  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29537\n\n                        Reglamento para Uso Público del Parque Nacional Isla del Coco\n\nTexto Completo acta: E3E05\nPODER EJECUTIVO\n\nNº 29537-MINAE\n\n    (Este decreto fue derogado por el artículo 81 del Reglamento de Uso Público del Parque Nacional\nIsla del Coco,       aprobado mediante decreto ejecutivo N° 37023 del 23 de enero del 2012)\n\nLA PRIMERA VICEPRESIDENTA\n\nEN EJERCICIO DE LA PRESIDENCIA DE LA REPÚBLICA\n\nY LA MINISTRA DEL AMBIENTE Y ENERGÍA\n\nEn uso de las facultades que le confiere el artículo 140, incisos 3) y 18) de la Constitución\nPolíticas; en relación con los artículos 1º y 3º, inciso a) de la Ley Nº 6084 del 24 de agosto de\n1977, Ley de Creación del Servicio de Parques Nacionales; la Ley Nº 7317, Ley de Conservación de la\nVida Silvestre; la Ley Nº 7554, Ley Orgánica del Ambiente; La Ley Nº 7575, Ley Forestal; la Ley Nº\n7788, Ley de la Biodiversidad, la Ley Nº 6227 del 2 de mayo de 1978, artículo 6º, inciso d) y La Ley\nNº 6794, del 9 de agosto de 1982, de ratificación de las Leyes y Decretos que crearon o ampliaron\nlos Parques Nacionales.\n\nConsiderando:\n\nQue el Parque Nacional Isla del Coco, fue creado el 22 de junio de 1978, mediante Decreto Ejecutivo\nNº 8748, y declarado Sitio de Patrimonio de la Humanidad (UNESCO) el 4 de diciembre de 1997, y Sitio\nRAMSAR en mayo de 1998.\n\nQue en los últimos años se han venido incrementando las visitas de turistas al Parque.\n\nQue debido a lo anterior, se hace necesario regular la afluencia de turistas al Parque Nacional Isla\ndel Coco, según lo dispuesto en el Plan General de Manejo, a fin de evitar posteriores perjuicios y\nalteración a la ecología del lugar.\n\nDecretan:\n\nReglamento para el Uso Público\n\ndel Parque Nacional Isla del Coco\n\nTodo visitante que ingrese al Parque Nacional Isla del Coco, con fines turísticos, científicos u\notros (emergencias, abastecimiento de agua), deberá cumplir con las disposiciones indicadas en el\npresente Reglamento, así como, con las directrices que emita el Ministerio del Ambiente y Energía\n(MINAE) a través del Sistema Nacional de Áreas de Conservación (SINAC) y de la Dirección del Área de\nConservación Marina Isla del Coco (ACMIC).\n\nCAPÍTULO I\n\nIngreso al Parque Nacional Isla del Coco\n\nArtículo 1º-Toda persona, grupos organizados, empresas de turismo, investigadores, u otros, que\ndeseen ingresar al Parque Nacional Isla del Coco, deberán contar con la autorización de la Dirección\ndel Área de Conservación Marina Isla del Coco.\n\nArtículo 2º-Para los efectos del artículo anterior, se deberá llenar el formulario de solicitud de\ningreso al Parque Nacional Isla del Coco, (diseñado en inglés y español) y presentarlo ante la\nDirección del Área de Conservación, con quince días de anticipación a la fecha prevista de Ingreso a\nla Isla del Coco. Dicho formulario consignará los siguientes datos:\n\nNombre completo, número de cédula y/o pasaporte y nacionalidad, de las personas que visitarán el\nParque, incluyendo el capitán y tripulantes de las embarcaciones en que realizarán el viaje.\n\nFechas de ingreso y salida del Parque.\n\nPersona encargada y responsable de los visitantes.\n\nNombre, matrícula y características básicas de la embarcación o aeronave en que se realizará el\nviaje al Parque.\n\nCopia del Certificado de navegación y autonomía, aérea y/o marítima, de la nave o embarcación que\nrealizará el viaje al Parque.\n\nMotivo de la visita y cronograma de las actividades que se realizarán en el Parque.\n\nDirección, número de teléfono y/o fax, del responsable o encargado de los visitantes, para efectos\nde notificaciones.\n\nComprobantes de pago por los servicios que disfrutarán en el Parque Nacional Isla del Coco (Derecho\nde admisión, buceo, atraque, etc.) o bien comprometerse al pago de los mismos en la administración\ndel Parque, por los días que permanecerán en el mismo.\n\nLas empresas de turismo y/o grupos organizados deberán presentar copia de la Licencia de Turismo,\nextendida por el Instituto Costarricense de Turismo (ICT).\n\nArtículo 3º-Corresponderá a la Dirección del Área, aprobar o denegar las solicitudes de visita al\nParque Nacional Isla del Coco, las cuales deberá resolver dentro de los ocho días hábiles siguientes\na la fecha de su recibo, en caso de rechazo, esta deberá hacerse mediante resolución debidamente\nrazonada.\n\nArtículo 4º-La Dirección del Área de Conservación, con base en un programa de visitas presentado por\nlas empresas turísticas podrá reservar a las mismas el derecho de ingreso a la Isla del Coco por un\nperíodo máximo de un año, siempre y cuando dichos permisos se soliciten, por lo menos con tres meses\nde antelación. Previo a cada ingreso a la Isla del Coco, las empresas deberán coordinar con la\nDirección del Área de Conservación para obtener el permiso definitivo.