  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 30102\n\n                        Regulaciones para la caza menor y mayor y pesca continental e insular\n\nTexto Completo acta: FCF0A\nNº 30102-MINAE\n\nNº 30102-MINAE\n\n(Este decreto ejecutivo fue\nderogado por el artículo 30 del decreto ejecutivo N° 31077 del 11 de febrero de\n2003, \"Regulaciones para\nla caza menor y mayor y pesca continental e insular\")\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LA MINISTRA DE AMBIENTE Y ENERGÍA(*)\n\n(*)(Modificada su denominación por el artículo 11 de\nla Ley \"Traslado del sector\nTelecomunicaciones del Ministerio de Ambiente, Energía y Telecomunicaciones al\nMinisterio de Ciencia y Tecnología\", N° 9046 del 25 de junio de 2012)\n\nEn\nel ejercicio de las facultades que les confiere el artículo 140, inciso 3) de\nla Constitución Política y de conformidad con la Convención sobre el Comercio\nInternacional de Especies Amenazadas de Fauna y Flora Silvestre (CITES), Ley Nº\n5605 del 22 de octubre de 1974 y lo establecido en los artículos 6, 12, 14 y 18\nde la Ley de Conservación de la Vida Silvestre Nº 7317 de 30 de octubre de\n1992.\n\nConsiderando:\n\n1°-Que\nla administración de los recursos de vida silvestre, así como el dictar medidas\ny establecer procedimientos necesarios para asegurar la conservación de la\ndiversidad biológica del país es función del Ministerio de Ambiente y Energía.\n\n2°-Que\nla destrucción del hábitat, la cacería furtiva, la contaminación ambiental y el\ncomercio ilegal de animales vivos o sus productos derivados han disminuido\npeligrosamente las poblaciones de algunas especies de fauna silvestre, al\ntiempo que otras se encuentran en inminente peligro de extinción en el\nterritorio nacional.\n\n3°-Que\nalgunas especies de fauna silvestre son raras o endémicas de áreas muy\nreducidas del territorio nacional y requieren estrictas medidas de control para\nasegurar su sobrevivencia.\n\n4°-Que\nel establecimiento de medidas de gestión y control de aprovechamiento de la\nfauna silvestre fortalecerá los valores culturales del país. Por tanto,\n\nDecretan:\n\nRegulaciones para la caza menor y mayor\n\ny pesca continental e insular\n\nCAPÍTULO I\n\nLa caza en áreas protegidas\n\nArtículo\n1°-Se prohíbe la caza mayor y menor, la caza menor de aves canoras y de\nplumaje, así como la pesca en Parques Nacionales (excepto lo establecido en el\nartículo 10 de la Ley Nº 6084, Ley de Creación del Servicio de Parques\nNacionales), Reservas Biológicas, Monumentos Naturales, Reservas Forestales,\nZonas Protectoras del país, Reservas Indígenas (excepto la caza de\nsubsistencia), Refugios de Vida Silvestre, (excepto cuando se trate de\nprogramas o planes de manejo que realice el Sistema Nacional de Áreas de\nConservación del MINAE) y las fincas sometidas al régimen de Pago de Servicios\nAmbientales.\n\nCAPÍTULO II\n\nProhibiciones\n\nArtículo 2°-Se prohíbe la caza mayor y menor de todas las especies con poblaciones reducidas o en\npeligro de extinción (artículo 58 y 60 del Reglamento de la Ley de Conservación de la Vida\nSilvestre) con excepción de lo que disponga técnicamente el Sistema Nacional de Áreas de\nConservación.\n\nArtículo 3°-Se prohíbe:\n\na)      \"Calentar\" (exponer al sol) aves silvestres en jaulas con trampas o jaulas cogedoras durante\nlos días no autorizados para la caza.\n\nb)      La caza de aves silvestres con luz artificial durante la noche, al igual que la captura de\naves con pegamentos y redes de niebla\n\nc)      El traslado dentro del país de aves en jaulas con trampas o jaulas cogedoras en temporadas\nno autorizadas para la caza.\n\nd)      La caza de todas las especies de aves silvestres residentes y migratorias en todo el\nterritorio nacional, con excepción de las que se indiquen en el presente Decreto Ejecutivo.\n\ne)      Transportar aves canoras (aves con llamativos cantos) o de plumaje (aves con plumaje de\nllamativos colores) en jaulas hechadoras o con trampas, en temporada no autorizadas para la caza,\nsin los respectivos permisos del SINAC (licencia de caza y permiso de tenencia vigente y permiso de\ntraslado).\n\nArtículo 4°-Se prohíbe la caza de las siguientes aves canoras y de plumaje, en los lugares que se\nindican a continuación:\n\na)      Aves silvestres canoras y de plumaje, en los distritos de Los Ángeles, Piedades Norte y San\nRafael del cantón de San Ramón, el distrito de Monterrey de San Carlos; en la zona comprendida entre\nla carretera que conduce de San Ramón a la Fortuna entre los ríos la Esperanza y Burro, margen\nizquierda hasta colindar con El Bosque Eterno de los Niños en los distritos de La Tigre de San\nCarlos y San Isidro de Peñas Blancas del cantón de San Ramón.\n\nb)      Aves silvestres canoras y de plumaje en los cantones de Puriscal, Turrubares, Mora, Dota y\nTarrazú de la provincia de San José.\n\nc)\tAves canoras y de plumaje en el cantón de Aguirre, provincia de Puntarenas.\n\nd)      La caza del jilguero (Myadestes melanops) en: 1. El cantón de Pérez Zeledón y en la fila\nCruces, partiendo del punto 1, ubicado en el puente sobre el río Piedras Blancas la carretera\ninteramericana sur hasta el punto 2 en Ciudad Neily, continuando por la carretera que conduce hasta\nel punto 3 en San Vito de Coto Brus, siguiendo por la carretera hacia Paso Real, pasando por la\nUnión hasta el punto 4 ubicado en el cruce a San Gerardo, de este punto se sigue hacia el punto 5,\nen Paraíso, continuando con una línea recta con rumbo sudoeste hasta las nacientes del río Piedras\nBlancas, punto 6; continuando por la margen izquierda aguas abajo hasta el puente sobre la carretera\ninteramericana sur, punto de inicio. 2. El distrito central de Turrialba y el cantón de Jiménez de\nla provincia de Cartago. 3. En la zona de amortiguamiento de 0.5 kilómetros de ancho alrededor del\nParque Nacional Braulio Carrillo y la Reserva Forestal Cordillera Volcánica Central.\n\ne)      Un kilómetro en ambas márgenes del río Virilla, en la zona comprendida entre el puente sobre\nla autopista General Cañas y el puente de Piedras Negras en la carretera que comunica Puriscal con\nTurrúcares de Alajuela.\n\nArtículo 5°-Se prohíbe la caza menor de las siguientes aves canoras, de plumaje, y otras especies\nsilvestres en todo el territorio nacional en el período que a continuación se indica:\n\nAves canoras:\n\na)\tSolitario carinegro, jilguero, (Myadestes melanops) del 1º de marzo al 30 de setiembre.\n\nb)\tAguío coroniamarillo, monjito (Euphonia luteicapilla) del 1º de enero al 30 de setiembre.\n\nc)\tAguío gorgiamarillo (Euphonia hirundinacea) del 1º de enero al 30 setiembre.\n\nd)\tEuphonia menuda, canaria (Euphonia minuta) del 1º de enero al 30 setiembre.\n\ne)\tFinito gargantinegra, finito (Euphonia affinis) del 1º de enero al 30 setiembre.\n\nf)\tGallito, semillerito cariamarillo (Tiaris olivacea) del 1º de abril al 30 de setiembre.\n\ng)\tSetillero collarejo (Sporophila torqueola) del 1º de abril al 30 de setiembre.\n\nh)\tSetillero garganta negra (Sporophila aurita) del 1º de abril al 30 de setiembre.\n\nAves de plumaje:\n\na)\tTangara moteada, zebra (Tangara guttata) del 1º de marzo al 30 de setiembre.\n\nb)\tTangara dorada, Juanita (Tangara icterocephata) del 1º de marzo al 30 de setiembre.