Naranjo V. a la sazón Canciller de la República de Costa Rica.\n\nConsiderando:\n\n1º—Que el Convenio de Basilea sobre el Control de los Movimientos\nTransfronterizos de los Desechos Peligrosos y su Eliminación, hecho en Basilea, Suiza el\n22 de marzo de 1989 conocido como Convenio de Basilea, del cual Costa Rica es Parte,\nproporciona una estructura para controlar el tráfico internacional de desechos\npeligrosos.\n\n2º—Que dicho Convenio en su artículo 11, párrafo 1 contempla la\nposibilidad de que Estados que no sean Parte de este Convenio, como es el caso de los\nEstados Unidos de América, puedan celebrar un Acuerdo con un Estado Parte, para el\nmovimiento transfronterizo de desechos peligrosos, con tal que dicho Acuerdo no menoscabe\nel manejo ambientalmente racional de los desechos peligrosos, y que las cláusulas que\nestipule tal Acuerdo no sean menos ambientalmente racionales que las previstas por este\nConvenio.\n\n3º—Que el Acuerdo sobre el Movimiento Transfronterizo de Desechos\nPeligrosos entre el Gobierno de la República de Costa Rica y el Gobierno de los Estados\nUnidos de América mencionado, se formalizó mediante la Nota número130 de 30 de\nsetiembre de 1997 del Excelentísimo Señor Peter Jon de Vos a la sazón Embajador de los\nEstados Unidos de América y la Nota DM-560-97 de 17 de noviembre de 1997(Nota de\nrespuesta) del Señor Fernando E. Naranjo V. a la sazón Canciller de la República de\nCosta Rica.\n\n4º—Que de conformidad con los principios generales que rigen el\nDerecho de los Tratados un convenio internacional puede ser enmendado por acuerdo entre\nlas partes.\n\n5º—Que ambas Partes han convenido en celebrar el presente Acuerdo\nmediante la modalidad de canje de notas de acuerdo a lo expresado en los considerandos\nanteriores.
