5395 de 30 de octubre de 1973, Ley General de\nSalud.\n\nConsiderando:\n\n1º-Que\nes responsabilidad del Estado velar por la salud de los costarricenses.\n\n2º-Que\nla marea roja es un fenómeno natural que se ha identificado en la Costa del\nPacífico de Costa Rica desde el año 1972 y se ha presentado en forma repetida\nhasta la fecha.\n\n3º-Que\nel fenómeno de marea roja tiene impacto serio en la salud pública y la economía\ndel país, la cual ha ocasionado intoxicaciones en la población y eventualmente\npérdidas en recursos de naturaleza comercializables.\n\n4º-Que\nes necesaria la cooperación y coordinación de los Ministerios encargados e\ninstituciones relacionadas con dicho problema. Por tanto,\n\nDecretan:\n\nArtículo\n1º-Créase una Comisión Interinstitucional para la Prevención y Control de la\nMarea Roja en Costa Rica, como Órgano Asesor y Consultivo adscrita al Instituto\nCostarricense de la Pesca y Acuacultura, con el propósito de coordinar la\nacción pública en este campo, sin perjuicio del cumplimiento de los propios\nobjetivos que por ley le corresponden a las instituciones que conforman la\nComisión.\n\nArtículo 2º-Serán funciones de la Comisión:\n\n1º Proponer un sistema nacional permanente de prevención y control de la marea roja, que\npermita la comunicación rápida y efectiva de este fenómeno.\n\n2º Coordinar y promover campañas de educación, divulgación y conocimiento de las mareas rojas\ntóxicas dirigidas a toda la población.\n\n3º\tIncentivar, fomentar y coordinar las investigaciones que se realicen en este campo.\n\n4º Recomendar ante las autoridades competentes las acciones conjuntas necesarias para abordar\nel problema y la atención del fenómeno.\n\n5º Proponer la legislación o normativa necesaria que contribuya a mantener un programa de\nmonitoreo y dé alerta temprana de la marea roja.\n\n6º\tCualesquiera otras relacionadas con el cumplimiento y fines de la misma.\n\nArtículo 3º—La Comisión, estará integrada de la siguiente\nmanera:\n\n1. El Presidente Ejecutivo del INCOPESCA o su representante, quien la\n presidirá.\n\n2. El Director General Técnico del INCOPESCA o su representante.\n\n3. Un representante de la Dirección de Vigilancia de la Salud del\n Ministerio de Salud.\n\n4. Un representante de la Dirección de Registros y Controles del\n Ministerio de Salud.\n\n5. Un representante de la Gerencia Médica de la Caja Costarricense del\n Seguro Social.\n\n6. Un representante del Laboratorio de Fitoplancton Marino de la\n Universidad Nacional.\n\n7. Therefore,\n\nThey decree:\n\nArticle 1º—An Interinstitutional Commission for the Prevention and Control of Red Tide in Costa Rica is created, as an Advisory and Consultative Body attached to the Costa Rican Institute of Fisheries and Aquaculture, with the purpose of coordinating public action in this field, without prejudice to the fulfillment of the objectives that by law correspond to the institutions that make up the Commission.\n\nArticle 2º—The functions of the Commission shall be:\n\n1º To propose a permanent national system for the prevention and control of red tide, allowing for rapid and effective communication of this phenomenon.\n\n2º To coordinate and promote education, dissemination, and awareness campaigns regarding toxic red tides aimed at the entire population.\n\n3º To incentivize, encourage, and coordinate the research carried out in this field.\n\n4º To recommend to the competent authorities the joint actions necessary to address the problem and manage the phenomenon.\n\n5º To propose the necessary legislation or regulations that contribute to maintaining a monitoring and early warning program for red tide.\n\n6º Any others related to its fulfillment and purposes.\n\nArticle 3º—The Commission shall be composed as follows:\n\n1. The Executive President of INCOPESCA or his representative, who shall preside over it.\n\n2. The Technical Director General of INCOPESCA or his representative.\n\n3. A representative of the Health Surveillance Directorate of the Ministry of Health.\n\n4. A representative of the Registries and Controls Directorate of the Ministry of Health.\n\n5. A representative of the Medical Management of the Costa Rican Social Security Fund.\n\n6. A representative of the Marine Phytoplankton Laboratory of the National University.\n\n7. A representative of the Animal Health Directorate of the MAG-National Laboratory of Veterinary Services.\n\n8. The Director of the Center for Research in Limnology and Marine Sciences (CIMAR) of the University of Costa Rica.\n\n(Point 8 thus added by Article 1 of Executive Decree N° 30805 of October 2, 2002)\n\nArticle 4º—For the fulfillment of the purposes, objectives, and tasks of the Commission, the Ministry of Agriculture and Livestock, the Ministry of Health, and INCOPESCA shall provide, within their means, the required logistical support, as well as economic and human resources and facilitation of the use of structures and provision of services.\n\nArticle 5º—INCOPESCA inspectors, duly accredited before the Registries and Controls Directorate of the Ministry of Health, and by prior Executive Agreement, are granted the authority of ad honorem health authorities, for the fulfillment of pertinent actions related to public health concerning fishing activity.
