la venta de artesanía,\n transportes y servicios turísticos a los turistas que visitan Costa Rica al arribar al\n Complejo. Portuario de Limón.\n\nArtículo 2°—Clasificación:\n para efectos de este reglamento, las actividades a regular dentro de las instalaciones\n portuarias son:\n\na) Venta de artesanía: deberá entenderse como\n la venta de artesanía la manufactura artesanal y fabricación nacional de souvenirs, con\n mayor énfasis en motivos caribeños.\n\nNo se permitirá la venta de artículos\n terminados que sean de fabricación industrial; en caso de duda, el permisionario deberá\n demostrar que los bienes terminados son parte de un trabajo\n\nartesanal propio.\n\nNo se permitirá ninguna venta de comidas o\n bebidas por parte de los artesanos, ni se permitirá la venta de artesanía por parte de\n empleados de JAPDEVA.\n\nb) Venta de servicios turísticos y de\n transportes: para la venta de servicios turísticos (buses y busetas) y transporte\n público (taxis) el vehículo deberá estar en perfecto estado de funcionamiento y\n conservación y se le dará prioridad al servicio de transporte autorizado para la\n provincia de Limón, debiendo cumplir con las regulaciones establecidas al efecto por el\n Ministerio de Obras Públicas y Transportes (MOPT) y el Instituto Costarricense de Turismo\n (ICT).\n\nc) Buses para Servicio Turístico: estos deben\n contar con lo siguiente: aire acondicionado en buen estado, guías bilingües, seguros al\n día con cobertura para el vehículo y pasajeros, capacidad mínima de 15 personas y\n máxima de cincuenta pasajeros, los permisionarios deberán contar con experiencia\n comprobada en el manejo de turistas.\n\nd) Transporte (Taxis): deberán ser modelos\n recientes, conforme a la Ley de Tránsito y contar con todos los seguros al día, puertas\n rotuladas con el triángulo amarillo, y todo el vehículo debe estar en buenas\n condiciones.\n\nArtículo 3°—Lugar\n de prestación de los servicios:\n\nA. Venta de artesanía: sólo estará\n permitida la venta de artesanía en el área especialmente designada por JAPDEVA para ese\n fin.\n\nB. Venta de servicios de transporte: la\n venta de servicios deberá ofrecerse mediante la instalación de un stand, donde los\n clientes podrán solicitar el servicio, el cual será ubicado en el área especialmente\n designado por JAPDEVA.\n\nLas tarifas serán uniformes, deberán ser\n colocadas en un lugar visible para los pasajeros, dentro del vehículo y en el stand de\n ventas.\n\nC. Venta de servicios turísticos: la\n venta de servicios turísticos será el ofrecido por los Tours Operadores que tienen\n contratos establecidos con las Líneas de Cruceros.\n\nPor los empresarios locales que ingresan al\n puerto y mediante la instalación de un stand, donde los clientes pueden solicitar el\n servicio. Las tarifas serán uniformes y deberán ser colocados en lugar visible para los\n pasajeros en el stand, y que cumplan las regulaciones de la Ley de Tránsito para este\n tipo de modalidad de servicio.\n\nTodos los oferentes de servicios de transporte y\n servicios turísticos deberán permanecer fuera del área portuaria hasta que: a) su\n servicio sea solicitado por el cliente; b) según programa de tours vendidos les\n corresponda ingresar; c) cuando regresa a dejar al turista para que aborde el barco. Luego\n de regresar a formar fila de nuevo.\n\nD. Número de permisionarios: el número\n de permisionarios para la venta de artesanía, transporte público y de servicios\n turísticos serán definidos por la Sección de Turismo de JAPDEVA en coordinación con\n las Superintendencias de las terminales portuarias, de acuerdo con las necesidades de\n prestación de los servicios dentro del área portuaria.\n\nArtículo 4°-Vigencia del permiso: los permisos para utilización de áreas portuarias, tendrán\nvigencia únicamente durante la temporada de atraque de cruceros en el Complejo Portuario de Limón\nperíodo en el cual se tramitó.\n\nEn todo caso, dichos permisos deberán ser renovados para la próxima temporada, mediante la\npresentación de los documentos citados en el artículo 7°, un mes antes del inicio de la temporada\ncorrespondiente.\n\nArtículo 5°—Autoridad\n encargada: la Sección de Turismo de JAPDEVA recomendará el número de permisos en\n coordinación con la Superintendencia de las Terminales Portuarias y se encargará de que\n se cumpla el presente reglamento.\n\nDentro de sus funciones, la Sección de Turismo\n analizará y recomendará a la Gerencia Portuaria de JAPDEVA, el otorgamiento de los\n permisos de uso de las instalaciones para la venta temporal de artesanía servicios\n turísticos y transporte de turistas, para la aprobación por parte del Consejo de\n Administración (art. 17 de la Ley Orgánica de JAPDEVA).