  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 29960\n\n                        Reforma Reserva Indígena Guaymí de Abrojo de Montezuma\n\nTexto Completo acta: 42FA1\nNº 29960-G\n\nNº 29960\n\nEL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE GOBERNACIÓN Y\nPOLICÍA, Y SEGURIDAD PÚBLICA\n\nCon fundamento en los incisos 3) y 18) del artículo 140, de\nla Constitución Política y las leyes 5251 de fecha 11 de Julio de 1973 y sus\nreformas, la Ley Indígena 6172 de 29 de noviembre de 1977, Ley 7316 de 12 de\noctubre de 1992, Convenio 169 de la O.I.T.\n\nConsiderando:\n\n1º-Que la Reserva Indígena Guaymí de Abrojo Montezuma, en su delimitación establecida\npor Decreto 12115-G de La Gaceta 6 del 9 de enero de 1981 no incluyó dentro de\nsu delimitación el territorio conocido como \"Bajo Los Indios\" y\n\"Montezuma\", territorios de tradición indígena.\n\n2º-Que la comunidad indígena apela\nal Poder Ejecutivo para que los territorios conocidos como \"Bajo Los\nIndios\" y \"Montezuma\" sea incluido\ndentro de los límites de la Reserva de Abrojo Montezuma, amparado al artículo\n14 del Convenio 169 de la O.I.T.\n\n3º-Que los sectores de \"Bajo\nlos Indios\" y \"Montezuma\" comprenden un territorio histórico,\npatrimonio cultural para la etnia Guaymí de la\nReserva Indígena de Abrojo Montezuma.\n\n4º-Que la Reserva Indígena Guaymí de Abrojo Montezuma fue reducida en superficie\nmediante el Decreto 12115-G de La Gaceta 6 de 9 de enero de 1981, lo que\ncontradice las disposiciones de ley.\n\n5º-Que la comunidad indígena Guaymí de Abrojo Montezuma solicitó a la Comisión Nacional\nde Asuntos Indígenas CONAI, efectuar los estudios pertinentes y ésta ya los\nrealizó, con la recomendación de que se incluya a su vez el sector suroeste del\nCerro Corredor a efecto de brindar protección a la riqueza ecológica en\nconcordancia con la conservación de los recursos naturales de la zona.\n\n6º-Que en el Decreto 8514 Alcance 93\na La Gaceta 105 de 2 de junio de 1978, artículo 3, se establece la Reserva\nIndígena Abrojo Montezuma como un anexo de la Reserva Indígena Guaymí de Conteburica y que el\nDecreto 12115-G de La Gaceta 6 de 9 de enero de 1981, en su artículo 1 señala:\n\"Establécese la Reserva Indígena Guaymí de\nAbrojo Montezuma\", lo que dejó confusión de si la reserva de Abrojo\nMontezuma se tiene como anexa a la Reserva Indígena de Conteburica\no si se constituye en una reserva independiente, lo cual se debe aclarar.\n\n7º-Que la Reserva Indígena de Abrojo Montezuma en términos geográficos queda muy distante de la\nreserva Indígena de Conteburica y aquella contado con su respectiva Asociación de Desarrollo\nIntegral Indígena legalmente constituida por mucho años, por lo que no existe razón alguna para que\nésta constituya un anexo de la reserva de Conteburica y es necesario definir entonces su\nindependencia. Por lo tanto,\n\nDECRETAN:\n\nArtículo\n1º-Modifíquese el\nartículo 3 del Decreto 8514-G de 2 de mayo de 1978, publicado en el Alcance 93\na La Gaceta 105 de 2 de junio de 1978, para que en adelante se lea así:\n\n \n\nSe establece la Reserva Indígena de\nAbrojo de Montezuma como reserva Indígena independiente de cualquier otra\nreserva, dejando de ser anexo de la Reserva Indígena Guaymí\nde Conteburica.\n\nArtículo\n2º-Modifíquese el\nartículo 1 del Decreto 12115-G, publicado en La Gaceta 6 de 9 de enero de 1981,\npara que en adelante se lea así:\n\n \n\nLa Reserva Indígena Guaymí de Abrojo Montezuma se localiza en las hojas\ncartográficas del Instituto Geográfico Nacional, escala 1:50.000, Canoas 3641\nIV y Cañas Gordas, 3642 III.