de una adecuada planificación, ejecución, administración y\ncontrol, lo cual debe realizarse por medio de una estructura organizativa formal,\nresponsable de la administración de las inversiones en infraestructura física. Por\ntanto,\n\nDecretan:\n\nArtículo 1º—Créase la Oficina Asesora en Infraestructura Física del Ministerio del Ambiente y\nEnergía, como una oficina de asesoría y de apoyo técnico y normativo, responsable de la\nfiscalización de todos los proyectos de obras mayores, referentes al desarrollo, ampliación y\nacondicionamiento general de la planta física del MINAE, de acuerdo con el Plan Anual Operativo del\nMinisterio y las respectivas partidas presupuestarias. Ministerio.\n\nf) Realizar los estudios necesarios que sirvan de guía\n para el diseño de la planta física en general y de los edificios en particular, así\n como de sus ampliaciones y remodelaciones, que se construyan con fondos propios,\n préstamos internacionales, préstamos nacionales, por medio de organismos no\n gubernamentales y donaciones.\n\ng)  Elaborar los documentos técnicos necesarios para\n efectuar los procedimientos de contratación de estudios preliminares, planos de conjunto,\n planos de anteproyecto y planos constructivos de los proyectos de planta física del\n Ministerio.\n\n(Así reformado el inciso anterior mediante el\n artículo 2 del decreto ejecutivo N°33164 del 10 de mayo del 2006).\n\nh) Fiscalizar los plazos y prioridades establecidas en el\n desarrollo de la infraestructura física del Ministerio.\n\n(Así reformado el inciso anterior mediante el\n artículo 2 del decreto ejecutivo N°33164 del 10 de mayo del 2006).\n\ni) Fiscalizar el avance de los proyectos y vigilar que se\n cumplan las correspondientes especificaciones técnicas, las normas generales y demás\n documentos contractuales que se establezcan para el desarrollo de la infraestructura\n física del Ministerio.\n\n(Así reformado el inciso anterior mediante el\n artículo 2 del decreto ejecutivo N°33164 del 10 de mayo del 2006).\n\nj) Coordinar con el ente encargado de la administración\n financiera de los recursos, el manejo de los fondos destinados a las obras mayores del\n Ministerio.\n\nk) Coordinar con la Proveeduría Ministerial, los aspectos\n relacionados con licitaciones y contrataciones de estudios de consultoría, de\n construcción de obras y, cuando corresponda de adquisición de bienes inmuebles.\n\nl) Estudiar y recomendar la adjudicación, en los aspectos\n técnicos, de las licitaciones para las consultorías y construcción de obras.\n\nm) Coordinar con el equipo encargado de la parte legal, la\n elaboración y el cumplimiento de los contratos de consultoría y de construcción.\n\nn) Efectuar las recepciones provisionales y finales de cada\n obra concluida y levantar el acta correspondiente.\n\no) Coordinar la ejecución de las obras menores con el\n Departamento de Servicios Generales, en aquellos casos en que su impacto o grado de\n complejidad lo amerite.\n\nArtículo 3º-La Oficina Ejecutora del Plan de Inversiones en Infraestructura Física del Ministerio\ndel Ambiente y Energía, estará a cargo de un Director, quien responderá en sus actuaciones ante el\nDespacho Ministerial y deberá reunir los siguientes requisitos:\n\na) Ser ingeniero civil o arquitecto, con el grado mínimo de licenciatura, con al menos cinco años de\nexperiencia profesional y preferiblemente con una especialidad en ciencias ambientales.\n\nb) Estar incorporado al Colegio Federado de Ingenieros y Arquitectos de Costa Rica.\n\nc) Contar con experiencia en el campo de la Planificación y Administración de Proyectos.\n\nArtículo 4º—Son funciones del\nDirector de la Oficina:\n\na) Asesorar al Despacho Ministerial, o a quien este\n designe, en materia de su competencia.\n\nb) Actuar como superior jerárquico de la oficina y asignar\n los deberes y responsabilidades al personal propio y al que haya sido asignado a la\n oficina temporalmente, para desarrollar proyectos específicos.\n\nc) Establecer mecanismos tendientes a lograr la mayor\n eficacia y eficiencia para la fiscalización del desarrollo de la infraestructura física\n del Ministerio.\n\n(Así reformado el inciso anterior mediante el\n artículo 3 del decreto ejecutivo N°33164 del 10 de mayo del 2006).\n\nd)  Vigilar que se cumplan con eficacia y dentro de\n los plazos establecidos, todos los aspectos técnicos, administrativos y financieros\n relativos a los proyectos de desarrollo de infraestructura física del Ministerio.\n\n(Así reformado el inciso anterior mediante el\n artículo 3 del decreto ejecutivo N°33164 del 10 de mayo del 2006).