  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29279\n\n                        Crea la Comisón Asesora sore Degradación de Tierras (CEDETI)\n\nNº 29279-MINAE-MAG\n\n (Este\ndecreto fue derogado por el artículo 19° del decreto ejecutivo N° 35216 del 11\nde marzo del 2009).\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LOS MINISTROS DE AMBIENTE Y ENERGÍA(*)\n\nY DE AGRICULTURA Y GANADERÍA\n\n(*)(Modificada su denominación por el artículo 11 de\nla Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al\nMinisterio de Ciencia y Tecnología\", N° 9046 del 25 de junio de 2012)\n\n \n\nEn el\nejercicio de las facultades que les confiere el artículo 140, inciso 3) de la\nConstitución Política.\n\nConsiderando:\n\n1º-Que tanto\nel gobierno como los diversos segmentos de la sociedad costarricense se han\ncomprometido a promover en forma conjunta la puesta en marcha de la Declaración\nde Río de Janeiro, así como la Agenda 21 y la Alianza Centroamericana para el\nDesarrollo Sostenible.\n\n2º-Que la\nAgenda 21 indica que es fundamental establecer en los países un diálogo, a\ntodos los niveles de la sociedad, para propiciar un consenso nacional en torno\nal Programa 21, así como promover actividades conjuntas de cooperación entre el\nsector público y el privado, con el fin de buscar coherencia y compatibilidad\nen las medidas que se tomen.\n\n3º-Que es de\nimportancia insoslayable que el desarrollo sostenible de Costa Rica, de acuerdo\ncon la política planteada por el Presidente de la República, sea capaz de\nresponder a las urgentes necesidades del presente, sin que esto signifique\natentar contra el derecho de las generaciones futuras de satisfacer sus propias\nnecesidades.\n\n4º-Que\nmediante la Ley Nº 7699 publicada en La Gaceta Nº 211 del 3 de noviembre\nde 1997, que aprueba la \"Convención de las Naciones Unidas de lucha contra\nla desertificación en los países afectados por sequía grave o desertificación,\nen particular en África\" se reconoce la importancia del problema de la\ndegradación de las tierras y la necesidad de un trabajo conjunto entre los\ndiversos sectores de la sociedad civil y el gobierno para ejecutar programas de\nacción de lucha contra esta problemática.\n\n5º-Que\nmediante Decreto Nº 27258-MINAE publicado en el Alcance Nº 60 a La Gaceta\nNº 178 del viernes 11 de setiembre de 1998 se creó la Comisión Asesora sobre\nDegradación de Tierras (CADETI).\n\n6º-Que a fin\nde desarrollar las actividades encomendadas a CADETI se impone una adecuación\nde su marco regulatorio establecido en Decreto mencionado, con el fin de\najustarlo al nivel de sus funciones.\n\n7º-Que la\nLey de Uso, Manejo y Conservación de Suelos Nº 7779, establece en su artículo\ncinco una labor liderada por el MAG en coordinación con el MINAE para el\ncumplimiento de las disposiciones y fines de la Ley en materia de manejo,\nconservación y recuperación de suelos.\n\nDecretan:\n\nArtículo\n1º-Créase la Comisión Asesora sobre Degradación de Tierras (CADETI), adscrita\nal Ministerio de Ambiente y Energía actúan en estrecha coordinación con el\nMinisterio de Agricultura y Ganadería, como un órgano participativo de consulta\ny de elaboración de instrumentos técnicos, científicos, de ejecución y\nasesoría, que propicien el más adecuado cumplimiento de los principios de la\nConvención contra la Desertificación y Sequía, así como de cualquier otro\nconvenio de cooperación internacional relacionado con problemas de degradación\nde tierras y erosión, que en el futuro suscriba el Gobierno de Costa Rica.\n\nArtículo\n2º-La Comisión Asesora sobre Degradación de Tierras tendrá las siguientes\nfunciones:\n\na.\nParticipar, coordinar y dar seguimiento al proceso de definición de políticas,\nacuerdos planes y programas relacionados con la lucha contra la degradación de\nlas tierras, en el marco de la Convención. Asimismo, facilitar y participar en\nla integración de las actividades que se realizan en el ámbito nacional\nreferentes a la degradación de tierras.\n\nb.\nAsesorar al Punto Focal del Gobierno ante la Convención. El Punto Focal será\nuno de los miembros de CADETI y será designado por el Ministro de Ambiente y\nEnergía(*).\n\nc.\nColaborar con los organismos nacionales e internacionales existentes en el país\nrelacionados con esta temática, con el fin de realizar talleres, simposios,\ncharlas y demás para capacitar a la población costarricense sobre el problema\nde la degradación de tierras, recuperación de cuencas hidrográficas, erosión y\ndemás actividades.\n\nd.\nFacilitar la formulación y ejecución de proyectos de rehabilitación,\nrecuperación y prevención de degradación de tierras.\n\ne.\nSolicitar el apoyo y colaboración logística de entes públicos y privados.\n\nf.\nProponer la firma de acuerdos de cooperación para la realización de proyectos\nrelativos a las metas de la Convención.\n\ng-Promover\ny facilitar la investigación científica en el país sobre esta temática.\n\n(Así adicionado su inciso g) por el Decreto Ejecutivo N°\n30231 de 6 de febrero del 2002)\n\n(*)(Modificada su denominación por el artículo 11 de\nla Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al\nMinisterio de Ciencia y Tecnología\", N° 9046 del 25 de junio de 2012)\n\nArtículo\n3º-La Comisión estará integrada por miembros de los sectores académico,\ngubernamental y no gubernamental del país, distribuidos de la siguiente manera:\n\na.