  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 30478\n\n                        Determina no aumentar el área ya establecida para pago de servicios\nambientales en la modalidad de manejo de bosque para el período 2002.\n\nTexto Completo acta: 50D1A\nNº 30478-MINAE\n\nNº 30478-MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DEL AMBIENTE Y ENERGÍA\n\nEn ejercicio de las facultades constitucionales y normativas que les confieren el artículo 140,\nincisos 3) y 18) y 146 de la Constitución Política en relación con lo dispuesto en el artículo 3\ninciso k) de la Ley Forestal N° 7575; en los artículos 3°, 46, 47, inciso d) y artículo 4 de la Ley\nN° 8114 Simplificación y Eficiencia Tributaria del 4 de julio del 2001; en el artículo 3 incisos c)\ny d), del Convenio Regional para el Manejo y Conservación de Ecosistemas Naturales Forestales y el\nDesarrollo de Plantaciones Forestales, Ley N° 7572 del 1° de febrero de 1996; en el artículo 4°,\npárrafo 1, inciso d), de la Convención Marco de las Naciones Unidas sobre Cambio Climático, Ley N°\n7414 del 6 de junio de 1994; y en aplicación de lo dispuesto en el artículo 27 inciso 1) de la Ley\nGeneral de la Administración Pública\n\nConsiderando:\n\n1°-Que es política del Gobierno reconocer a los propietarios y propietarias de bosques y\nplantaciones forestales el pago de los servicios ambientales que brindan las áreas boscosas, tales\ncomo mitigación de emisiones de gases efecto invernadero, protección de recurso hídrico para el\nconsumo humano y generación de energía eléctrica, protección de la biodiversidad y belleza escénica.\n\n2°-Que la sociedad costarricense reconoce y contribuye al pago de servicios ambientales que brindan\nlos bosques y las plantaciones forestales, por medio del impuesto a los combustibles y otros\nhidrocarburos.\n\n3°-Que el Fondo Nacional de Financiamiento Forestal está facultado para captar financiamiento tanto\na nivel nacional como internacional para el pago de servicios ambientales que brindan los bosques y\nplantaciones forestales y otras actividades necesarias para fortalecer el desarrollo del sector de\nrecursos naturales del país.\n\n4º-Que para el año 2002 en el Decreto Ejecutivo N° 30090-MINAE se destinó para el pago de servicios\nambientales por los servicios que brindan las áreas boscosas, que técnicamente permitan el manejo\nforestal, mediante planes de manejo ejecutados por personas físicas o jurídicas en forma individual,\nque permitan un control y seguimiento más eficiente de las operaciones realizadas en el bosque, y\nque cumplan con los principios, criterios e indicadores de manejo sostenible, de conformidad a lo\nestablecido en los Decretos Ejecutivos N° 27388-MINAE y N° 27998-MINAE la suma de doscientos\ncuarenta y cuatro millones cincuenta y tres mil doscientos setenta colones (¢244.053.270,00) para el\nreconocimiento de los servicios ambientales en tres mil novecientos cincuenta y un hectáreas, (3 951\nha.).\n\n5º-Que el dicho decreto determinó en el artículo 11 un plazo máximo para la presentación de\nsolicitudes para el pago de servicios ambientales para el año dos mil dos, de treinta días naturales\ndespués de la publicación del respectivo decreto.\n\n6º-Que el plazo para la presentación de solicitudes para el pago de servicios venció el 14 de marzo\ndel 2002; y\n\n7º-Que es interés de la presente administración aumentar el área del pago de servicios ambientales\nen las modalidades de protección y reforestación.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 30478\n\n                        Determines not to increase the area already established for environmental service payments under the forest management (manejo de bosque) modality for the 2002 period.\n\nFull Text of Record: 50D1A\nNo. 30478-MINAE\n\nNo. 30478-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nExercising the constitutional and regulatory powers conferred by Article 140, subsections 3) and 18) and Article 146 of the Political Constitution in relation to the provisions of Article 3, subsection k) of the Forest Law (Ley Forestal) No. 7575; Articles 3, 46, 47, subsection d) and Article 4 of Law No. 8114, Tax Simplification and Efficiency, of July 4, 2001; Article 3, subsections c) and d), of the Regional Convention for the Management and Conservation of Natural Forest Ecosystems and the Development of Forest Plantations, Law No. 7572 of February 1, 1996; Article 4, paragraph 1, subsection d), of the United Nations Framework Convention on Climate Change, Law No. 7414 of June 6, 1994; and applying the provisions of Article 27, subsection 1) of the General Law on Public Administration\n\nConsidering:\n\n1.—That it is Government policy to recognize the owners of forests and forest plantations through environmental service payments (Pago de Servicios Ambientales) for the environmental services provided by forested areas, such as mitigation of greenhouse gas emissions, protection of water resources for human consumption and hydroelectric power generation, protection of biodiversity, and scenic beauty.\n\n2.—That Costa Rican society recognizes and contributes to the environmental service payments provided by forests and forest plantations, through the tax on fuels and other hydrocarbons.\n\n3.—That the National Forest Financing Fund is authorized to raise financing both nationally and internationally for the environmental service payments provided by forests and forest plantations and for other activities necessary to strengthen the development of the country's natural resource sector.\n\n4.—That for the year 2002, Executive Decree No. 30090-MINAE allocated for environmental service payments for services provided by forested areas, which technically allow forest management (manejo forestal), through management plans executed by individuals or legal entities, individually, which allow for more efficient control and monitoring of operations carried out in the forest, and which comply with the principles, criteria, and indicators of sustainable management, in accordance with the provisions of Executive Decrees No. 27388-MINAE and No. 27998-MINAE, the sum of two hundred forty-four million fifty-three thousand two hundred seventy colones (¢244,053,270.00) for the recognition of environmental services on three thousand nine hundred fifty-one hectares (3,951 ha.).\n\n5.—That the said decree established in Article 11 a maximum deadline for submitting applications for environmental service payments for the year two thousand two, of thirty calendar days after the publication of the respective decree.\n\n6.—That the deadline for submitting applications for service payments expired on March 14, 2002; and\n\n7.—That it is the interest of the current administration to increase the area of environmental service payments in the modalities of protection and reforestation.