\n\nc)      Tangara capuchidorada, siete colores, mariposa (Tangara larvata) del 1º de marzo al 30 de\nsetiembre.\n\nd)\tTangara vientricastaña (Tangara dowii) del 1º de marzo al 30 de setiembre.\n\ne)\tGorrión común, eléctrico (Passer domesticus) del 1º de mayo al 30 agosto.\n\nCaza menor de aves con arma de fuego:\n\na)      Paloma collareja (Columba fasciata) durante el período comprendido del 1º de Febrero al 31\nde agosto.\n\nb)      Paloma arrocera (Zenaida macroura), paloma alablanca (Zenaida asiática), del 1º de abril al\n31 de octubre.\n\nc)      Piches alablanca (Dendrocygma autumnalis) y Cerceta aliazul (Anas discor) del 1º de abril al\n31 de octubre.\n\nd)\tCodorniz común (Colinus leucopogon) del 1º de abril al 31 de setiembre.\n\ne)      Paloma morada (Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba\nspeciosa, Columba nigrirostris) del 1 de marzo al 30 setiembre.\n\nCAPÍTULO III\n\nAutorizaciones\n\nCaza menor de aves\n\nArtículo 6°-Se podrá cazar aves silvestres canoras y de plumaje, en las condiciones siguientes:\n\na)\tEn tiempo autorizado y únicamente con una jaula cogedora por cazador.\n\nb)      2 machos adultos de cada especie por cazador, por temporada de caza, en todo el territorio\nnacional.\n\nc)\tÚnicamente durante los días sábados, domingos y feriados por ley, con horario de 6 a.m. a 5 p.m.\n\nArtículo 7°-Se podrán cazar con arma de fuego, en tiempo autorizado, las siguientes especies de aves\nde caza menor, en un horario de 6,00 a. m. a 5,00 p. m., durante los días sábado, domingo y feriados\nde ley con un límite máximo de piezas según se indica a continuación:\n\na)      Codorniz común (Colinus leucopogon), 10 piezas por día por temporada, por cazador, en todo\nel territorio nacional en el período comprendido entre el 1 de octubre y el 31 de marzo.\n\nb)      Zanate (Quiscalus mexicanus), sin límite de piezas, en todo el territorio nacional, en\nfechas autorizados para la caza en cada zona (artículos 10, 11, 12, 13 del presente decreto).\n\nc)      Paloma arrocera (Zenaida macroura); paloma alablanca (Zenaida asiática), 20 piezas por día,\npor cazador, en todo el territorio nacional, en el período comprendido entre el 1 de noviembre y el\n31 de marzo.\n\nd)      Piches alablanca (Dendrocygma autumnalis) y cerceta aliazul (Anas discor), 15 piezas por\ndía, por cazador, en todo el territorio nacional, en el período comprendido entre el 1 de noviembre\ny el 31 de marzo.\n\ne)      Paloma morada (Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba\nspeciosa, Columba nigrirostris), 10 piezas por día, por cazador, en todo el territorio nacional, en\nel período comprendido entre el 1 de octubre y el 29 de febrero.\n\ng)      Paloma collareja (Columba fasciata), 15 piezas por día, por cazador, en el período\ncomprendido entre el 1 de setiembre y el 31 de enero, en los siguientes lugares:\n\n1.      En fincas privadas en las márgenes de la Carretera Interamericana Sur, entre el Kilómetro 34\nhasta el km. 39, entre el km. 41 y el km. 47, entre el km. 52 y el km. 55, entre el Km. 57 y el km.\n64 (sitio conocido como Madreselva). Únicamente a más de 50 mts del límite de la carretera y fuera\nde los límites de la Reserva Forestal Los Santos y El Parque Nacional Tapantí Macizo de la Muerte.\nEn las zonas no autorizadas (entre el kilómetro 39 al km. 40, entre el km. 41 al km. 46, entre el\nkm. 52 al km. 54, y entre el km. 55 al km. 56) que incluye poblados a la orilla de la carretera solo\nse permitirá la caza en fincas particulares fuera de la Reservas Forestal Los Santos y El Parque\nNacional Tapantí Macizo de la Muerte en sitios que se ubiquen a 1 km. o más de la carretera.\n\n2.      En fincas privadas, en ambas márgenes de la carretera entre Carrizal de Alajuela y Poasito,\na más de 50 metros de los límites de carretera.\n\n3.      En fincas privadas en ambas márgenes de las carreteras entre Tarbaca y Vuelta de Jorco, a\nmás de 50 mas de los límites de carretera.\n\nCAPÍTULO IV\n\nZonas para la caza con arco y flecha, armas\n\nde fuego, cuchillo y perros\n\nArtículo 8°-Se declaran las siguientes zonas de caza:\n\nZona 1. Provincia de Guanacaste\n\nZona 2. Provincias de Alajuela y Heredia\n\nZona 3. Provincias de Puntarenas y San José\n\nZona 4. Provincias de Cartago y Limón\n\nLa caza con arco y flecha, armas de fuego, cuchillo y perro se permite solamente de 6 a.m. a 6 p.m.\nen los días autorizados.\n\nCAPÍTULO V\n\nDe la caza menor y mayor con arco y flecha,\n\narmas de fuego, cuchillo y perro\n\nArtículo 9º-Se deberá de observar las regulaciones para las temporadas de caza, de acuerdo con las\nzonas declaradas en el artículo 8.\n\nArtículo 10.-Se autoriza únicamente la utilización de un perro por cazador.\n\nArtículo 11.-Zona 1. (Guanacaste). Se prohibe la caza mayor y menor con arco y flecha, arma de\nfuego, cuchillo o perro, como se detalla en los siguientes incisos:\n\na)      Con excepción de los siguientes días: 6, 7, 20, 21 y 25 de julio; 2, 3, 4, 15, 17 y 18 de\nagosto; 7, 8, 15, 21 y 22 de setiembre; 5, 6, 12, 19 y 20 de octubre; y 2, 3, 16 y 17 de noviembre.\n\nb)      En el área delimitada por la carretera y comprendida entre las siguientes poblaciones: Playa\nEl Coco, Sardinal, San Blas, Paso Tempisque, Filadelfia, Belén, Santa Ana, Coyolillo, Portegolpe,\nHuacas y Brasilito; siguiendo la línea de la costa en dirección norte hasta la Playa El Coco.\n\nc)      En la zona comprendida entre el punto de las coordenadas 364,500 y 315,500 de la hoja\ncartográfica Murciélago Nº 3048 1 sobre la carretera interamericana norte, siguiendo por esta\ncarretera hacia la ciudad de Liberia hasta el cruce de camino que conduce a la Hacienda La\nEsperanza, desviándose por esta camino hasta la Finca Bejuco pasando por el sitio Dama, continuando\npor el camino que conduce a Papagayo hasta el cruce a Cabuyal desviándose por este camino hasta\nPlaya Cabuyal, continuando por la costa hasta el punto de coordenadas 354,500 y 302; Hoja\nCartográfica Ahogados Nº 3048 2, en el Cerro Carbonal, limite del Parque Nacional Santa Rosa,\ncontinuando por el límite sur de dicho parque hasta el sitio inicial en coordenadas 364,500 y\n315,500 sobre la Carretera Interamericana.\n\nd)      En el área comprendida entre los siguientes puntos: de Punta Coyote, en coordenadas 193950 N\n396400 E, siguiendo al noreste al camino que inicia en Caletas, en coordenadas 193950 N 397150 E. Se\ncontinúa al noreste por ese mismo camino hasta San Francisco de Coyote, en coordenadas 198650 N\n399900 E. Se sigue al NE por el camino hasta Javillo, en coordenadas 205925 N 401725 E. Sigue al NW\npor ese camino hasta el cruce que va hacia Quebrada Grande, en coordenadas 207375 N 396425 E,\ncontinúa luego al NW por el camino hasta el cruce que va hacia Los Ángeles, en coordenadas 209525 N\n395675 E, de este cruce se continúa al NW por ese camino hasta el cruce con el camino a San Ramón\n(Río Ora), en coordenadas 213150 N 393650 E, continúa al NW por el camino a San Ramón hasta la\nintersección que va de Cangrejal a San Ramón en coordenadas 214275 N   389850 E. Sigue al NE por el\ncamino a San Ramón hasta la intersección de este con el río Chiles en coordenadas 214300 N 389875 E,\ncontinúa al Suroeste aguas abajo del río Chiles hasta su confluencia con el Río Ora, en coordenadas\n213950 N 389600 E, continúa al suroeste aguas abajo del río Ora hasta su desembocadura en\ncoordenadas 205300 N 376950 E, sigue luego al SE por la orilla de la playa hasta el punto inicial en\nPunta Coyote coordenadas 193950 N 396400 E.