\nDos representantes de la Universidad de Costa Rica, uno del Programa de\nInvestigación en Sinecología y Restauración de\nEcosistemas terrestres (SIRECO) y otro del Observatorio del Desarrollo (ODD)\ncomo centro colaborador para Centroamérica del Programa de las Naciones Unidas\npara el Medio Ambiente (PNUMA).\n\nb.\nUn representante de las organizaciones no gubernamentales que desarrollen\nactividades afines a los objetivos de la Convención, nombrados por el Despacho\ndel Ministro de Ambiente y Energía(*).\n\nc.\nUn representante del Sistema Nacional de Areas de\nConservación (SINAC) del Ministerio del Ambiente.\n\nd-\nUn representante del Despacho del Ministerio de Ambiente y Energía(*).\n\n(Así reformado por el artículo 2 del Decreto Ejecutivo N°\n30231 de 6 de febrero del 2002)\n\ne.\nUn representante del Instituto Meteorológico Nacional.\n\nf.\nDos representantes del Ministerio de Agricultura y Ganadería: uno del\nDepartamento de Suelos y Evaluación de Tierras y el otro del Departamento de\nAgricultura Conservacionista.\n\nCada\nmiembro propietario tendrá un suplente, el cual participará con voz y voto en\nausencia del primero. Los acuerdos se tomarán por votación\ny requerirán de la mayoría simple de los presentes para su aprobación.\n\nArtículo 5º—Para mayor efectividad en su labor, la Comisión\npodrá crear en su seno subcomisiones permanentes y ad hoc que sean necesarias, cuidando\nla participación de los diversos sectores en cada una de ellas.\n\nArtículo 6º—La Comisión se reunirá en forma ordinaria una vez\nal mes, o en forma extraordinaria cuando lo solicite el Presidente o dos de sus miembros.\n\nArtículo 7º—Una vez integrada la Comisión, ésta nombrará de\nsu seno, mediante votación y por lapso de un año, al Presidente, Vicepresidente y\nSecretario.   "body_en_text": "throughout the entire text\n\n-\n\nFull Text of Norm 29279\n\nCreates the Advisory Commission on Land Degradation (CEDETI)\n\nNo. 29279-MINAE-MAG\n\n(This decree was repealed by Article 19° of Executive Decree No. 35216 of March 11, 2009).\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF ENVIRONMENT AND ENERGY(*)\n\nAND OF AGRICULTURE AND LIVESTOCK\n\n(*)(Its name amended by Article 11 of Law \"Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology\", No. 9046 of June 25, 2012)\n\nIn exercise of the powers conferred upon them by Article 140, subsection 3) of the Political Constitution.\n\nConsidering:\n\n1º—That both the government and the various segments of Costa Rican society have committed to jointly promoting the implementation of the Rio de Janeiro Declaration, as well as Agenda 21 and the Central American Alliance for Sustainable Development.\n\n2º—That Agenda 21 indicates that it is essential to establish a dialogue in countries, at all levels of society, to foster a national consensus around Programme 21, as well as to promote joint cooperative activities between the public and private sectors, in order to seek coherence and compatibility in the measures taken.\n\n3º—That it is of unavoidable importance that Costa Rica's sustainable development, in accordance with the policy set forth by the President of the Republic, be capable of responding to the urgent needs of the present, without this meaning compromising the right of future generations to meet their own needs.\n\n4º—That through Law No. 7699 published in La Gaceta No. 211 of November 3, 1997, which approves the \"United Nations Convention to Combat Desertification in Countries Experiencing Serious Drought and/or Desertification, Particularly in Africa,\" the importance of the problem of land degradation (degradación de las tierras) and the need for joint work between the various sectors of civil society and the government to execute action programs to combat this problem is recognized.\n\n5º—That through Decree No. 27258-MINAE published in Alcance No. 60 to La Gaceta No. 178 of Friday, September 11, 1998, the Advisory Commission on Land Degradation (Comisión Asesora sobre Degradación de Tierras, CADETI) was created.\n\n6º—That in order to develop the activities entrusted to CADETI, an adaptation of its regulatory framework established in the aforementioned Decree is required, in order to adjust it to the level of its functions.\n\n7º—That the Law on the Use, Management, and Conservation of Soils No. 7779 establishes in its Article five a task led by MAG in coordination with MINAE for the fulfillment of the provisions and purposes of the Law regarding the management, conservation, and recovery of soils.\n\nDecree:\n\nArticle 1º—The Advisory Commission on Land Degradation (Comisión Asesora sobre Degradación de Tierras, CADETI) is hereby created, attached to the Ministry of Environment and Energy acting in close coordination with the Ministry of Agriculture and Livestock, as a participatory body for consultation and the development of technical, scientific, execution, and advisory instruments that promote the most adequate fulfillment of the principles of the Convention to Combat Desertification and Drought, as well as any other international cooperation agreement related to problems of land degradation and erosion that the Government of Costa Rica may sign in the future.