  "body_en_text": "throughout the entire text\n\n                    -\n\n                        Full Text of Rule 90\n\n                        Amendment to the Interim Zoning Allowance Regulations\n\nFull Text of record: 44BB8\nINSTITUTO DE DESARROLLO AGRARIO\n\nINSTITUTO DE DESARROLLO AGRARIO\n\nCOMMUNICATION OF BOARD OF DIRECTORS’ RESOLUTIONS\n\nIn order for you to proceed with its execution, I hereby communicate the resolution adopted by the Board of Directors in article No. XIV, of session No. 90-01, held on December 3, 2001:\n\nArticle fourteen.-The official communication PE-2054-2001, signed by the Executive Presidency, dated December 3, 2001, is submitted for consideration by the directors, concerning note DAJ-981-01, regarding a legal opinion on the payment of zoning allowance (zonaje) for the institution’s employees, in relation to the directives issued by the Contraloría General de la República.\n\nHaving analyzed said case and in accordance with the order of the Contraloría General de la República, it is resolved:\n\na) To amend Article 12 of the Interim Zoning Allowance Regulations (Reglamento Interino de Zonaje), as indicated below, so that once it enters into force after its publication, the administrative procedure for reducing the amount for zoning allowance (zonaje) shall commence, with the constitutional rights of defense and due process (debido proceso) being upheld within each procedure, in order not to cause defenselessness (indefensión):\n\nArticle 12.-The payment of zoning allowance (zonaje) shall be a percentage, taking into consideration means and risks of transportation, climate, health conditions, local living conditions and cost, educational opportunities and medical care for the employee and the employee’s family, such that one hundred percent corresponds to the maximum amount that the Contraloría General de la República sets for the payment of zoning allowance (zonaje) to public employees.\n\nThe percentage calculation shall be fixed by cantons (cantones) and districts (distritos). The amount corresponding to each percentage shall be determined after the Contraloría General de la República sets the variation in the total\n\namount, and it shall be varied ex officio by the Human Resources Area and shall take effect when budgetary availability exists."