\n\ne)      En la zona comprendida en los cerros Caballlito y Quebrada Honda, área delimitada por el\ncamino que conduce de Quebrada Honda, Caballito y Corralillo hasta encontrar el camino entre Puerto\nHumo y Nicoya, siguiendo por esta ruta hasta el cruce de Santa Ana, continuando por este camino\npasando por los poblados de Santa Ana y Barra Honda hasta la carretera hacia Puerto Moreno,\nsiguiendo hasta el poblado de Quebrada Honda, punto original de partida. Dicha área se encuentra\nubicada en las hojas cartográficas Talolinga y Matambú, Provincia de Guanacaste.\n\nf)\tEl cabro de monte (Mazama americana) en toda la provincia de Guanacaste.\n\nArtículo 12.-Zona 2. (Alajuela, Heredia) Se prohibe la caza mayor y menor con arco y flecha, arma de\nfuego, cuchillo y perro, según se detalla en los siguientes incisos:\n\na)      Con excepción de los siguientes días: 1º, 5, 6, 19 y 20 de enero; 2, 3, 16 y 17 de febrero;\n2, 3, 16 y 17 de marzo; 6, 7, 11, 20 y 21 de abril; y 1, 4, 5, 18 y 19 de mayo.\n\nb)      En el cantón de Grecia y en los distritos de Piedades Norte, Los Ángeles, Santiago, Piedades\nSur, San Rafael y Zapotal del cantón de San Ramón; el distrito de Monterrey del cantón de San\nCarlos.\n\nc)      En la zona comprendida entre la carretera que conduce de San Ramón a la Fortuna entre los\nríos la Esperanza y Río Burro, margen izquierda hasta colindar con El Bosque Eterno de los Niños en\nlos distritos de La Tigra de San Carlos y San Isidro de Peñas Blancas del Cantón de San Ramón.\n\nd)      100 mts. en ambas márgenes del Río San Rafael en Muelle de San Carlos, entre el puente sobre\nla carretera que comunica la comunidad de Muelle con Pital y la desembocadura del Río San Rafael en\nel río San Carlos\n\ne)      Un kilómetro en la margen derecha aguas abajo del Río Virilla, en la zona comprendida entre\nel Puente sobre la autopista General Cañas y el Puente de Piedras Negras en la carretera que\ncomunica Puriscal con Turrúcares de Alajuela.\n\nArtículo 13.-Zona 3. (Puntarenas, San José) Se prohibe la caza mayor y menor con arco y flecha, arma\nde fuego, cuchillo y perro: Con excepción de los siguientes días: 6, 7, 20, 21 y 25 de julio; 2, 3,\n4, 15, 17 y 18 de agosto; 7, 8, 15, 21 y 22 de setiembre; y 5, 6, 12, 19 y 20 de octubre. Además se\nprohibe la caza en los siguientes sitios:\n\na)\tEn la Isla San Lucas.\n\nb)      En la zona comprendida en el distrito único Parrita, del cantón de Parrita, partiendo del\npoblado de Valle Vasconia entre el camino que conduce a la Fila Aguacate hasta intersectar el cauce\ndel río Negro, siguiendo a partir de este punto el cauce del mismo río aguas abajo hasta su\nconfluencia con el Río Chires. A partir de este punto se sigue el cauce de este río hasta\nintersectar la carretera Puriscal Parrita a la altura del poblado de Vista de Mar; y de aquí se\nsigue la Carretera Costanera hasta intersectar el Río Pirris, aguas arriba hasta llegar al poblado\nde Valle Vasconia.\n\nc)      En la zona comprendida entre Golfito de la provincia de Puntarenas, siguiendo por la\ncarretera que conduce hasta Río Claro, continuando por la margen izquierda de la Carretera\nInteramericana Sur hasta el puente sobre el Río Terraba, en Palmar Sur, de este punto continua por\nla margen derecha del río hasta la Boca Coronado, para cerrar finalmente en Golfito, punto original,\nse exceptúa de esta prohibición la caza de patos y palomas que se realice en lagunas y áreas\nsembradas de arroz ubicadas fuera de áreas protegidas.\n\nd)      Un kilómetro en ambas márgenes del Río María Aguilar, en la zona comprendida entre el puente\nLos Anonos en la carretera vieja que comunica a San José con Escazú y la desembocadura en el Río\nVirilla.\n\ne)      Un kilómetro en la margen izquierda del río Virilla, aguas abajo, en la zona comprendida\nentre el Puente sobre la autopista General Cañas y el puente de Piedras Negras en la carretera que\ncomunica Puriscal con Turrúcares de Alajuela.\n\nf)      La caza de la paloma collareja en la carretera que conduce entre Vuelta de Jorco y Palmichal\nde Acosta, en ambas márgenes y en el Cerro el Guabal ubicado en coordenadas 205,500 latitud Norte y\n51,800 longitud oeste, Lambert Norte, Hoja Caraigres.\n\nArtículo 14.-Zona 4. (Cartago, Limón). Se prohibe la caza mayor y menor con arco y flecha, arma de\nfuego, cuchillo y perro:\n\na)      Con excepción de los siguientes días: 1, 5, 6, 19 y 20 de enero; 2, 3, 16 y 17 de febrero;\n2, 3, 16 y 17 de marzo; 6, 7, 11, 20 y 21 de abril; y 1, 4, 5, 18 y 19 de mayo.\n\nb)      Del tepezcuintle (Agouti paca) en el distrito de Orosí, cantón de Paraíso, los cantones de\nJiménez y Turrialba, provincia de Cartago.\n\nc)      De conejos silvestres en los cantones Central, Paraíso, La Unión, Jiménez, Alvarado,\nOreamuno y El Guarco de la provincia de Cartago, con excepción de las fechas 5, 6, 12, 19 y 20 de\noctubre y 2, 3, 16 y 17 de noviembre.\n\nArtículo 15.-Se declaran como especies de caza mayor los mamíferos listados en este artículo; se\npodrán cazar, de acuerdo a las fechas autorizadas (artículos 11 al 14 de este decreto) para cada\nzona.\n\na)\tOdocoileus virginianus: Venado cola blanca; 2 machos por año.\n\nb)\tMazama americana: cabro de monte, 1 macho por año.\n\nb)\tCanis latrans: coyote; 6 animales por año, sujeto a temporada de caza autorizada por zona.\n\nc)      Tayassu tajacu: sahino; 1 macho por año, solo en los distritos de Paquera, Cóbano y Lepanto,\nprovincia de Puntarenas.\n\nArtículo 16.-Se declaran como especies de caza menor los animales listados en este artículo, se\npodrán cazar de acuerdo a las fechas autorizadas para cada zona:\n\na)\tDidelphis marsupialis: zorro pelón; 5 piezas por año, por cazador.\n\nb)\tDidelphis virginiana: zorro pelón; 5 piezas por año, por cazador.\n\nc)\tSylvilagus brasilensis: conejo de monte; 10 piezas por año, por cazador.\n\nd)\tSylvilagus floridanus: conejo de monte; 10 piezas por año, por cazador.\n\ne)\tSylvilagus dicei: conejo de altura; 10 piezas por año por cazador.\n\nf)\tSciurus variegatoides: ardilla común; 10 piezas por año, por cazador.\n\ng)\tAgouti paca: tepezcuintle; 2 piezas por año por cazador.\n\nh)\tDasyprocta punctata: guatuza; 2 piezas por año, por cazador.\n\ni)\tUrocyon cineroargenteus: zorra gris; 2 piezas por año, por cazador.\n\nj)\tProcyon lotor: mapache; 4 piezas por año, por cazador.\n\nk)\tNassua narica: pizote; 3 piezas por año, por cazador.\n\nl)\tCtenosaura similis: garrobo; 4 piezas por año, por cazador.\n\nCAPÍTULO VI\n\nGeneralidades sobre la caza mayor y menor\n\nArtículo 17.-Tratándose de fincas privadas, los cazadores deberán obtener el correspondiente permiso\ndel propietario, de conformidad con lo establecido en el artículo 32 de la Ley de Conservación de la\nVida Silvestre.\n\nArtículo 18.-De conformidad con lo establecido en los artículos 12, 17, 30 y 63 de la Ley Nº 7317,\nLey de Conservación de la Vida Silvestre, las Oficinas Subregionales, así como las oficinas de\nAdministración de los Refugios Nacionales de Fauna Silvestre en las diferentes Areas de\nConservación, que conforman el Sistema Nacional de Areas de Conservación, serán las encargadas de\nautorizar, emitir y suscribir las licencias de caza y pesca deportiva continental y marina en\naquellas áreas protegidas que incluyen extensiones marinas, requeridas para el cumplimiento de los\nfines previstos en este Decreto.