  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29147\n\n                        Reforma Reglamento a la Ley Forestal\n\nTexto Completo acta: ABA6A\n\n(Este decreto fue derogado por\nel artículo 6° del decreto ejecutivo N° 33815 del 15 de febrero de\n2007)\n\nN° 29147-MINAE\n\nEL PRESIDENTE DE LA REPUBLICA Y LA MINISTRA DEL AMBIENTE Y ENERGIA\n\nEn ejercicio de las facultades que les confieren el articulo 140, incisos 3) y 18) de\nla Constitucion Publica y de conformidad con lo dispuesto en la Ley Forestal N° 7575\npublicada en el Alcance N° 21 a La Gaceta N° 72 del martes 16 de abril de 1996.\n\nConsiderando:\n\n1°-Que de conformidad con la Ley Forestal N° 7575, publicada en el Alcance N° 21 a\nLa Gaceta N° 72 del dia 16 de abril de 1996, se establece en su articulo 1° la funcion\nesencial y prioritaria del Estado, en velar por la conservacion, proteccion y\nadministracion de los bosques naturales, el aprovechamiento, la industrializacion y el\nfomento de los recursos forestales del pais destinados a ese fin, de acuerdo con el\nprincipio de uso adecuado y sostenible de los recursos naturales renovables.\n\n2°-Que el articulo 6 de la Ley Forestal N° 7575 del 6 de abril de 1996 establece en\nel inciso o), que es competencia de la Administracion Forestal del Estado otorgar las\nlicencias de certificadores forestales, a propuesta de una Comision integrada por\nrepresentantes de entes academicos y cientificos reconocidos, nacionales y extranjeros,\ndestacados en el tema ambiental. A esta Comision, tambien, se le encomendar  regular\ny vigilar el sistema de sellos verdes o certificaciones forestales.\n\n3°-Que el articulo 26 del Reglamento a la Ley Forestal N° 7575, Decreto Ejecutivo\n25721-MINAE, crea la Comision Nacional de Certificacion Forestal, como un organo de la\nAdministracion Forestal Estado, dicha Comision est  integrada por ocho miembros de\nreconocida solvencia tecnica y moral y tendr n un nombramiento que regir  por\ntres años.\n\n4°-Que la Academia Nacional de Ciencias no ha mostrado interes en participar y formar\nparte de la Comision Nacional de Certificacion Forestal.\n\n5°-Que es de vital importancia para la Administracion Forestal del Estado y la\nComision Nacional de Certificacion forestal contar con un mecanismo de renovacion de sus\nmiembros que garantice la continuidad del trabajo del Sistema Nacional de Certificacion\nForestal.\n\nPor tanto, Decretan:\n\nArticulo 1°-Modifiquese el parrafo primero del articulo 26 del Reglamento a la Ley\nForestal N° 7575, Decreto Ejecutivo N° 25721-MINAE del 17 de octubre de 1996, para que\nen lo sucesivo se lea:\n\nArticulo 26.-Crease la Comision Nacional de Certificacion Forestal, como organo de la\nA.F.E., dicha comision esta  integrada por ocho miembros de reconocida solvencia\ntecnica y moral, tres representantes sera n de las universidades nacionales con\ndesarrollo de carreras de educacion superior en el  area forestal y biologia, dos\nrepresentantes de organismos cientificos internacionales involucrados en proyectos de\ncooperacion tecnica y desarrollo forestal, dos representantes de entidades cientificas de\nreconocida trayectoria en el campo de la investigacion forestal y un representante del\nColegio de Ingenieros Agronomos. This Commission is also entrusted with regulating\nand overseeing the system of green seals or forest certifications.\n\n3°-That article 26 of the Regulation to the Forestry Law No. 7575, Executive Decree\n25721-MINAE, creates the National Forest Certification Commission (Comisión Nacional de Certificación Forestal), as a body of the\nState Forestry Administration; said Commission is composed of eight members of\nrecognized technical and moral solvency, and their appointment shall be valid for\nthree years.\n\n4°-That the National Academy of Sciences (Academia Nacional de Ciencias) has not shown interest in participating and being\npart of the National Forest Certification Commission.\n\n5°-That it is of vital importance for the State Forestry Administration and the\nNational Forest Certification Commission to have a mechanism for the renewal of its\nmembers that guarantees the continuity of the work of the National Forest Certification\nSystem.\n\nTherefore, They Decree:\n\nArticle 1-The first paragraph of article 26 of the Regulation to the\nForestry Law No. 7575, Executive Decree No. 25721-MINAE of October 17, 1996, is hereby amended to\nhenceforth read:\n\nArticle 26.-The National Forest Certification Commission is hereby created, as a body of the\nA.F.E.; said commission is composed of eight members of recognized technical\nand moral solvency; three representatives shall be from national universities with\nhigher education programs in the fields of forestry and biology, two\nrepresentatives from international scientific organizations involved in\ntechnical cooperation and forest development projects, two representatives from scientific entities of\nrecognized trajectory in the field of forest research, and one representative from the\nCollege of Agronomists (Colegio de Ingenieros Agrónomos). None of the representatives may be a forestry regent (regente\nforestal) or have been one in the six months prior to their designation, nor have a direct\nor indirect relationship with any national certifying entity. MINAE shall convene the\nentities indicated in this article so that they submit to the Minister of the Environment and Energy\na shortlist of three candidates one month after the publication of this Regulation, who\nshall make the appointments. The appointment shall be valid for three years, with the possibility of being\nreelected. In order to give continuity to the work of the Commission, as of the\npublication of this Decree, appointments shall be made in the following manner:\n\na) The current representatives of: one of\nthe universities, two of the international scientific organizations, and one of\nthe scientific entities of recognized trajectory in the field of forest research shall remain in their positions for one more year.\n\nb) The other representatives must be appointed within the period and for the term\nestablished in this article. In the event of resignation, removal from office, or any other\ncircumstance, the appointment of the substitute shall be made for the remaining\nperiod, following the same shortlist procedure established in this article.\n\nIn the event of resignation, removal from office, or any other circumstance, the appointment\nof the substitute shall be made for the remaining period, following the same shortlist procedure established in this article.\n\nArticle 2-It shall become effective upon its publication."