\n\nLa Reserva Indígena se delimita por los puntos de coordenadas siguientes: Partiendo de la\nconfluencia de la quebrada Planes con el Río Corredor en el punto de coordenadas N 292 700 E 584\n450. De ahí se sigue por los puntos de coordenadas N 292 150 E 585 350 (cerro, 490 m.), N 291 950 E\n586 250. Punto que interseca un camino (trillo) que conduce en sentido noreste al camino principal\nque va de Montezuma (Bellavista) a Planes. Se sigue por este camino con rumbo noreste pasando por\nlos puntos de coordenadas N 292 000 E 586 400, N 292 160 E 586 525. Punto este último que interseca\nel camino principal de Montezuma a Planes. De ahí una recta al Río Abrojo, en el punto de\ncoordenadas N 292 155 E 587 100. De este punto se sigue aguas abajo por el Río Abrojo hasta el punto\nde coordenadas N 291 625 E 588 350. Punto de confluencia de una quebradilla sobre el Río Abrojo. Se\nsigue aguas arriba por esta quebradilla (dibujada en el mapa por curvas de nivel), mediante una\nrecta, hasta el punto de coordenadas N 292 290 E 588 675. Punto ubicado sobre la línea fronteriza\nCosta Rica - Panamá. El lindero sigue por la línea fronteriza Costa Rica - Panamá en sentido\nsureste, la cual es a su vez línea divisoria de aguas entre los ríos Abrojo (de Costa Rica) y\nChiriquí Viejo (de Panamá), hasta el punto de coordenadas N 288 050 E 591 800 (Hito, 911 m.). De\neste punto se continúa por los puntos de coordenadas N 287 950 E 591 700, N 287 940 E 591 525. Este\núltimo punto interseca la naciente principal de la quebrada Callejonuda, por lo que el límite de la\nreserva sigue aguas abajo por esta quebrada, hasta el punto de coordenadas N 287 175 E 590 925. De\neste punto una recta a la naciente en el mapa, de la quebrada Mamey, en el punto de coordenadas N\n288 675 E 589 800. Se sigue aguas abajo por esta quebrada, hasta su confluencia con la quebrada Ojo\nde Agua en el punto de coordenadas N 289 075 E 588 425. Se continúa por esta última quebrada aguas\nabajo, hasta su confluencia con el Río Abrojo en el punto de coordenadas N 289 000 E 588 310. De\nahí, el límite sigue aguas abajo por el Río Abrojo hasta el punto de coordenadas N 288 950 E 588\n150. A partir de este punto se deja el Río Abrojo para continuar por los puntos de coordenadas\nsiguientes:\n\nN 289 100 E 587 650\n\nN 288 250 E 583 650\n\nN 288 200 E 583 000\n\nN 288 700 E 581 920\n\nDe este último punto, una\nrecta al punto de coordenadas N 288 870 E 581 945. Punto que interseca una\nquebrada sin nombre en el mapa pero definida por curvas de nivel. Se sigue\naguas abajo por esta quebrada, hasta su desembocadura sobre el Río Corredor en\nel punto de coordenadas N 289 700 E 581 575.\n\nDe este punto, el lindero\nde la reserva sigue aguas arriba por el Río Corredor, hasta el punto de\ncoordenadas N 290 950 E 583 550. Punto donde confluye una pequeña quebrada\ndefinida en el mapa por curvas de nivel, sobre el Río Corredor. Se sigue por\nesta quebrada aguas arriba, hasta el punto de coordenadas N 291 575 E 583 175.\nDe ahí, una recta al punto de coordenadas N 291 825 E 583 345, punto de\nconfluencia entre las quebradas Luis Umaña y Grande. Therefore,\n\nTHEY DECREE:\n\nArticle 1º-Article 3 of Decree 8514-G of May 2, 1978, published in Scope 93 to La Gaceta 105 of June 2, 1978, is modified to read henceforth as follows:\n\nThe Abrojo de Montezuma Indigenous Reserve is established as an Indigenous reserve independent from any other reserve, ceasing to be an annex of the Guaymí de Conteburica Indigenous Reserve.\n\nArticle 2º-Article 1 of Decree 12115-G, published in La Gaceta 6 of January 9, 1981, is modified to read henceforth as follows:\n\nThe Guaymí de Abrojo Montezuma Indigenous Reserve is located on the cartographic sheets of the National Geographic Institute, scale 1:50,000, Canoas 3641 IV and Cañas Gordas, 3642 III.