\n\nArtículo 5º-La Dirección del Área de Conservación, velará porque exista equidad en el otorgamiento\nde permisos y, se reservará el derecho de aprobación y/o denegación de los mismos, limitar el número\nde visitantes, días de visita y/o variar las fechas de visita, de acuerdo a su conveniencia y\nconsiderando factores como capacidad de carga máxima y mínimas, indicadas en el Plan General de\nManejo del Parque y situaciones especiales, relacionada con la conservación, manejo y desarrollo del\nÁrea. En todo caso deberá comunicarse mediante resolución.\n\nArtículo 6º-De conformidad con el Plan General de Manejo y Desarrollo del Parque Nacional Isla del\nCoco, aprobado mediante Decreto Nº 24235-MIRENEM del 21 de abril de 1995, ninguna visita que se\nautorice podrá exceder los 12 días de permanencia continua, ni la presencia de más de 60 personas a\nla vez en el Parque, para lo cual, la Dirección del Área de Conservación, llevará un sistema de\ncontrol actualizado, que le permitirá determinar en todo momento, el número de embarcaciones y\nvisitantes presentes, así como los días autorizados de permanencia en el Parque.\n\nArtículo 7º-Toda embarcación que visite el Parque Nacional Isla del Coco, deberá reportar su arribo\n8 millas antes de llegar a la Isla, por medio de la radio, haciendo uso de la frecuencia de canal 16\nque opera en la banda marina VHF, o en la frecuencia 8325 USB y presentar en las Oficinas\nAdministrativas del Parque, el permiso de ingreso aprobado por la Dirección del Área de Conservación\ny el permiso de zarpe extendido por la Capitanía de Puerto correspondiente. En caso de no contar con\nlos respectivos permisos antes citados, deberá suministrar la información conforme lo establece el\nartículo 2º de este Reglamento, en la Administración del Parque Nacional Isla del Coco.\n\nArtículo 8º-Aquellas embarcaciones que no porten los permisos correspondientes para visitar el\nParque Nacional Isla del Coco, por estar de paso en el Océano Pacífico, y que por algún motivo deban\narribar a la Isla del Coco, ya sea para reabastecerse de agua, atender alguna emergencia y/o\ndesperfecto de la embarcación, podrán hacerlo y permanecer en la Isla, hasta un máximo de 8 horas,\npasado este tiempo deberá cancelar el derecho de admisión de todos sus tripulantes y el derecho de\natraque de la embarcación.\n\nCAPÍTULO II\n\nZonificación\n\nArtículo 9º-El Plan de Manejo y Desarrollo del Parque Nacional Isla del Coco, determina las\nsiguientes zonas de uso:\n\na)\tZona restringida o de protección absoluta.\n\nb)\tZona de uso público.\n\nc)\tZona de recuperación de vida silvestre.\n\nd)\tZona de amortiguamiento.\n\na)\tZona restringida o de protección absoluta:\n\nEl objetivo principal de esta zona es la conservación de la biodiversidad marina y terrestre;\nsolamente se permitirán en ésta, actividades relacionadas con medidas de manejo esenciales para la\nprotección.\n\nAmbiente Terrestre: Se considera que toda la Isla es de protección absoluta, exceptuando los sitios\nde uso público, en razón de su inaccesibilidad fragilidad de suelos y ecosistemas vegetales. Cae\nbajo esta categoría el sistema insular que gravita alrededor de la Isla.\n\nAmbiente Marino: Esta conformado por el área marina, comprendida entre los 15 km alrededor de la\nIsla, exceptuando los sitios de uso publico. Dentro de esta zona no se puede aceptar ningún tipo de\nextracción de recursos marinos, vivo o no ni actividad comercial, industrial o acuícola alguna, de\nconformidad con el artículo 8º de la Ley Nº 6084, Ley de Parques Nacionales.\n\nb)\tZona de uso público:\n\nSon aquellos ambientes marinos y terrestres con diferentes grados de restricción de acuerdo con la\nnaturaleza del ambiente, se permite el acceso al público\n\nAmbiente Terrestre: Se incluye dentro de esta zonificación los siguientes senderos: sendero Waffer-\ncascada Río Genio, sendero Waffer-cerro Iglesias, sendero Waffer-Chatham y sendero Cavernas Gisller\ny las áreas verdes existente alrededor de las instalaciones administrativas de Waffer y Chatham.\n\nAmbientes Marinos: Se incluye dentro de esta zonificación los siguientes sitios de buceo y de\nanclaje:\n\nSitios de Buceo: isla Manuelita (superficial y profundo), isla Cónica, Piedra Sucia, isla Cáscara,\nisla Pájara, punta Ulloa, Roca Sumergida, cabo Dampier, Dos Amigos I y II, Aleta de Tiburón punta\nMaría y Bajo Alcyone. Para buceo nocturno se autorizan solamente: la sección somera de isla\nManuelita, Silverado, Roca Vikingo y \"Barco Hundido\" localizado en bahía Waffer.\n\nSitios de Anclaje: Se definen como sitios de anclaje a utilizar por las diferentes embarcaciones las\nbahías de Chathan y Waffer, para lo cual deberán utilizar las boyas dispuestas para ese fin. La\nAdministración del Parque Nacional Isla del Coco, podrá autorizar el anclaje en casos especiales, en\notros sitios diferentes a los mencionados anteriormente.\n\nc)\tZonas de Recuperación de vida silvestre:\n\nEsta zona cubre la totalidad de la Isla, se permitirá la manipulación especial del ambiente con el\npropósito de promover la recuperación científica, de especies de flora y fauna afectadas por la\nacción de las especies exóticas introducidas a la Isla del Coco.