  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 30071\n\n                        Otorga un subsidio económico, por una única vez a aquellas y aquellos\ncostarricenses que se dedican a la extracción del molusco bilvao, denominado Spondylus Calcifer\n(Ostión Vaca) en el Litoral Pacífico identificados por INCOPESCA\n\nTexto Completo acta: 4834D\nPODER EJECUTIVO\n\nPODER EJECUTIVO\n\nDECRETOS\n\nNº 30071-MP-MTSS\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LOS MINISTROS DE LA PRESIDENCIA\n\nY DE TRABAJO Y SEGURIDAD SOCIAL\n\nEn ejercicio de las atribuciones conferidas por los artículos 140, incisos 3), 8) y\n18) de la Constitución Política y 25, 26 y 27 de la Ley General de la Administración\nPública.\n\nConsiderando:\n\n1º—Que de conformidad con lo dispuesto en el artículo 2º, incisos e), f) y g),\nde la Ley Orgánica del Ministerio de Trabajo y Seguridad Social, número 1860 del 21 de\nabril de 1955 y sus reformas, es función de dicha Cartera Ministerial, velar porque la\npolítica nacional en el campo del bienestar social, cuente con una reglamentación\nadecuada que garantice una asistencia efectiva a los costarricenses, sus familias y la\ncomunidad.\n\n2º—Que mediante el Decreto Ejecutivo Nº 18647-TSS, de fecha 3 de noviembre de\n1988, se adecuó la labor de la Dirección Nacional de Empleo del Ministerio de Trabajo y\nSeguridad Social, estableciéndose como la dependencia responsable de llevar a cabo las\nactividades del Poder Ejecutivo, tendientes a obtener el bienestar social de la nación, a\ntravés de un adecuado equilibrio entre las situaciones socioeconómicas y políticas\ncoyunturales del país.\n\n3º—Que en virtud del decreto mencionado en el considerando anterior, la\nDirección Nacional de Empleo, es una dependencia técnica permanente del Ministerio de\nTrabajo y Seguridad Social, que tiene la potestad de ayudar económicamente a las personas\ndel sector privado, que se encuentran desocupadas y en aflictiva situación.\n\n4º—Que en ejercicio de las facultades establecidas tanto en la Constitución\nPolítica, Ley General de la Administración Pública y las Leyes, 7064, del 29 de abril\nde 1987, Ley Orgánica del Ministerio de Agricultura, la Ley Nº 5395, del 30 de octubre\nde 1973, Ley General de Salud, y la Ley Nº 7384, del 16 de mayo de 1994, Ley de Creación\ndel Instituto Costarricense de Pesca y Acuacultura (INCOPESCA), El Presidente de la\nRepública y los Ministros de Agricultura y Ganadería y de Salud, emitieron el Decreto\nEjecutivo número 29571-MAG-S, publicado en La Gaceta Nº 114, de fecha 14 de junio\ndel 2001, donde establecen y mantienen una prohibición total a la extracción y\ncomercialización en todo el país del molusco bivaldo, denominado Spondylus Calcifer\n(Ostión Vaca), hasta tanto los estudios técnicos y científicos demuestren que este\nproducto puede ser apto nuevamente para el consumo humano.\n\n5º—Que un porcentaje importante de la población de que habita en el Litoral\nPacífico, especialmente en el Golfo de Nicoya y el Golfo Dulce, tiene como su principal\ny, en algunos casos, como única actividad económica y de subsistencia, la extracción de\nmoluscos bivaldo.\n\n6º—Que, como lo indican los resultados del censo nacional, la zona del Litoral\nPacífico es una de las que tienen un mayor nivel de desempleo en el país, además de ser\ntambién una de las de menor desarrollo económico relativo.\n\n7º—Que para las personas cuya actividad laboral principal es la extracción de\nmoluscos bivaldo, la prohibición decretada por el Poder Ejecutivo, señalada en el\nconsiderando cuatro anterior, implicó y ha tenido como consecuencias directas e\ninmediatas, situaciones difíciles económicas apremiantes, que requieren el auxilio del\nEstado, a través de mecanismos de asistencia para ser paliadas al menos temporalmente.\n\n8º—Que, precisamente para los efectos indicados en el aparte anterior, el\npárrafo final del artículo 73 del Código de Trabajo, prevé la posibilidad del Poder\nEjecutivo de \"... dictar medidas de emergencia que, sin lesionar los intereses\npatronales den por resultado el alivio de la situación económica de los\ntrabajadores\"; y en el Presupuesto del Ministerio de Trabajo y Seguridad, para el\naño 2001, se contempla la partida número 605, \"Auxilio a Trabajadores\", que\nincluye gastos destinados a ayudar económicamente a personas del sector privado, que se\nencuentren desocupadas y en aflictiva situación. Por tanto,\n\nDecretan:\n\nArtículo 1º—El Ministerio de Trabajo y Seguridad Social, a través de la\nDirección Nacional de Empleo, otorgará un subsidio económico, por una única vez, a\naquellos y aquellas costarricenses que se dedican a la extracción del molusco bivalvo, en\nel Litoral Pacífico, que estén debidamente identificados por el INCOPESCA como tales,\nque resultaron imposibilitados para realizar su actividad productiva como consecuencia de\nla prohibición decretada por el Poder Ejecutivo, según Decreto Ejecutivo N° 29595-S,\npublicado el 22 de junio del 2001 en La Gaceta Nº 120\".