\n\nArtículo 19.-Se define como \"límite de piezas\" al máximo número de animales de caza autorizada en el\npresente decreto. El límite de piezas podrá ser acumulativo por días de caza en el caso de los\npatos, palomas y codornices, siempre y cuando el cazador reporte el número de piezas cazado por día,\nen la Delegación de la Guardia de Asistencia Rural o a la oficina del SINAC, más cercana a la zona\nde caza visitada.\n\nArtículo 20.-El Sistema Nacional de Areas de Conservación (SINAC) a través de sus oficinas\nsubregionales podrá autorizar la realización de torneos de caza (Art. 24 del reglamento de la Ley de\nConservación de la Vida Silvestre), dependiendo del comportamiento de las poblaciones, mediante\nresolución administrativa, solo cuando se trate de:\n\na)      Rastreo de huellas preparadas para los efectos del torneo en un día determinado; para lo\ncual no se autoriza el acoso, maltrato o muerte de animales silvestres.\n\nb)      Torneos de caza menor de aves canoras y de plumaje y su liberación en el mismo sitio de\ncaptura, con un máximo de 4 torneos por sitio por el período autorizado.\n\nc)      Torneos de canto de aves canoras en sitios bajo techo o cerrados y acondicionados para tal\nefecto.\n\nPara los torneos de caza menor de aves canoras y de plumaje, los participantes deberán portar y\nmostrar si fuera requerido la correspondiente licencia de caza vigente.\n\nLos torneos de caza deberán ser fiscalizados por funcionarios del SINAC del Area de Conservación\ncorrespondiente.\n\nCAPÍTULO VII\n\nDe la pesca continental\n\nArtículo 21.-Se prohíbe la pesca:\n\na)      De trucha Arco Iris (Salmo gardnieri) en todos los ríos nacionales, entre el 1 de febrero y\nel 30 de abril inclusive; fuera de ese plazo se podrá pescar con un límite de 5 piezas con un tamaño\nmínimo de 25 cm. de longitud, por persona por día. La pesca de truchas cultivadas en estanques se\npueda realizar durante todo el año.\n\nb)      De la trucha en el río Toro y sus afluentes en el distrito Toro Amarillo del cantón de\nValverde Vega.\n\nc)      De guapote (Parachromis spp) róbalo (Centropomus undecimalis), sábalo (Megalops atlanticus)\ny demás especies de peces, en los siguientes ríos y sus afluentes: Frío, Zapote, Niño o Pizote,\nlagunas del Refugio de Fauna Silvestre de Caño Negro y el Refugio de Fauna Silvestre las Camelias,\nentre el 1º de abril y el 31 de julio inclusive. Fuera de este plazo, se podrá pescar con un límite\nde 5 peces con un tamaño mínimo de 25 cm. de longitud, por persona por día. La pesca de peces\ncultivados en estanques se puede realizar durante todo el año.\n\nd)      Del gaspar (Atractosteus tropicus) en los siguientes ríos y sus afluentes: Frío, Zapote,\nNiño o Pizote, lagunas del Refugio de Fauna Silvestre de Caño Negro y el Refugio de Fauna Silvestre\nlas Camelias, entre el 1 de marzo y el 31 de agosto inclusive.\n\nFuera de este plazo, se podrá pescar con un límite de 2 peces con un tamaño mínimo de 60 cm. de\nlongitud, por persona por día.\n\ne)      De todas las especies de peces de agua dulce en todos los ríos incluyendo sus afluentes,\nlagos y lagunas (exceptuando lo establecido en el inciso c y d de este artículo, entre el 1 de\nsetiembre y el 30 de noviembre inclusive. Fuera de ese plazo se podrá pescar con un límite de 5\npiezas con un tamaño mínimo de 25 cm. de longitud, por persona con licencia por día. Se exceptúa el\ntepemechín (Agonostomus monticola), para el cual no se establece límite de longitud y gaspar para el\ncual se fija un tamaño mínimo de 60 cm.\n\nf)      Del langostino o camarón de río (Macrobrachium spp.) en todos los ríos nacionales entre el\n15 de mayo y el 31 de diciembre, inclusive. Fuera de este plazo, se podrá pescar con un límite de 10\npiezas por persona, por día.\n\ng)      La pesca deportiva en la Laguna de Hule, ubicada en el Refugio de Fauna Privado Bosque\nAlegre, Cariblanco.\n\nh)      En las Reservas Indígenas (excepto la pesca de subsistencia que realicen los indígenas con\npermiso del SINAC).\n\nArtículo 22.-Se autoriza:\n\na)      La pesca deportiva, con caña y carrete, así como cuerdas de mano, en un horario de 6:00 a.\nm. a 5:00 p. m.\n\nb)\tLa pesca todos los días del año en:\n\n1.      El río Reventazón desde Palomo de Orosí hasta su desembocadura, con excepción de sus\nafluentes. El límite de piezas se establece en 5 peces con un tamaño superior a 25 cm., por pescador\ncon licencia por día.\n\n2.      La que se realice con cuerda de mano o caña y carrete en el Embalse de Arenal. Se establece\nel límite de piezas en 10 peces por pescador con licencia por día.\n\n3.      En las Barras de Colorado, Parismina, Tortuguero y Matina. El límite de piezas en las barras\ncitadas será de 5 peces por pescador por día. Se entenderá por barra de un río como el cauce\ncomprendido hasta un kilómetro aguas arriba, partiendo de su boca.\n\nc)      La pesca de subsistencia que realicen los Indígenas en las Reservas Indígenas con permiso\ndel SINAC.\n\nd)      La pesca en Refugios de Fauna Silvestre y Parques Nacionales cuando la actividad esté\ncontemplada en el Plan de Manejo.\n\nArtículo 23.-Se prohíbe la pesca por tiempo indefinido en los ríos: Sarapiquí, entre la confluenciua\ndel Río Peje hasta la unión con el Puerto Viejo Puerto Viejo, entre la confluencia del Río Sábalo\nEsquina hasta la unión con el Sarapiquí.\n\nArtículo 24.-El Sistema Nacional de Areas de Conservación (SINAC) a través de sus oficinas\nsubregionales podrá autorizar la realización de torneos de pesca deportiva (Art. 24 del reglamento\nde la Ley de Conservación de la Vida Silvestre), a grupos organizados, dependiendo del\ncomportamiento de las poblaciones, mediante resolución administrativa. Los participantes deberán\npresentar su licencia de pesca vigente.\n\nCAPÍTULO VIII\n\nDe la tenencia de animales silvestres en cautiverio\n\nArtículo 25.-De conformidad con el artículo 19 de la Ley Nº 7317 del 7 de diciembre de 1992, los\nadministrados que capturen animales silvestres autorizados por el presente decreto y al amparo de la\nlicencia correspondiente, deberán inscribir dichos animales ante la oficina subregional del Sistema\nNacional de Areas de Conservación del MINAE que corresponda dentro del mes siguiente a la captura.\n\nEn el caso de tenencia de aves de plumaje y canoras en cautiverio en aviarios adecuadamente\nacondicionados, se establece un límite de 15 aves en total, por permisionario con licencia.\n\nArtículo 26.-Se prohíbe por tiempo indefinido, la caza o captura de las especies que no aparezcan\ncontempladas en las listas de especies autorizadas para la caza (artículos 5, 7, 15 y 16 de este\ndecreto).\n\nArtículo 27.-Se prohibe la exhibición de aves canoras o de plumaje en las ferias del agricultor y\nestablecimientos comerciales.\n\nArtículo 28.-La tenencia de aves silvestres en cautiverio deberá regirse por lo estipulado en el\npresente Decreto y los Decretos Ejecutivos número N° 26435 MINAE y 28312 MINAE.\n\nArtículo 29.-Se exceptúa la aplicación del presente Decreto a las fincas cinegéticas debidamente\ninscritas ante Sistema Nacional de Areas de Conservación del MINAE.\n\nArtículo 30.-Modifíquese el inciso p), del artículo 15 del Decreto Nº 26435 MINAE, para que en lo\nsucesivo las oficinas subregionales puedan autorizar las licencias de caza y pesca y autorizar los\ntorneos de caza y pesca.\n\nArtículo 31.-Deróguese el Decreto Ejecutivo Nº 29148 MINAE.\n\nArtículo 32.-Este Decreto rige a partir del día primero de enero del año 2002 y vence el treinta y\nuno de marzo del 2003.",
