INSTITUTO COSTARRICENSE\n\nDE PESCA Y ACUACULTURA\n\nACUERDA:\n\n1º-Conceder hasta por un período de dos años, dieciocho (18) permisos de pesca de buceo a pulmón,\ncon compresor o con trampas, para la langosta Panulirus gracilis y exclusivos para pescar en los\nalrededores de Paquera, en una zona comprendida desde la Isla de San Lucas hasta Punta Tambor.\n\n2º-Dichos permisos serán concedidos a personas físicas que hallan vivido en la comunidad de Paquera\no sus alrededores por un mínimo de 5 años y que durante todo ese período se hayan dedicado a la\npesca artesanal en dicha zona, cuestión ésta que será acreditada a la Administración a través de\nconstancias emitidas al respecto por las organizaciones de pescadores debidamente constituidas de\nPaquera.\n\n3º-Los interesados deberán demostrar al INCOPESCA que están capacitados y gozan de buena salud para\nbucear a pulmón o con compresor.\n\n4º-Se permitirá, cuando sea necesario la utilización de embarcaciones pequeñas, comúnmente conocidas\ncomo pangas, las cuales serán utilizadas para el transporte de los buzos y sus equipos de pesca\ndesde y hacia los caladeros de pesca.\n\n5º-Se prohíbe la captura de langosta Panulirus gracilis proveniente de aguas jurisdiccionales del\nPacífico Costarricense con otro arte que no sea el bichero (hasta tanto no se cuente con un método\nde pesca alternativo) o la trampa.\n\n6º-Se establece la longitud mínima de captura y comercio de Panulirus gracilis en 80 mm de longitud\ndel cefalotórax, medida desde el centro del rostro ubicado entre los dos cuernos frontales hasta el\nborde posterior del cefalotórax o bien, en 128 mm cuando se trate del abdomen. En este último caso\nla longitud se medirá cuando la cola se encuentre sobre una superficie plana y en cuyo caso será la\ndistancia entre el centro del borde anterior del abdomen y el borde posterior del telson.\n\n7º-Toda persona que se dedique a la captura, transporte o comercio de langosta Panulirus gracilis en\nel territorio nacional deberá portar un calibrador construido, preferiblemente de metal, que\ngarantice cumplir con al menos una de las medidas mínimas establecidas en el articulo 6º del\npresente acuerdo.\n\n8º-Se prohíbe la captura y comercio de langostas ovígeras, sea aquellas que tienen huevos visibles\nen el abdomen.\n\n9º-Se prohíbe en forma absoluta la captura de langosta Panulirus gracilis durante el mes de\nseptiembre en el Golfo de Nicoya.\n\n10.-Se ordena a la Dirección Técnica del INCOPESCA inicie estudios técnicos encaminados a la\nbúsqueda de artes de pesca que sean ambientalmente amigables. Herbert Nanne Echandi, Presidente Ejecutivo.-Yahaira Chambers Vargas, Secretaria Junta\nDirectiva.", "body_en_text": "throughout the entire text\n\n-\n\nFull Text of Regulation 144\n\nBreath-Hold Diving, Compressor Diving, or Trap Permits for the Lobster\n*Panulirus gracilis* around Paquera\n\nFull Text of Act: 7006F\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/144.—Puntarenas, at thirteen hundred hours on the eleventh day of May of the year two thousand.\n\n(This Agreement was EXPANDED by Agreement AJDIP/463 of November 7, 2003, published in La Gaceta No. 236 of December 8, 2003.)\n\nConsidering:\n\n1.—That the lobster *Panulirus gracilis* constitutes an important resource for artisanal fishermen of the Pacific Coast of our country.\n\n2.—That a recent study carried out with the collaboration of the Asociación de Buzos de Paquera (ABUZPA), an association whose members have collaborated for several years in carrying out scientific studies and in the preservation of the environment, demonstrated that the lobster population found in the Paquera zone is underexploited (sub-explotada).\n\n3.—That said study also indicates the fragility of said population in the face of the onslaught of severe oceanographic changes as well as excessive and indiscriminate fishing.\n\n4.—That by agreement AJDIP/143-2000 of May 11 of this year, agreement AJDIP/103-2000, which contained a series of regulations regarding the capture and commercialization of the lobster *Panulirus gracilis*, was rendered null and void.\n\n5.—That it is necessary to regulate fishing effort and manage that fishery under the concepts of responsibility and sustainability.\n\nTherefore,\n\nTHE BOARD OF DIRECTORS OF THE COSTA RICAN INSTITUTE\nOF FISHERIES AND AQUACULTURE\n\nHEREBY AGREES:\n\n1.—To grant for a period of up to two years, eighteen (18) fishing permits for breath-hold diving (buceo a pulmón), with a compressor, or with traps, for the lobster *Panulirus gracilis* and exclusively for fishing in the surroundings of Paquera, in an area extending from Isla de San Lucas to Punta Tambor.\n\n2.—Said permits will be granted to natural persons who have lived in the community of Paquera or its surroundings for a minimum of 5 years and who during that entire period have been dedicated to artisanal fishing in said area, a matter that must be accredited to the Administration through certifications (constancias) issued to that effect by the duly constituted fishermen's organizations of Paquera.\n\n3.—Interested parties must demonstrate to INCOPESCA that they are qualified and enjoy good health for breath-hold diving or diving with a compressor.\n\n4.—The use of small vessels, commonly known as pangas, will be permitted, when necessary, which will be used for transporting divers and their fishing equipment to and from the fishing grounds (caladeros de pesca).\n\n5.—The capture of lobster *Panulirus gracilis* originating from the jurisdictional waters of the Costa Rican Pacific with any gear other than the bichero (until such time as an alternative fishing method becomes available) or the trap is prohibited.\n\n6.—The minimum length for capture and trade of *Panulirus gracilis* is established at 80 mm of carapace (cefalotórax) length, measured from the center of the rostrum located between the two frontal horns to the posterior edge of the carapace, or alternatively, at 128 mm when dealing with the abdomen. In this latter case, the length will be measured with the tail placed on a flat surface, in which case it will be the distance between the center of the anterior edge of the abdomen and the posterior edge of the telson.\n\n7.—Any person engaged in the capture, transport, or trade of lobster *Panulirus gracilis* in the national territory must carry a measuring gauge (calibrador) constructed, preferably of metal, which guarantees compliance with at least one of the minimum measurements established in article 6 of this agreement.\n\n8.—The capture and trade of berried (ovígeras) lobsters, that is, those with visible eggs on the abdomen, is prohibited.\n\n9.—The capture of lobster *Panulirus gracilis* during the month of September in the Golfo de Nicoya is absolutely prohibited.\n\n10.—The Technical Directorate of INCOPESCA is ordered to initiate technical studies aimed at finding fishing gear that is environmentally friendly. For such purposes, it may request assistance from the different fishermen's organizations of the Paquera Zone, who, for the present purposes, must provide the information requested by the professionals dedicated to this research.\n\n11.—Decree No. 16947-MAG of March 30, 1990, published in La Gaceta No. 89 of May 11, 1990, is hereby repealed.\n\n12.—It shall become effective upon its publication.\n\nMSc.