\n\nArticle 2º—The Advisory Commission on Land Degradation shall have the following functions:\n\na. Participate in, coordinate, and follow up on the process of defining policies, agreements, plans, and programs related to the fight against land degradation, within the framework of the Convention. Likewise, facilitate and participate in the integration of activities carried out at the national level regarding land degradation.\n\nb. Advise the Government's Focal Point to the Convention. The Focal Point shall be one of the members of CADETI and shall be designated by the Minister of Environment and Energy(*).\n\nc. Collaborate with national and international organizations existing in the country related to this topic, in order to carry out workshops, symposia, talks, and other activities to train the Costa Rican population on the problem of land degradation, recovery of watersheds (cuencas hidrográficas), erosion, and other activities.\n\nd. Facilitate the formulation and execution of projects for the rehabilitation, recovery, and prevention of land degradation.\n\ne. Request support and logistical collaboration from public and private entities.\n\nf. Propose the signing of cooperation agreements for carrying out projects related to the goals of the Convention.\n\ng—Promote and facilitate scientific research in the country on this topic.\n\n(Subsection g) thus added by Executive Decree No. 30231 of February 6, 2002)\n\n(*)(Its name amended by Article 11 of Law \"Transfer of the Telecommunications Sector from the Ministry of Environment, Energy and Telecommunications to the Ministry of Science and Technology\", No. 9046 of June 25, 2012)\n\nArticle 3º—The Commission shall be composed of members from the academic, governmental, and non-governmental sectors of the country, distributed as follows:\n\na. Two representatives from the University of Costa Rica, one from the Research Program in Synecology and Restoration of Terrestrial Ecosystems (SIRECO) and another from the Observatory of Development (ODD) as a collaborating center for Central America of the United Nations Environment Programme (UNEP).\n\nb. One representative from non-governmental organizations that carry out activities related to the objectives of the Convention, appointed by the Office of the Minister of Environment and Energy(*).\n\nc. One representative from the National System of Conservation Areas (Sistema Nacional de Areas de Conservación, SINAC) of the Ministry of Environment.\n\nd—One representative from the Office of the Minister of Environment and Energy(*).\n\n(Thus amended by Article 2 of Executive Decree No. 30231 of February 6, 2002)\n\ne. One representative from the National Meteorological Institute.\n\nf. Two representatives from the Ministry of Agriculture and Livestock: one from the Department of Soils and Land Evaluation and the other from the Department of Conservationist Agriculture.\n\nEach full member shall have an alternate, who shall participate with voice and vote in the absence of the former. Agreements shall be made by vote and shall require a simple majority of those present for approval.\n\nArticle 5º—For greater effectiveness in its work, the Commission may create within its core the permanent and ad hoc subcommittees that are necessary, ensuring the participation of the various sectors in each one of them.\n\nArticle 6º—The Commission shall meet ordinarily once a month, or extraordinarily when requested by the President or two of its members.\n\nArticle 7º—Once the Commission is formed, it shall appoint from its core, by vote and for a period of one year, the President, Vice President, and Secretary. They may be re-elected for consecutive periods.\n\nArticle 8º—The powers of the President of the Commission shall be:\n\na. Preside over sessions and direct debates;\n\nb. Convene ordinary and extraordinary sessions;\n\nc. Officially represent the Commission;\n\nd. Decide with a casting vote in the event of a tie;\n\ne. They shall also be responsible for the files of the Commission and shall have the other powers assigned to them by it.\n\nArticle 11.—In the temporary absence of the Secretary, another member of the Commission shall assume their functions.\n\nArticle 12.—If one or more members of the Commission becomes incapacitated, resigns, or is absent without justification for more than three consecutive sessions, the President shall proceed to request their immediate replacement. If the permanent absence, for any reason, is of the President or Vice President, the Commission shall proceed to immediately designate their replacement for the remainder of the term.\n\nArticle 13.—A record shall be kept of each session. It must be read and approved at the following session, thus making the agreements contained therein final. Likewise, it must be signed by the President and the Secretary at the session in which it was read and approved.\n\nThe record shall state the result of the votes as well as any dissenting votes if there are any.\n\nArticle 14.—Any member of the Commission may request the review of an agreement made at the previous session, with the exception of final agreements. The review shall be resolved at the same session in which it was raised.\n\nArticle 15.—Decree No. 27258-MINAE of May 20, nineteen ninety-eight, published in Alcance 60-A to La Gaceta No. 178 of September 11, 1998, is hereby repealed.\n\nArticle 16.—It shall enter into force upon its publication."
