Ley de Creación del Instituto Costarricense de\n\nla Pesca\n y Acuacultura y en el Acuerdo AJDIP/107-2000, del 12 de abril del 2000,\npublicado en\n\nLa Gaceta N\n° 85 del 4 de mayo del 2000.\n\nGLOSARIO Y SIGLAS\n\n-\nAcuerdo sobre el Programa Internacional para\n\nla Conservación\n de los Delfines (APICD): suscrito por Costa Rica y los\nEstados Unidos de América aprobado mediante Ley N° 7938 del 4 de noviembre de\n1999.\n\n-\nAtún dolphin safe (ADS): Es el atún capturado\nen lances en los que no hay delfines muertos o con daño aparente.\n\n-\nAtún no\ndolphin safe (ANDS): Es el atún capturado con daño aparente o mortalidad\nde deIfines.\n\n-\nAutoridad Nacional (AN): Es\nla Dirección General\n Técnica del Institulo Costarricense de Pesca y Acuacultura (INCOPESCA)\n\n-\nÁrea del acuerdo: Es la zona abarcada\npor el APICD\n\n-\nBarco Atunero: Embarcación\ncon red de cerco dedicada a la captura de túnidos.\n\n-\nCertificación: Es el procedimiento realizado por\nla Autoridad Pesquera\n Nacional que culmina en la emisión de un documento que certifica el\ncumplimiento del proceso de trazabilidad del atún dolphin sale acorde con el\nAPICD.\n\n-\nComisión Interamericana del Atún Tropical (CIAT):\nComisión Intergubernamental integrada por países signatarios y observadores,\nencargados de regular el recurso atunero en el Océano Pacifico Oriental.\n\n- Secretariado: Es el personal de\nla CIAT.\n\n-\nFrigorífico: Infraestructura requerida para el\nalmacenamiento congelado del atún.\n\n-\nObservador: Oficial acreditado y asignado a un\nbarco atunero por\n\nla Comisión\n Interamericana\n del Atún Tropical para realizar labores específicas de observación a bordo.\n\n-\nPlanta de Proceso: Instalaciones\ndedicadas a la transformación industrial\ndel atún.\n\n-\nRegistro de Seguimiento del Atún (RSA);\nSon los formularios bilingües en Español e Inglés en los cuales se\nidentificara el número del viaje correspondiente v el registro de la información\nde cada lance de pesca realizado durante el viaje que permita identificar el\ncontenido de cualquier bodega, del barco atunero como dolphin safe o no dolphin\nsale. Estos documentos están sujetos a las disposiciones del párrafo 3,6 del\nsistema de seguimiento y verificación que los clasifica como documentos\noficiales confidenciales del Programa Internacional para\n\nla Conservación\n de los Delfines (Art. XVIII).\n\n-\nTanques, pozos o bodegas: Entiéndase los\ncompartimentos destinados al almacenamiento de atún en los barcos atuneros.\n\n-\nTrazabilidad: Es el procedimiento que permite\ndeterminar el origen del atún en cualquier parte de su proceso, entiéndase\ndesde su descarga en puertos nacionales hasta su exportación.\n\n1. REQUISITOS GENERALES\n\n1.1  \nEl barco atunero debe tener\n\nla Licencia\n de Pesca o el registro al día.\n\n1.2 \nEl barco atunero que no tenga registro o licencia nacionales podrá\ndescargar su producción total o parcialmente siempre cuando la misma halla sido\ncapturada en aguas no jurisdiccionales de Costa Rica y cumpla con los requisitos\nestablecidos por el Acuerdo sobre el Programa Internacional de Conservación de\nDelfines (APICD).\n\n1.3 \nEl Frigorífico y\n\nla Planta\n de Proceso deben contar con los respectivos permisos o licencias exigidas por\nel INCOPESCA. Los cuales para el presente reglamento serán: Licencia de\ncomercialización.\n\n1.4\nLos vehículos utilizados para el transporte de los tú nidos entre el barco\natunero y frigorífico y de este hasta la planta de proceso deberán\ncontar con el respectivo permiso de transporte emitido por el INCOPESCA.\n\n1.5 \nLa solicitud de inspección, lanío de la descarga, como de su\nsubsiguiente transporte, almacenamiento debe presentarse por escrito ante\n\nla Dirección\n General\n Técnica del INCOPESCA.\n\n1.6\nEl interesado deberá informar a\nla AN\n el día y la hora en que iniciará el proceso industrial del ADS ya almacenado.\n\n2. PRESENTACIÓN DE\nDOCUMENTOS\n\n2.1   Las\nsolicitudes a que se refieren los puntos 1.5 y 1.6: deberán\nestar firmadas por el responsable debidamente acreditado por el consignatario\ndel atún ante\nla AN. Esta\n deberá ser presentada por escrito en original y copia ante esa misma\nAutoridad con al menos 8 horas hábiles de anidación al inicio de las\noperaciones correspondientes y en las mismas deberá hacerse constar\ninmediatamente el día y la hora de recibo, la copia se entregara al interesado\n\n2.2 \nLos documentos RSA: Debe ' ser retenidos por\nla AN\n, para tal fin estos documentos le serán entregados al inicio de\n\nla Inspección\n por parle del Observador, el Capitán o el Responsable de la embarcación. En\ncaso fortuito o de fuerza mayor, el Observador, el Capitán o el Ingeniero de máquinas,\npodrán dejar los RSA con el destinatario del Atún, en un sobre cerrado y\nfirmado para que le sea entregado a\nla AN\n a la mayor brevedad.