De igual forma promueve la investigación científica, el estudio de los ecosistemas y su\nequilibrio así como el conocimiento y las tecnologías que permitan el uso sostenible de, los\nrecursos naturales del país y de su conservación.\n\n4º-Que la cantidad de personas que visitan al área protegida durante la temporada de anidación de la\ntortuga Baula (Dermochelys coriacea), es de considerable magnitud. Es por este motivo que se hace\nnecesario regular la afluencia de turistas al área protegida.\n\n5º-Que se han desarrollado estudios científicos que han demostrado la necesidad de tomar medidas\nestrictas en pro de la conservación de la tortuga Baula, especie que se encuentran en peligro de\nextinción , pues se has estimado que la población anidante en el Parque Nacional Marino las Baulas y\nRefugio Nacional de Vida Silvestre Tamarindo, tendera a desaparecer para el año 2005. Por lo tanto,\n\nDecretan:\n\nArtículo 1º-Declarar como área destinada a la observación de la tortuga Baula el sector comprendido\nentre punta ventanas hasta la boca del estero Tamarindo. Para efecto de controlar la afluencia\nmasiva de personas al Refugio Nacional de Vida Silvestre Tamarindo, se declara de acceso restringido\ndicha área durante la época de desove de la tortuga Baula (Dermochelys coriacea), que comprende el\nperiodo que va desde el primero de octubre hasta el quince de marzo de cada año.\n\nArtículo 2º-En las fechas comprendidas desde el primero de octubre al veinte de del mismo mes y del\nquince de febrero al quince de marzo del ano siguiente, la visitación se autorizara únicamente para\nactividades de Educación ambiental con escuelas, colegios y universidades de todo el país.\n\nArtículo 3º-Se autorizan las siguientes actividades:\n\na- Observar una sola tortuga en cualquiera de las siguientes fases: cavando el nido, desovando,\ntapando el nido.\n\nb- Solo podrán entran por noche a la playa a observar la tortuga Baula 120 personas,\norganizadas en grupos no mayores de 15 personas entre adultos y menores de edad.\n\nc- Las actividades de filiación se podrían realizar únicamente de conformidad con lo\nestablecido en la ley Nº 7317 y su reglamento.\n\nd- La utilización de focos con luz roja en la playa por los funcionarios del MINAE, promotores\nturísticos, investigadores y voluntarios.\n\nArtículo 4º-No se permitirá:\n\na- La presencia de personas o grupos de personas no autorizadas en la playa, especialmente en\nlas áreas de anidación entre las 18 horas y las 5 de la mañana, en el periodo de desove y nacimiento\nde la tortuga Baula.\n\nb- La utilización de focos, linternas, cámaras fotográficas y de vídeo por aquellas personas\nque no hayan sido autorizadas por la administración del refugio.\n\nc- Los ruidos fuertes y los movimientos bruscos durante el recorrido por la playa y en la\nobservación de la tortuga.\n\nd- El tránsito de turistas y visitantes por el área de incubación de huevos de tortuga, parte\nalta de la playa.\n\ne- La observación de una tortuga que no haya sido asignada para este fin por los funcionarios\ndel MINAE, como tratar de mirarla e iluminarla por el frente, tocarla o modificar la estructura del\nnido.\n\nf-\tEl ingreso de personas que se encuentren en estado de ebriedad.\n\ng- La conducción por parte de un promotor turístico que se encuentre bajo los efectos de\nbebidas alcohólicas, drogas o sustancias enervantes. El incumplimiento de esta disposición facultará\nal Ministerio del Ambiente y Energía, a expulsar del Refugio y cancelar el carne de promotor\nturísticos a quien incurriese en esto, dentro del Área Silvestre Protegida.\n\nh- Realizar fogatas, ningún tipo de actividad recreativa en las zonas de las dunas, ni acampar\ndentro de los limites del área protegida.\n\ni- La observación de la tortuga mientras se encuentre en el proceso de anidación, cuando esta\nconstruye su cama, ni en las etapas de camuflaje y regreso al mar, a excepción de las que\npreviamente las haya autorizado la administración.\n\nArtículo 5º-La administración del Refugio, previamente determinara la ubicación de dos casetas, que\nserán los únicos puntos de entrada a la playa. Por cada caseta podrán entrar únicamente 60 turistas\npor noche, las cuales se turnaran para la visitación.