\n\nArtículo 6°-Sujetos beneficiarios: de acuerdo con los objetivos de este Reglamento, los permisos de\nartesanía, venta de servicios turísticos y transportes a turistas, podrán ser otorgados a personas\nfísicas y jurídicas, sean estas últimas organizaciones sociales, fundaciones, asociaciones,\ncooperativas o sociedades mercantiles.\n\nArtículo 7°-Requisitos de los permisos: para obtener un permiso, todo solicitante debe cumplir los\nsiguientes requisitos:\n\n1. Presentar una solicitud por escrito indicando la modalidad del permiso solicitado y descripción\nde las condiciones en que se ofrecerá el servicio, con copia.\n\n2. Adjuntar copia de la cédula de identidad persona física o cédula jurídica, según sea el caso.\n\n3. Acreditar que contará, durante su desempeño, con todas las condiciones necesarias para ofrecer un\nservicio de calidad, según lo solicite la Sección de Turismo de JAPDEVA.\n\n4. Acreditar que contará para la venta de sus servicios con un stand con las siguientes\ncaracterísticas: medidas de 150 x 122, debidamente pintados en azul, lona azul, altura de 2.20 m, en\nel caso de usar delantal el mismo debe ser azul, para el caso de los artesanos.\n\n5. Todos los vehículos deben portar en la parte delantera la placa de permiso temporal de\nautorización entregado por JAPDEVA, a través de la Superintendencia de Limón.\n\n6. Acreditar que durante el desempeño contarán con basureros con bolsas plásticas disponibles para\nel público, para el caso de los artesanos.\n\n7. Acreditar que se tiene preparado durante el desempeño los empaques adecuados para la mercancía\nvendida, si ésta lo requiere o/a solicitud del turista.\n\n8. Una vez otorgado el permiso deberán presentar manifestación por medio de declaración jurada que\naceptan todos los términos solicitados por la Sección de Turismo para el Otorgamiento de Permiso de\nuso de las Instalaciones Portuarias:\n\na) Que se somete(n) a los lineamientos que emane la Sección de Turismo, la Gerencia Portuaria y\nreglamentación de JAPDEVA.\n\nb) Que se compromete(n) a comportarse en forma decorosa y tratar con respeto y comprensión a los\nturistas y a los miembros de las demás agrupaciones que laboren en el puerto.\n\nc) Que toda la información que manifiestan en la solicitud es verdadera.\n\nd) Que los permisionarios estarán uniformados dentro de las instalaciones del puerto, y mantendrán\nuna buena conducta.\n\ne) Suministrar lista detallada de los asociados o personas físicas que efectivamente ofrecerá el\nservicio en el muelle.\n\nf) Suministra la información de los tours que van a ofrecer y las horas exactas en que están\nprogramados para salir.\n\n9. Portar siempre en un lugar visible el carné de su grupo o empresa u otra que le otorgue JAPDEVA.\n\n10. Las solicitudes deberán ser presentadas ante la Sección de Turismo de JAPDEVA del Departamento\nde Mercadeo, que a su vez las analizará y dará tramite para la aprobación.\n\n11. Cancelar el canon por uso de las instalaciones, en el caso de los Artesanos. Dicho canon deberá\npagarse conforme a los términos que establezca JAPDEVA y su monto será establecido conforme a las\ntarifas aprobadas por JAPDEVA y laARESEP (La Gaceta No 93 del 16-5-2001 y No 64 del 30-3-2001), para\nuso de áreas portuarias, el cuál esta sujeto a modificaciones.)\n\n12. Ninguna persona física y jurídica que tenga cuenta pendiente con JAPDEVA por no pagar el canon u\notro servicio que JAPDEVA le haya brindado podrá optar por permiso de uso de las instalaciones.\n\n13. Ninguna persona física o jurídica que ha sido adjudicado (a) con un espacio en la temporada\nanterior y haya abandonado el espacio sin justificación alguna, puede optar por un nuevo espacio en\nesta temporada.\n\n14. El permiso regirá únicamente para la Temporada de Cruceros del período respectivo.\n\n15. Una vez otorgados los permisos, los permisionarios de venta de artesanía deberán contar con una\npóliza de Riesgos del Trabajo, tanto para el oferente como el personal que tenga laborando en la\nprestación de los servicios.\n\n16. Los permisionarios de venta de artesanía, tendrán 8 días hábiles para analizar , llenar y\ndevolver la solicitud de permiso. Después de este período no se recibirá ninguna solicitud.\n\n17. JAPDEVA no asumirá ninguna responsabilidad civil ni de ningún otro tipo por accidentes u otras\nsituaciones que se presenten con motivo de la prestación de estos servicios y venta de artesanía en\nlas Terminales Portuarias.