  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29571\n\n                        Deroga el decreto que establece Prohibición Total de Extracción y\nComercialización de Moluscos Bilvabos en todo el País\n\nTexto Completo acta: 3EC51\nNº 29571-MAG-S\n\nNº 29571-MAG-S\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LOS MINISTROS DE AGRICULTURA Y GANADERÍA,\n\nY DE SALUD\n\nEn ejercicio de las facultades establecidas en el artículo 140,\nincisos 3) y 18) de la Constitución Política, la Ley Nº 6227 de 2 de mayo de 1978, Ley\nGeneral de la Administración Pública, la Ley Nº 7064 de 29 de abril de 1987, que\nincorpora la Ley Orgánica del Ministerio de Agricultura y Ganadería, la Ley Nº 7384 de\n16 de marzo de 1994, Ley de Creación del Instituto Costarricense de la Pesca y\nAcuacultura y la Ley Nº 5395 de 30 de octubre de 1973, Ley General de Salud.\n\nConsiderando:\n\n1º—Que mediante Decreto Ejecutivo Nº 29184-S-MAG de 12 de\ndiciembre del año 2000, publicado en La Gaceta Nº 247 del 26 de diciembre del\n2000, se estableció una prohibición total a la extracción y comercialización de\nmoluscos bivalbos, por efecto de la presencia del fenómeno de la marea roja en las aguas\ncosteras del Pacífico Costarricense y el riesgo a la vida humana.\n\n2º—Que de conformidad con los análisis laboratoriales, de aguas\ny muestras de carne y monitoreos realizados por las instancias técnicas competentes,\nrespecto del seguimiento del comportamiento del fenómeno, ha determinado que a la fecha,\nlas causas que dieron origen al establecimiento de dicha prohibición, ha disminuido\nsensiblemente tratándose de las especies afectas a la regulación, con excepción del\nmolusco bivalbo Spondylus Calcifer (Ostión Vaca).\n\n3º—Que la comercialización de moluscos bivalbos, por su consumo\ne importancia en el mercado, repercute significativamente en el subsector pesquero\ndedicado a su extracción, por lo cual no es conveniente ni oportuno mantener dicha\nafectación, si la misma técnicamente hoy no se justifica, pero manteniendo la\nregulación respecto del molusco en el cual el fenómeno de la marea roja mantiene su\nincidencia y riesgo para la salud y la vida humana.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 29571\n\n                        Repeals the decree establishing a Total Ban on the Extraction and\nCommercialization of Bivalve Mollusks throughout the Country\n\nFull Text record: 3EC51\nNo. 29571-MAG-S\n\nNo. 29571-MAG-S\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF AGRICULTURE AND LIVESTOCK,\n\nAND OF HEALTH\n\nIn exercise of the powers established in Article 140,\nsubsections 3) and 18) of the Political Constitution, Law No. 6227 of May 2, 1978, General\nLaw of Public Administration, Law No. 7064 of April 29, 1987, which\nincorporates the Organic Law of the Ministry of Agriculture and Livestock, Law No. 7384 of\nMarch 16, 1994, Law Creating the Costa Rican Institute of Fisheries and\nAquaculture, and Law No. 5395 of October 30, 1973, General Health Law.\n\nConsidering:\n\n1st—That through Executive Decree No. 29184-S-MAG of December\n12, 2000, published in La Gaceta No. 247 of December 26,\n2000, a total ban was established on the extraction and commercialization of\nbivalve mollusks, due to the presence of the red tide phenomenon (fenómeno de la marea roja) in the coastal waters\nof the Costa Rican Pacific and the risk to human life.\n\n2nd—That in accordance with the laboratory analyses of waters\nand meat samples and the monitoring carried out by the competent technical bodies,\nregarding the tracking of the phenomenon's behavior, it has been determined that to date,\nthe causes that gave rise to the establishment of said ban have\nsignificantly decreased in the case of the species affected by the regulation, with the exception of the\nbivalve mollusk Spondylus Calcifer (Ostión Vaca).\n\n3rd—That the commercialization of bivalve mollusks, due to their consumption\nand importance in the market, has a significant impact on the fishing subsector\ndedicated to their extraction, for which reason it is neither convenient nor opportune to maintain said\nrestriction, if technically it is not justified today, while maintaining the\nregulation regarding the mollusk in which the red tide phenomenon (fenómeno de la marea roja) maintains its\nincidence and risk to human health and life. Therefore,\n\nThey Decree:\n\nArticle 1— REPEALED\n\n(Repealed by Article 4 of\nExecutive Decree number 29595-S of June 15, 2001)\n\nArticle 2—A total ban is hereby established and maintained on the extraction and commercialization throughout\nthe country of the bivalve mollusk called Spondylus Calcifer (Ostión Vaca), until such time as the\ntechnical and scientific studies demonstrate that this product may once again be fit for human\nconsumption.\n\nArticle 3—This decree shall take effect upon its publication."
