de la Constitución Política, 41\nde la Ley Orgánica del Ambiente del 4 de octubre de 1995 y el transitorio I de\nla Ley Forestal número 7575, modificado por la Ley Nº 7761, publicada en La\nGaceta Nº 95 del 19 de mayo de 1998, y la Ley de Conservación de la Vida\nSilvestre Nº 7317, del 30 de octubre de 1992.\n\nConsiderando:\n\n1º-Que\nla Ley de Aguas número 276, del 27 de agosto de 1942, se declara que los\nmanglares y esteros así como una franja de 50 metros a lo largo de los ríos\nnavegables bienes de dominio público los cuales son inalienables y no\nsusceptibles de apropiación de parte de particulares.\n\n2º-Que\nla Ley Orgánica del Ambiente, en su articulo 32 le otorga a los humedales la\ncategoría de área silvestre protegida.\n\n3º-Que\nel país suscribió y ratificó la Convención Relativa a los Humedales de\nImportancia Internacional, dado que se ha comprobado que es el hábitat de la\naves acuáticas, que en la Convención RAMSAR aprobada mediante Ley Nº 7224 del 2\nde abril de 1991 se declara que los humedales son áreas silvestres de uso\nmúltiple, pero que para su uso debe contarse con planes de manejo, que\ngaranticen el desarrollo humano garantizando su permanencia en el tiempo\nrespetando sus características ecológicas.\n\n4º-Que\nlos humedales representan ecosistemas con dependencia de regímenes acuáticos ,\nnaturales o artificiales, permanentes o temporales, lénticos o lóticos, dulces,\nsalobre o salados, incluyendo las extensiones marinas hasta el límite posterior\nde fanerógamas marinas o arrecifes de coral o, en su ausencia hasta seis metros\nde profundidad en marea baja.\n\n5º-Que\nla Ley Forestal Nº 7575, en su artículo 1º prohíbe la corta de mangle, sin\nembargo en su transitorio 1 establece la posibilidad de mantener vía contrato\naquellas áreas de manglar en las cuales se establecieron en el pasado salineras\no proyectos de acuacultura, siempre y cuando el permisionario demuestre que el\nárea se han establecido obras de infraestructura.\n\nDecretan:\n\nArtículo 1º-Declárese\nRefugio Nacional de Vida Silvestre de propiedad estatal el cual se denominará\n\"Refugio de Vida Silvestre Cipanci\" en el área que se describe a continuación:\n\nLos límites del\nRefugio Nacional de Vida Silvestre Cipanci por la siguiente descripción literal\ny de coordenadas referidas al sistema de proyección cartográfica oficial para\nCosta Rica CRTM05 y su Datum asociado CR05:\n\nSe parte de un punto\nlocalizado en la confluencia del río Lajas con el río Bebedero en el punto con\nlas coordenadas 1 E 367596 N 1141044.\n\nContinúa en dirección\nsureste aguas arriba del río Lajas sobre su ribera izquierda, hasta una\ndistancia de 50 metros en punto con las coordenadas 2 E 367643 N 1141040.\n\nDe este punto se\ncontinúa en dirección suroeste en una línea paralela a la ribera izquierda del\nrío Bebedero aguas abajo, delimitando una franja de terreno con un ancho de 50\nmetros correspondiente a la Zona Pública de dicho río, hasta el punto con las\ncoordenadas 3 E 367252 N 1139061.\n\nDe este punto se\ncontinúa el límite del Refugio en sentido sur sobre el límite del manglar según\nel insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 4\nE 368027 N 1137758, este último punto se encuentra localizado a una\ndistancia de 50 metros desde la ribera izquierda del río Bebedero en línea\nperpendicular.\n\nSe continúa en\ndirección sureste en una línea paralela a esa ribera del río aguas abajo,\ndelimitando una franja de terreno con un ancho de 50 metros correspondiente a\nla Zona Pública, hasta el punto con las coordenadas 5 E 367668 N 1137134.\nEste último punto se encuentra localizado a una distancia de 50 metros desde la\nribera del río en línea perpendicular.\n\nDe este punto se\ncontinúa el límite del Refugio en sentido sur sobre el límite del manglar según\nel insumo de Patrimonio Natural del Estado, hasta el punto con las coordenadas 6\nE 365083 N 1134000.\n\nDe este último punto\nse continúa el límite con una línea recta hasta el punto con las coordenadas 7\nE 365447 N 1133417.\n\nSe continúa sobre el\nlímite del manglar según el insumo de Patrimonio Natural del Estado, hasta el\npunto con las coordenadas 8 E 365429 N 1130760, localizado a una\ndistancia de 50 metros desde la ribera izquierda del río Tempisque en línea\nperpendicular.\n\nDe este último punto\nse continúa en dirección suroeste en una línea paralela a esa ribera del río\naguas abajo, delimitando una franja de terreno con un ancho de 50 metros\ncorrespondiente a la Zona Pública, hasta el punto con las coordenadas 9 E\n365328 N 1130178, localizado a una distancia de 50 metros desde la ribera\nizquierda del río Tempisque en línea perpendicular.\n\nDe este punto se\ncontinúa el límite del Refugio en sentido sureste sobre el límite del manglar\nsegún el insumo de Patrimonio Natural del Estado, hasta el punto con las\ncoordenadas 10 E 365541 N 1130193.