\n\ne) Presentar anualmente un plan de trabajo y un informe de\n labores al Despacho Ministerial.\n\nf) Coordinar con las autoridades respectivas, en lo que\n corresponda, los planes de trabajo de las oficinas o direcciones que lleven a cabo labores\n relacionadas con las funciones de la Oficina.\n\ng) Proponer al Despacho Ministerial, de acuerdo con las\n normas establecidas, la incorporación del personal que la Oficina requiera.\n\nh) Promover programas de adiestramiento y capacitación\n para el personal a su cargo, con el propósito de lograr el más adecuado ejercicio de sus\n funciones.\n\ni) Preparar, con base en el plan de trabajo, el proyecto\n del presupuesto de la Oficina.\n\nj) Ejecutar los acuerdos del Despacho Ministerial que le\n correspondan y las tareas que éste le asigne.\n\nk) Realizar cualquier ENERGY\n\nExercising the powers conferred upon them by Article 140, subsections 2),\n3), 8), and 18) of the Political Constitution and Law No. 7152 of June 5, 1990,\n\"Law for the Conversion of the Ministry of Industry, Energy and Mines into the Ministry of\nNatural Resources, Energy and Mines,\" and\n\nConsidering:\n\n1.—That the administration of Natural Resources by the\nMinistry of Environment and Energy requires the existence of adequate physical\ninfrastructure, consistent with the nature of the Ministry.\n\n2.—That the Conservation Areas under the administration of\nMINAE, which have facilities for visitor services such as research\ncenters, information offices, and trails, are one of the main destinations\nfor national and international tourism.\n\n3.—That it is in the interest of the Ministerial Office that said\nadministration be efficient, effective, and consistent with the economic resources available\nfor physical infrastructure.\n\n4.—That the Technical Manual for the Development of Public Works Projects of the\nComptroller General of the Republic establishes that any public works project executed\ntotally or partially with public funds and resources or resources of\npublic origin requires adequate planning, execution, administration, and\ncontrol, which must be carried out through a formal organizational structure\nresponsible for the administration of investments in physical infrastructure. Therefore,\n\nThey Decree:\n\nArticle 1.—The Advisory Office for Physical Infrastructure of the Ministry of Environment and\nEnergy is hereby created as an advisory, technical, and normative support office, responsible for the\noversight of all major works projects related to the development, expansion, and\ngeneral conditioning of the physical plant of MINAE, in accordance with the Annual Operating Plan of the\nMinistry and the respective budget allocations. Said Advisory Office shall report directly\nto the (*)National System of Conservation Areas and shall be governed by the provisions issued by the latter in\nmatters of investment in physical properties, and conservation areas.\n\nb) To provide technical advice to the Ministerial Office or to\n whomever it designates, in matters within its competence.\n\nc) To oversee the development of\n physical infrastructure carried out through international cooperation\n projects.\n\n(Thus reformed the previous subsection by\n Article 2 of Executive Decree No. 33164 of May 10, 2006).\n\nd) To work in coordination with the Offices and Directorates\n of the Ministry responsible for other aspects necessary for the execution of the\n projects.\n\ne) To propose to the Ministerial Office, in coordination with\n the Planning Office and any other pertinent office, appropriate plans and policies\n for the harmonious and rational development of the Ministry's physical plant.\n\nf) To conduct the necessary studies that serve as a guide\n for the design of the physical plant in general and of the buildings in particular, as well\n as their expansions and remodels, that are constructed with own funds,\n international loans, national loans, through non-governmental\n organizations, and donations.\n\ng) To prepare the technical documents necessary to\n carry out the contracting procedures for preliminary studies, site plans,\n preliminary project plans, and construction plans for the Ministry's physical plant projects.\n\n(Thus reformed the previous subsection by\n Article 2 of Executive Decree No. 33164 of May 10, 2006).\n\nh) To monitor the timelines and priorities established in the\n development of the Ministry's physical infrastructure.\n\n(Thus reformed the previous subsection by\n Article 2 of Executive Decree No. 33164 of May 10, 2006).