\n\n18. JAPDEVA tampoco asumirá responsabilidad alguna por la irregularidad e incumplimiento que pueda\nproducirse en el arribo y atraque de los cruceros.\n\n19. En caso de que se incumpliera con lo antes mencionado y se diera alguna anomalía por parte de\nlas organizaciones o personas físicas, JAPDEVA podrá revocar unilateralmente los permisos otorgados,\nsin responsabilidad para la Administración.\n\nArtículo 8°-De los requisitos: para la venta de artesanía, el prestatario deberá:\n\n1. Indicar cuáles de los miembros de la agrupación se dedicarán a la venta o manufactura y venta de\nartesanía en los puertos.\n\n2. Indicar claramente el tipo de artesanía que fabrica y vende al turista. La Autoridad Portuaria\nexigirá que todo prestatario del servicio de transporte cumpla con:\n\n1. Acreditar las pólizas de seguros con la cobertura de responsabilidad civil que protejan a los\npasajeros y cubran daños a terceros.\n\n2. Fecha del día en que ésta se presenta, nombre completo de la agrupación, dirección exacta,\nteléfono y fax, debe consignarse los datos de todos y cada uno de los miembros que estarán prestando\nel servicio, el número de placa del vehículo, el modelo, año, características generales de la\ncondición de cada vehículo, copia certificada de la tarjeta de circulación así como del título de\npropiedad para demostrar que el vehículo está a nombre de la persona u organización solicitante.\n\n3. Cada Persona u Organización deberá asegurarse de que sus vehículos cumplan con lo establecido por\nel Ministerio de Obras Públicas y Transporte, en los Decretos 15203 y 20141 \"Reglamento para la\nExplotación de Servicios Especiales de Transporte Automotor Remunerado de Personas\", publicados en\nLa Gaceta No 38 del 22 de febrero de 1984 y La Gaceta No 13 del 18 de enero de 1991,\nrespectivamente, así como las normativas establecidas por el Instituto Costarricense de Turismo para\nel servicio de transporte a Turistas.\n\nEl solicitante deberá manifestar por escrito su aceptación expresa de someterse al régimen\nestablecido en el presente Reglamento.\n\nLas solicitudes deberán ser presentadas ante la Sección de Turismo de JAPDEVA, que las analizará y\nemitirá recomendación para la aprobación por parte del Consejo de Administración.\n\nArtículo 9°—Del\n canon por uso de las instalaciones: el canon por uso de las instalaciones, es una suma\n de dinero que se pagará por uso del área asignada. Dicho canon deberá pagarse al\n momento de ser asignado el puesto, y su monto es establecido conforme a las tarifas\n aprobadas por JAPDEVA y la ARESEP (La Gaceta No 93 del 16-5-2000 y No 64 del 30-\n 3-2001), para uso de áreas portuarias, el cuál esta sujeto a modificaciones.\n\nArtículo 10.-Del peaje para servicios de transporte: peaje es el pago fijado por JAPDEVA, que\ndeberán cancelar todos los vehículos de transporte que ingresen al área portuaria, dicho peaje podrá\nser modificado, previo seguimiento del debido proceso.\n\nArtículo 11.—De\n la declaración jurada: deberá otorgarse una vez adjudicada la solicitud de acuerdo\n con el artículo 7° de este reglamento, declaración jurada ante Notario Público,\n manifestación que deberá indicar:\n\na) Que se someterá (n) a los lineamientos que\n emane la Sección de Turismo, la Gerencia Portuaria y la normativa vigente.\n\nb) Que se compromete (n) a comportarse en forma\n decorosa y tratar con respeto y comprensión a los turistas y a los miembros de las demás\n agrupaciones que laboren en el puerto.\n\nc) Que toda la información que se brinda en la\n solicitud es verdadera.\n\nd) Que los permisionarios estarán uniformados\n dentro de las instalaciones del puerto, y mantendrán una buena conducta.\n\ne) Lista detallada de los asociados o personas\n físicas que efectivamente ofrecerá el servicio en el muelle.\n\nArtículo 12.—Del\n stand para venta:\n\n1. Para venta de artesanía:\n\na) Los artesanos debidamente autorizados deberán\n acreditar que contará para la venta de sus servicios con un stand con las siguientes\n características: medidas de 150 x 122, debidamente pintados en azul, lona azul, altura de\n 2.20 m, en el caso de usar delantal el mismo debe ser azul.\n\nb) Su acarreo hasta las instalaciones portuarias,\n así como su salida corre por cuenta y riesgo del permisionario.\n\n2. Para venta de servicios turísticos y\n transporte:\n\na) El stand de venta de servicios debe tener un\n mostrador y sillas para atender a los turistas. El techo debe ser de lona y debidamente\n instalado en el mueble.