  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29285\n\n                        Prohibe el Uso de cualquier Componente o Material Específico Proveniente de\nRumiantes, sean Nacionales o Importadas en la Alimentación de Rumiantes\n\nTexto Completo acta: 3C33E\n\n29285-MAG-S\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LOS MINISTROS DE AGRICULTURA Y GANADERÍA\n\nY DE SALUD\n\nEn ejercicio de las facultades que les confiere el artículo 140,\ninciso 3) y 18) de la Constitución Política; los artículos 1, 2 incisos b) y d),\n3 incisos a), b), c) y d), y 7 de la Ley número 6243 y sus reformas que es Ley de Salud\nAnimal; artículo 1 siguientes y concordantes de la Ley Número 5395 y sus reformas\nque es Ley General de Salud; los artículos 1, inciso 1), 2 incisos 1), 2), 3), 5) y 7)\ndel Acuerdo de Medidas Sanitarias y Fitosanitarias de la Ley número 7475 que es\nLey de Ejecución de los Acuerdos de la Ronda Uruguay; y la Ley\nnúmero 6883 que es Ley para la Elaboración y Expendio de Alimentos para Animales en su\nartículo 1, siguientes y concordantes.\n\nConsiderando:\n\n1º—Que al ser función esencial del Estado proteger la salud y\nla vida de las personas y animales, resulta fundamental controlar y vigilar la\nimportación de animales, sus productos y subproductos destinados al consumo humano, así\ncomo los alimentos para animales elaborados con base en materias primas de origen animal.\n\n2º—Que para la economía nacional la ganadería bovina de carne\nrepresenta un importante segmento, por lo que el Estado debe adoptar todas las normas,\nmedidas y procedimientos requeridos para proteger las explotaciones de ganado bovino de\nenfermedades que puedan afectar los hatos ganaderos, en especial previniendo el ingreso de\nenfermedades exóticas.\n\n3º—Que la enfermedad Encefalopatía Espongiforme Bovina ( EEB) ,\nconocida como la \"enfermedad de las vacas locas\", una enfermedad nerviosa de\nconsecuencia fatales para los bovinos, que afecta y destruye su sistema nervioso y\ncerebral, ha sido detectada y localizada en otras naciones del mundo y que en nuestro\npaís, es considerada una enfermedad exótica y por encontrarse libre de Encefalopatías\nEspongiformes Transmisibles, ya que no se han reportado casos de estas en territorio\nnacional.\n\n4º—Que la EEB, podría tener un vínculo con otras\nEncefalopatías Espongiformes Transmisibles que afectan al ser humano, en especial la\nenfermedad Creutzfeldt-Jacob Nueva Variante, por lo que los nuevos eventos registrados en\npaíses europeos y relacionados directamente con la EEB han modificado la situación\nepidemiológica en esos países, generando un alto grado de incertidumbre con relación a\nlas posibles fuentes de transmisión y a la distribución de estas en nuestra región.\n\n5º—Que está demostrado que los productos cárnicos pueden\ncontener y mantener a los agentes de las Encefalopatías Espongiformes Transmisibles\ncuando fueren elaborados a partir de rumiantes infectados.\n\n6º—Que no es posible garantizar que los animales faenados en los\npaíses que han presentado casos y aquellos potencialmente afectados no sean portadores de\nlos agentes de las Encefalopatías Espongiformes Transmisibles, aún cuando se encontraran\nclínicamente sanos al momento del sacrificio.\n\n7º—Que los actuales procesos industriales de residuos y\ndespojos de sacrificio de animales para la preparación de harina de carne y hueso y de\notros subproductos, no pueden, por sus características, garantizar la\ninactivación del agente causal de la E.E.B.\n\n8º—Que una de las formas de transmisión de la E.E.B en los\nrumiantes es por la vía digestiva a través de alimentos que contengan materiales\nespecíficos de riesgo.   "body_en_text": "throughout the entire text\n\n                    -\n\n                        Full Text of Norm 29285\n\n                        Prohibits the Use of Any Component or Specific Material Originating from\nRuminants, whether National or Imported, in the Feeding of Ruminants\n\nFull Text record: 3C33E\n\n29285-MAG-S\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF AGRICULTURE AND LIVESTOCK\n\nAND OF HEALTH\n\nIn exercise of the powers conferred by Article 140,\nsubsections 3) and 18) of the Political Constitution; Articles 1, 2 subsections b) and d),\n3 subsections a), b), c) and d), and 7 of Law Number 6243 and its amendments, which is the Animal Health\nLaw; Article 1 et seq. and concordant articles of Law Number 5395 and its amendments,\nwhich is the General Health Law; Articles 1, subsection 1), 2 subsections 1), 2), 3), 5) and 7)\nof the Agreement on Sanitary and Phytosanitary Measures of Law Number 7475, which is\nthe Law on the Implementation of the Uruguay Round Agreements; and Law\nNumber 6883, which is the Law for the Elaboration and Sale of Animal Feed, in its\nArticle 1 et seq. and concordant articles.\n\nConsidering:\n\n1º—That, as it is an essential function of the State to protect the health and\nlives of persons and animals, it is fundamental to control and monitor the\nimportation of animals, their products and by-products intended for human consumption, as well\nas animal feed manufactured from raw materials of animal origin.\n\n2º—That for the national economy, beef cattle farming\nrepresents an important segment, for which reason the State must adopt all the norms,\nmeasures and procedures required to protect bovine cattle operations from\ndiseases that may affect cattle herds, especially by preventing the entry of\nexotic diseases.\n\n3º—That the disease Bovine Spongiform Encephalopathy (BSE),\nknown as \"mad cow disease,\" a nervous disease with\nfatal consequences for bovines, which affects and destroys their nervous and\ncerebral system, has been detected and located in other nations of the world and that in our\ncountry, it is considered an exotic disease and it is found free of Transmissible Spongiform\nEncephalopathies, since no cases of these have been reported in national\nterritory.\n\n4º—That BSE could have a link with other\nTransmissible Spongiform Encephalopathies that affect human beings, especially the\nNew Variant Creutzfeldt-Jakob disease, for which reason the new events recorded in\nEuropean countries and directly related to BSE have changed the epidemiological\nsituation in those countries, generating a high degree of uncertainty regarding\nthe possible sources of transmission and their distribution in our region.\n\n5º—That it has been demonstrated that meat products can\ncontain and maintain the agents of Transmissible Spongiform Encephalopathies\nwhen they are produced from infected ruminants.\n\n6º—That it is not possible to guarantee that animals slaughtered in\ncountries that have presented cases and those potentially affected are not carriers of\nthe agents of Transmissible Spongiform Encephalopathies, even when they were\nclinically healthy at the time of sacrifice.\n\n7º—That current industrial processes for waste and\nslaughter offal from animals for the preparation of meat and bone meal and\nother by-products cannot, due to their characteristics, guarantee the\ninactivation of the causal agent of BSE.\n\n8º—That one of the forms of transmission of BSE in\nruminants is via the digestive tract through feed containing\nspecific risk materials. Therefore,\n\nThey Decree:\n\nArticle 1º—The use of meat meal, bone meal, meat and bone meal, tankage (tankage), blood, tallow, greaves (chicharrones), or any specific risk material originating from ruminants, whether national or imported, in the feeding of ruminants is prohibited.\n\nArticle 2º—Establishments that store, keep and process raw materials and feed containing raw materials originating from ruminants must guarantee that there is no cross-contamination in the manufacturing, handling and storage processes.\n\nArticle 3º—The raw materials, premixes, mixtures and feeds that contain the specific materials indicated in article one of this decree and all those originating from ruminants, which in the judgment of the competent authorities are considered at risk, must state on the label \"precaution: do not use in ruminants.\"\n\nArticle 4º—Article 5 of the Reglamento de Defensa Sanitaria Animal, which is Decreto Ejecutivo number 14584-MAG of May 16, 1983, is hereby amended, including within the list of diseases of mandatory declaration in bovines, bovine spongiform encephalopathy (BSE).\n\nArticle 5º—It enters into force upon its publication."