  "body_en_text": "throughout the entire text\n\n                    -\n\n                        Complete Text of Regulation 30102\n\n                        Regulations for small and large game hunting and continental and insular fishing\n\nComplete Text of record: FCF0A\nNº 30102-MINAE\n\nNº 30102-MINAE\n\n(This executive decree was\nrepealed by article 30 of executive decree N° 31077 of February 11,\n2003, \"Regulations for\nsmall and large game hunting and continental and insular fishing\")\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY(*)\n\n(*)(Name modified by article 11 of\nLaw \"Transfer of the\nTelecommunications Sector from the Ministry of Environment, Energy and Telecommunications to\nthe Ministry of Science and Technology\", N° 9046 of June 25, 2012)\n\nIn\nthe exercise of the powers conferred by article 140, subsection 3) of\nthe Political Constitution and in accordance with the Convention on International\nTrade in Endangered Species of Wild Fauna and Flora (CITES), Law Nº\n5605 of October 22, 1974 and the provisions established in articles 6, 12, 14 and 18\nof the Wildlife Conservation Law Nº 7317 of October 30,\n1992.\n\nConsidering:\n\n1°-That\nthe administration of wildlife resources, as well as issuing measures\nand establishing necessary procedures to ensure the conservation of the\ncountry's biological diversity, is a function of the Ministry of Environment and Energy.\n\n2°-That\nhabitat destruction, poaching (cacería furtiva), environmental pollution and the\nillegal trade of live animals or their derivative products have dangerously\ndiminished the populations of some wildlife species,\nwhile others are in imminent danger of extinction within the\nnational territory.\n\n3°-That\nsome wildlife species are rare or endemic to very\nsmall areas of the national territory and require strict control measures to\nensure their survival.\n\n4°-That\nthe establishment of management and control measures for the utilization of\nwildlife will strengthen the country's cultural values. Therefore,\n\nThey decree:\n\nRegulations for small and large game hunting\n\nand continental and insular fishing\n\nCHAPTER I\n\nHunting in protected areas\n\nArticle\n1°-Large and small game hunting (caza mayor y menor), hunting of songbirds (aves canoras) and ornamental birds (aves de plumaje), as well as fishing in National Parks (except as established in\narticle 10 of Law Nº 6084, Law for the Creation of the National Parks\nService), Biological Reserves, Natural Monuments, Forest Reserves,\nProtected Zones of the country, Indigenous Reserves (except subsistence\nhunting), Wildlife Refuges (except when dealing with\nmanagement programs or plans carried out by the National System of Conservation Areas (Sistema Nacional de Áreas de\nConservación) of MINAE) and properties subject to the Payment for Environmental Services (Pago de Servicios Ambientales) regime is prohibited.\n\nCHAPTER II\n\nProhibitions\n\nArticle 2°-Large and small game hunting of all species with reduced populations or in\ndanger of extinction (articles 58 and 60 of the Regulations to the Wildlife Conservation\nLaw) is prohibited, with the exception of what is technically provided by the National System of\nConservation Areas.\n\nArticle 3°-The following is prohibited:\n\na)      \"Sun-heating\" (Calentar) (exposing to the sun) wild birds in cages with traps or catching cages during\ndays not authorized for hunting.\n\nb)      Hunting wild birds with artificial light at night, as well as capturing\nbirds with adhesives and mist nets (redes de niebla).\n\nc)      The movement within the country of birds in cages with traps or catching cages during seasons\nnot authorized for hunting.\n\nd)      Hunting of all species of resident and migratory wild birds throughout the entire\nnational territory, with the exception of those indicated in this Executive Decree.\n\ne)      Transporting songbirds (aves canoras) or ornamental birds (aves de plumaje) in decoy cages or with traps, during a season not authorized for hunting,\nwithout the respective permits from SINAC (valid hunting license and possession permit and\nmovement permit).\n\nArticle 4°-Hunting of the following songbirds and ornamental birds is prohibited in the places\nindicated below:\n\na)      Wild songbirds and ornamental birds, in the districts of Los Ángeles, Piedades Norte and San\nRafael of the canton of San Ramón, the district of Monterrey of San Carlos; in the area between\nthe road that leads from San Ramón to La Fortuna between the La Esperanza and Burro rivers, left\nbank until adjoining El Bosque Eterno de los Niños in the districts of La Tigre of San\nCarlos and San Isidro de Peñas Blancas of the canton of San Ramón.\n\nb)      Wild songbirds and ornamental birds in the cantons of Puriscal, Turrubares, Mora, Dota and\nTarrazú of the province of San José.\n\nc)     Songbirds and ornamental birds in the canton of Aguirre, province of Puntarenas.\n\nd)      Hunting of the black-faced solitaire (jilguero) (Myadestes melanops) in: 1. In the buffer zone (zona de amortiguamiento) 0.5 kilometers wide around\nBraulio Carrillo National Park and the Cordillera Volcánica Central Forest Reserve.\n\ne)      One kilometer on both banks of the Virilla river, in the area between the bridge on\nthe General Cañas highway and the Piedras Negras bridge on the road that connects Puriscal with\nTurrúcares of Alajuela.\n\nArticle 5°-Small game hunting of the following songbirds, ornamental birds, and other wild\nspecies is prohibited throughout the entire national territory in the period indicated below:\n\nSongbirds:\n\na)     Black-faced solitaire, jilguero (Myadestes melanops) from March 1 to September 30.\n\nb)     Yellow-crowned euphonia, monjito (Euphonia luteicapilla) from January 1 to September 30.\n\nc)     Yellow-throated euphonia (Euphonia hirundinacea) from January 1 to September 30.\n\nd)     White-vented euphonia, canaria (Euphonia minuta) from January 1 to September 30.\n\ne)     Scrub euphonia, finito (Euphonia affinis) from January 1 to September 30.\n\nf)     Yellow-faced grassquit, gallito (Tiaris olivacea) from April 1 to September 30.\n\ng)     White-collared seedeater (Sporophila torqueola) from April 1 to September 30.\n\nh)     Variable seedeater (Sporophila aurita) from April 1 to September 30.\n\nOrnamental birds:\n\na)     Speckled tanager, zebra (Tangara guttata) from March 1 to September 30.\n\nb)     Silver-throated tanager, Juanita (Tangara icterocephata) from March 1 to September 30.\n\nc)     Golden-hooded tanager, siete colores, mariposa (Tangara larvata) from March 1 to September\n30.\n\nd)     Spangle-cheeked tanager (Tangara dowii) from March 1 to September 30.\n\ne)     House sparrow, eléctrico (Passer domesticus) from May 1 to August 30.