\n\nb) Su acarreo hasta las instalaciones así como\n su salida corre por cuenta y riesgo del permisionario.\n\nc) En el stand deberá permanecer únicamente el\n personal designado para la venta del servicio, el cual debe estar debidamente capacitado e\n identificado.\n\nArtículo 13.-De la aprobación de la solicitud. Las solicitudes serán analizadas por la Sección de\nTurismo de JAPDEVA, que emitirá recomendación para los permisos a la Gerencia Portuaria y posterior\naprobación del Consejo de Administración.\n\nEn forma escrita, la Sección de Turismo comunicará el resultado de los trámites a cada uno de los\nsolicitantes del permiso, dentro del plazo de los ocho (8) días siguientes al otorgamiento del\nmismo.\n\nArtículo 14.-Terminación del permiso. La autorización termina en forma normal por las condiciones\ndel artículo 4° de este reglamento.\n\nEl permiso podrá ser revocado, sin responsabilidad para la administración, en caso de que el\npermisionario incumpla las obligaciones establecidas en este reglamento, dicho procedimiento lo\ninstruirá la Sección de Turismo; in case of doubt, the permit holder (permisionario) must demonstrate that the finished goods are part of their own artisanal\n\nwork.\n\nNo sale of food or drinks by the artisans shall be permitted, nor shall the sale of crafts by employees of JAPDEVA be permitted.\n\nb) Sale of tourist services and transportation: For the sale of tourist services (buses and minibuses) and public\n transport (taxis), the vehicle must be in a perfect state of operation and\n upkeep, and priority shall be given to authorized transportation service for the\n province of Limón, complying with the regulations established for this purpose by the\n Ministry of Public Works and Transport (MOPT) and the Costa Rican Tourism Institute\n (ICT).\n\nc) Tourist Service Buses: These must have the following: air conditioning in good condition, bilingual guides, up-to-date insurance\n with coverage for the vehicle and passengers, a minimum capacity of 15 persons and\n a maximum of fifty passengers; permit holders (permisionarios) must have\n proven experience in handling tourists.\n\nd) Transportation (Taxis): These must be recent\n models, in accordance with the Traffic Law, and have all up-to-date insurance, doors\n marked with the yellow triangle, and the entire vehicle must be in good\n condition.\n\nArticle 3.—Place of service provision:\n\nA. Sale of crafts: The sale of crafts shall only be\n permitted in the area specifically designated by JAPDEVA for that\n purpose.\n\nB. Sale of transportation services: The\n sale of services must be offered through the installation of a stand, where\n clients may request the service, which shall be located in the area specifically\n designated by JAPDEVA.\n\nThe rates shall be uniform and must be\n placed in a visible location for passengers, inside the vehicle and at the sales\n stand.\n\nC. Sale of tourist services: The\n sale of tourist services shall be that offered by Tour Operators that have\n established contracts with the Cruise Lines.\n\nBy local entrepreneurs who enter the\n port and through the installation of a stand, where clients may request the\n service. The rates shall be uniform and must be placed in a visible location for\n passengers at the stand, and they must comply with the Traffic Law regulations for this\n type of service mode.\n\nAll offerors of transportation services and\n tourist services must remain outside the port area until: a) their\n service is requested by the client; b) according to the sold tour program, it is their turn\n to enter; c) when they return to drop off the tourist to board the ship. Afterwards,\n they must return to form the line again.\n\nD. Number of permit holders (permisionarios): the number\n of permit holders (permisionarios) for the sale of crafts, public transportation, and tourist\n services shall be defined by the JAPDEVA Tourism Section in coordination with\n the Superintendencies of the port terminals, in accordance with the needs of\n service provision within the port area.\n\nArticle 4.—Validity of the permit: Permits for the use of port areas shall be\nvalid only during the cruise docking season at the Limón Port Complex,\nthe period in which it was processed.\n\nIn any case, said permits must be renewed for the next season, by\nsubmitting the documents cited in Article 7, one month before the start of the corresponding\nseason.\n\nArticle 5.—Responsible Authority:\n The JAPDEVA Tourism Section shall recommend the number of permits in\n coordination with the Superintendency of the Port Terminals and shall ensure\n compliance with these regulations.