\n\nArtículo 6º-El procedimiento para ingresar a observar la tortuga Baula, se regirá bajo el sistema de\nreservaciones, el cual se describe en la Resolución Administrativa Nº R-SINAC-Nº 52-99, de las ocho\nhoras del siete de octubre, del Sistema Nacional de Áreas de Conservación.\n\nArtículo 7º-Todos los visitantes al Área Silvestre Protegida que deseen observar la tortuga Baula\ndeberán hacerse acompañar por un promotor turístico debidamente autorizados (persona que muestra la\nriqueza natural del área protegida).\n\nArtículo 8º-Las personas que ejerzan funciones como promotores turísticos deberán comprometerse a\nrespetar todas las reglas que la administración dicte para proteger a la tortuga Baula en el\nproceso de desove, sus nidos y neonatos. Para fungir como tal, deberá poseer el carne otorgado por\nel Área de Conservación Tempisque del Ministerio del Ambiente y Energía, que lo autorice para tal\nfin, el cual debe de estar vigente.\n\nArtículo 9º-El tránsito de los grupos visitantes y turistas dentro del Refugio será por la zona\nhúmeda de la playa, formando doble fila. Deberán realizar en perfecto orden, acatando las\ndisposiciones de los funcionarios del MINAE, voluntarios y promotores turísticos. La persona que\ndesacate estas disposiciones será expulsada de la playa por los funcionarios del MINAE.\n\nArtículo 10.-En caso de que un grupo de turistas este dentro de la playa y una tortuga no anide, el\ngrupo deberá detenerse y permanecer en el sitio que se le indique, en espera hasta que ingrese otra\ntortuga y se le asigne.\n\nArtículo 11.-Se dará por finalizado el recorrido una vez que hayan observado alguna de las fases del\nproceso del desove de la tortuga Baula.\n\nArtículo 12.-Las personas que se desempeñen como promotores turísticos, deberán guardar en todo\nmomento las normas de decoro, respeto y educación con todas las personas que deseen ingresar a\nobservar alguna etapa del desove. De incumplirse esta disposición se aplicara las disposiciones de\nLey.\n\nArtículo 13.-Las zonas que comprenden Playa Langosta y Playa Ventanas, estarán dedicadas únicamente\npara la investigación. It likewise promotes scientific research, the study of ecosystems and their balance, as well as the knowledge and technologies that enable the sustainable use of the country's natural resources and their conservation.\n\n4º-That the number of people visiting the protected area during the nesting season of the\nLeatherback turtle (Dermochelys coriacea) is of considerable magnitude. For this reason, it is\nnecessary to regulate the influx of tourists to the protected area.\n\n5º-That scientific studies have been developed that have demonstrated the need to take strict measures for the conservation of the Leatherback turtle, a species that is in danger of extinction, since it has been estimated that the nesting population in the Las Baulas National Marine Park and Tamarindo National Wildlife Refuge will tend to disappear by the year 2005. Therefore,\n\nDecree:\n\nArticle 1º-To declare as an area destined for the observation of the Leatherback turtle the sector comprised between punta ventanas to the mouth of the Tamarindo estuary. For the purpose of controlling the massive influx of people to the Tamarindo National Wildlife Refuge, said area is declared to have restricted access during the spawning season of the Leatherback turtle (Dermochelys coriacea), which comprises the period from the first of October to the fifteenth of March of each year.\n\nArticle 2º-On the dates comprised from the first of October to the twentieth of the same month and from the fifteenth of February to the fifteenth of March of the following year, visitation shall be authorized only for Environmental Education activities with schools, high schools, and universities from throughout the country.\n\nArticle 3º-The following activities are authorized:\n\na- Observe a single turtle in any of the following phases: digging the nest, spawning,\ncovering the nest.\n\nb- Only 120 people may enter the beach per night to observe the Leatherback turtle, organized in groups of no more than 15 people including adults and minors.