\n\nd)\tZona de amortiguamiento:\n\nComprende la franja de 7,2 km entre el anillo de protección absoluta (15 km) y el límite de los 22,2\nkm que constituyen el mar territorial. Dentro de esta zona el único tipo de extracción de recursos\npesquero que se permite será la pesca con línea o cuerda, según lo establece el Plan de Manejo y\nDesarrollo del Parque Nacional Isla del Coco, oficializado mediante el Decreto Nº 23752-MIRENEM.\n\nCAPÍTULO III\n\nActividades de buceo\n\nArtículo 10.-Toda persona, grupo organizado y/o empresa turística, que desee realizar actividades de\nbuceo en la zona marítima del Parque Nacional Isla del Coco, deberá contar con la autorización\nprevia de la Administración del Parque y estar debidamente acreditado como buzo avanzado y\ncertificado por una agencia de buceo, reconocida a nivel nacional e internacional.\n\nArtículo 11.-La actividad de buceo no se podrá realizar en forma individual, siempre deberá hacerse\nen grupos mayores a dos personas. Los grupos de buceo deberán estar bajo la tutela de un guía de\nbuceo (dive master), debidamente reconocido por el ACMIC.\n\nArtículo 12.-El buceo se permitirá únicamente en las zonas y/o sitios autorizados en el presente\nReglamento. Para tal efecto, se entregará a las empresas turísticas y grupos organizados de buzos,\nun mapa que indicará la ubicación de los sitios y sus principales características, al momento de\ncancelar el derecho de buceo y obtener el permiso correspondiente.\n\nArtículo 13.-Los sitios de buceo autorizados en el presente Reglamento, solamente podrán ser\nvisitados tres veces durante el día (mañana, mediodía y tarde ) y una sola vez durante la noche (de\n6,00 p.m. a 9,00 p.m.) por grupos no mayores a las once personas cada vez para un sitio dado,\nincluyendo el dive master con el propósito de no interferir y/o alterar el hábitat de las especies\nmarinas.\n\nArtículo 14.-La operación de arribo a las zonas de buceo, deberá llevarse a cabo con el apoyo de un\nbote debidamente identificado con la bandera de buceo, debiendo ser éste adecuado al número de\nintegrantes del grupo.\n\nArtículo 15.-Las autoridades del Parque Nacional Isla del Coco, velarán porque la actividad de buceo\nse realice conforme a la capacidad de carga, autorizada en el presente Reglamento.\n\nArtículo 16.-Los funcionarios del Parque Nacional, que posean la licencia de buzo, podrán sin previo\naviso, acompañar a los grupos de buceo cuando lo estimen conveniente, con el fin de fiscalizar,\ncontrolar y monitorear las actividades que estos realicen.\n\nArtículo 17.-La práctica de snorkel, buceo a pulmón y/o natación, solo se podrá realizar en los\nsitios someros de isla Manuelita, bahía Chathan y bahía Waffer, cuando las condiciones climáticas\nlos permitan y se efectué acompañado de un bote, lancha o panga, que indique la presencia de\npersonas en el agua.\n\nArtículo 18.-El Ministerio del Ambiente y Energía, o el Área de Conservación Marina Isla del Coco,\nno asumirán bajo ninguna circunstancia, la responsabilidad por accidentes que puedan sufrir los\nvisitantes de la Isla del Coco, como producto de actividades de buceo, natación, snorkel, caminatas\npor senderos y otros servicios que ofrezca el Área.\n\nArtículo 19.-Las embarcaciones de cualquier tipo, utilizadas para el transporte de personas a los\nsitios de buceo y desplazamiento al área administrativa del Parque, no podrán navegar dentro de la\nbahías Chathan y Waffer, a una velocidad mayor a los cinco nudos, debido a que la turbulencia que\ncrea una velocidad mayor a la indicada, incide negativamente en los arrecifes coralinos y\ncomunidades asociadas, y/o causar algún accidente a los buzos que podrán estar en esa zona marítima.\n\nArtículo 20.-La Dirección del Área de Conservación Marina Isla de Coco, podrá cancelar los permisos\nde visitación y/o expulsar del Área, a aquellos visitantes y/o empresas que cometan anomalías y\ndependiendo de la gravedad de la infracción cometida, dar seguimiento a la causa penal que\ncorresponda. Todo ello previo levantamiento de la información respectiva con copia a la dirección\ndel SINAC.\n\nCAPÍTULO IV\n\nPesquería\n\nArtículo 21.—Está totalmente prohibida la realización de toda\npráctica de pesca, sea ésta deportiva o comercial dentro del perímetro de las 12 millas\nnáuticas o 22.22 kilómetros alrededor de la Isla del Coco, que conforman el área marina\ndel Parque Nacional Isla del Coco. Igualmente, queda prohibida la extracción y caza de\ncualquier producto de origen marino o del territorio insular de la Isla del Coco dentro de\nlos límites del Parque, excepto para fines de investigación y manejo del Área,\ndebidamente justificada y aprobada por la Dirección del Área de Conservación. La\nextracción de especímenes propios del territorio insular de la Isla del Coco para fines\nde investigación o bioprospección, queda sujeta al previo cumplimiento de los requisitos\ncontenidos en la normativa oficial de acceso a elementos de la biodiversidad.\n\n(Así reformado por Artículo 7 del Decreto Ejecutivo N°30838\nde 21 de noviembre de 2002).\n\nArtículo 22.-Las embarcaciones de cualquier tipo que sean sorprendidas dentro del perímetro Parque\nNacional Isla del Coco, realizando actividades de cacería, pesca y/o extrayendo cualquier producto o\ndespojo de origen marino, serán decomisadas conforme lo establece la legislación vigente, junto con\nlas artes de pesca y/o caza, y productos marinos que se encontraren en la misma, y denunciados ante\nlos tribunales de justicia y autoridades administrativas pertinentes.