A. THE USE, REHABILITATION\n\nAND OPERATION OF THE TACARES\n\nHYDROELECTRIC PLANT\n\nArticle 1—The Costa Rican Railway Institute (Instituto Costarricense de Ferrocarriles, INCOFER) is hereby authorized to delegate to the Public Services Company of Heredia, S. A. (Empresa de Servicios Públicos de Heredia, S. A., ESPHSA), the use, rehabilitation, and operation of the hydroelectric plant named Tacares, which forms part of its assets and is duly registered in the Immovable Property Registry, Department of the National Registry, in the volume of State properties, province of Alajuela, No. 5, folio 119, entry 1, property No. 74,795, under the conditions that both entities define by way of an agreement. For such purposes, the water use concessions granted to INCOFER shall be used by ESPHSA, under the same conditions in which they were granted.\n\nArticle 2—INCOFER is hereby authorized to agree with the Municipality of Grecia to use, rehabilitate, and operate, in a tourism project, the area of the property where the Tacares hydroelectric plant is located that is not required to develop the rehabilitation and operation works of the plant to be carried out by ESPHSA. It may agree upon the term and with the stipulations that both parties define, and under the conditions determined by the National Environmental Technical Secretariat (Secretaría Técnica Nacional Ambiental, SETENA) and the corresponding department of the Ministry of Culture, Youth, and Sports. Likewise, ESPHSA is authorized to collaborate with the Municipality of Grecia in the rehabilitation works of the area, through the economic and material resources it may have available for such purposes.\n\nArticle 3—The properties where the Tacares hydroelectric plant, its installations, and constructions are located are hereby released (desaféctanse) from any current or potential use that destines them for railway operation and from any public use that restricts, in any manner, their use, rehabilitation, and operation by ESPHSA and the Municipality of Grecia.\n\nArticle 4—INCOFER, or the entity, body, or agency of the Public Administration that for any reason becomes the owner of its assets, is hereby authorized so that, once the plant has been rehabilitated and put into operation by ESPHSA, it may negotiate with it during the term of the agreement referred to in Article 1 of this Law, the transfer for valuable consideration, under the conditions that both determine and in accordance with the amount of a technically prepared appraisal for such purposes.\n\nIt shall take effect from its publication."