\n\nThe Indigenous Reserve is delimited by the following coordinate points: Starting from the confluence of the Planes stream with the Corredor River at the coordinate point N 292 700 E 584 450. From there, continue through the coordinate points N 292 150 E 585 350 (hill, 490 m.), N 291 950 E 586 250. Point that intersects a road (trail) leading northeast to the main road that goes from Montezuma (Bellavista) to Planes. Continue along this road heading northeast passing through the coordinate points N 292 000 E 586 400, N 292 160 E 586 525. This last point intersects the main road from Montezuma to Planes. From there, a straight line to the Abrojo River, at the coordinate point N 292 155 E 587 100. From this point, go downstream along the Abrojo River to the coordinate point N 291 625 E 588 350. Confluence point of a small stream on the Abrojo River. Go upstream along this small stream (drawn on the map by contour lines), by means of a straight line, to the coordinate point N 292 290 E 588 675. Point located on the Costa Rica - Panama border line. The boundary follows the Costa Rica - Panama border line heading southeast, which is also the watershed divide between the Abrojo (Costa Rica) and Chiriquí Viejo (Panama) rivers, to the coordinate point N 288 050 E 591 800 (Boundary marker, 911 m.). From this point, continue through the coordinate points N 287 950 E 591 700, N 287 940 E 591 525. This last point intersects the main spring (naciente) of the Callejonuda stream, so the reserve boundary follows downstream along this stream, to the coordinate point N 287 175 E 590 925. From this point, a straight line to the spring (naciente) shown on the map, of the Mamey stream, at the coordinate point N 288 675 E 589 800. Go downstream along this stream, to its confluence with the Ojo de Agua stream at the coordinate point N 289 075 E 588 425. Continue downstream along this latter stream, to its confluence with the Abrojo River at the coordinate point N 289 000 E 588 310. From there, the boundary goes downstream along the Abrojo River to the coordinate point N 288 950 E 588 150. From this point, leave the Abrojo River to continue through the following coordinate points:\n\nN 289 100 E 587 650\n\nN 288 250 E 583 650\n\nN 288 200 E 583 000\n\nN 288 700 E 581 920\n\nFrom this last point, a straight line to the coordinate point N 288 870 E 581 945. Point that intersects a stream unnamed on the map but defined by contour lines. Follow downstream along this stream, to its mouth on the Corredor River at the coordinate point N 289 700 E 581 575.\n\nFrom this point, the reserve boundary goes upstream along the Corredor River, to the coordinate point N 290 950 E 583 550. Point where a small stream, defined on the map by contour lines, flows into the Corredor River. Follow upstream along this stream, to the coordinate point N 291 575 E 583 175. From there, a straight line to the coordinate point N 291 825 E 583 345, point of confluence between the Luis Umaña and Grande streams. The boundary continues upstream along the Quebrada Grande, to the coordinate point N 292 198 E 583 230 to then continue through the following coordinate points:\n\nN 292 300 E 583 800\n\nN 292 675 E 584 000\n\nN 292 700 E 594 450 (starting point of this\n\ndescription).\n\nArticle 3º-The boundaries defined in article 2 of this decree are the definitive boundaries of the Abrojo de Montezuma Indigenous Reserve.\n\nArticle 4º-It takes effect as of its publication.\n\nGiven at the Presidential House.— San José, the twenty-sixth of October, two thousand one."
