de Creación del Programa Ganadero y de Sanidad\nAnimal (PROGASA), la Dirección de Salud Animal pasó a denominarse Dirección de Salud y Producción\nPecuaria.\n\n4º-Que conforme a lo dispuesto en la Ley Orgánica del Ministerio de Agricultura y Ganadería,\nartículo 51, inciso d), incorporada en la Ley Nº 7064, la organización funcional y administrativa de\naquellas estructuras institucionales creadas por leyes especiales se dictará por el Ministerio a\ntravés del mecanismo correspondiente, a efecto de dar respuesta a las necesidades que demandan los\nproductores agropecuarios de nuestro país.\n\n5º-Que resulta necesario a efecto de ajustar la estructura de la Dirección de Salud y Producción\nPecuaria a su marco legal y funcional, reformar en lo pertinente, el Decreto Ejecutivo Nº Los servicios serán brindados\ncon el costo que establezca el Decreto de Cobro de Servicios del Ministerio de Agricultura\ny Ganadería.\n\n4º Coordinar a través del\nDirector de Salud Animal y Producción Pecuaria, los convenios, acuerdos, contratos,\ncartas de entendimiento y similares con personas jurídicas, públicas o privadas,\nnacionales o internacionales en las materias de su competencia.\n\n5º Cualquier otra función que\nlas autoridades superiores, leyes, reglamentos o disposiciones normativas le asignen.\n\nArtículo 5º-A partir de la publicación del presente Decreto, el Director de Investigaciones\nAgropecuarias y las autoridades administrativas del Ministerio de Agricultura y Ganadería,\nrealizarán y dispondrán las acciones y el traslado pertinente y que fuere requerido de los bienes,\nactivos y recursos del Centro de Inseminación Artificial y del Laboratorio de Piensos y Forrajes,\nque funcionan actualmente, a los efectos de su integración a la Dirección de Salud y Producción\nPecuaria.\n\nArtículo 6º-Los funcionarios de la Dirección de Investigaciones Agropecuarias que con motivo de las\nmodificaciones aquí contempladas deban pasar a prestar sus servicios para la Dirección de Salud y\nProducción Pecuaria, conservarán todos sus derechos y obligaciones laborales, debiendo el\nDepartamento de Recursos Humanos realizar las acciones y gestiones administrativas necesarias para\nimplementar su traspaso de la Dirección de Investigaciones Agropecuarias a la Dirección de Salud y\nProducción Pecuaria.\n\nArtículo 7º—Rige a partir de su publicación.", "body_en_text": "across the entirety of the text\n\n -\n\n Complete Text of Regulation 29252\n\n Amendment to the Regulation to the Organic Law of the Ministry of Agriculture and\nLivestock\n\nComplete Text record: 3BE59\nNo. 29252-MAG\n\nNo. 29252-MAG\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nIn exercise of the powers granted to them by article 140, subsections 3) and 18) of the Political Constitution, Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 6243 of May 2, 1978, Animal Health Law, Law No. 7060 of March 31, 1987, Law Creating the Livestock and Animal Health Program (PROGASA), and Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural and Livestock Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock.\n\nConsidering:\n\n1º—That the Animal Health Directorate of the Ministry of Agriculture and Livestock was created by Law No. 6243 of May 2, 1978.\n\n2º—That said law declares sanitary measures and those that promote the improvement of animal production to be of public interest and mandatory application.\n\n3º—That by Law No. 7060 of March 31, 1987, Law Creating the Livestock and Animal Health Program (PROGASA), the Animal Health Directorate was renamed the Directorate of Animal Health and Livestock Production.\n\n4º—That pursuant to the provisions of the Organic Law of the Ministry of Agriculture and Livestock, article 51, subsection d), incorporated into Law No. 7064, the functional and administrative organization of those institutional structures created by special laws shall be issued by the Ministry through the corresponding mechanism, in order to respond to the needs demanded by the agricultural and livestock producers of our country.\n\n5º—That it is necessary, in order to adjust the structure of the Directorate of Animal Health and Livestock Production to its legal and functional framework, to amend, as pertinent, Executive Decree No. 26431-MAG of October 2, 1997, published in La Gaceta No. 213 of November 5, 1997, \"Regulation to the Organic Law of the Ministry of Agriculture and Livestock.