  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 30494\n\n                        Determina los documentos necesarios para el transporte de la madera por vías\npúblicas terrestres en el territorio nacional\n\nNº\n30494-MINAE-MOPT-SP\n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY LOS MINISTROS DEL\nAMBIENTE Y ENERGÍA,\n\nDE OBRAS PÚBLICAS Y\nTRANSPORTES\n\nY DE SEGURIDAD PÚBLICA\n\nCon fundamento en las\nfacultades que les confieren los artículos 50, 140, incisos 3) y 18) y 146 de\nla Constitución Política, la Ley Forestal Nº 7575 del 6 de marzo de 1996; lo\ndispuesto en la Ley Orgánica del Ambiente N° 7554 del 4 de octubre de 1995; en\nla Ley de Biodiversidad Nº 7788 del 30 de abril de 1998; lo dispuesto en los\nartículos 100, 101 y concordantes de la Ley N° 7331, de Tránsito por Vías\nPúblicas Terrestres, y lo dispuesto en la Ley General de la Administración\nPública Nº 6227 del 2 de mayo de 1978.\n\nConsiderando:\n\n1º-Que es función\nesencial y prioritaria del estado, velar por la conservación, protección y\nadministración de los bosques naturales y por la producción, el\naprovechamiento, la industrialización y el fomento de los recursos forestales\ndel país, destinados a ese fin, de acuerdo con el principio de uso adecuado y\nsostenible de los recursos naturales renovables.\n\n2º-Que estudios\ntécnicos señalan que un 34% de la madera que se comercializa en el país\npreviene de la tala ilegal. (\"La tala ilegal en Costa Rica, un análisis\npara la discusión\", elaborado por el Centro Agroeconómico Tropical de\nInvestigación y Enseñanza, CATIE).\n\n3º-Que la doctrina del\nderecho público, reconoce que el uso de una vía pública, al igual que sucede\ncon el uso de los demás bienes públicos, debe ser regulado sobre la base de\nrequisitos derivados de la seguridad y sanidades públicas, así como por razones\nque conciernen al buen régimen de la cosa pública o a su conservación.\n\n4º-Que la\nAdministración tiene la facultad general de reglamentación del uso de la vías\npúblicas; y\n\n5º-Que se requiere un\ntiempo prudencial para la que la Administración Forestal del Estado, ante el\ngrave problema de la tala ilegal, documentado por el estudio del CATIE antes\nreferido, diseñe y establezca un sistema institucional de control de tala\nlegal. Para ese fin formará\nbrigadas de control a nivel central y regional. Éstas brigadas contarán con el\napoyo de todas las instituciones del Estado para el cumplimiento de los fines\nprevistos en esta norma.\n\nArtículo 4º-La madera\nproveniente del bosque sea escuadrada, en block o en troza y los medios de\ntransporte utilizados que circulen fuera de las horas autorizadas en esta\nnorma, quedarán a la orden de la autoridad competente instruida para este fin,\nhasta tanto no se verifiquen los documentos respectivos y la procedencia de la\nmadera, verificación que será llevada a cabo por las autoridades\nadministrativas competentes.\n\nArtículo 5º-La madera\nque no cuente con la respectiva documentación será decomisada por las\nautoridades correspondientes. También se decomisará el medio de transporte\nusado. Ambos serán puestos a la orden de las autoridades del Ministerio del\nAmbiente y Energía, quienes contarán con un plazo de hasta tres días para\nrealizar la respectiva investigación y si es del caso, ponerlos a la orden de\nla autoridad judicial competente.\n\nArtículo 6º-Las guías\nde transporte que emita la Administración Forestal del Estado para el\ntransporte de madera en troza o aserrada, no podrán tener una vigencia mayor de\ntres meses. Dichas guías no podrán ser renovadas, lo cual implicará realizar\nuna nueva solicitud, siendo esta debidamente justificada por parte del regente\ny del criterio razonado producto de una inspección al lugar, por parte de los\nfuncionarios de la Administración Forestal del Estado. Los regentes deberán\naportar copia de los documentos que autoricen o expidan ante la correspondiente\noficina subregional de la Administración Forestal del Estado.\n\nArtículo 7º-La\nAdministración Forestal del Estado deberá sistematizar la información\nproveniente de las actas elaboradas en estos casos, y de los demás documentos\npertinentes para elaborar un estudio general y determinar el impacto jurídico\nde la normativa vigente para fundamentar los cambios legislativos necesarios.\n\nArtículo 8º-El\nMinisterio del Ministerio del Ambiente y Energía evaluará el problema de la\ntala ilegal, en el territorio nacional y establecerá las medidas\nadministrativas para reducirla, así como recomendar los cambios en la\nlegislación vigente.\n\nArtículo 9º-La\nResolución N° R-SINAC-DG-010-2000 del Ministerio del Ambiente y Energía,\nSistema Nacional de Áreas de conservación, publicada en el Diario Oficial La\nGaceta Nº 143 del miércoles 26 de julio del 2000, continuará aplicándose en lo\nque no se regule en este decreto para el transporte de madera, indistintamente\ncual sea su procedencia.\n\nArtículo 10.-Rige a\npartir de su publicación.",
