and Lepanto, province of Puntarenas.\n\nArticle 15.—The animals listed in this article are declared minor game (caza menor) species; they may be hunted according to the authorized dates for each zone:\n\na) Didelphis marsupialis: Common opossum (zorro pelon); 5 pieces per year.\n\nb) Didelphis virginiana: Virginia opossum (zorro pelon); 5 pieces per year.\n\nc) Sylvilagus brasilensis: Forest rabbit (conejo de monte); 10 pieces per year.\n\nd) Sylvilagus floridanus: Eastern cottontail (conejo de monte); 10 pieces per year.\n\ne) Sylvilagus dicei: Dice's cottontail (conejo de altura); 10 pieces per year\n\nf) Sciurus variegatoides: Variegated squirrel (ardilla comun); 10 pieces per year.\n\ng) Agouti paca: Tepescuintle; 2 pieces per year.\n\nh) Dasyprocta punctata: Agouti (guatusa); 2 pieces per year.\n\ni) Urocyon cinereoargenteus: Gray fox (tigrillo, zorra gris); 2 pieces per year.\n\nj) Mustela frenata: Long-tailed weasel (comadreja); 3 pieces per year.\n\nk) Procyon lotor: Raccoon (mapache); 4 pieces per year. l) Nasua narica: White-nosed coati (pizote); 3 pieces per year.\n\nm) Ctenosaura similis: Black spiny-tailed iguana (garrobo); 4 pieces per year.\n\nCHAPTER VI\n\nGeneral Provisions on Major and Minor Hunting\n\nArticle 16.—In the case of private farms, hunters must obtain the corresponding permit from the owner, in accordance with the provisions of Article 32 of the Wildlife Conservation Law (Ley de Conservacion de la Vida Silvestre).\n\nArticle 17.—In accordance with the provisions of Articles 12, 17, 30, and 63 of Law 7317, Wildlife Conservation Law, the Subregional Offices, as well as the Administration Offices of the National Wildlife Refuges (Refugios Nacionales de Fauna Silvestre) in the different Conservation Areas that make up the National System of Conservation Areas, will be responsible for authorizing, issuing, and signing continental and marine sport hunting and fishing licenses in those protected areas that include marine extensions, required for the fulfillment of the purposes set forth in this Decree.\n\nArticle 18.—\"Bag limit\" (limite de piezas) is defined as the maximum number of game animals authorized in this decree. The bag limit may be cumulative per days of hunting in the case of ducks, pigeons, and quails, provided that the hunter reports the number of pieces hunted per day, at the Delegation of the Rural Assistance Guard (Guardia de Asistencia Rural) or the SINAC office closest to the hunting zone visited.\n\nArticle 19.—The National System of Conservation Areas (SINAC), through its regional offices, may authorize the holding of hunting tournaments (Art. 24 of the regulation of the Wildlife Conservation Law), during the authorized periods in each hunting zone in accordance with Article 8, by administrative resolution, only when dealing with:\n\na) Tracking of prepared tracks for the purposes of the tournament on a specific day; for which the harassment, mistreatment, or killing of wild animals is not authorized.\n\nb) Minor hunting tournaments of songbirds and plumage birds and their release at the same capture site.\n\nc) Song tournaments of songbirds in indoor or enclosed sites conditioned for such purpose.\n\nIn all cases, participants must carry and show, if required, the corresponding valid hunting license. Hunting tournaments must be supervised by SINAC officials from the corresponding Conservation Area.\n\nCHAPTER VII\n\nOn Continental Fishing\n\nArticle 20.—Fishing is prohibited:\n\na) For rainbow trout (Trucha Arco Iris) (Salmo gardnieri) in all national rivers, between February 1 and April 30 inclusive; outside of that period, fishing will be allowed with a limit of 5 pieces with a minimum size of 25 cm in length, per person per day. Fishing for trout raised in ponds may be conducted throughout the year.\n\nb) For trout in the Rio Toro and its tributaries in the district of Toro Amarillo of the canton of Valverde Vega.