\n\nArtículo 23.-Las embarcaciones pesqueras que arriben al Parque Nacional Isla del Coco, podrán\npermanecer en el Área hasta una máximo de ocho horas, lapso en el cual podrán abastecerse de agua,\ny/o atender cualquier situación que requiera apoyo del personal de la Isla. Pasado este período de\ntiempo, si desean permanecer dentro de los límites del Parque deben pagar los derechos de admisión y\natraque conforme a las tarifas establecidas; así como, cualquier otro servicio que requieran del\nÁrea (teléfono, radio comunicación, alimentación, etc.)\n\nArtículo 24.—(DEROGADO, por artículo 8 del Decreto\nEjecutivo N°30838 de 21 de noviembre de 2002).\n\nArtículo 25.-Personal del Parque Nacional, debidamente identificado, podrá cuando lo estime\nnecesario, visitar las embarcaciones de pesca, de turismo y de cualquier otro tipo, que arriben a la\nIsla del Coco, con el propósito de inspeccionar y corroborar la información sobre las\ncaracterísticas de la embarcación (permisos, matrícula, tamaño, tonelaje, capacidad de carga) y\npersonal a bordo, incluyendo visitantes y tripulación y ofrecer la información del área que\ncorresponda.\n\nCAPÍTULO V\n\nRegulaciones generales\n\nArtículo 26.-De acuerdo con el inciso 11) del artículo 8º de la Ley Nº 6084 del Servicio de Parques\nNacionales, se prohíbe cualquier tipo de contaminación ambiental dentro de los límites del Parque,\nproducida por desechos sólidos o aguas servidas (tales como: basura, jabones, champús, aguas negras\ny servidas, ruido, combustibles, productos químicos, aceites, eliminación de restos de comida) ya\nque pueden alterar las cadenas alimenticias y/o cambiar los hábitos alimenticios de las especies\nterrestres y marinas.\n\nArtículo 27.-Las embarcaciones de cualquier tipo que visten el Parque Nacional Isla del Coco, no\npodrán mientras estén fondeadas y/o navegando en territorio del Parque Nacional, realizar\nactividades de mantenimiento y/o reparación, que generen desechos sólidos o líquidos contaminantes\ny/o que provoquen alteraciones al ambiente y sus especies, preparar o reparar equipo de pesca,\nhelar, salar o destripar el producto pescado.\n\nArtículo 28.-La pesca, caza, extracción, manipuleo, acoso, y hostigamiento, de especies marinas y/o\nterrestres, (tiburones, rayas, mantas, tortugas, peces, langostas, estrellas de mar, corales,\nconchas, piedras, arena, etc.) queda prohibido a los visitantes, solamente se permitirá esta acción,\ncuando la misma se efectúe con fines científicos a los investigadores autorizados por la Dirección\ndel Área de Conservación Marina Isla del Coco.\n\nArtículo 29.-Dentro de la zona marítima del Parque Nacional Isla del Coco, no se permitirán\nactividades deportivas (excepto, el buceo autorizado), tales como: deslizamiento sobre el agua (jet\nesquíe), surf, motos acuáticas, alas delta, paracaidismo acuático, vehículos aéreos de cualquier\ntipo, y el uso de vehículo de competencia o exhibición marina.\n\nArtículo 30.-Queda totalmente prohibido la introducción en la Isla del Coco, de cualquier especie\nexótica animal o vegetal, sin la debida autorización de la Dirección del Área y solamente podrá\ndarse esta situación, con fines científicos debidamente justificados.\n\nArtículo 31.-La Dirección del Área de Conservación Marina Isla del Coco, tendrá la potestad de\nordenar el cierre temporal o permanente de las actividades de uso público en el Parque Nacional Isla\ndel Coco, si mediante el criterio del personal técnico del Área y/o de especialistas, a través del\nmonitoreo ambiental y otras actividades técnicas propuestas en el Plan General de Manejo y\nDesarrollo y/o en otros estudios técnicos necesarios para el adecuado manejo de los recursos\nbiológicos y culturales del Parque Nacional, se detecte algún impacto negativo o deterioro en la\nintegridad de los mismos, tanto a nivel marino y como terrestre. También podrá ordenarse el cierre\ncuando sea necesaria, la ejecución de las acciones recomendadas por los programas de manejo, cuyo\nbuen desarrollo pudieran ser afectados por la presencia de visitantes en el Área y/o atentar contra\nsu salud, seguridad e integridad física, entre otros aspectos.\n\nArtículo 32.-La utilización de botes inflables, y/o pangas, solo podrán ser utilizados por las\nembarcaciones para el transporte de personas a los sitios de buceo autorizados, visitar las oficinas\nadministrativas y/o puestos de control del Parque Nacional Isla del Coco y los sitios que la\nAdministración del Área, autorice previa solicitud oral o escrita.\n\nArtículo 33.-Queda totalmente prohibido para todos los visitantes que ingresen al Parque Nacional\nIsla del Coco, el marcaje, de árboles, piedras, rocas y cualquier otro elemento, con nombres,\niniciales, leyendas, letreros, etc. Así como la extracción de desechos o despojos de animales\nmarinos o terrestres.\n\nArtículo 34.