\n\nSmall game bird hunting with firearms:\n\na)     Band-tailed pigeon (Columba fasciata) during the period from February 1 to August\n31.\n\nb)     Mourning dove (Zenaida macroura), white-winged dove (Zenaida asiatica), from April 1 to\nOctober 31.\n\nc)     Black-bellied whistling duck (Dendrocygma autumnalis) and Blue-winged teal (Anas discor) from April 1 to\nOctober 31.\n\nd)     Crested bobwhite (Colinus leucopogon) from April 1 to September 31.\n\ne)     Red-billed pigeon, Ruddy pigeon, Pale-vented pigeon, Scaled pigeon, Short-billed pigeon (Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba\nspeciosa, Columba nigrirostris) from March 1 to September 30.\n\nCHAPTER III\n\nAuthorizations\n\nSmall game bird hunting\n\nArticle 6°-Wild songbirds and ornamental birds may be hunted under the following conditions:\n\na)     In authorized time and only with one catching cage per hunter.\n\nb)      2 adult males of each species per hunter, per hunting season, in the entire national\nterritory.\n\nc)     Only on Saturdays, Sundays, and legal holidays, from 6 a.m. to 5 p.m.\n\nArticle 7°-The following species of small game birds may be hunted with firearms, in authorized time, from 6:00 a.m. to 5:00 p.m., on Saturdays, Sundays, and legal\nholidays, with a maximum bag limit (límite de piezas) as indicated below:\n\na)      Crested bobwhite (Colinus leucopogon), 10 pieces per day per season, per hunter, throughout\nthe national territory in the period between October 1 and March 31.\n\nb)      Great-tailed grackle (Quiscalus mexicanus), no bag limit, throughout the national territory, on\ndates authorized for hunting in each zone (articles 10, 11, 12, 13 of this decree).\n\nc)      Mourning dove (Zenaida macroura); white-winged dove (Zenaida asiatica), 20 pieces per day,\nper hunter, throughout the national territory, in the period between November 1 and\nMarch 31.\n\nd)      Black-bellied whistling duck (Dendrocygma autumnalis) and blue-winged teal (Anas discor), 15 pieces per\nday, per hunter, throughout the national territory, in the period between November 1\nand March 31.\n\ne)      Red-billed pigeon, Ruddy pigeon, Pale-vented pigeon, Scaled pigeon, Short-billed pigeon (Columba flavirostris, Columba subvinacea, Columba cayanensis, Columba\nspeciosa, Columba nigrirostris), 10 pieces per day, per hunter, throughout the national territory, in\nthe period between October 1 and February 29.\n\ng)      Band-tailed pigeon (Columba fasciata), 15 pieces per day, per hunter, in the period\nbetween September 1 and January 31, in the following places:\n\n1.      On private properties on the margins of the Pan-American Highway South, between Kilometer 34\nto km. 39, between km. 41 and km. 47, between km. 52 and km. 55, between Km. 57 and km.\n64 (site known as Madreselva). Only more than 50 mts from the highway boundary and outside\nthe boundaries of the Los Santos Forest Reserve and Tapantí Macizo de la Muerte National Park.\nIn unauthorized zones (between kilometer 39 to km. 40, between km. 41 to km. 46, between\nkm. 52 to km. 54, and between km. 55 to km. 56) which include towns along the highway, hunting is only\npermitted on private farms outside the Los Santos Forest Reserve and Tapantí Macizo de la Muerte National Park in sites located 1 km. or more from the highway.\n\n2.      On private properties, on both margins of the road between Carrizal de Alajuela and Poasito,\nmore than 50 meters from the road boundaries.\n\n3.      On private properties on both margins of the roads between Tarbaca and Vuelta de Jorco,\nmore than 50 meters from the road boundaries.\n\nCHAPTER IV\n\nZones for hunting with bow and arrow, firearms,\n\nknife, and dogs\n\nArticle 8°-The following hunting zones are declared:\n\nZone 1. Province of Guanacaste\n\nZone 2. Provinces of Alajuela and Heredia\n\nZone 3. Provinces of Puntarenas and San José\n\nZone 4. Provinces of Cartago and Limón\n\nHunting with bow and arrow, firearms, knife, and dog is permitted only from 6 a.m. to 6 p.m.\non authorized days.\n\nCHAPTER V\n\nSmall and large game hunting with bow and arrow,\n\nfirearms, knife, and dog\n\nArticle 9º-The regulations for hunting seasons must be observed, in accordance with\nthe zones declared in article 8.\n\nArticle 10.-The use of only one dog per hunter is authorized.\n\nArticle 11.-Zone 1. (Guanacaste). Large and small game hunting with bow and arrow, firearm,\nknife, or dog is prohibited, as detailed in the following subsections:\n\na)      With the exception of the following days: July 6, 7, 20, 21, and 25; August 2, 3, 4, 15, 17, and 18;\nSeptember 7, 8, 15, 21, and 22; October 5, 6, 12, 19, and 20; and November 2, 3, 16, and 17.\n\nb)      In the area delimited by the road and comprised between the following towns: Playa\nEl Coco, Sardinal, San Blas, Paso Tempisque, Filadelfia, Belén, Santa Ana, Coyolillo, Portegolpe,\nHuacas, and Brasilito; following the coastline northwards to Playa El Coco.\n\nc)      In the area comprised between the point at coordinates 364,500 and 315,500 on the map\nsheet Murciélago Nº 3048 1 on the Pan-American Highway north, following this\nhighway towards the city of Liberia to the junction of the road leading to Hacienda La\nEsperanza, turning off along this road to Finca Bejuco passing through the site Dama, continuing\nalong the road leading to Papagayo to the junction to Cabuyal, turning off along this road to\nPlaya Cabuyal, continuing along the coast to the point at coordinates 354,500 and 302; Map\nSheet Ahogados Nº 3048 2, at Cerro Carbonal, boundary of Santa Rosa National Park,\ncontinuing along the southern boundary of said park to the initial site at coordinates 364,500 and\n315,500 on the Pan-American Highway.\n\nd)      In the area comprised between the following points: from Punta Coyote, at coordinates 193950 N\n396400 E, continuing northeast to the road that starts in Caletas, at coordinates 193950 N 397150 E. Continue northeast along that same road to San Francisco de Coyote, at coordinates 198650 N\n399900 E. Continue NE along the road to Javillo, at coordinates 205925 N 401725 E. Continue NW\nalong that road to the junction that goes towards Quebrada Grande, at coordinates 207375 N 396425 E,\ncontinue then NW along the road to the junction that goes towards Los Ángeles, at coordinates 209525 N\n395675 E, from this junction continue NW along that road to the junction with the road to San Ramón\n(Río Ora), at coordinates 213150 N 393650 E, continue NW along the road to San Ramón to the\nintersection that goes from Cangrejal to San Ramón at coordinates 214275 N   389850 E. Continue NE along the\nroad to San Ramón to its intersection with the Chiles river at coordinates 214300 N 389875 E,\ncontinue southwest downstream along the Chiles river to its confluence with the Río Ora, at coordinates\n213950 N 389600 E, continue southwest downstream along the Ora river to its mouth at\ncoordinates 205300 N 376950 E, continue then SE along the beach edge to the initial point at\nPunta Coyote coordinates 193950 N 396400 E.