\n\n2.3\nRevisión de los documentos RSA: Serán revisados inmediatamente después de\nrecibidos por\nla AN\n, a efecto que no presenten alteraciones u omisiones que hagan dudar de\nsu validez. Si los mismos tuvieran dichas alteraciones u omisiones deberán ser\ndevueltos a quien los entregó para su corrección inmediata, si eso no fuera\nposible el atún al cual se refieren se considerará ANDS.\n\n2.4.\nTramitación de los\nKSA:\n\n2.4.1\nCuando la totalidad de la. captura es desembarcada en Cosía Rica. En un plazo\nno mayor de 20 días después de recibidos los RSA\n\nla AN\n enviará una copia del o de los documentos al Secretariado de\nla CIAT\n,.así como a\n\nla Autoridad Nacional\n de la parte bajo cuya jurisdicción opera el barco.\n\n2.4.2\nCuando la captura es desembarcada parcialmente y el viaje de pesca termina. Se\nreciben los RSA, se revisaran según se estableció en el punto 2.3 y se emitirán\notros nuevos RSA. El atún que fue retenido en e! barco se anotara como dalo\ninicial en dicho documento, los documentos recibidos por\n\nla AN\n se tratarán según párrafo anterior.\n\n2.4.3\nCuando la captura es desembarcada parcialmente y el viaje de pesca no termina.\nEl barco retendrá los RSA originales y entregará una copia de los mismos con\nfirmas originales a\nla AN\n, la cual seguirá el mismo proceso de remisión de copias de los mismos\nestablecido en el párrafo 2.4.1\n\n2.4.4\nLa información que reciba\nla AN\n, deberá ser ingresada por esta a una base de datos, que deberá reflejar, en\notros, la ubicación del atún para efectos de su trazabilidad \ny  posterior certificación de\nsu exportación.\n\n3 PROCEDIMIENTO INTERNO\n\n3.1  Inspección de la\ndescarga\n\n3.1.2\n\nLa AN\n verificará la cantidad y ubicación del ANDS que haya anotado el observador en\nel o los RSA correspondientes.\n\n3.1.3\n\nLa AN\n verificará los pesos y las especies del ADS y ANDS, los cuales serán\ndescargados a contenedores de transporte separados según esas dos categorías,\nestos deberán a su vez. estar debidamente identificados.. Una vez. clasificado\ne] atún será almacenado en \"tinas\" u otros tipos de bodegas que\ntambién deberán ser debidamente identificados, indicando además el número de\nRSA correspondiente, el peso y la especie de atún que contiene.\n\n3.1.4\nSi el atún recibido y almacenado por un primer destinatario es transferido a un\nsegundo, aquel deberá notificar a\nla AN\n la transferencia, detallando los números de RSA, de las tinas u otros tipos de\nbodega, la especie y el peso, así como el nombre del nuevo destinatario.\n\n3.2  Inspección del procesa\nmiento\n\n3.2.1\n\nLa AN\n verificará que el ADS y ANDS no sean procesados en la misma línea al mismo tiempo.\n\n3.2.2\n\nLa AN\n verificará que los procesadores mantengan registros lo suficientemente\ncompletos que permitan seguir los números de lote de atún procesado hasta el número\nde RSA correspondiente para lo cual tendrá las facilidades necesarias.\n\n3.2.3\n\nLa AN\n deberá realizar verificaciones in situ de acuerdo a su discreción, emitiendo\npara cada inspección un informe que deberá firmar tanto\n\nla AN\n como el responsable de la planta procesadora.\n\n4.\nPROCEDIMIENTO EXTERNO\n\n4.1\nCertificación. Cada exportación de ADS que una planta de proceso realice\nbajo el APICD, debe de contar con una certificación emitida por\n\nla AN\n en la cual se debe indicar que el atún en referencia que se está exportando,\nha cumplido con todos los requisitos establecidos en el presente reglamento, que\nle confieren de ADS según el APICU. En cada certificación debe de incluirse la\nreferencia del RSA correspondiente.\n\n5.\nTRATAMIENTO DE\nLA INFORMACIÓN. GENERAL REQUIREMENTS\n\n1.1\nThe tuna vessel must have\nthe Fishing License or registration up to date.\n\n1.2\nThe tuna vessel that does not have a national registration or license may\nunload its production in whole or in part provided that it was\ncaught in non-jurisdictional waters of Costa Rica and complies with the requirements\nestablished by the Agreement on the International Program for the Conservation of\nDolphins (APICD).\n\n1.3\nThe Cold Storage Facility and\nthe Processing Plant must have the respective permits or licenses required by\nINCOPESCA, which for the present regulation shall be: Commercialization License.\n\n1.4\nThe vehicles used for the transport of tunas between the tuna vessel\nand the cold storage facility, and from the latter to the processing plant, must\nhave the respective transport permit issued by INCOPESCA.\n\n1.5\nThe request for inspection, both of the unloading and of its\nsubsequent transport and storage, must be submitted in writing to\nthe General Technical Directorate of INCOPESCA.\n\n1.6\nThe interested party must inform\nthe AN of the day and time when the industrial process of the already-stored ADS will begin.