\n\nWithin its functions, the Tourism Section shall\n analyze and recommend to the JAPDEVA Port Management the granting of\n use permits for facilities for the temporary sale of crafts, tourist services,\n and tourist transportation, for approval by the Board of Directors\n (Art. 17 of the Organic Law of JAPDEVA).\n\nArticle 6.—Eligible beneficiaries: In accordance with the objectives of these Regulations, permits for\ncrafts, sale of tourist services, and transportation to tourists may be granted to natural\npersons and legal entities, the latter being social organizations, foundations, associations,\ncooperatives, or commercial companies.\n\nArticle 7.—Permit requirements: To obtain a permit, every applicant must meet the\nfollowing requirements:\n\n1. Submit a written request indicating the type of permit requested and a description\nof the conditions under which the service will be offered, with a copy.\n\n2. Attach a copy of the identity card for a natural person or the legal entity identification card, as the case may be.\n\n3. Certify that, during their performance, they will have all the necessary conditions to offer a\nquality service, as requested by the JAPDEVA Tourism Section.\n\n4. Certify that, for the sale of their services, they will have a stand with the following\ncharacteristics: dimensions of 150 x 122, properly painted blue, blue canvas, height of 2.20 m; in\nthe case of using an apron, it must be blue, for the case of the artisans.\n\n5. All vehicles must display on the front part the temporary authorization permit\nplate issued by JAPDEVA, through the Superintendency of Limón.\n\n6. Certify that during their performance they will have trash cans with plastic bags available for\nthe public, for the case of the artisans.\n\n7. Certify that they have, during their performance, the appropriate packaging prepared for the merchandise\nsold, if required or at the tourist's request.\n\n8. Once the permit is granted, they must submit a statement by means of an affidavit stating that\nthey accept all the terms requested by the Tourism Section for the Granting of the Use Permit for Port Facilities:\n\na) That they submit to the guidelines issued by the Tourism Section, the Port Management, and\nJAPDEVA regulations.\n\nb) That they commit to behaving decorously and treating tourists and members of other\ngroups working at the port with respect and understanding.\n\nc) That all the information stated in the application is true.\n\nd) That the permit holders (permisionarios) shall be uniformed within the port facilities, and will maintain\ngood conduct.\n\ne) Provide a detailed list of the associates or natural persons who will effectively offer the\nservice on the pier.\n\nf) Provide the information on the tours they will offer and the exact times they are\nscheduled to depart.\n\n9. Always carry in a visible place the ID card of their group or company or another one granted by JAPDEVA.\n\n10. Applications must be submitted to the JAPDEVA Tourism Section of the Marketing\nDepartment, which in turn will analyze them and process them for approval.\n\n11. Pay the fee (canon) for the use of the facilities, in the case of the Artisans. Said fee (canon) must be\npaid according to the terms established by JAPDEVA, and its amount shall be established according to the\nrates approved by JAPDEVA and ARESEP (La Gaceta No. 93 of 5-16-2001 and No. 64 of 3-30-2001), for\nthe use of port areas, which is subject to modifications.)\n\n12. No natural person or legal entity that has a pending account with JAPDEVA for non-payment of the fee (canon) or\nother service that JAPDEVA has provided may apply for a use permit for the facilities.\n\n13. No natural person or legal entity that was awarded a space in the previous\nseason and abandoned the space without any justification may apply for a new space in\nthis season.\n\n14. The permit shall be valid only for the Cruise Season of the respective period.\n\n15. Once the permits are granted, the permit holders (permisionarios) for the sale of crafts must have a\nWorkers' Compensation Insurance policy, for both the offeror and the personnel working in the\nprovision of services.\n\n16. The permit holders (permisionarios) for the sale of crafts shall have 8 business days to analyze, complete, and\nreturn the permit application. After this period, no application will be received.