  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29391\n\n                        Adiciones al Reglamento Control y Revisión Gases y Emisiones Contaminantes\nVehículos\n\nTexto Completo acta: 3CC91\nNº 29391-MOPT-MINAE-S\n\nNº 29391-MOPT-MINAE-S\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LOS MINISTROS DE OBRAS PÚBLICAS Y TRANSPORTES,\n\nAMBIENTE Y ENERGÍA Y SALUD\n\nEn uso de las facultades que les confieren los artículos 140, incisos 3 y 18 de la Constitución\nPolítica; artículo 27 de la Ley General de la Administración Pública; artículos 34, 35, 36,\nsiguientes y concordantes de la Ley de Tránsito por Vías Públicas Terrestres, Nº 7331 del 13 de\nabril de 1993 y sus reformas.\n\nConsiderando:\n\n1º-Que ante la preocupación mundial por el deterioro del medio ambiente, durante los últimos años el\npaís se ha abocado a la tarea de poner en vigencia instrumentos jurídicos que garanticen una\nprotección real y efectiva del mismo.\n\n2º-Que en razón de lo anterior, desde la promulgación de la actual Ley de Tránsito por Vías Públicas\nTerrestres, los Ministerios de Obras Públicas y Transportes, de Salud y del Ambiente y Energía, se\nhan abocado con mayor impulso a la regulación de todos los aspectos relacionados con la\ncontaminación ambiental producida por los vehículos automotores.\n\n3º-Que dentro de esa coyuntura el Poder Ejecutivo emitió el Decreto Ejecutivo Nº 28280-MOPT-MINAE-S,\n\"Reglamento para el Control y Revisión Técnica de las Emisiones de Gases Contaminantes Producidas\npor Vehículos Automotores\".\n\n4º-Que el artículo 2 del citado cuerpo normativo dispone, en lo que es de interés, que los\ncertificados de cumplimiento para vehículos nuevos y usados a que se refiere el artículo 36 de la\nLey de Tránsito por Vías Públicas y Terrestres y sus reformas, deberán ser certificados por el\nfabricante del vehículo o por una autoridad competente, en materia de emisiones vehiculares, del\npaís del cual se realice la importación.\n\n5º-Que a tenor de lo dispuesto en el artículo 36, siguientes y concordantes de la Convención de\nViena sobre Relaciones Diplomáticas, las Embajadas pueden importar vehículos para el uso oficial de\nla misión y de los funcionarios allí destacados.\n\n6º-Que en algunos países no existe disposición legal que establezca una regulación de control de\nemisiones en materia de vehículos, por lo que resulta material y legalmente imposible para algunos\ndiplomáticos, aportar el certificado respectivo, de conformidad con lo dispuesto en el artículo 2\ndel Reglamento antes citado.\n\n7º-Que por razones de interés público y a efecto de armonizar la normativa vigente con el Principio\nde Reciprocidad, pilar fundamental de las relaciones internacionales, resulta primordial adicionar\nun último párrafo al artículo 2 del \"Reglamento para el Control y Revisión Técnica de las Emisiones\nde Gases Contaminantes Producidas por Vehículos Automotores\", para contemplar la situación\nparticular de los vehículos que se importen para el uso de las representaciones diplomáticas.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 29391\n\n                        Additions to the Regulation for the Control and Review of Gases and Polluting Emissions\nVehicles\n\nComplete Text of Act: 3CC91\nNº 29391-MOPT-MINAE-S\n\nNº 29391-MOPT-MINAE-S\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF PUBLIC WORKS AND TRANSPORT,\n\nENVIRONMENT AND ENERGY, AND HEALTH\n\nExercising the powers conferred by Articles 140, subsections 3 and 18 of the Political\nConstitution; Article 27 of the General Law of Public Administration; Articles 34, 35, 36,\nsubsequent and related articles of the Law of Transit on Public Land Routes, Nº 7331 of April 13,\n1993 and its amendments.\n\nConsidering:\n\n1st—That given the global concern over environmental deterioration, in recent years the\ncountry has undertaken the task of enacting legal instruments that guarantee its real and effective\nprotection.\n\n2nd—That by reason of the foregoing, since the enactment of the current Law of Transit on Public Land\nRoutes, the Ministries of Public Works and Transport, of Health, and of Environment and Energy, have\nundertaken with greater impetus the regulation of all aspects related to environmental\ncontamination produced by motor vehicles.\n\n3rd—That within this situation, the Executive Branch issued Executive Decree Nº 28280-MOPT-MINAE-S,\n\"Regulation for the Control and Technical Review of Polluting Gas Emissions Produced by\nMotor Vehicles.\"\n\n4th—That Article 2 of the cited regulatory body provides, as is of interest, that the\ncompliance certificates for new and used vehicles referred to in Article 36 of the\nLaw of Transit on Public Land Routes and its amendments must be certified by the\nvehicle manufacturer or by a competent authority, in matters of vehicular emissions, of the\ncountry from which the importation is made.\n\n5th—That pursuant to the provisions of Article 36, subsequent and related articles of the\nVienna Convention on Diplomatic Relations, Embassies may import vehicles for the official use of\nthe mission and of the officials stationed there.\n\n6th—That in some countries there is no legal provision establishing a regulation for the control of\nemissions regarding vehicles, which makes it materially and legally impossible for some\ndiplomats to provide the respective certificate, in accordance with the provisions of Article 2\nof the aforementioned Regulation.\n\n7th—That for reasons of public interest and in order to harmonize the current regulations with the Principle\nof Reciprocity, a fundamental pillar of international relations, it is essential to add\na final paragraph to Article 2 of the \"Regulation for the Control and Technical Review of the Emissions\nof Polluting Gases Produced by Motor Vehicles,\" to address the particular\nsituation of vehicles imported for the use of diplomatic missions. Therefore,\n\nThey decree:\n\nArticle 1—A final paragraph is hereby added to Article 2 of Executive Decree Nº 28280-MOPT-MINAE-S,\n\"Regulation for the Control and Technical Review of the Emissions of Polluting Gases Produced\nby Motor Vehicles,\" so that it reads as follows:\n\n\"Article 2—(...)\n\nIn the case of vehicles imported by diplomatic missions, the\ncompliance certificates referred to in Article 36 of Law Nº 7331 may be issued\nwithin the national territory, provided that the interested diplomatic mission previously\ncertifies that said document is not issued in the country of origin.\"\n\nArticle 3—This decree is effective as of its publication."
