Nº\n202 del 25 del mismo mes y año, este Ministerio creó una \"Unidad Ejecutora MOPT-Ferry Tempisque\" con\nel fin de que provisionalmente se hiciera cargo de la administración del servicio de cabotaje,\nmodalidad ferry o transbordador, en el río Tempisque.\n\n3º-Que los Decretos Ejecutivos Nos. 24256-MOPT del 26 de abril de 1995 (La Gaceta 101 del 26 de mayo\ndel mismo año) y 26158-MOPT del 13 de junio de 1997 (La Gaceta 131 del 17 de julio del mismo año)\nreafirman la situación jurídica de la \"Unidad Ejecutora MOPT-Ferry Tempisque\" como dependencia\nadscrita al Ministerio de Obras Públicas y Transportes.\n\n4º-Que la Contraloría General de la República según oficio DAJ-1108 del 26 de mayo de 1999, a la vez\nque coincidió en señalar que la mencionada \"Unidad Ejecutora\" se encuentra adscrita al Ministerio de\nObras Públicas y Transportes, determinó que con fundamento en lo dispuesto por los artículos 176 y\n180 de la Constitución Política y sustentada en Sentencias de la propia Sala Constitucional (caso\ndel Voto 6240-93, por ejemplo), los recursos de la ya mencionada Unidad Ejecutora \"deben formar\nparte de la caja única del Estado y que de modo alguno pueden manejarse de forma separada o\naislada...\" .\n\n5º-Que en lo referente a los \"recursos humanos\" que conforman la citada \"Unidad Ejecutora MOPT-Ferry\nTempisque\", el Ente Contralor en el referido pronunciamiento DAJ-1108 indicó que a los trabajadores\nque laboran para la tantas veces señalada \"Unidad Ejecutora\" les son aplicables las disposiciones\nnormativas y directrices gubernamentales, por lo cual quienes brinden sus servicios para la citada\nUnidad Ejecutora deben ser servidores públicos, con la salvedad de aquellos casos en donde se\ncontratare la prestación de servicios profesionales a tenor de lo dispuesto en la Ley de\nContratación Administrativa y su Reglamento.\n\n6º-Que de acuerdo con lo anterior deben establecerse partidas en el presupuesto de este Ministerio\nque den contenido financiero a la administración del Ferry, para el pago de los contratos de obra,\nsuministros, servicios, gastos de personal, costos administrativos y otros extremos laborales.\n\n7º-Que para dar cumplimiento a lo dispuesto por el ordenamiento jurídico y a lo establecido, en ese\nmismo sentido, por la Contraloría General de la República según pronunciamiento DAJ-1108, de\nrepetida cita, se promulgó el Decreto Ejecutivo Nº 28142-MOPT, publicado en La Gaceta 203 del 20 de\noctubre de 1999.\n\n8º-Que por medio de Decreto Ejecutivo Nº 28364-MOPT del 20 de diciembre de 1999, publicado en La\nGaceta Nº 5 del 7 de enero del 2000 se dispuso modificar el Decreto Ejecutivo Nº 28142-MOPT,\npublicado en La Gaceta Nº 203 del 20 de octubre de 1999, con el propósito, entre otras cosas, de\nque para el año 2000, por última vez, los servidores que laboran para la citada Unidad Ejecutora\nfueran pagados con los fondos provenientes de dicha unidad administrativa, mientras se incorporaban\nlos gastos necesarios dentro del presupuesto de la República.\n\n9º-Que mediante acuerdo firme tomado por la Autoridad Presupuestaria en Sesión Ordinaria Nº 13-2000\ndel 6 de setiembre del 2000, se autorizó al Ministerio de Obras Públicas y Transportes la creación\nde cuarenta y seis plazas para dar cumplimiento a lo establecido por la Contraloría General de la\nRepública en su oficio DAJ-1108, de manera tal que los servidores destacados en la Unidad Ejecutora\nya mencionada pasen de manera efectiva a estar incorporados dentro del Presupuesto de la República a\npartir del 1º de enero del 2001, respetándose sus derechos laborales.\n\n10.-Que la Autoridad Presupuestaria mediante oficio STAP Nº 2052-2000 del 26 de octubre del 2000,\nestableció que en virtud de la situación jurídica que ha ostentado la Unidad Ejecutora MOPT-Ferry\nTempisque, como órgano desconcentrado del Ministerio de Obras Públicas y Transportes, según ya lo\nestableciera la Contraloría General de la República en su pronunciamiento DAJ-1108 del 26 de mayo de\n1999, fijó normas y disposiciones de plena aplicación al presente caso.\n\n11.-Que en virtud de lo expuesto y dado que a la fecha aun no se ha concluido el proceso de\nincorporación de los servidores de la Unidad Ejecutora al presupuesto de la República, que así lo\ndeseen, ni se han fijado reglas para aquellos otros que en razón de lo expuesto, prefieran se\nprescinda de sus servicios con el pago de los extremos laborales que resulten procedentes, se hace\nnecesario promulgar el presente Decreto. Por tanto,\n\nDecretan:\n\nArtículo 1º-A los servidores de la Unidad Ejecutora MOPT-Ferry Tempisque que en virtud de lo\nestablecido por el Decreto Ejecutivo Nº 28364-MOPT del 20 de diciembre de 1999, publicado en La\nGaceta Nº 5 del 7 de enero del 2000, deseen seguir brindando sus servicios para el Estado con cargo\nal presupuesto de la República, les serán respetados sus derechos laborales en todos aquellos\nextremos que resultaren conformes con el ordenamiento jurídico.