\" Therefore,\n\nThey decree:\n\nArticle 1º—Subsection 9 of article 12, subsections 7, 14, and 17 of article 16, and subsection 17 of article 22 of Executive Decree No. 26431-MAG are hereby repealed.\n\nArticle 2º—The nomenclature assigned to the Animal Health Directorate in Executive Decree No. 26431-MAG is corrected so that it correctly reads: \"Of the Directorate of Animal Health and Livestock Production.\"\n\nArticle 3º—Modify subsection 22 of article 12 and articles 13, 16, 22, and 23 of Executive Decree No. 26431-MAG, in the manner set forth below so that they correctly read as follows:\n\n\"Article 12.—...\n\n22. Integrate the actions developed by the Agricultural, Soils, and Livestock Research Departments.\"\n\n\"Article 13.—The Directorate of Agricultural and Livestock Research shall be composed of:\n\n- Agricultural Department\n\n- Livestock Research Department.\n\n- Soils and Land Evaluation Department\"\n\n\"Article 16.—The Livestock Research Department shall have the following functions: ...\".\n\n\"Article 22.—The Directorate of Animal Health and Livestock Production shall have the following functions: ...\n\n17. Maintain animal germplasm collections aimed at the production of genotypes important for livestock production.\n\n18. Any other function assigned to it by higher authorities, laws, regulations, or normative provisions.\"\n\n\"Article 23.—The Directorate of Animal Health and Livestock Production, for the fulfillment of its functions, shall have a Director, a Subdirector, and the Departments of: International Animal Health Services, National Animal Health Services, Livestock Inputs Control, Veterinary Diagnosis, and Livestock Production and Genetic Improvement.\"\n\nArticle 4º—An article 27 Bis is incorporated into Executive Decree No. 26431-MAG, for the purpose of establishing the creation of the Department of Livestock Production and Genetic Improvement of the Directorate of Animal Health and Livestock Production and its respective functions, which shall read as follows:\n\n\"Article 27 Bis.—The Department of Livestock Production and Genetic Improvement shall have the following functions:\n\n1º Conduct research on animal breeds and crossbreeding that leads to a genotype suited to the agroclimatic and socioeconomic conditions of our country.\n\n2º Promote genetic improvement and the nutrition and feeding of the national livestock herd, through artificial insemination processes, animal selection, and the improvement of pastures and forages and animal feeding practices, with emphasis on bovines.\n\n3º Provide artificial insemination services and laboratory analysis in the specific fields of its competence to national producers, individually or organized, as well as to Public or Private Institutions that so require. The services shall be provided at the cost established by the Decree on Service Charges of the Ministry of Agriculture and Livestock.\n\n4º Coordinate, through the Director of Animal Health and Livestock Production, agreements, accords, contracts, memoranda of understanding, and similar instruments with legal persons, public or private, national or international, in matters within its competence.\n\n5º Any other function assigned to it by higher authorities, laws, regulations, or normative provisions.\n\nArticle 5º—As of the publication of this Decree, the Director of Agricultural and Livestock Research and the administrative authorities of the Ministry of Agriculture and Livestock shall carry out and arrange the actions and the pertinent and required transfer of the goods, assets, and resources of the Artificial Insemination Center and the Feed and Forage Laboratory, which are currently operating, for the purpose of their integration into the Directorate of Animal Health and Livestock Production.\n\nArticle 6º—The officials of the Directorate of Agricultural and Livestock Research who, as a result of the modifications contemplated herein, must transfer to provide their services to the Directorate of Animal Health and Livestock Production, shall retain all their labor rights and obligations, and the Department of Human Resources must carry out the necessary administrative actions and procedures to implement their transfer from the Directorate of Agricultural and Livestock Research to the Directorate of Animal Health and Livestock Production.\n\nArticle 7º—It shall enter into force upon its publication." }
