  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 30747\n\n                        Reforma al Decreto que determina que previo a la autorización para la\nimportación de arroz, deben ser sometidos a una evaluación de riesgo de conformidad con la Norma\nTécnica RTCR 379-2000\n\nTexto Completo acta: 58FD3\nNº 30747-MAG\n\nNº 30747-MAG\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AGRICULTURA Y GANADERÍA\n\nEn ejercicio de las facultades que\nles confieren los artículos 140, incisos 3) y 18), y 146 de la Constitución Política,\nla Ley Nº 7664 del 8 de abril de 1997, Ley de Protección Fitosanitaria y el Acuerdo de\nMedidas Sanitarias y Fitosanitarias de la Ley Nº 7473 del 20 de diciembre de 1994, Ley de\nEjecución de los Acuerdos de la Ronda Uruguay de Negociaciones Comerciales\nMultilaterales.\n\nConsiderando:\n\n1º—Que es función esencial del Estado proteger la salud y la\nvida de las personas y animales, así como garantizar la protección de los cultivos de\nlas plagas y enfermedades que puedan poner en riesgo o causar daños a la producción\nagrícola.\n\n2º—Que para la economía nacional y la seguridad alimentaria, la\nprotección fitosanitaria de los cultivos en nuestro país resulta fundamental, en\nespecial de aquellos que son esenciales en la dieta de los costarricenses, lo que obliga\nal Estado a adoptar todas las medidas de prevención, vigilancia y control necesarias para\nevitar el ingreso al país de plagas y enfermedades que pongan o causen daños a la salud\nde las personas o al patrimonio vegetal de nuestro país.\n\n3º—Que es un derecho fundamental de todo Estado, en el marco del\nacuerdo para la aplicación de medidas sanitarias y fitosanitarias, adoptar aquellas que\nresulten necesarias para proteger la salud y vida de las personas, los animales y los\nvegetales, basando esas medidas en una evaluación adecuada a las circunstancias y los\nriesgos eventuales que ello conlleve.\n\n4º—Que la producción y consumo de arroz constituye un aspecto\nfundamental en la alimentación de la población, lo que obliga a adoptar todas las\nmedidas de control requeridas para evitar que plagas o enfermedades ingresen a nuestro\npaís y causen daños a la salud de los consumidores o se ponga en riesgo la seguridad\nalimentaria.\n\n5º—Que en los últimos meses la alta incidencia de la maleza\nconocida como arroz rojo, ha obligado al Servicio Fitosanitario del Estado, a establecer\nun programa de control de dicha maleza, en especial los controles en los puntos de ingreso\ndel arroz importado mediante laboratorios de prediagnóstico para identificación de la\nmaleza, lo que obliga a incrementar el costo de los servicios de inspección, toma y\nanálisis de muestras del producto importado.
