Forestal, Nº\n7575, publicada en La Gaceta Nº 16 del 23 de enero de 1997, así como con los artículos\n82, 84 y 87 de la Ley de Conservación de la Vida Silvestre, Nº 7317 y los artículos 80\ny 81 del Reglamento a la Ley, Nº 26435-MINAE, así como con el artículo 32 de la Ley\nOrgánica del Ambiente, Nº 7554.\n\nConsiderando:\n\n1º—Que es interés del Gobierno fortalecer las estructuras\nadministrativas en el campo de los recursos naturales, a fin de contar con políticas\ndefinidas que garanticen el uso racional de dichos recursos.\n\n2º—Que en el área de Río Cuarto, entre las coordenadas\nverticales 522000-525000 y horizontales 264000-267000, del Sistema de Proyección Lambert,\nen la comunidad llamada Tirimbina, del distrito segundo La Virgen, cantón décimo\nSarapiquí, provincia de Heredia, se encuentra el inmueble inscrito al Folio Real número\nciento setenta y cuatro mil cuatrocientos veinticinco- cero cero cero, con una medida de\ndos millones cincuenta y nueve decímetros cuadrados (296,37 Has.) según plano catastrado\nNº H-569810-99, el cual es un área de repastos, montaña, frutales, pimienta y una\nedificación de once casas, propiedad de la empresa \"Reserva Biológica La Tirimbina,\nLimitada\", con cédula jurídica número tres-ciento dos- ciento cincuenta y cuatro\nmil setecientos noventa y cuatro.\n\n3º—Que el área antes descrita constituye un núcleo muy\nimportante para la conservación de la vida silvestre dentro de la categoría de manejo de\nrefugio privado silvestre. Que por continuar desapareciendo de nuestro medio y por ende de\nnuestro planeta los bosques y las especies de vida silvestre, esta categoría de manejo\npermite conservarlas y manejarlas dentro de un desarrollo sostenible sirviendo a la vez\ncomo regulador ambiental, mediante la implementación de un plan de manejo.\n\n4º—Que en el documento técnico presentado efectuado en la zona,\nse demuestra que es un área silvestre protegida para la protección de la biodiversidad y\nque sirve para brindar oportunidades a la investigación científica, la recreación y la\neducación; siendo objetivos primordiales de este refugio, conservar y proteger el bosque\nnatural primario y secundario, así como la perpetuación y protección de especies con\npoblaciones amenazadas y reducidas de flora y fauna; los ríos Tirimbina y el Uno\natraviesan el refugio; además, varias quebradas que nacen dentro del sitio como afluentes\ndel río Sarapiquí y cuenta aproximadamente con un 99,40% que corresponde a bosque, 0,40%\na potrero y 0,20% es humedal; los terrenos se encuentran sometidos al pago de servicios\nambientales.\n\n5º—Considerando además que se encuentran 304 especies de flora\npertenecientes a 76 familias y 186 géneros, en donde un 14% corresponde a la familia\nRubiaceae, 11% a la familia Areacaceae, 8% a la familia Fabaceae, en cuanto a la fauna hay\n30 especies de mamíferos y 196 especies de aves, 23 especies de reptiles, 20 especies de\nanfibios, razón por la cual, se considera importante en la propuesta del Corredor\nBiológico Mesoamericano.\n\n6º—Que el manejo racional integrado de los recursos naturales,\ncontribuye a satisfacer las necesidades regionales para la investigación, recreación,\neducación ambiental, ecoturismo, así como el aprovechamiento de los recursos naturales\nrenovables explotados racionalmente, de ahí que tiene varios convenios con diferentes\nONG’s, así como instituciones estatales.\n\n7º—Que los propietarios de dicho inmueble, acceden\nvoluntariamente a incorporarse a este régimen de protección de vida silvestre,\ncomprometiéndose a no desarrollar ninguna actividad que ponga en peligro la fragilidad de\nlos diferentes ecosistemas existentes en la zona. Por tanto,\n\nDECRETAN:\n\nArtículo 1º—Declarar \"Refugio de Vida Silvestre\nCategoría Privada La Tirimbina\", los inmuebles pertenecientes a la sociedad Reserva\nBiológica La Tirimbina, Ltda., Folio Real número ciento setenta y cuatro mil\ncuatrocientos veinticinco-cero cero cero, con una medida de 296,34 hectáreas amparados al\nplano catastrado Nº H-569810-99, situados en La Tirimbina, del distrito segundo de La\nVirgen, cantón décimo Sarapiquí, de la provincia de Heredia, ubicados entre las\ncoordenadas verticales 522000-525000 y horizontales 264000-267000, del Sistema de\nProyección Lambert.\n\nArtículo 2º-El propietario del inmueble se compromete a no desarrollar ninguna actividad que\ncomprometa la existencia de la flora y fauna sin el respectivo permiso del MINAE. En caso de no querer mantener dicha categoría de manejo, los propietarios deberán de\nmanifestar su deseo de desafectar las fincas mediante escrito presentado ante el Área de\nConservación Cordillera Volcánica Central, con un año de anticipación.\n\nArtículo 4º-La administración del Refugio le compete a los dueños de la propiedad, pero el MINAE,\nserá quien dicte políticas, en cuanto al manejo y uso de los recursos naturales y medio ambiente.\n\nArtículo 5º-Rige a partir de su publicación.", "body_en_text": "across the entirety of the text\n\n -\n\n Complete Text of Norm 29998\n\n Declares \"La Tirimbina Private Category Wildlife Refuge\"\n\nComplete Text record: 446EC\nNo. 29998-MINAE\n\nNo. 29998-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND\nENERGY\n\nBased on article 140, subsections 3) and 18) of the\nPolitical Constitution, and in accordance with article 1 of the Forestry Law (Ley Forestal), No.