\n\n(Así reformado por el artículo 1 del Decreto Ejecutivo N° 30134 del 22 de enero\ndel 2002)\n\nArtículo 2º-De conformidad con el artículo anterior, la Dirección Nacional de Empleo será la Unidad\nEjecutora, responsable del otorgamiento del citado subsidio; por lo cual tendrá la obligación de\nverificar contra documentación y registros existentes en poder del INCOPESCA, que las personas\nincluidas en las listas otorgadas y debidamente certificadas por el INCOPESCA, cumplan con todos los\nrequisitos establecidos en el artículo cuarto de este Decreto.\n\nArtículo 3º—Dicho subsidio económico será otorgado a 700 extractores de\nmoluscos, por una única vez, por un monto de ¢ 30.000,00 (treinta mil colones) por\npersona; y se otorgará con cargo a la Partida 605, Auxilio a Trabajadores del Programa\n732, Desarrollo y Seguridad Social, del Presupuesto del Ministerio de Trabajo y Seguridad\nSocial\".\n\n(Así reformado por el artículo 1 del Decreto\nEjecutivo N° 30134 de 22 de enero del 2002)\n\nArtículo 4º—Podrán ser beneficiarios del subsidio económico contemplado en\neste Decreto, las personas (extractoras de moluscos) que cumplan con los siguientes\nrequisitos:\n\na- Ser costarricense, con cédula de identidad vigente.\n\nb- Contribuir con sus ingresos al sostenimiento familiar.\n\nc- Aportar certificación de INCOPESCA, donde se exprese que son extractores (as) de\n  moluscos; que residen en el Cantón Central de la Provincia de Puntarenas y que han\n  enfrentado disminución en sus ingresos, lo cual ha modificado desfavorablemente las\n  condiciones de trabajo en la actividad de extracción de moluscos, durante el período del\n  1º de noviembre al 31 de diciembre del 2001, como consecuencia de la prohibición\n  decretada mediante Decreto Ejecutivo 29595-S, publicado el 14 de junio del 2001 en La\n  Gaceta Nº 120\".\n\n(Así reformado el  inciso c) por el artículo 1 del Decreto Ejecutivo N°\n  30134 de 22 de enero del 2002)\n\nArtículo 5º-Presentada la documentación requerida, se levantará la lista de beneficiarios del\nauxilio económico aquí dispuesto, según las variables del Sistema de Pagos que envía la Dirección\nNacional de Empleo al Departamento Financiero del Ministerio de Trabajo y Seguridad Social, para el\ntrámite de la planilla ante el Ministerio de Hacienda, para la aplicación electrónica a la cuenta\ncliente de cada beneficiario, por los mecanismos establecidos por el Banco Popular y de Desarrollo\nComunal.\n\nArtículo 6º-No se reconocerá el auxilio económico a ningún trabajador o trabajadora [extractor(a)]\nque no esté incluido(a) en la lista certificada por el INCOPESCA o que fuese reportado\nextemporáneamente.\n\nArtículo 7º—Rige a partir de su firma\n\n(Así reformado por el artículo 1 del Decreto Ejecutivo N°\n30134 de 22 de enero del 2002)",
  "body_en_text": "in the entirety of the text\n\n-\n\nFull Text of Norm 30071\n\nGrants a one-time economic subsidy to those Costa Ricans dedicated to the extraction of the bivalve mollusk called Spondylus Calcifer (Ostión Vaca) in the Pacific Littoral identified by INCOPESCA\n\nFull Text of act: 4834D\nEXECUTIVE BRANCH\n\nEXECUTIVE BRANCH\n\nDECREES\n\nNo. 30071-MP-MTSS\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF THE PRESIDENCY\n\nAND OF LABOR AND SOCIAL SECURITY\n\nExercising the powers conferred by Articles 140, subsections 3), 8), and 18) of the Political Constitution and Articles 25, 26, and 27 of the General Law of Public Administration.\n\nConsidering:\n\n1º—That in accordance with the provisions of Article 2, subsections e), f), and g), of the Organic Law of the Ministry of Labor and Social Security, Number 1860 of April 21, 1955, and its amendments, it is a function of said Ministry to ensure that national policy in the field of social welfare has adequate regulation that guarantees effective assistance to Costa Ricans, their families, and the community.\n\n2º—That through Executive Decree No. 18647-TSS, dated November 3, 1988, the work of the National Employment Directorate (Dirección Nacional de Empleo) of the Ministry of Labor and Social Security was adapted, establishing it as the dependency responsible for carrying out the activities of the Executive Branch aimed at achieving the social welfare of the nation, through an adequate balance between the country’s conjunctural socioeconomic and political situations.\n\n3º—That by virtue of the decree mentioned in the previous Considerando, the National Employment Directorate is a permanent technical dependency of the Ministry of Labor and Social Security, which has the authority to provide economic assistance to private-sector individuals who are unemployed and in a distressing situation.\n\n4º—That in exercise of the powers established in both the Political Constitution, the General Law of Public Administration, and Laws 7064 of April 29, 1987, the Organic Law of the Ministry of Agriculture, Law No. 5395 of October 30, 1973, General Health Law, and Law No. 7384 of May 16, 1994, Law Creating the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), The President of the Republic and the Ministers of Agriculture and Livestock and of Health issued Executive Decree number 29571-MAG-S, published in La Gaceta No. 114, dated June 14, 2001, wherein they establish and maintain a total prohibition on the extraction and commercialization throughout the country of the bivalve mollusk, called Spondylus Calcifer (Ostión Vaca), until technical and scientific studies demonstrate that this product may be fit again for human consumption.