\n\nc) For guapote (Cichlasoma spp), snook (robalo) (Centropomus undecimalis), tarpon (sabalo) (Tarpon atlanticus), gaspar (Atractosteus tropicus), and other fish species, in the following rivers and their tributaries: Frio, Zapote, Niño or Pizote, lagoons of the Caño Negro Wildlife Refuge (Refugio de Fauna Silvestre) and the Las Camelias Wildlife Refuge, between April 1 and July 31 inclusive. Outside of this period, fishing will be allowed with a limit of 5 fish with a minimum size of 25 cm in length, per person per day. Fishing for fish raised in ponds may be conducted throughout the year.\n\nd) For all species of freshwater fish in all rivers, including their tributaries, lakes, and lagoons (except as provided in subsection c) and Article 20 of this decree), between September 1 and November 30 inclusive. Outside of that period, fishing will be allowed with a limit of 5 pieces with a minimum size of 25 cm in length, per person with a license per day. The tepemechin is excepted, for which no length limit is established.\n\ne) For river prawn or shrimp (langostino o camaron de rio) (Macrobrachium spp.) in all national rivers between May 15 and December 31, inclusive. Outside of this period, fishing will be allowed with a limit of 5 pieces per person, per day.\n\ne) Sport fishing in the Laguna de Hule, located in the Bosque Alegre Private Fauna Refuge (Refugio de Fauna Privado), Cariblanco.\n\nf) In Indigenous Reserves (except subsistence fishing (pesca de subsistencia) conducted by indigenous people with a SINAC permit)\n\nArticle 21.—The following is authorized:\n\na) Sport fishing, with rod and reel, as well as hand lines, from 6:00 a.m. to 5:00 p.m.\n\nb) Fishing every day of the year in:\n\n1. In the Rio Reventazon from Palomo de Orosi to its mouth, with the exception of its tributaries. The bag limit is established at 5 fish per licensed angler per day.\n\n2. Fishing conducted with a hand line or rod and reel in the Arenal Reservoir (Embalse de Arenal). The bag limit is established at 10 fish per licensed angler per day.\n\n3. In the Bars of Colorado, Parismina, Tortuguero, and Matina. The bag limit in the cited bars will be 5 fish per angler per day. A river bar (barra) shall be understood as the riverbed comprised up to one kilometer upstream, starting from its mouth.\n\nc) Subsistence fishing conducted by Indigenous people in the Indigenous Reserves with a SINAC permit.\n\nd) Fishing in Wildlife Refuges (Refugios de Fauna Silvestre) and National Parks when the activity is contemplated in the Management Plan (Plan de Manejo).\n\nCHAPTER VIII\n\nOn the Keeping of Wild Animals in Captivity\n\nArticle 22.—In accordance with Article 19 of Law N° 7317 of December 7, 1992, individuals who capture wild animals authorized by this decree and under the protection of the corresponding license must register said animals before the corresponding regional office of the National System of Conservation Areas of MINAE within one month following the capture.\n\nIn the case of keeping plumage birds and songbirds in captivity in properly conditioned aviaries, a total limit of 15 birds per licensee with a license is established.\n\nArticle 23.—The hunting or capture of species that do not appear contemplated in the lists of species authorized for hunting is prohibited indefinitely.\n\nArticle 24.—The exhibition of songbirds or plumage birds at farmer's markets (ferias del agricultor) is prohibited.\n\nArticle 25.—The keeping of wild birds in captivity shall be governed by the stipulations in this Decree and Executive Decrees N° 26435-MINAE and 28312-MINAE.\n\nArticle 26.—The application of this Decree is excepted for game farms (fincas cinegeticas) duly registered with the National System of Conservation Areas of MINAE.\n\nArticle 27.—Modify subsection p) of Article 15 of Decree N° 26435-MINAE.\n\nArticle 28.—Repeal Executive Decree N° 28884-MINAE.\n\nArticle 29.—This Decree shall take effect on the first day of January of the year 2001 and expires on the thirty-first of March of 2002." }