\n\ni) To monitor the progress of projects and ensure compliance with\n the corresponding technical specifications, general standards, and other\n contractual documents established for the development of the Ministry's physical infrastructure.\n\n(Thus reformed the previous subsection by\n Article 2 of Executive Decree No. 33164 of May 10, 2006).\n\nj) To coordinate with the entity in charge of the financial\n administration of resources the management of funds destined for the Ministry's major works.\n\nk) To coordinate with the Ministry Procurement Office the aspects\n related to bidding processes and contracting of consulting studies, construction\n of works, and, when applicable, acquisition of real estate.\n\nl) To study and recommend the award, in the technical\n aspects, of bidding processes for consulting services and construction of works.\n\nm) To coordinate with the team in charge of the legal aspects the\n preparation and fulfillment of consulting and construction contracts.\n\nn) To carry out the provisional and final acceptances of each\n completed work and draw up the corresponding record.\n\no) To coordinate the execution of minor works with the\n General Services Department in those cases where their impact or degree of\n complexity warrants it.\n\nArticle 3.—The Executing Office of the Physical Infrastructure Investment Plan of the Ministry\nof Environment and Energy shall be headed by a Director, who shall answer for his/her actions before the\nMinisterial Office and must meet the following requirements:\n\na) Be a civil engineer or architect, with a minimum degree of licentiate, with at least five years of\nprofessional experience, and preferably with a specialty in environmental sciences.\n\nb) Be a member of the Federated College of Engineers and Architects of Costa Rica.\n\nc) Have experience in the field of Project Planning and Administration.\n\nArticle 4.—The functions of the\nOffice Director are:\n\na) To advise the Ministerial Office, or whomever it\n designates, in matters within his/her competence.\n\nb) To act as the hierarchical superior of the office and assign\n duties and responsibilities to its own personnel and to personnel temporarily assigned to the\n office to develop specific projects.\n\nc) To establish mechanisms aimed at achieving the greatest\n effectiveness and efficiency in the oversight of the development of the Ministry's physical infrastructure.\n\n(Thus reformed the previous subsection by\n Article 3 of Executive Decree No. 33164 of May 10, 2006).\n\nd) To ensure that all technical, administrative, and financial\n aspects related to the Ministry's physical infrastructure development projects are fulfilled effectively and within\n the established deadlines.\n\n(Thus reformed the previous subsection by\n Article 3 of Executive Decree No. 33164 of May 10, 2006).\n\ne) To annually present a work plan and a report on activities\n to the Ministerial Office.\n\nf) To coordinate with the respective authorities, as\n pertinent, the work plans of offices or directorates that carry out tasks\n related to the functions of the Office.\n\ng) To propose to the Ministerial Office, in accordance with the\n established standards, the incorporation of personnel that the Office requires.\n\nh) To promote training and capacity-building programs\n for the personnel under his/her charge, with the purpose of achieving the most adequate exercise of their\n functions.\n\ni) To prepare, based on the work plan, the\n draft budget for the Office.\n\nj) To execute the agreements of the Ministerial Office that\n pertain to him/her and the tasks assigned by it.\n\nk) To carry out any other function inherent to the\n exercise of his/her position.\n\nArticle 5.—This decree shall take effect upon its publication.\n\nTRANSITORY PROVISIONS:\n\n1.—Once this decree is published, the Executing Unit of the\nParque Marino del Pacífico Project shall constitute the Executing Office of the Physical\nInfrastructure Investment Plan of MINAE, supervising, on a priority basis, the\ndevelopment of both the first stage of the Parque Marino del Pacífico project and\nany other that is established.\n\n2.—All physical, human, logistical, and material resources currently\nassigned to the Executing Unit of the Parque Marino del Pacífico Project shall become part\nof the Executing Office of the Physical Infrastructure Investment Plan once it is created.\n\n3.—The Procedures Manual for the Executing Office shall be\nprepared within fifteen days following the publication of this decree and shall be\nsubmitted for approval to the Minister of Environment and Energy." }