\n7575, published in La Gaceta No. 16 of January 23, 1997, as well as articles\n82, 84 and 87 of the Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre), No. 7317 and articles 80\nand 81 of the Regulation to the Law (Reglamento a la Ley), No. 26435-MINAE, as well as article 32 of the\nOrganic Law of the Environment (Ley Orgánica del Ambiente), No. 7554.\n\nConsidering (Considerando):\n\n1.—That it is in the Government's interest to strengthen administrative\nstructures in the field of natural resources, in order to have defined\npolicies that guarantee the rational use of said resources.\n\n2.—That in the area of Río Cuarto, between the vertical\ncoordinates 522000-525000 and horizontal 264000-267000, of the Lambert Projection System,\nin the community called Tirimbina, of the second district La Virgen, tenth canton\nSarapiquí, province of Heredia, is located the property inscribed in the Real Estate Folio (Folio Real) number\none hundred seventy-four thousand four hundred twenty-five - zero zero zero, with an area of\ntwo million fifty-nine square decimeters (296.37 Ha.) according to cadastral plan\nNo. H-569810-99, which is an area of pastures, mountain, fruit trees, pepper and a\nbuilding of eleven houses, owned by the company \"Reserva Biológica La Tirimbina,\nLimitada\", with legal identification number three - one hundred two - one hundred fifty-four\nthousand seven hundred ninety-four.\n\n3.—That the area described above constitutes a very important\ncore for wildlife conservation within the private wildlife refuge management category.\nThat because forests and wildlife species continue to disappear from our environment and therefore from\nour planet, this management category allows them to be conserved and managed within\nsustainable development, serving at the same time as an environmental regulator, through the\nimplementation of a management plan.\n\n4.—That in the technical document submitted and carried out in the zone,\nit is demonstrated that it is a protected wild area for the protection of biodiversity and\nthat it serves to provide opportunities for scientific research, recreation and\neducation; the primary objectives of this refuge being to conserve and protect natural primary\nand secondary forest, as well as the perpetuation and protection of species with\nthreatened and reduced populations of flora and fauna; the Tirimbina and Uno rivers\ncross the refuge; in addition, several streams that originate (nacientes) within the site as tributaries\nof the Sarapiquí river, and it has approximately 99.40% corresponding to forest, 0.40%\nto pasture and 0.20% is wetland; the lands are subject to payment for environmental services (Pago de Servicios Ambientales, PSA).\n\n5.—Considering also that there are 304 species of flora\nbelonging to 76 families and 186 genera, where 14% corresponds to the family\nRubiaceae, 11% to the family Areacaceae, 8% to the family Fabaceae; as for fauna, there are\n30 species of mammals and 196 species of birds, 23 species of reptiles, 20 species of\namphibians, which is why it is considered important in the proposal of the Mesoamerican Biological Corridor (Corredor Biológico Mesoamericano).\n\n6.—That integrated rational management of natural resources\ncontributes to satisfying regional needs for research, recreation,\nenvironmental education, ecotourism, as well as the use of renewable natural\nresources exploited rationally; hence it has several agreements with different\nNGOs, as well as state institutions.\n\n7.—That the owners of said property voluntarily\nagree to join this wildlife protection regime,\ncommitting not to develop any activity that endangers the fragility of\nthe different ecosystems existing in the area. Therefore (Por tanto),\n\nDECREE (DECRETAN):\n\nArticle 1.—To declare \"Refugio de Vida Silvestre Categoría Privada La Tirimbina\", the\nproperties belonging to the company Reserva Biológica La Tirimbina, Ltda., Real Estate Folio (Folio Real) number one hundred seventy-four thousand\nfour hundred twenty-five - zero zero zero, with an area of 296.34 hectares covered by\ncadastral plan No. H-569810-99, located in La Tirimbina, of the second district of La\nVirgen, tenth canton Sarapiquí, of the province of Heredia, located between the\nvertical coordinates 522000-525000 and horizontal 264000-267000, of the Lambert Projection System.\n\nArticle 2.—The property owner commits not to develop any activity that\ncompromises the existence of flora and fauna without the respective permit from MINAE. Likewise, it will provide\nall necessary collaboration to the officials of this Ministry, for the control and\nverification of environmental policies through the Área de Conservación Cordillera Volcánica Central\nof the Sistema Nacional de Áreas de Conservación, as well as to researchers, students and\nothers who sporadically visit said area in the functions proper to their respective positions,\nstudies and investigations. Likewise, they commit to comply with the provisions set forth for this purpose\nby the General Wildlife Law (Ley General de Vida Silvestre), the Forestry Law (Ley Forestal), their respective Regulations, as well as the\nother provisions in force regarding environmental legislation.\n\nArticle 3.—Said property will be subject to the Private Wildlife Refuge Regime (Régimen de Refugio de Vida Silvestre Privado), for a\nperiod of ten years, renewable for equal periods, for which the company owning the\nproperty must request it at least six months in advance of the end of said\nperiod.