\n\n2. PRESENTATION OF\nDOCUMENTS\n\n2.1 The\nrequests referred to in points 1.5 and 1.6 must\nbe signed by the responsible person duly accredited by the tuna consignee\nbefore the AN. This\nmust be submitted in writing in original and copy before that same\nAuthority with at least 8 working hours of anticipation prior to the start of the\ncorresponding operations, and the day and time of receipt must be noted\nimmediately on them; the copy will be given to the interested party.\n\n2.2\nThe RSA documents: Must be retained by\nthe AN; to this end, these documents shall be delivered to them at the start of\nthe Inspection by the Observer, the Captain, or the Person in Charge of the vessel. In\nunforeseen circumstances or force majeure, the Observer, the Captain, or the Chief Engineer\nmay leave the RSAs with the recipient of the Tuna, in a closed and\nsigned envelope, so that it may be delivered to\nthe AN as soon as possible.\n\n2.3\nReview of the RSA documents: They shall be reviewed immediately after\nthey have been received by\nthe AN, in order to ensure they do not present alterations or omissions that cast doubt on\ntheir validity. If said alterations or omissions exist, they must be\nreturned to the person who delivered them for immediate correction; if that is not\npossible, the tuna to which they refer shall be considered ANDS.\n\n2.4.\nProcessing of the\nRSAs:\n\n2.4.1\nWhen the entire catch is landed in Costa Rica. Within a period\nno greater than 20 days after receiving the RSAs,\nthe AN shall send a copy of the document(s) to the Secretariat of\nthe CIAT, as well as to\nthe National Authority of the party under whose jurisdiction the vessel operates.\n\n2.4.2\nWhen the catch is partially landed and the fishing trip ends. Upon receiving\nthe RSAs, they shall be reviewed as established in point 2.3, and\nnew RSAs shall be issued. The tuna that was retained on the vessel shall be noted as the initial\ndata on said document; the documents received by\nthe AN shall be handled according to the preceding paragraph.\n\n2.4.3\nWhen the catch is partially landed and the fishing trip does not end.\nThe vessel shall retain the original RSAs and deliver a copy of them with\noriginal signatures to\nthe AN, which shall follow the same process of sending copies of them as\nestablished in paragraph 2.4.1.\n\n2.4.4\nThe information that\nthe AN receives must be entered by it into a database, which must reflect,\namong other things, the location of the tuna for purposes of its traceability\nand subsequent certification of\nits export.\n\n3 INTERNAL PROCEDURE\n\n3.1 Inspection of the unloading\n\n3.1.2\nThe AN shall verify the quantity and location of the ANDS that the observer has noted on\nthe corresponding RSA(s).\n\n3.1.3\nThe AN shall verify the weights and species of the ADS and ANDS, which shall be\nunloaded into separate transport containers according to these two categories;\nthese must in turn be duly identified. Once classified,\nthe tuna will be stored in bins (\"tinas\") or other types of holds that\nmust also be duly identified, also indicating the corresponding\nRSA number, the weight, and the tuna species they contain.\n\n3.1.4\nIf the tuna received and stored by a first recipient is transferred to a\nsecond, the former must notify\nthe AN of the transfer, detailing the RSA numbers, the bins or other types of\nholds, the species, and the weight, as well as the name of the new recipient.\n\n3.2 Inspection of the processing\n\n3.2.1\nThe AN shall verify that the ADS and ANDS are not processed on the same line at the same time.\n\n3.2.2\nThe AN shall verify that processors maintain sufficiently\ncomplete records that allow tracking the lot numbers of processed tuna to the\ncorresponding RSA number, for which they shall have the necessary facilities.\n\n3.2.3\nThe AN must carry out on-site verifications at its discretion, issuing\na report for each inspection that must be signed by both\nthe AN and the person in charge of the processing plant.\n\n4.\nEXTERNAL PROCEDURE\n\n4.1\nCertification. Every export of ADS that a processing plant carries out\nunder the APICD must have a certification issued by\nthe AN in which it must be stated that the tuna in question being exported\nhas met all the requirements established in this regulation, which\nconfer upon it the status of ADS according to the APICD. Each certification must include the\nreference of the corresponding RSA.\n\n5.\nPROCESSING OF\nINFORMATION. As\nestablished in Article 18 of the international agreement for the conservation of\ndolphins, signed between\nthe Republic of Costa Rica and the United States of America, the tuna tracking\nforms shall be treated by\nthe National Authority as confidential official documents.\n\nFinal agreement, let it be published.\n\nPuntarenas, November 21, 2000." }