-Dentro del Parque Nacional Isla del Coco, no está permitido la portación y/o uso, de\nningún tipo de arma (sean estas de fuego, blancas, aire comprimido o resorte, etc.)\n\nArtículo 35.-El acatamiento del presente Reglamento y las indicaciones que emitan los funcionarios\ndel Parque debidamente identificados, a los visitantes del Área, serán de carácter obligatorio.\nQuien las incumpla podrá ser acreedor de las sanciones legales en los tribunales correspondientes.\n\nArtículo 36.-El canal 16 que opera en la banda marina VHF debe utilizarse apropiadamente y por el\ntiempo que sea estrictamente necesario, ya que este, debe estar disponible para transmitir y/o\natender cualquier mensaje urgente y/o necesario de las embarcaciones presentes en la zona y/o\neventuales emergencias en la zona.\n\nArtículo 37.-El horario de atención al público, es de 8,00 a.m. a 5,00 p.m. durante todos los días\nde la semana.�",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 29537\n\n                        Regulations for Public Use of Isla del Coco National Park\n\nComplete Text record: E3E05\nEXECUTIVE BRANCH\n\nNo. 29537-MINAE\n\n    (This decree was repealed by Article 81 of the Regulations for Public Use of Isla del Coco\nNational Park,       approved by Executive Decree No. 37023 of January 23, 2012)\n\nTHE FIRST VICE PRESIDENT\n\nIN EXERCISE OF THE PRESIDENCY OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nUsing the powers conferred by Article 140, subsections 3) and 18) of the Political Constitution; in relation to Articles 1 and 3, subsection a) of Law No. 6084 of August 24, 1977, Law Creating the National Parks Service; Law No. 7317, Wildlife Conservation Law; Law No. 7554, Organic Environmental Law; Law No. 7575, Forest Law; Law No. 7788, Biodiversity Law, Law No. 6227 of May 2, 1978, Article 6, subsection d) and Law No. 6794, of August 9, 1982, ratifying the Laws and Decrees that created or expanded the National Parks.\n\nConsidering:\n\nThat Isla del Coco National Park was created on June 22, 1978, by Executive Decree No. 8748, and declared a World Heritage Site (UNESCO) on December 4, 1997, and a RAMSAR Site in May 1998.\n\nThat in recent years, tourist visits to the Park have been increasing.\n\nThat due to the foregoing, it is necessary to regulate the influx of tourists to Isla del Coco National Park, in accordance with the provisions of the General Management Plan, in order to avoid future damage and alteration to the ecology of the site.\n\nThey decree:\n\nRegulations for Public Use\n\nof Isla del Coco National Park\n\nEvery visitor entering Isla del Coco National Park for tourism, scientific, or other purposes (emergencies, water supply) must comply with the provisions set forth in these Regulations, as well as with the guidelines issued by the Ministry of Environment and Energy (MINAE) through the National System of Conservation Areas (SINAC) and the Directorate of the Isla del Coco Marine Conservation Area (ACMIC).\n\nCHAPTER I\n\nEntry to Isla del Coco National Park\n\nArticle 1.-Any person, organized groups, tourism companies, researchers, or others wishing to enter Isla del Coco National Park must have the authorization of the Directorate of the Isla del Coco Marine Conservation Area.\n\nArticle 2.-For the purposes of the preceding article, the application form for entry to Isla del Coco National Park (designed in English and Spanish) must be completed and submitted to the Directorate of the Conservation Area fifteen days prior to the planned date of entry to Isla del Coco. Said form shall record the following information:\n\nFull name, identification number and/or passport number, and nationality of the persons visiting the Park, including the captain and crew of the vessels on which they will travel.\n\nDates of entry to and exit from the Park.\n\nPerson in charge of and responsible for the visitors.\n\nName, registration number, and basic characteristics of the vessel or aircraft on which the trip to the Park will be made.\n\nCopy of the navigation and autonomy certificate, air and/or maritime, for the ship or vessel making the trip to the Park.\n\nPurpose of the visit and schedule of activities to be carried out in the Park.\n\nAddress, telephone and/or fax number of the person responsible for or in charge of the visitors, for notification purposes.\n\nProof of payment for the services to be enjoyed in Isla del Coco National Park (admission fee, diving, docking, etc.) or a commitment to pay for them at the Park administration office for the days they will remain there.\n\nTourism companies and/or organized groups must present a copy of the Tourism License issued by the Costa Rican Tourism Institute (ICT).\n\nArticle 3.-The Directorate of the Area shall be responsible for approving or denying visitation requests to Isla del Coco National Park, which must be resolved within eight business days following the date of receipt. In case of denial, it must be done by means of a duly reasoned resolution.\n\nArticle 4.-The Directorate of the Conservation Area, based on a visitation program submitted by tourism companies, may reserve the right of entry to Isla del Coco for a maximum period of one year, provided that such permits are requested at least three months in advance. Prior to each entry to Isla del Coco, the companies must coordinate with the Directorate of the Conservation Area to obtain the final permit.