\n\ne)      In the area comprised in the Caballlito and Quebrada Honda hills, an area delimited by the\nroad that leads from Quebrada Honda, Caballito, and Corralillo to meet the road between Puerto\nHumo and Nicoya, following this route to the Santa Ana junction, continuing along this road\npassing through the towns of Santa Ana and Barra Honda to the road towards Puerto Moreno,\ncontinuing to the town of Quebrada Honda, the original starting point. Said area is\nlocated on the Talolinga and Matambú map sheets, Province of Guanacaste.\n\nf)     The red brocket deer (cabro de monte) (Mazama americana) in the entire province of Guanacaste.\n\nArticle 12.-Zone 2. (Alajuela, Heredia) Large and small game hunting with bow and arrow, firearm,\nknife, and dog is prohibited, as detailed in the following subsections:\n\na)      With the exception of the following days: January 1, 5, 6, 19, and 20; February 2, 3, 16, and 17;\nMarch 2, 3, 16, and 17; April 6, 7, 11, 20, and 21; and May 1, 4, 5, 18, and 19.\n\nb)      In the canton of Grecia and in the districts of Piedades Norte, Los Ángeles, Santiago, Piedades\nSur, San Rafael, and Zapotal of the canton of San Ramón; the district of Monterrey of the canton of San\nCarlos.\n\nc)      In the area comprised between the road that leads from San Ramón to La Fortuna between the\nLa Esperanza and Río Burro rivers, left bank until adjoining El Bosque Eterno de los Niños in\nthe districts of La Tigra of San Carlos and San Isidro de Peñas Blancas of the Canton of San Ramón.\n\nd)      100 mts. on both banks of the Río San Rafael in Muelle de San Carlos, between the bridge on\nthe road that connects the community of Muelle with Pital and the mouth of the Río San Rafael in\nthe San Carlos river.\n\ne)      One kilometer on the right bank downstream of the Río Virilla, in the area comprised between\nthe Bridge on the General Cañas highway and the Piedras Negras Bridge on the road that\nconnects Puriscal with Turrúcares of Alajuela.\n\nArticle 13.-Zone 3. (Puntarenas, San José) Large and small game hunting with bow and arrow, firearm,\nknife, and dog is prohibited: With the exception of the following days: July 6, 7, 20, 21, and 25; August 2, 3,\n4, 15, 17, and 18; September 7, 8, 15, 21, and 22; and October 5, 6, 12, 19, and 20. Furthermore,\nhunting is prohibited in the following sites:\n\na)     On Isla San Lucas.\n\nb)      In the area comprised in the single district of Parrita, of the canton of Parrita, starting from the\ntown of Valle Vasconia along the road that leads to Fila Aguacate until intersecting the channel\nof the Negro river, following from this point the channel of the same river downstream to its\nconfluence with the Río Chires. From this point, follow the channel of this river until\nintersecting the Puriscal Parrita road at the town of Vista de Mar; and from here,\nfollow the Costanera Highway until intersecting the Río Pirris, upstream until reaching the town\nof Valle Vasconia.\n\nc)      In the area between Golfito of the province of Puntarenas, following the\nroad that leads to Río Claro, continuing along the left bank of the Pan-American\nHighway South to the bridge over the Río Terraba, in Palmar Sur, from this point continuing along\nthe right bank of the river to Boca Coronado, finally closing at Golfito, the original starting point;\nexcepted from this prohibition is the hunting of ducks and doves carried out in lagoons and\nrice-planted areas located outside protected areas.\n\nd)      One kilometer on both banks of the Río María Aguilar, in the area comprised between the Los Anonos bridge on the old road that connects San José with Escazú and its mouth in the Río\nVirilla.\n\ne)      One kilometer on the left bank of the Virilla river, downstream, in the area comprised\nbetween the Bridge on the General Cañas highway and the Piedras Negras bridge on the road that\nconnects Puriscal with Turrúcares of Alajuela.\n\nf)      Hunting of the band-tailed pigeon on the road that leads between Vuelta de Jorco and Palmichal\nde Acosta, on both banks, and on Cerro el Guabal located at coordinates 205,500 North latitude and\n51,800 West longitude, Lambert North, Caraigres Sheet.\n\nArticle 14.-Zone 4. (Cartago, Limón). Large and small game hunting with bow and arrow, firearm,\nknife, and dog is prohibited:\n\na)      With the exception of the following days: January 1, 5, 6, 19, and 20; February 2, 3, 16, and 17;\nMarch 2, 3, 16, and 17; April 6, 7, 11, 20, and 21; and May 1, 4, 5, 18, and 19.\n\nb)      Of the paca (tepezcuintle) (Agouti paca) in the district of Orosí, canton of Paraíso, the cantons of\nJiménez and Turrialba, province of Cartago.\n\nc)      Of wild rabbits in the cantons of Central, Paraíso, La Unión, Jiménez, Alvarado,\nOreamuno, and El Guarco of the province of Cartago, with the exception of the dates October 5, 6, 12, 19, and 20 and November 2, 3, 16, and 17.\n\nArticle 15.-The mammals listed in this article are declared large game species (especies de caza mayor); they\nmay be hunted, according to the authorized dates (articles 11 to 14 of this decree) for each\nzone.\n\na)     Odocoileus virginianus: White-tailed deer; 2 males per year.\n\nb)     Mazama americana: red brocket deer, 1 male per year.\n\nb)     Canis latrans: coyote; 6 animals per year, subject to the authorized hunting season per zone.\n\nc)      Tayassu tajacu: collared peccary (sahino); 1 male per year, only in the districts of Paquera, Cóbano, and Lepanto,\nprovince of Puntarenas.\n\nArticle 16.-The animals listed in this article are declared small game species (especies de caza menor); they\nmay be hunted according to the authorized dates for each zone:\n\na)     Didelphis marsupialis: common opossum (zorro pelón); 5 pieces per year, per hunter.\n\nb)     Didelphis virginiana: Virginia opossum (zorro pelón); 5 pieces per year, per hunter.\n\nc)     Sylvilagus brasilensis: forest rabbit (conejo de monte); 10 pieces per year, per hunter.\n\nd)     Sylvilagus floridanus: eastern cottontail (conejo de monte); 10 pieces per year, per hunter.\n\ne)     Sylvilagus dicei: Dice's cottontail (conejo de altura); 10 pieces per year per hunter.\n\nf)     Sciurus variegatoides: variegated squirrel (ardilla común); 10 pieces per year, per hunter.\n\ng)     Agouti paca: paca; 2 pieces per year per hunter.\n\nh)     Dasyprocta punctata: Central American agouti (guatuza); 2 pieces per year, per hunter.\n\ni)     Urocyon cineroargenteus: gray fox (zorra gris); 2 pieces per year, per hunter.\n\nj)     Procyon lotor: raccoon (mapache); 4 pieces per year, per hunter.\n\nk)     Nassua narica: white-nosed coati (pizote); 3 pieces per year, per hunter.\n\nl)     Ctenosaura similis: black spiny-tailed iguana (garrobo); 4 pieces per year, per hunter.\n\nCHAPTER VI\n\nGeneralities on large and small game hunting\n\nArticle 17.-In the case of private properties, hunters must obtain the corresponding permit\nfrom the owner, in accordance with the provisions of article 32 of the Wildlife Conservation Law.\n\nArticle 18.-In accordance with the provisions of articles 12, 17, 30, and 63 of Law Nº 7317,\nWildlife Conservation Law, the Subregional Offices, as well as the\nAdministration offices of the National Wildlife Refuges in the different Conservation\nAreas, which make up the National System of Conservation Areas, shall be responsible for\nauthorizing, issuing, and signing continental and marine sport hunting and fishing licenses in\nthose protected areas that include marine extensions, required for the fulfillment of the\npurposes provided in this Decree.