\n\n17. JAPDEVA shall assume no civil liability or any other type of liability for accidents or other\nsituations that arise due to the provision of these services and sale of crafts in\nthe Port Terminals.\n\n18. JAPDEVA shall also assume no liability whatsoever for any irregularity and non-compliance that may\noccur in the arrival and docking of cruises.\n\n19. In the event of non-compliance with the aforementioned and if any anomaly occurs on the part of\nthe organizations or natural persons, JAPDEVA may unilaterally revoke the granted permits,\nwithout liability to the Administration.\n\nArticle 8.—Of the requirements: For the sale of crafts, the provider must:\n\n1. Indicate which of the members of the group will be dedicated to the sale or manufacture and sale of\ncrafts at the ports.\n\n2. Clearly indicate the type of crafts they manufacture and sell to the tourist. The Port Authority\nshall require that every provider of the transportation service comply with:\n\n1. Certify the insurance policies with civil liability coverage that protect the\npassengers and cover damages to third parties.\n\n2. Date on which it is submitted, full name of the group, exact address,\ntelephone, and fax; the data of each and every one of the members who will be providing\nthe service must be recorded, the vehicle license plate number, the model, year, general characteristics of the\ncondition of each vehicle, a certified copy of the registration card as well as the property\ntitle to demonstrate that the vehicle is in the name of the requesting person or organization.\n\n3. Each Person or Organization must ensure that their vehicles comply with the provisions established by\nthe Ministry of Public Works and Transport (MOPT), in Decrees 15203 and 20141 \"Regulations for the\nExploitation of Special Remunerated Motor Vehicle Passenger Transport Services\", published in\nLa Gaceta No. 38 of February 22, 1984, and La Gaceta No. 13 of January 18, 1991,\nrespectively, as well as the regulations established by the Costa Rican Tourism Institute (ICT) for\nthe tourist transport service.\n\nThe applicant must expressly state in writing their acceptance of submitting to the regime\nestablished in these Regulations.\n\nThe applications must be submitted to the JAPDEVA Tourism Section, which shall analyze them and\nissue a recommendation for approval by the Board of Directors.\n\nArticle 9.—Of the fee (canon) for the use of facilities:\n The fee (canon) for the use of facilities is a sum\n of money that shall be paid for the use of the assigned area. Said fee (canon) must be paid at\n the time the stall is assigned, and its amount is established according to the\n rates approved by JAPDEVA and ARESEP (La Gaceta No. 93 of 5-16-2000 and No. 64 of 3-30-2001), for\n the use of port areas, which is subject to modifications.\n\nArticle 10.—Of the toll (peaje) for transportation services: Toll (peaje) is the payment established by JAPDEVA that\nall transportation vehicles entering the port area must pay; said toll (peaje) may\nbe modified, following due process.\n\nArticle 11.—Of the affidavit:\n It must be granted once the application is awarded in accordance\n with Article 7 of these regulations, an affidavit before a Notary Public,\n a statement that must indicate:\n\na) That they will submit to the guidelines\n issued by the Tourism Section, the Port Management, and the regulations in force.\n\nb) That they commit to behaving decorously and treating\n tourists and members of other groups working at the port with respect and understanding.\n\nc) That all the information provided in the\n application is true.\n\nd) That the permit holders (permisionarios) shall be uniformed\n within the port facilities and will maintain good conduct.\n\ne) A detailed list of the associates or natural\n persons who will effectively offer the service on the pier.\n\nArticle 12.—Of the sales stand:\n\n1. For the sale of crafts:\n\na) Duly authorized artisans must\n certify that, for the sale of their services, they will have a stand with the following\n characteristics: dimensions of 150 x 122, properly painted blue, blue canvas, height of\n 2.20 m; in the case of using an apron, it must be blue.\n\nb) Its transport to and from the port facilities\n shall be at the expense and risk of the permit holder (permisionario).\n\n2. For the sale of tourist services and\n transportation:\n\na) The service sales stand must have a\n counter and chairs to attend to tourists. The roof must be made of canvas and properly\n installed on the furniture.\n\nb) Its transport to and from the facilities\n shall be at the expense and risk of the permit holder (permisionario).