\n\nArticle 5.-The Directorate of the Conservation Area shall ensure equity in the granting of permits and reserves the right to approve and/or deny them, limit the number of visitors, days of visit, and/or vary the dates of visit, according to its convenience and considering factors such as the maximum and minimum carrying capacity indicated in the Park's General Management Plan, and special situations related to the conservation, management, and development of the Area. In any case, this must be communicated by means of a resolution.\n\nArticle 6.-In accordance with the General Management and Development Plan for Isla del Coco National Park, approved by Decree No. 24235-MIRENEM of April 21, 1995, no authorized visit may exceed 12 days of continuous stay, nor the presence of more than 60 people at a time in the Park. For this purpose, the Directorate of the Conservation Area shall maintain an updated control system that will allow it to determine, at all times, the number of vessels and visitors present, as well as the authorized days of stay in the Park.\n\nArticle 7.-Any vessel visiting Isla del Coco National Park must report its arrival 8 miles before reaching the Island, by radio, using channel 16 which operates on the VHF marine band, or on frequency 8325 USB, and present at the Park's Administrative Offices the entry permit approved by the Directorate of the Conservation Area and the departure clearance (permiso de zarpe) issued by the corresponding Port Authority. In the event of not having the respective permits cited above, it must provide the information as established in Article 2 of these Regulations at the Administration office of Isla del Coco National Park.\n\nArticle 8.-Those vessels not carrying the corresponding permits to visit Isla del Coco National Park, because they are passing through the Pacific Ocean, and that for some reason must arrive at Isla del Coco, whether to replenish water, attend to an emergency, and/or address a vessel breakdown, may do so and remain on the Island for a maximum of 8 hours. After this time, they must pay the admission fee for all their crew members and the docking fee for the vessel.\n\nCHAPTER II\n\nZoning\n\nArticle 9.-The Management and Development Plan for Isla del Coco National Park determines the following use zones:\n\na) Restricted or absolute protection zone.\nb) Public use zone.\nc) Wildlife recovery zone.\nd) Buffer zone.\n\na) Restricted or absolute protection zone:\n\nThe main objective of this zone is the conservation of marine and terrestrial biodiversity; only activities related to management measures essential for protection shall be permitted here.\n\nTerrestrial Environment: The entire Island is considered an absolute protection zone, except for the public use sites, due to its inaccessibility and soil and plant ecosystem fragility. The insular system orbiting around the Island falls under this category.\n\nMarine Environment: This consists of the marine area within 15 km around the Island, except for the public use sites. Within this zone, no type of extraction of marine resources, living or non-living, or any commercial, industrial, or aquaculture activity is permitted, in accordance with Article 8 of Law No. 6084, National Parks Law.\n\nb) Public use zone:\n\nThese are marine and terrestrial environments with different degrees of restriction according to the nature of the environment; public access is permitted.\n\nTerrestrial Environment: The following trails are included within this zoning: Waffer-Río Genio waterfall trail, Waffer-Cerro Iglesias trail, Waffer-Chatham trail, and Cavernas Gisller trail, and the existing green areas around the administrative facilities at Waffer and Chatham.\n\nMarine Environments: The following diving and anchoring sites are included within this zoning:\n\nDiving Sites: Isla Manuelita (shallow and deep), Isla Cónica, Piedra Sucia, Isla Cáscara, Isla Pájara, Punta Ulloa, Roca Sumergida, Cabo Dampier, Dos Amigos I and II, Aleta de Tiburón, Punta María, and Bajo Alcyone. For night diving, only the following are authorized: the shallow section of Isla Manuelita, Silverado, Roca Vikingo, and the \"Sunken Ship\" (Barco Hundido) located in Bahía Waffer.\n\nAnchoring Sites: The bays of Chatham and Waffer are defined as anchoring sites to be used by the different vessels, for which they must use the buoys provided for this purpose. The Administration of Isla del Coco National Park may authorize anchoring in special cases at sites other than those mentioned above.\n\nc) Wildlife recovery zone:\n\nThis zone covers the entirety of the Island. Special manipulation of the environment shall be permitted for the purpose of promoting the scientific recovery of flora and fauna species affected by the action of exotic species introduced to Isla del Coco.