\n\n5º—That a significant percentage of the population inhabiting the Pacific Littoral, especially in the Gulf of Nicoya and Golfo Dulce, has as its principal and, in some cases, its sole economic and subsistence activity, the extraction of bivalve mollusks.\n\n6º—That, as indicated by the results of the national census, the Pacific Littoral zone is one of those with the highest level of unemployment in the country, besides being also one of those with the least relative economic development.\n\n7º—That for persons whose main work activity is the extraction of bivalve mollusks, the prohibition decreed by the Executive Branch, indicated in Considerando four above, has implied and had as direct and immediate consequences, difficult and pressing economic situations, which require the State’s aid, through assistance mechanisms, to be at least temporarily mitigated.\n\n8º—That, precisely for the effects indicated in the preceding section, the final paragraph of Article 73 of the Labor Code provides for the possibility of the Executive Branch to \"... dictate emergency measures that, without harming employer interests, result in the alleviation of the economic situation of workers \"; and in the Budget of the Ministry of Labor and Security, for the year 2001, line item number 605, \"Worker Assistance\" (Auxilio a Trabajadores), is contemplated, which includes expenditures intended to economically aid private-sector individuals who are unemployed and in a distressing situation. Therefore,\n\nDecree:\n\nArticle 1º—The Ministry of Labor and Social Security, through the National Employment Directorate, shall grant an economic subsidy, on a one-time basis, to those Costa Ricans dedicated to the extraction of the bivalve mollusk, in the Pacific Littoral, who are duly identified by INCOPESCA as such, and who were rendered unable to carry out their productive activity as a consequence of the prohibition decreed by the Executive Branch, per Executive Decree No. 29595-S, published on June 22, 2001, in La Gaceta No. 120\".\n\n(Thus amended by Article 1 of Executive Decree No. 30134 of January 22, 2002)\n\nArticle 2º—In accordance with the preceding article, the National Employment Directorate shall be the Executing Unit, responsible for granting the aforementioned subsidy; therefore, it shall have the obligation to verify against documentation and records held by INCOPESCA that the persons included in the lists provided and duly certified by INCOPESCA meet all the requirements established in Article four of this Decree.\n\nArticle 3º—Said economic subsidy shall be granted to 700 mollusk extractors, on a one-time basis, for an amount of ¢ 30,000.00 (thirty thousand colones) per person; and shall be granted charged to Line Item 605, Worker Assistance of Program 732, Development and Social Security, of the Budget of the Ministry of Labor and Social Security\".\n\n(Thus amended by Article 1 of Executive Decree No. 30134 of January 22, 2002)\n\nArticle 4º—The persons (mollusk extractors) who meet the following requirements may be beneficiaries of the economic subsidy contemplated in this Decree:\n\na- Be a Costa Rican, with a valid identity card.\n\nb- Contribute with their income to family support.\n\nc- Provide certification from INCOPESCA, stating that they are mollusk extractors; that they reside in the Central Canton of the Province of Puntarenas and that they have faced a decrease in their income, which has unfavorably modified their working conditions in the mollusk extraction activity, during the period from November 1 to December 31, 2001, as a consequence of the prohibition decreed through Executive Decree 29595-S, published on June 14, 2001, in La Gaceta No. 120\".\n\n(Thus amended subsection c) by Article 1 of Executive Decree No. 30134 of January 22, 2002)\n\nArticle 5º—Once the required documentation is submitted, the list of beneficiaries of the economic assistance provided herein shall be drawn up, according to the variables of the Payment System that the National Employment Directorate sends to the Financial Department of the Ministry of Labor and Social Security, for the processing of the payroll before the Ministry of Finance, for electronic application to each beneficiary’s client account, through the mechanisms established by Banco Popular y de Desarrollo Comunal.\n\nArticle 6º—No economic assistance shall be recognized for any worker [extractor] who is not included in the list certified by INCOPESCA or who was reported extemporaneously.\n\nArticle 7º—Shall take effect upon signature.\n\n(Thus amended by Article 1 of Executive Decree No. 30134 of January 22, 2002)"