\n\nArtículo 2º-Los servidores que prefieran que les sean cancelados los extremos laborales\ncorrespondientes, se procederá a su pago, conforme al procedimiento usual de la Administración y en\ntales casos las respectivas plazas podrán llenarse conforme lo dispone la normativa jurídica\nvigente.\n\nQuienes se acojan a la cancelación de los extremos laborales deberán comunicarlo a la Administración\ndel ferry el día 30 de abril del 2001 como fecha límite e improrrogable.\n\nArtículo 3º-Las cuarenta y seis plazas por Servicios Especiales creadas por la Autoridad Reguladora\npara el traslado a Cargos Fijos del Presupuesto de la República de los servidores de la Unidad\nEjecutora MOPT-Ferry Tempisque serán ocupadas por aquellos servidores de la citada Unidad Ejecutora\nque prefieran seguir brindando sus servicios para el Estado, y las que quedaren sin ocuparse en\nvirtud de que hubiere servidores que optaren por acogerse al pago de los extremos laborales, deberán\nllenarse designándose el nuevo personal que en tales casos resulte procedente, con el fin de\ngarantizar la eficiente prestación del servicio.\n\nArtículo 4º-Se modifica en lo conducente el Decreto Ejecutivo Nº 28364-MOPT del 20 de diciembre de\n1999, publicado en La Gaceta Nº 5 del 5 de enero del 2000, con el propósito de que la Unidad\nEjecutora MOPT-Ferry Tempisque continúe haciéndose cargo del pago de los servicios del Ferry\nTempisque, incluyendo el pago de salarios y otros extremos laborales de sus servidores, hasta 29347-MOPT\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF PUBLIC WORKS AND TRANSPORT\n\nIn the exercise of the powers conferred by the Political Constitution and based on the provisions of the Law Creating the Ministry of Public Works, No. 4786 of July 5, 1971 and its amendments, and the provisions of the General Law of Public Administration, No. 6227 of May 2, 1978.\n\nConsidering:\n\n1.—That in accordance with the provisions of Article 34 of Law No. 7111 of November 24, 1988, the Ordinary and Extraordinary, Fiscal, and Program Budget Law of the Republic for the 1989 Fiscal Year, the Costa Rican Development Corporation (CODESA) was authorized to transfer to the Ministry of Public Works and Transport the ferry, lands, and facilities operating on the Tempisque River.\n\n2.—That through Executive Decree No. 23723-MOPT of October 10, 1994, published in La Gaceta No. 202 of the 25th of the same month and year, this Ministry created an \"MOPT-Ferry Tempisque Executing Unit (Unidad Ejecutora MOPT-Ferry Tempisque)\" in order to provisionally take charge of the administration of the cabotage service, in the ferry or transbordador modality, on the Tempisque River.\n\n3.—That Executive Decrees No. 24256-MOPT of April 26, 1995 (La Gaceta 101 of May 26 of the same year) and 26158-MOPT of June 13, 1997 (La Gaceta 131 of July 17 of the same year) reaffirm the legal status of the \"MOPT-Ferry Tempisque Executing Unit\" as a unit attached to the Ministry of Public Works and Transport.\n\n4.—That the Office of the Comptroller General of the Republic, through official communication DAJ-1108 of May 26, 1999, while concurring that the aforementioned \"Executing Unit\" is attached to the Ministry of Public Works and Transport, determined that based on the provisions of Articles 176 and 180 of the Political Constitution and supported by rulings of the Constitutional Chamber itself (case of Voto 6240-93, for example), the resources of the already mentioned Executing Unit \"must form part of the single state treasury and may in no way be managed separately or in isolation...\" .\n\n5.—That regarding the \"human resources\" that make up the cited \"MOPT-Ferry Tempisque Executing Unit,\" the Comptroller Entity, in the aforementioned pronouncement DAJ-1108, indicated that the regulatory provisions and governmental directives are applicable to the workers who work for the repeatedly mentioned \"Executing Unit,\" whereby those who provide their services for the cited Executing Unit must be public servants, with the exception of those cases where the provision of professional services is contracted under the provisions of the Law on Administrative Procurement and its Regulations.\n\n6.—That in accordance with the foregoing, budget items must be established in this Ministry's budget to provide financial substance to the administration of the Ferry, for the payment of works contracts, supplies, services, personnel expenses, administrative costs, and other employment-related matters.\n\n7.—That to comply with the provisions of the legal system and with what was established, in that same sense, by the Office of the Comptroller General of the Republic according to the repeatedly cited pronouncement DAJ-1108, Executive Decree No. 28142-MOPT was promulgated, published in La Gaceta 203 of October 20, 1999.