la ley N° 2762 del 21 de junio de 1961 y sus reformas, que es\nLey sobre el R‚gimen de Relaciones entre productores, beneficiadores y exportadores\nde caf‚; y de conformidad con lo dispuesto en la ley n£mero 7664, del 8 de abril de\n1997, que es Ley de Protección Fitosanitaria.\n\nConsiderando:\n\n1°-Que el Servicio Fitosanitario del Estado ha confirmado en territorio nacional, la\npresencia de la plaga denominada como Broca del Cafeto (Hypothenemus hampei, Ferr.); la\ncual, hasta ahora, era considerada exótica pues no había sido detectada en las\nplantaciones cafetaleras de nuestro país.\n\n2°-Que la broca del cafeto constituye una plaga de gran importancia cuarentenaria y\nque afecta las plantaciones cafetaleras, en especial el grano.\n\n3°-Que se hace necesario adoptar las medidas técnicas y jurídicas que permitan\nevitar la diseminación de la plaga a efecto de disminuir los daños y perjuicios que\nocasiona a la actividad cafetalera y a la economía nacional.\n\n4°-Que la actividad cafetalera es de interés público conforme lo dispone el artículo\n2° de la ley número 2762 y sus reformas, Ley sobre el Régimen de relaciones entre\nproductores, beneficiadores y exportadores de caf‚.\n\n5°-Que ante la presencia de plagas de importancia cuarentenaria y económica, que\namenacen la producción agrícola, el Poder Ejecutivo podr  decretar Estado de\nEmergencia Nacional.\n\nPor tanto, Decretan:\n\nDECLARATORIA DE ESTADO DE EMERGENCIA NACIONAL POR LA PLAGA CUARENTENAL BROCA DEL CAFETO\n(Hypothenemus hampei, Ferr.)\n\nArtículo 1°-Se declara oficialmente emergencia nacional cuarentenaria por la\npresencia en territorio nacional de la plaga denominada Broca del Cafeto (Hypothenemus\nhampei, Ferr).\n\nArtíulo 2°-Se declara que la lucha contra dicha plaga es de combate particular\nobligatorio y todas las medidas fitosanitarias que dicte el Poder Ejecutivo a través del\nServicio Fitosanitario del Estado son de orden público y de obligatorio cumplimiento.\n\nArtículo 3°-Todo productor, beneficiario, o sujeto público o privado, involucrado\ndirecta o indirectamente en la producción cafetalera, que tenga conocimiento de la plaga\ndeber  denunciarlo al Servicio Fitosanitario del Estado.\n\nArtículo 4°-Los propietarios de las plantaciones de café afectadas por la broca\ndeberán ejecutar todas las medidas sanitarias que se les ordene por parte del Servicio\nFitosanitario del Estado. En caso contrario se proceder  conforme a lo dispuesto en\nel artículo 15 de la Ley de Protección Fitosanitaria del Estado.\n\nArtículo 5°-Como efecto inmediato de la detección de la plaga, la plantación\nafectada quedar  de inmediato cuarentenada. Para efectos de detección y control de\nla broca, los funcionarios del Servicio Fitosanitario tendrán libre acceso a las\nplantaciones cafetaleras.\n\nArtículo 6º—A partir de la presente declaración de emergencia y para evitar la\n diseminación de la plaga de la broca del cafeto es obligatorio para productores y\n beneficiadores, beneficiar el café en su zona de producción y se prohíbe el traslado de\n café de zonas con presencia de broca hacia zonas libres. Otherwise, proceedings shall be in accordance with the provisions of Article 15 of the State Phytosanitary Protection Law.\n\nArticle 5—As an immediate effect of the detection of the pest, the affected plantation shall be immediately quarantined. For purposes of detection and control of the borer, officials of the Phytosanitary Service shall have free access to coffee plantations.\n\nArticle 6—As of this declaration of emergency and to prevent the dissemination of the coffee berry borer pest, it is mandatory for producers and processors to process the coffee in its production zone, and the transfer of coffee from zones with borer presence to pest-free zones is prohibited.
