En la cantidad de 0.08 litros por segundo que se tomará de una naciente\nsin nombre, efectuando la captación en la propiedad de los señores Josip y Bok Hee ambos Stefanovic\npara destinarla al uso doméstico y abrevadero, conduciendo la tubería por la propiedad de los\nseñores Stefanovic hasta el sitio del aprovechamiento.\n\n2º-Que el señor José Alfredo Gutiérrez Zumbado, en su condición de presidente de Jagus, S. A.,\npresentó solicitud de imposición de servidumbre forzosa de acueducto ante el Ministerio de\nGobernación y Policía, de conformidad con la Ley de Aguas Nº 276 del 27 de agosto de 1942.\n\n3º-Que\nel Ministerio de Gobernación y Policía, mediante resolución Nº 311-2001 DMG de\nlas 12,00 horas del 19 de febrero del 2001, previo cumplimiento del debido\nproceso, resolvió declarar con lugar la solicitud de imposición de servidumbre\nforzosa de acueducto y ordenó el pago de la indemnización del solicitante a\nfavor de los señores Stefanovic, fijándola en la suma\nde ¢150.000,00 con base en el peritaje rendido por el perito nombrado por el\nEstado el cual consta en el expediente así como el pago realizado por medio del\ndepósito Nº 04506268, por la supra citada suma en la cuenta corriente a nombre\nde Stefanovic Hoe Josip, propietario del inmueble afectado, señores Josip y Bok Hee\nambos Stefanovic del Banco Nacional de Costa Rica.\n\n4º-Que\nde conformidad con las actuaciones de este Ministerio y la concesión de\naprovechamiento de agua otorgada por el Ministerio de Ambiente y Energía(*),\nresolución Nº R-1034-MINAE de las 12,30 horas del día 21 de octubre de 1998\nleyes precitadas y artículo 383 siguientes y concordantes del Código Civil,\nprocede a decretar la constitución de la presente imposición de servidumbre\nforzosa de acueducto.