\n\nd) Buffer zone:\n\nThis comprises the strip of 7.2 km between the absolute protection ring (15 km) and the 22.2 km limit comprising the territorial sea. Within this zone, the only type of fishing resource extraction permitted is line or rod fishing, as established in the Management and Development Plan for Isla del Coco National Park, formalized by Decree No. 23752-MIRENEM.\n\nCHAPTER III\n\nDiving Activities\n\nArticle 10.-Any person, organized group, and/or tourism company wishing to carry out diving activities in the maritime zone of Isla del Coco National Park must have the prior authorization of the Park Administration and be duly accredited as an advanced diver and certified by a nationally and internationally recognized diving agency.\n\nArticle 11.-The diving activity may not be carried out individually; it must always be done in groups of more than two people. Diving groups must be under the supervision of a dive guide (dive master) duly recognized by the ACMIC.\n\nArticle 12.-Diving shall only be permitted in the zones and/or sites authorized in these Regulations. For this purpose, a map indicating the location of the sites and their main characteristics shall be provided to tourism companies and organized groups of divers upon payment of the diving fee and obtaining the corresponding permit.\n\nArticle 13.-The diving sites authorized in these Regulations may only be visited three times during the day (morning, noon, and afternoon) and only once during the night (from 6:00 p.m. to 9:00 p.m.), by groups of no more than eleven people each time for a given site, including the dive master, with the purpose of not interfering with and/or altering the habitat of the marine species.\n\nArticle 14.-The arrival operation to the diving zones must be carried out with the support of a boat duly identified with the diving flag, which must be appropriate for the number of members in the group.\n\nArticle 15.-The authorities of Isla del Coco National Park shall ensure that the diving activity is carried out in accordance with the carrying capacity authorized in these Regulations.\n\nArticle 16.-The personnel of the National Park who hold a diver's license may, without prior notice, accompany the diving groups when they deem it convenient, in order to audit, control, and monitor the activities carried out by them.\n\nArticle 17.-The practice of snorkeling, free diving (buceo a pulmón), and/or swimming may only be carried out in the shallow sites of Isla Manuelita, Bahía Chatham, and Bahía Waffer, when climatic conditions allow it, and must be done accompanied by a boat, launch, or panga indicating the presence of people in the water.\n\nArticle 18.-The Ministry of Environment and Energy, or the Isla del Coco Marine Conservation Area, shall under no circumstances assume responsibility for accidents that visitors to Isla del Coco may suffer as a result of diving activities, swimming, snorkeling, walks on trails, and other services offered by the Area.\n\nArticle 19.-Vessels of any type used to transport people to the diving sites and travel to the administrative area of the Park may not navigate within Bahía Chatham and Bahía Waffer at a speed greater than five knots, because the turbulence created by a speed greater than that indicated negatively impacts the coral reefs and associated communities, and/or may cause an accident to divers who may be in that maritime zone.\n\nArticle 20.-The Directorate of the Isla del Coco Marine Conservation Area may cancel visitation permits and/or expel from the Area those visitors and/or companies that commit irregularities, and depending on the severity of the infraction committed, pursue the corresponding criminal case. All of this after the gathering of the respective information, with a copy to the directorate of SINAC.\n\nCHAPTER IV\n\nFishery\n\nArticle 21.—The carrying out of any fishing practice, whether sport or commercial, within the perimeter of the 12 nautical miles or 22.22 kilometers around Isla del Coco, which constitute the marine area of Isla del Coco National Park, is strictly prohibited. Likewise, the extraction and hunting of any product of marine origin or from the insular territory of Isla del Coco within the limits of the Park is prohibited, except for research and management purposes for the Area, duly justified and approved by the Directorate of the Conservation Area. The extraction of specimens native to the insular territory of Isla del Coco for research or bioprospecting purposes is subject to the prior fulfillment of the requirements contained in the official regulations on access to biodiversity elements.\n\n(Thus amended by Article 7 of Executive Decree No. 30838 of November 21, 2002).\n\nArticle 22.-Vessels of any type that are caught within the perimeter of Isla del Coco National Park carrying out hunting, fishing activities, and/or extracting any product or spoils of marine origin shall be confiscated as established by current legislation, along with the fishing and/or hunting gear and marine products found on board, and shall be reported to the courts of justice and pertinent administrative authorities.\n\nArticle 23.