  "body_en_text": "in the entirety of the text\n\n-\n\nFull Text of Norm 30494\n\nDetermines the necessary documents for the transport of timber on public land roads in the national territory\n\nNo. 30494-MINAE-MOPT-SP\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTERS OF ENVIRONMENT AND ENERGY,\n\nOF PUBLIC WORKS AND TRANSPORT\n\nAND OF PUBLIC SECURITY\n\nBased on the powers conferred upon them by articles 50, 140, subsections 3) and 18) and 146 of the Political Constitution, the Forest Law (Ley Forestal) No. 7575 of March 6, 1996; the provisions of the Organic Environmental Law (Ley Orgánica del Ambiente) No. 7554 of October 4, 1995; the Biodiversity Law (Ley de Biodiversidad) No. 7788 of April 30, 1998; the provisions of articles 100, 101 and related articles of Law No. 7331, on Transit on Public Land Roads, and the provisions of the General Public Administration Law (Ley General de la Administración Pública) No. 6227 of May 2, 1978.\n\nConsidering:\n\n1º-That it is an essential and priority function of the state to ensure the conservation, protection and administration of natural forests and the production, utilization (aprovechamiento), industrialization and promotion of the country's forest resources destined for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources.\n\n2º-That technical studies indicate that 34% of the timber commercialized in the country comes from illegal logging. (\"Illegal logging in Costa Rica, an analysis for discussion\" (\"La tala ilegal en Costa Rica, un análisis para la discusión\"), prepared by the Tropical Agricultural Research and Higher Education Center, CATIE).\n\n3º-That the doctrine of public law recognizes that the use of a public road, as with the use of other public assets, must be regulated based on requirements derived from public safety and health, as well as for reasons concerning the good governance of public property or its conservation.\n\n4º-That the Administration has the general power to regulate the use of public roads; and\n\n5º-That a prudential period is required for the State Forest Administration (Administración Forestal del Estado), given the serious problem of illegal logging, documented by the aforementioned CATIE study, to design and establish an institutional system for controlling legal logging. If it is \"in situ\" sawn timber, the transport guide for sawn timber must be provided plus the sawing invoice, unless it is the property owner, in which case they must carry the transport guide issued by the AFE. |\n\n*\nFor the transport of \"in situ\" sawn timber, the Transport Guide (Guía de Transporte) for processed timber issued by the State Forest Administration (Administración Forestal del Estado) must be carried.\n\nArticle 2º-In the interest of reducing the impact of illegal logging and exercising the sovereign power of the public administration, the transport of log timber (madera en troza), in block, or squared, or sawn, may only occur during the following schedule: Monday through Friday from five hours to twenty-one hours, that is, from 5:00 a.m. to 9:00 p.m., and on Saturday from 5:00 a.m. to 5:00 p.m.; that is, timber transport is prohibited from Saturday starting at 5:00 p.m. until Monday at 5:00 a.m. Timber originating from forest plantations and timber deposits is exempted from this regulation.\n\nArticle 3º-The MINAE, through the State Forest Administration, and the Ministry of Public Security, shall establish fixed and mobile control posts on roads they deem appropriate in order to control illegal logging. For this purpose, they will form control brigades at the central and regional levels. These brigades shall have the support of all State institutions for the fulfillment of the purposes set forth in this norm.\n\nArticle 4º-Timber originating from the forest, whether squared, in block, or in logs, and the means of transport used that circulate outside the hours authorized in this norm, shall be placed at the order of the competent authority instructed for this purpose, until the respective documents and the origin of the timber are verified, a verification that shall be carried out by the competent administrative authorities.\n\nArticle 5º-Timber that does not have the respective documentation shall be seized (decomisada) by the corresponding authorities. The means of transport used shall also be seized. Both shall be placed at the order of the authorities of the Ministry of Environment and Energy, who shall have a period of up to three days to carry out the respective investigation and, if applicable, place them at the order of the competent judicial authority.\n\nArticle 6º-The transport guides issued by the State Forest Administration for the transport of log or sawn timber may not be valid for more than three months. Said guides may not be renewed, which shall imply making a new request, this being duly justified by the regent and the reasoned criteria resulting from an on-site inspection by officials of the State Forest Administration. Regents must provide copies of the documents they authorize or issue to the corresponding subregional office of the State Forest Administration.\n\nArticle 7º-The State Forest Administration must systematize the information coming from the reports (actas) prepared in these cases, and from other pertinent documents to prepare a general study and determine the legal impact of the current regulations to support the necessary legislative changes.\n\nArticle 8º-The Ministry of Environment and Energy shall evaluate the problem of illegal logging in the national territory and shall establish administrative measures to reduce it, as well as recommend changes to current legislation.\n\nArticle 9º-Resolution No. R-SINAC-DG-010-2000 of the Ministry of Environment and Energy, National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), published in the Official Gazette La Gaceta No. 143 of Wednesday, July 26, 2000, shall continue to apply insofar as it is not regulated in this decree for timber transport, regardless of its origin.\n\nArticle 10.-It shall be effective upon its publication."