\n\nArticle 19.-\"Bag limit\" (límite de piezas) is defined as the maximum number of game animals authorized in the\npresent decree. The bag limit may be cumulative per hunting days in the case of\nducks, doves, and bobwhites, provided that the hunter reports the number of pieces hunted per day,\nto the Rural Assistance Guard Post (Delegación de la Guardia de Asistencia Rural) or to the SINAC office, nearest to the hunting\nzone visited.\n\nArticle 20.-The National System of Conservation Areas (SINAC) through its subregional\noffices may authorize the holding of hunting tournaments (Art. 24 of the regulations to the\nWildlife Conservation Law), depending on the status of the populations, by\nadministrative resolution, only when it concerns:\n\na)      Tracking of tracks prepared for the purposes of the tournament on a specific day; for which\nharassment, mistreatment, or killing of wild animals is not authorized.\n\nb)      Tournaments for small game hunting of songbirds and ornamental birds and their release at the same site of\ncapture, with a maximum of 4 tournaments per site per authorized period.\n\nc)      Song tournaments for songbirds in indoor or enclosed sites conditioned for such\npurpose.\n\nFor small game hunting tournaments for songbirds and ornamental birds, participants must carry and\nshow, if required, the corresponding valid hunting license.\n\nHunting tournaments must be supervised by SINAC officials from the corresponding Conservation\nArea.\n\nCHAPTER VII\n\nContinental fishing\n\nArticle 21.-Fishing is prohibited:\n\na)      For rainbow trout (Salmo gardnieri) in all national rivers, between February 1 and\nApril 30 inclusive; outside this period, fishing is allowed with a bag limit of 5 pieces with a minimum size of 25 cm. in length, per person per day. Fishing for trout farmed in ponds may be\ncarried out all year round.\n\nb)      For trout in the Toro river and its tributaries in the Toro Amarillo district of the canton of\nValverde Vega.\n\nc)      For guapote (Parachromis spp) snook (Centropomus undecimalis), tarpon (Megalops atlanticus)\nand other fish species, in the following rivers and their tributaries: Frío, Zapote, Niño or Pizote,\nlagoons of the Caño Negro Wildlife Refuge and the Las Camelias Wildlife Refuge,\nbetween April 1 and July 31 inclusive. Outside this period, fishing is allowed with a bag limit\nof 5 fish with a minimum size of 25 cm. in length, per person per day. Fishing for fish\nfarmed in ponds may be carried out all year round.\n\nd)      For tropical gar (gaspar) (Atractosteus tropicus) in the following rivers and their tributaries: Frío, Zapote,\nNiño or Pizote, lagoons of the Caño Negro Wildlife Refuge and the Las Camelias Wildlife Refuge, between March 1 and August 31 inclusive.\n\nOutside this period, fishing is allowed with a bag limit of 2 fish with a minimum size of 60 cm. in\nlength, per person per day.\n\ne)      For all species of freshwater fish in all rivers including their tributaries,\nlakes, and lagoons (except as established in subsections c and d of this article), between September\n1 and November 30 inclusive. Outside this period, fishing is allowed with a bag limit of 5\npieces with a minimum size of 25 cm. in length, per person with a license per day. Excepted is the\nmountain mullet (tepemechín) (Agonostomus monticola), for which no length limit is established, and gar (gaspar) for\nwhich a minimum size of 60 cm. is set.\n\nf)      For freshwater prawn or river shrimp (langostino o camarón de río) (Macrobrachium spp.) in all national rivers between May\n15 and December 31, inclusive. Outside this period, fishing is allowed with a bag limit of 10\npieces per person, per day.\n\ng)      Sport fishing in Laguna de Hule, located in the Bosque Alegre Private Wildlife Refuge, Cariblanco.\n\nh)      In Indigenous Reserves (except subsistence fishing carried out by indigenous people with\na permit from SINAC).\n\nArticle 22.-The following is authorized:\n\na)      Sport fishing, with rod and reel, as well as handlines, from 6:00 a.\nm. to 5:00 p. m.\n\nb)     Fishing every day of the year in:\n\n1.      The Reventazón river from Palomo de Orosí to its mouth, with the exception of its\ntributaries. The bag limit is established at 5 fish with a size greater than 25 cm., per licensed fisherman per day.\n\n2.      Fishing carried out with handline or rod and reel in the Arenal Reservoir. The\nbag limit is established at 10 fish per licensed fisherman per day.\n\n3.      In the Bars of Colorado, Parismina, Tortuguero, and Matina. The bag limit in the cited bars\nwill be 5 fish per fisherman per day. A river bar (barra) is understood to mean the channel\ncomprised up to one kilometer upstream, starting from its mouth.\n\nc)      Subsistence fishing carried out by Indigenous people in Indigenous Reserves with a permit\nfrom SINAC.\n\nd)      Fishing in Wildlife Refuges and National Parks when the activity is\ncontemplated in the Management Plan.\n\nArticle 23.-Fishing is prohibited indefinitely in the rivers: Sarapiquí, between the confluence\nof the Río Peje to the junction with the Puerto Viejo, between the confluence of the Río Sábalo\nEsquina to the junction with the Sarapiquí.\n\nArticle 24.-The National System of Conservation Areas (SINAC) through its subregional\noffices may authorize the holding of sport fishing tournaments (Art. 24 of the regulations\nto the Wildlife Conservation Law), for organized groups, depending on the\nstatus of the populations, by administrative resolution. Participants must\npresent their valid fishing license.\n\nCHAPTER VIII\n\nPossession of wild animals in captivity\n\nArticle 25.-In accordance with article 19 of Law Nº 7317 of December 7, 1992, the\nadministered parties who capture wild animals authorized by this decree and under the protection of the\ncorresponding license, must register said animals before the subregional office of the National\nSystem of Conservation Areas of MINAE that corresponds within the month following the capture.\n\nIn the case of possession of ornamental birds and songbirds in captivity in adequately\nconditioned aviaries, a limit of 15 birds in total is established, per licensed permittee.\n\nArticle 26.-Hunting or capture of species that do not appear\ncontemplated in the lists of species authorized for hunting (articles 5, 7, 15, and 16 of this\ndecree) is prohibited indefinitely.\n\nArticle 27.-Exhibition of songbirds or ornamental birds in farmers' fairs and\ncommercial establishments is prohibited.\n\nArticle 28.-Possession of wild birds in captivity must be governed by the stipulations of this\nDecree and Executive Decrees number N° 26435 MINAE and 28312 MINAE.\n\nArticle 29.-The application of this Decree is excepted for hunting preserves (fincas cinegéticas) duly\nregistered with the National System of Conservation Areas of MINAE.\n\nArticle 30.-Amend subsection p) of article 15 of Decree Nº 26435 MINAE, so that henceforth\nthe subregional offices may authorize hunting and fishing licenses and authorize\nhunting and fishing tournaments.\n\nArticle 31.-Repeal Executive Decree Nº 29148 MINAE.\n\nArticle 32.-This Decree takes effect from the first day of January of the year 2002 and expires on March thirty-first,\n2003."