\n\nc- Filming activities may be carried out only in accordance with the provisions of Law No. 7317 and its regulation.\n\nd- The use of flashlights with red light on the beach by MINAE officials, tourist promoters, researchers, and volunteers.\n\nArticle 4º-The following shall not be permitted:\n\na- The presence of unauthorized persons or groups of persons on the beach, especially in the nesting areas between 6 p.m. and 5 a.m., during the spawning and hatching period of the Leatherback turtle.\n\nb- The use of spotlights, flashlights, photographic and video cameras by those persons who have not been authorized by the refuge administration.\n\nc- Loud noises and abrupt movements during the walk along the beach and during the observation of the turtle.\n\nd- The transit of tourists and visitors through the turtle egg incubation area, the upper part of the beach.\n\ne- The observation of a turtle that has not been assigned for this purpose by MINAE officials, as well as trying to look at it and illuminate it from the front, touching it, or modifying the structure of the nest.\n\nf- The entry of persons who are intoxicated.\n\ng- Driving by a tourist promoter who is under the influence of alcoholic beverages, drugs, or stimulant substances. Non-compliance with this provision shall empower the Ministry of Environment and Energy to expel from the Refuge and cancel the tourist promoter's permit of anyone who incurs in this, within the Protected Wild Area.\n\nh- Building campfires, carrying out any type of recreational activity in the dune zones, or camping within the limits of the protected area.\n\ni- The observation of the turtle while it is in the nesting process, when it builds its bed, nor in the stages of camouflage and return to the sea, with the exception of those previously authorized by the administration.\n\nArticle 5º-The Refuge administration shall previously determine the location of two stations, which will be the only entry points to the beach. Only 60 tourists may enter through each station per night, who will take turns for visitation.\n\nArticle 6º-The procedure to enter to observe the Leatherback turtle shall be governed under the reservation system, which is described in Administrative Resolution No. R-SINAC-Nº 52-99, of eight o'clock on the seventh of October, of the National System of Conservation Areas.\n\nArticle 7º-All visitors to the Protected Wild Area who wish to observe the Leatherback turtle must be accompanied by a duly authorized tourist promoter (a person who shows the natural wealth of the protected area).\n\nArticle 8º-Persons who serve as tourist promoters must commit to respecting all the rules that the administration dictates to protect the Leatherback turtle during the spawning process, its nests, and hatchlings. To serve as such, they must possess the permit issued by the Tempisque Conservation Area of the Ministry of Environment and Energy, which authorizes them for this purpose, and which must be valid.\n\nArticle 9º-The transit of visitor and tourist groups within the Refuge shall be along the wet zone of the beach, forming a double line. They must proceed in perfect order, complying with the provisions of MINAE officials, volunteers, and tourist promoters. Any person who disobeys these provisions shall be expelled from the beach by MINAE officials.\n\nArticle 10.-In the event that a group of tourists is on the beach and a turtle does not nest, the group must stop and remain at the site indicated, waiting until another turtle comes ashore and is assigned to them.\n\nArticle 11.-The tour shall be concluded once they have observed any of the phases of the spawning process of the Leatherback turtle.\n\nArticle 12.-Persons working as tourist promoters must at all times uphold standards of decorum, respect, and education with all persons who wish to enter to observe any stage of the spawning. If this provision is breached, the provisions of Law shall be applied.\n\nArticle 13.-The zones comprising Playa Langosta and Playa Ventanas shall be dedicated exclusively to research.