-Fishing vessels arriving at Isla del Coco National Park may remain in the Area for a maximum of eight hours, during which time they may replenish water and/or attend to any situation requiring support from the Island personnel. After this period, if they wish to remain within the limits of the Park, they must pay the admission and docking fees according to the established rates, as well as for any other services they require from the Area (telephone, radio communication, food, etc.).\n\nArticle 24.—(REPEALED by Article 8 of Executive Decree No. 30838 of November 21, 2002).\n\nArticle 25.-Duly identified National Park personnel may, when they deem it necessary, visit fishing vessels, tourism vessels, and those of any other type that arrive at Isla del Coco, for the purpose of inspecting and corroborating the information on the vessel's characteristics (permits, registration, size, tonnage, carrying capacity) and personnel on board, including visitors and crew, and offer the corresponding area information.\n\nCHAPTER V\n\nGeneral Regulations\n\nArticle 26.-In accordance with subsection 11) of Article 8 of Law No. 6084, National Parks Service, any type of environmental contamination within the limits of the Park produced by solid waste or wastewater (such as garbage, soaps, shampoos, blackwater and greywater, noise, fuels, chemical products, oils, disposal of food scraps) is prohibited, as they can alter the food chains and/or change the feeding habits of terrestrial and marine species.\n\nArticle 27.-Vessels of any type visiting Isla del Coco National Park may not, while anchored and/or navigating in the territory of the National Park, carry out maintenance and/or repair activities that generate contaminating solid or liquid waste and/or that cause alterations to the environment and its species, prepare or repair fishing equipment, freeze, salt, or gut caught fish product.\n\nArticle 28.-Fishing, hunting, extraction, handling, harassment, and chasing of marine and/or terrestrial species (sharks, rays, mantas, turtles, fish, lobsters, starfish, corals, shells, stones, sand, etc.) is prohibited for visitors. This action shall only be permitted when performed for scientific purposes by researchers authorized by the Directorate of the Isla del Coco Marine Conservation Area.\n\nArticle 29.-Within the maritime zone of Isla del Coco National Park, sports activities (except authorized diving) shall not be permitted, such as: water skiing (jet esquíe), surfing, personal watercraft, hang gliders, water parachuting, aerial vehicles of any type, and the use of marine competition or exhibition vehicles.\n\nArticle 30.-The introduction to Isla del Coco of any exotic animal or plant species without the due authorization of the Directorate of the Area is strictly prohibited, and this situation may only be permitted for duly justified scientific purposes.\n\nArticle 31.-The Directorate of the Isla del Coco Marine Conservation Area shall have the authority to order the temporary or permanent closure of public use activities in Isla del Coco National Park if, through the criteria of the Area's technical personnel and/or specialists, via environmental monitoring and other technical activities proposed in the General Management and Development Plan and/or in other technical studies necessary for the adequate management of the biological and cultural resources of the National Park, any negative impact or deterioration in their integrity is detected, both at the marine and terrestrial levels. Closure may also be ordered when necessary for the execution of actions recommended by management programs, whose proper development could be affected by the presence of visitors in the Area and/or could threaten their health, safety, and physical integrity, among other aspects.\n\nArticle 32.-The use of inflatable boats and/or pangas may only be used by vessels for the transportation of people to authorized diving sites, to visit the administrative offices and/or control posts of Isla del Coco National Park, and to sites authorized by the Area Administration upon prior oral or written request.\n\nArticle 33.-The marking of trees, stones, rocks, and any other element with names, initials, legends, signs, etc., is strictly prohibited for all visitors entering Isla del Coco National Park, as is the extraction of waste or spoils of marine or terrestrial animals.\n\nArticle 34.-Within Isla del Coco National Park, the carrying and/or use of any type of weapon (whether firearms, knives/blades, compressed air or spring weapons, etc.) is not permitted.\n\nArticle 35.-Compliance with these Regulations and the instructions given by duly identified Park personnel to visitors of the Area shall be mandatory. Anyone failing to comply may be subject to legal sanctions in the corresponding courts.\n\nArticle 36.-Channel 16, which operates on the VHF marine band, must be used appropriately and for the time strictly necessary, as it must remain available to transmit and/or attend to any urgent and/or necessary message from vessels present in the zone and/or any eventual emergencies in the zone.\n\nArticle 37.-The hours for public service are from 8:00 a.m. to 5:00 p.m. every day of the week."