\n\n8.—That through Executive Decree No. 28364-MOPT of December 20, 1999, published in La Gaceta No. 5 of January 7, 2000, it was ordered to amend Executive Decree No. 28142-MOPT, published in La Gaceta No. 203 of October 20, 1999, with the purpose, among other things, that for the year 2000, for the last time, the public servants working for the cited Executing Unit be paid with the funds coming from said administrative unit, while the necessary expenses were incorporated into the Budget of the Republic.\n\n9.—That through a firm agreement reached by the Budgetary Authority in Ordinary Session No. 13-2000 of September 6, 2000, the Ministry of Public Works and Transport was authorized to create forty-six positions to comply with what was established by the Office of the Comptroller General of the Republic in its official communication DAJ-1108, so that the public servants assigned to the already mentioned Executing Unit effectively become incorporated into the Budget of the Republic as of January 1, 2001, respecting their employment rights.\n\n10.—That the Budgetary Authority, through official communication STAP No. 2052-2000 of October 26, 2000, established that by virtue of the legal status that the MOPT-Ferry Tempisque Executing Unit has held, as a deconcentrated body of the Ministry of Public Works and Transport, as already established by the Office of the Comptroller General of the Republic in its pronouncement DAJ-1108 of May 26, 1999, it set rules and provisions fully applicable to the present case.\n\n11.—That by virtue of the foregoing and given that, to date, the process of incorporating the public servants of the Executing Unit into the Budget of the Republic who so desire has not yet been concluded, nor have rules been set for those others who, for the reasons stated, prefer that their services be terminated with the payment of the applicable employment-related matters, it is necessary to promulgate this Decree. Therefore,\n\nThey decree:\n\nArticle 1.—The public servants of the MOPT-Ferry Tempisque Executing Unit who, by virtue of the provisions of Executive Decree No. 28364-MOPT of December 20, 1999, published in La Gaceta No. 5 of January 7, 2000, wish to continue providing their services to the State charged to the Budget of the Republic, shall have their employment rights respected in all those matters that are in conformity with the legal system.\n\nArticle 2.—For the public servants who prefer that the corresponding employment-related matters be paid to them, their payment shall be processed in accordance with the usual procedure of the Administration, and in such cases, the respective positions may be filled as provided by the current legal regulations.\n\nThose who opt for the cancellation of the employment-related matters must inform the Ferry Administration thereof by April 30, 2001 as the final and non-extendable deadline.\n\nArticle 3.—The forty-six positions for Special Services created by the Regulatory Authority for the transfer to Fixed Positions in the Budget of the Republic of the public servants of the MOPT-Ferry Tempisque Executing Unit shall be occupied by those public servants of the cited Executing Unit who prefer to continue providing their services to the State, and those that remain unoccupied by virtue of there being public servants who choose to opt for the payment of employment-related matters must be filled by appointing the new personnel that is appropriate in such cases, in order to guarantee the efficient provision of the service.\n\nArticle 4.—Executive Decree No. 28364-MOPT of December 20, 1999, published in La Gaceta No. 5 of January 5, 2000, is amended as appropriate, so that the MOPT-Ferry Tempisque Executing Unit continues to be responsible for the payment of the Tempisque Ferry services, including the payment of salaries and other employment-related matters of its public servants, until such time as their transfer to the Budget of the Republic actually takes place, all of which must be concluded no later than the end of the first semester of 2001.\n\nConsequently, the previously indicated expenses shall be covered with the balance available as of December 31, 2000, in the current account of the MOPT-Ferry Tempisque Executing Unit.\n\nArticle 5.—The Executing Unit for the Administration of the Tempisque Ferry must adopt the necessary measures to guarantee that the ferry service is provided twenty-four hours a day, meeting the needs of the users of this public service, for which purpose it shall establish the duty roster and service systems that best suit the existing demand.\n\nArticle 6.—The Executing Unit for the Administration of the Tempisque Ferry shall continue to be integrated, for the period indicated in this Decree, as follows:\n\na) The Director of Maritime Transport of the Ministry of Public Works and Transport, Eng.