\n\nc) Only the personnel designated for the sale of the service may remain in the stand,\n which must be duly trained and\n identified.\n\nArticle 13.—Of the approval of the application. The applications shall be analyzed by the JAPDEVA\nTourism Section, which shall issue a recommendation for the permits to the Port Management and subsequent\napproval by the Board of Directors.\n\nIn writing, the Tourism Section shall communicate the result of the procedures to each of the\npermit applicants, within a period of eight (8) days following its\ngranting.\n\nArticle 14.—Termination of the permit. The authorization ends normally under the conditions\nof Article 4 of these regulations.\n\nThe permit may be revoked, without liability to the administration, in the event that the\npermit holder (permisionario) fails to comply with the obligations established in these regulations; said procedure\nshall be initiated by the Tourism Section, which shall then elevate it to the Board of Directors for the revocation\nof the permit.\n\nArticle 15.—Prohibitions: The following is prohibited for permit holders (permisionarios), without exception:\n\na) The sale of food or drinks by the artisans or allowing the sale of crafts to JAPDEVA employees.\n\nb) Entry to the port premises with minors during the operation is not permitted.\nIt is strictly prohibited, without exception, for a minor to work at the sales stall within\nthe port premises.\n\nc) Consuming food at the workplace during the operation is strictly prohibited, without\nexception.\n\nd) The sale of crafts outside the area specifically designated by the Cruise Commission for that\npurpose.\n\ne) Recording false or altered data in the permit application that distort reality.\n\nf) Not paying the fee (canon) for the use of facilities or the falsification of the respective receipts.\n\ng) Recording false data in the affidavit.\n\nh) Behaving indecorously, mistreating, or disrespecting tourists and members of other\ngroups; likewise, the use of incorrect vocabulary is prohibited.\n\ni) Appearing at the port facilities dressed inappropriately, without their respective\nuniform.\n\nj) Providing the service with a stand different from those authorized and specified in these regulations.\n\nk) In the case of taxis, buses, and minibuses, failing to comply with the standards established by the MOPT and the\nICT for the remunerated transport of persons.\n\nl) Assigning the provision of services to third parties without prior authorization from JAPDEVA.\n\nm) Providing tourist transport services directly, within the port\nfacilities, both for private individuals and in the case of being a JAPDEVA employee.\n\nArticle 16.—Penalties: Those who violate the prohibitions indicated in the previous article shall be\npunished with the cancellation of the granted permit.\n\nArticle 17.—Of the permit cancellation procedure: The cancellation of the permit for any of the\ncauses indicated herein shall be processed through a summary procedure conducted by the JAPDEVA\nTourism Section, which shall refer it to the Board of Directors for its revocation.\n\nAgainst the recommendation issued by the Tourism Section, only an appeal shall be admissible before the\nBoard of Directors, duly justified in writing, within a period not exceeding three days,\ncounted from the day following the notification.\n\nArticle 18.—Of the cancelled permit: Once the permit is revoked, according to the procedure indicated herein,\nthe persons against whom the resolution has been issued shall not be holders of a new\npermit for a term of two years, counted from the day on which the cancellation becomes final.\n\nNo artisan or group whose permit has been cancelled shall be allowed entry to the facilities with merchandise, nor may they go beyond the\nadministrative area of the port.\n\nArticle 19.—The Board of Directors, at the request of the JAPDEVA Tourism Section, the\nCruise Commission, and/or the Port Management, may, for reasons of organization of the port\nactivity, unilaterally revoke the permits granted under these regulations, without\nliability to the Administration.\n\nArticle 20.—JAPDEVA shall assume no civil liability or any other type of liability for accidents\nor other situations that arise due to the provision of these services.\n\nNor shall it assume any liability whatsoever for any irregularity and non-compliance that may occur\nin the arrival and docking of cruises.\n\nArticle 21.—Shall be effective upon its approval and publication." }
