la labor de la Dirección Nacional\n de Empleo del Ministerio de Trabajo y Seguridad Social, estableciéndose como la\n dependencia responsable de llevar a cabo las actividades del Poder Ejecutivo, tendientes a\n obtener el bienestar social de la nación, a través de un adecuado equilibrio entre las\n situaciones socioeconómicas y políticas coyunturales del país.\n\n3°- Que en virtud del decreto mencionado en el\n considerando anterior, la Dirección Nacional de Empleo, es una dependencia técnica\n permanente del Ministerio de Trabajo y Seguridad Social, que tiene la potestad de ayudar\n económicamente a las personas del sector privado, que se encuentran desocupadas y en\n aflictiva situación.\n\n4°—Que mediante la Ley No 7384 del 16 de\n mayo de 1994, Ley de Creación del Instituto Costarricense de Pesca y Acuacultura\n (INCOPESCA), se establece como atribución y competencia de dicho Instituto, proteger y\n conservar los recursos biológicos del mar y de la\n\nacuacultura, en aras de garantizar a las\n generaciones venideras los recursos vivos del mar.\n\n5°-Que, con base en lo anterior, el Instituto\n Costarricense de Pesca y Acuacultura, mediante acuerdo A1DP/142, de fecha 14 de mayo del\n año en curso, estableció una serie de regulaciones aplicables en el Golfo de Nicoya,\n dentro las que se contemplan: Prohibir a los barcos de arrastre, faenar durante el\n período que va del 1° de junio al 31 de octubre del 2001,\n\nasí como prohibir a la flota camaronera de\n arrastre, realizar su actividad durante todo el año 2001, en la zona antes indicada.\n\n6°—Que un porcentaje importante de la\n población aledaña al Golfo de Nicoya tiene como su principal y, en algunos casos, como\n única actividad económica y de subsistencia, la actividad pesquera.\n\n7°—Que, como lo indican los resultados del\n censo nacional, la provincia de Guanacaste es una de las que tienen un mayor nivel de\n desempleo en el país, además de ser también una de las de menor desarrollo económico\n relativo.\n\n8\"—Que para las personas cuya actividad\n laboral principal es la pesca, la veda dispuesta por el INCOPESCA, señalada en el\n considerando cuatro anterior, implicó y ha tenido como consecuencias directas e\n inmediatas, .situaciones difíciles económicas apremiantes, que requieren el auxilio del\n Estado, a través de mecanismos de asistencia para ser paliadas\n\nal menos temporalmente.\n\n9°—Que. precisamente para los efectos\n indicados en el aparte anterior, el párrafo final del articulo 73 del Código de Trabajo,\n prevé la posibilidad del Poder Ejecutivo de \"... dictar medidas de emergencia que,\n sin lesionar los intereses patronales den por resultado el alivio de la situación\n económica de los trabajadores\"; y en el Presupuesto del Ministerio de Trabajo y\n Seguridad, para el año 2001, se contempla la partida número 605, \"Auxilio a\n Trabajadores\", que incluye gastos destinados a ayudar económicamente a personas del\n sector privado, que se encuentren desocupadas y en aflictiva situación. Por tanto,\n\nDECRETAN:\n\nArtículo 1\"—El Ministerio de Trabajo y\n Seguridad Social, a través de la Dirección Nacional de Empleo, otorgará un subsidio\n económico, por una única vez, a aquellos y aquellas costarricenses que se dedican a la\n actividad pesquera en el Golfo de Nicoya, que resultaron imposibilitados para ello, como\n consecuencia de la veda decretada por INCOPESCA mediante MINISTERS OF THE PRESIDENCY AND OF LABOR AND SOCIAL SECURITY\n\nExercising the powers conferred by\n articles 140, subsections 3), 8) and 18) of the Political Constitution and 25, 26 and\n 27 of the General Law of Public Administration.\n\nConsidering:\n\n1.—That in accordance with the provisions\n of article 2, subsections e), f) and g) of the Organic Law of the Ministry of Labor and\n Social Security, number 1860 of April 21, 1955 and its amendments, it is the function of\n said Ministry to ensure that national policy in the field of social\n welfare has adequate regulation that guarantees effective assistance to\n Costa Ricans, their families, and the community.\n\n2.—That through Executive Decree No.\n 18647-TSS, dated November 3, 1988, the work of the National Employment\n Directorate of the Ministry of Labor and Social Security was adapted, establishing it as the\n body responsible for carrying out the activities of the Executive Branch aimed at\n achieving the social welfare of the nation, through an adequate balance between\n the country's conjunctural socioeconomic and political situations.\n\n3.—That by virtue of the decree mentioned in the\n preceding recital, the National Employment Directorate is a permanent technical\n body of the Ministry of Labor and Social Security, which has the authority to provide\n financial aid to individuals in the private sector who are unemployed and in\n a distressing situation.\n\n4.—That through Law No. 7384 of May 16,\n 1994, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture\n (INCOPESCA), it is established as an attribution and competence of said Institute to protect and\n conserve the biological resources of the sea and of\n\naquaculture, for the sake of guaranteeing to\n future generations the living resources of the sea.\n\n5.—That, based on the foregoing, the Costa Rican\n Institute of Fisheries and Aquaculture, through agreement A1DP/142, dated May 14 of the\n current year, established a series of regulations applicable in the Gulf of Nicoya,\n which include: Prohibiting trawling vessels from operating during the\n period from June 1 to October 31, 2001,\n\nas well as prohibiting the shrimp trawling\n fleet from carrying out its activity during the entire year 2001, in the aforementioned zone.\n\n6.—That a significant percentage of the\n population surrounding the Gulf of Nicoya has fishing as its main, and in some cases, its\n only economic and subsistence activity.\n\n7.—That, as the results of the national census\n indicate, the province of Guanacaste is one of those with the highest level of\n unemployment in the country, in addition to being one of those with the lowest relative economic\n development.\n\n8.—That for people whose primary\n work activity is fishing, the closed season ordered by INCOPESCA, indicated in the\n preceding recital four, implied and has had as direct and immediate\n consequences pressing economic hardships, which require State assistance,\n through aid mechanisms, to be mitigated\n\nat least temporarily.\n\n9.—That, precisely for the purposes\n indicated in the preceding section, the final paragraph of article 73 of the Labor Code\n provides for the possibility of the Executive Branch to \"... issue emergency measures that,\n without harming employer interests, result in the relief of the\n economic situation of the workers\"; and the Budget of the Ministry of Labor and\n Social Security for the year 2001 includes line item number 605, \"Aid to\n Workers,\" which includes expenditures intended to economically assist individuals from the\n private sector who are unemployed and in a distressing situation.