\n\nSe continúa por una sucesión de líneas rectas\nuniendo los puntos con las coordenadas:\n\n11 E 365512 N 1130365\n\n12 E 365587 N 1130507\n\n13 E 365916 N 1130289\n\n14 E Alegre.\n\nSe\ncontinúa el límite del Refugio sobre la margen izquierda sentido norte de la\nRuta Nacional que comunica el poblado de Monte Potrero con Puerto Alegre hasta\nel punto con las coordenadas 16 E 365735 N 1129747.\n\nDe\neste último punto se continúa el límite del Refugio en sentido suroeste sobre\nel límite del manglar según el insumo de Patrimonio Natural del Estado, hasta\nel punto con las coordenadas 17 E 365057 N 1129731, localizado a una\ndistancia de 50 metros desde la ribera izquierda del río Tempisque en línea\nperpendicular.\n\nDe\neste último punto se continúa en dirección suroeste en una línea paralela a esa\nribera del río aguas abajo, delimitando una franja de terreno con un ancho de\n50 metros correspondiente a la Zona Pública, hasta el punto con las coordenadas\n18 E 364792 N 1129467, localizado a una distancia de 50 metros desde la\nribera izquierda del río Tempisque en línea perpendicular.\n\nSe\ncontinúa por una sucesión de líneas   "body_en_text": "Full Text of Regulation 29398\n\nDeclares the Cipanci National Wildlife Refuge\n\nFull Text of file: 10627B\nNº 29398-MINAE\n\nNº 29398-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nPursuant to article 140, subsections 3) and 18) of the Political Constitution, 41 of the Organic Environmental Law of October 4, 1995, and Transitory Provision I of the Forest Law number 7575, amended by Law Nº 7761, published in La Gaceta Nº 95 of May 19, 1998, and the Wildlife Conservation Law Nº 7317, of October 30, 1992.\n\nConsidering:\n\n1º- That the Water Law number 276, of August 27, 1942, declares that mangroves and estuaries, as well as a 50-meter strip along navigable rivers, are public domain assets which are inalienable and not susceptible to appropriation by private parties.\n\n2º- That the Organic Environmental Law, in its article 32, grants wetlands the category of protected wilderness area.\n\n3º- That the country signed and ratified the Convention on Wetlands of International Importance, given that it has been proven to be the habitat of waterfowl, that the RAMSAR Convention approved by Law Nº 7224 of April 2, 1991, declares that wetlands are multiple-use wilderness areas, but that their use must be governed by management plans that guarantee human development while ensuring their permanence over time and respecting their ecological characteristics.\n\n4º- That wetlands represent ecosystems dependent on aquatic regimes, natural or artificial, permanent or temporary, lentic or lotic, fresh, brackish, or saline, including marine extensions up to the posterior limit of marine phanerogams or coral reefs or, in their absence, up to six meters in depth at low tide.\n\n5º- That the Forest Law Nº 7575, in its article 1, prohibits the cutting of mangroves; however, its Transitory Provision 1 establishes the possibility of maintaining, via contract, those mangrove areas where saltworks or aquaculture projects were established in the past, provided that the permit holder demonstrates that infrastructure works have been established in the area.\n\nDecree:\n\nArticle 1- Declare as a state-owned National Wildlife Refuge to be named \"Cipanci Wildlife Refuge\" in the area described below:\n\nThe boundaries of the Cipanci National Wildlife Refuge by the following literal description and coordinates referenced to the official cartographic projection system for Costa Rica CRTM05 and its associated Datum CR05:\n\nStarting from a point located at the confluence of the Lajas River with the Bebedero River at the point with coordinates 1 E 367596 N 1141044.\n\nIt continues southeast upstream along the Lajas River on its left bank, for a distance of 50 meters to the point with coordinates 2 E 367643 N 1141040.\n\nFrom this point, it continues southwest in a line parallel to the left bank of the Bebedero River downstream, delimiting a strip of land with a width of 50 meters corresponding to the Public Zone of said river, to the point with coordinates 3 E 367252 N 1139061.\n\nFrom this point, the Refuge boundary continues southward along the mangrove limit according to the State Natural Heritage input, to the point with coordinates 4 E 368027 N 1137758, this last point being located at a distance of 50 meters from the left bank of the Bebedero River in a perpendicular line.\n\nIt continues southeast in a line parallel to that river bank downstream, delimiting a strip of land with a width of 50 meters corresponding to the Public Zone, to the point with coordinates 5 E 367668 N 1137134.
