  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29190\n\n                        Reforma Reglamento para el Control de Contaminación por Ruido\n\n(Este\ndecreto fue derogado por el artículo 1° del decreto ejecutivo N° 33168 del 17\nde mayo del 2006).\n\n \n\nN°\n29190\n\n \n\nEL\nPRESIDENTE DE LA REPÚBLICA\n\nY\nEL MINISTRO DE SALUD\n\n \n\nEn\nejercicio de las facultades que les confieren los artículos 140, incisos 3) y\n18) 176 y 185 de la\n Constitución Política, 28 de la ley N° 6227 de 2 de mayo de\n1978, Ley General de\nla Administración Pública y 2) y 7) de\nla Ley N° 5395 del 23 de\noctubre de 1997 Ley General de Salud.\n\n \n\nConsiderando:\n\n \n\n1°-Que\nmediante Decreto N° 78718- S, publicado en\nLa Gaceta N° 155 del 14 de\nagosto del 2000, el Poder Ejecutivo emitió el Reglamento para el Control de\nla Contaminación por\nRuido.\n\n2°-Que\nla Defensoría\nde los Habitantes de la\n República, interpone ante\nla Sala Constitucional\nde la Corte Suprema\nde Justicia, Acción de inconstitucionalidad contra el supracitado\nDecreto 78718-S.\n\n3°-Que\nmediante resolución de las 15,45 horas del nueve de octubre del dos mil,\nla Sala Constitucional\nde la Corte Suprema\nde Justicia, con relación a la\n Acción de Inconstitucionalidad señala: \"...lo único que\nla acción suspende en vía administrativa es el dictado de la resolución final\nen los procedimientos tendentes a agotar esa vía, que son los que se inician\ncon y a partir del recurso de alzada o de reposición interpuestos contra el\nacto final, salvo claro está que se trate de normas que deben aplicarse durante\nla tramitación en cuyo caso la suspensión opera inmediatamente\".\n\n4°-Que\nel Decreto 78718-S supracitado derogó los artículos 6\ny 50 del Decreto Ejecutivo N° 11492-S de 22 de abril de 1980 y sus reformas,\npor lo que no existe norma legal vigente que permita a las autoridades de salud\nejercer el control de la contaminación por ruido.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 29190\n\n                        Reform of the Regulation for the Control of Pollution by Noise\n\n(This\ndecree was repealed by article 1 of executive decree No. 33168 of May 17,\n2006).\n\n \n\nNo.\n29190\n\n \n\nTHE\nPRESIDENT OF THE REPUBLIC\n\nAND\nTHE MINISTER OF HEALTH\n\n \n\nIn\nexercise of the powers conferred by articles 140, subsections 3) and\n18), 176, and 185 of the\n Political Constitution, 28 of Law No. 6227 of May 2,\n1978, the General Law of\nPublic Administration, and 2) and 7) of\n Law No. 5395 of October 23,\n1997, the General Health Law.\n\n \n\nConsidering:\n\n \n\n1°—That\nthrough Decree No. 78718- S, published in\nLa Gaceta No. 155 of August 14,\n2000, the Executive Branch issued the Regulation for the Control of\nPollution by\nNoise.\n\n2°—That\nthe Office of the Ombudsman (Defensoría\nde los Habitantes) of the\n Republic filed before\nthe Constitutional Chamber (Sala Constitucional)\nof the Supreme Court\nof Justice an action of unconstitutionality against the above-cited\nDecree 78718-S.\n\n3°—That\nthrough a resolution issued at 3:45 p.m. on October 9, 2000,\nthe Constitutional Chamber (Sala Constitucional)\nof the Supreme Court\nof Justice, regarding the\n Action of Unconstitutionality, states: \"...the only thing\nthat the action suspends in the administrative channel is the issuance of the final resolution\nin the proceedings aimed at exhausting that channel, which are those that commence\nwith and following the appeal or motion for reconsideration filed against\nthe final act, except, of course, in the case of rules that must be applied during\nthe proceedings, in which case the suspension takes effect immediately.\"\n\n4°—That\nthe above-cited Decree 78718-S repealed articles 6\nand 50 of Executive Decree No. 11492-S of April 22, 1980, and its amendments,\nand therefore no legal rule is in force that allows the health authorities\nto exercise control of pollution by noise. It is therefore necessary and timely\nto repeal article 30 of Executive Decree No. 78718-S, for the\npurpose of bringing back into force articles 6 and 50 of Executive Decree\nNo. 11492-S and its amendments.\n\n \n\nTherefore,\n\n \n\nThey decree:\n\n \n\nArticle\n1°—Article 30 of Executive Decree No. 78718-S of August 14,\n2000, is repealed.\n\nArticle 2°—This decree takes effect upon publication.\n\nIssued at the Office of the President of the Republic.— San José, on the\nfourth day of December, two thousand."
