  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 30754\n\n                        Deroga el Decreto Ejecutivo número 29415-MP-MIVAH- MINAE\n\nTexto Completo acta: 5952F\nNº 30754-MP-MIVAH-MINAE\n\nNº 30754-MP-MIVAH-MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA,\n\nLA MINISTRA DE LA PRESIDENCIA,\n\nEL MINISTRO DE VIVIENDA Y ASENTAMIENTOS HUMANOS\n\nY EL MINISTRO DEL AMBIENTE Y ENERGÍA\n\nEn uso de las facultades que le confieren, los incisos 10) y 12) del\nartículo 140 de la Constitución Política de la República de Costa Rica.\n\nConsiderando:\n\n1º—Que con fecha diecinueve de abril del dos mil dos, se publicó\nen La Gaceta número setenta y cinco, el Decreto Ejecutivo número\n29415-MP-MIVAH-MINAE, mediante el cual se adiciona un inciso 4.6 al artículo 4 del\nDecreto Ejecutivo 25902-MIVAH-MP-MINAE, publicado en el Alcance número 15 a La Gaceta\nnúmero 66 del día lunes 7 de abril de 1997.\n\n2º—Que mediante dicha adición se rompe el anillo de contención\ndel desarrollo urbano establecido por el Plan Regional de Desarrollo Urbano de la Gran\nÁrea Metropolitana (GAM) el cual es la línea divisoria, en su mayor parte aunque no\nexclusivamente, entre zonas bajas o planas y las zonas altas del Valle Central, en el\nÁrea Metropolitana de San José, Heredia y Alajuela y el cantón del Guarco,\nperteneciente al Área Metropolitana de Cartago.\n\n3º—Que la decisión de hacer este rompimiento no está respaldada\npor un estudio técnico completo que demuestre que los estudios anteriores que sirven de\nbase a la ubicación y existencia del anillo de contención establecido en la GAM han\nquedado obsoletos.\n\n4º—Que el rompimiento del anillo de contención ya mencionado\nhace más vulnerables desde el punto de vista ambiental zonas de protección no aptas para\nel desarrollo de proyectos urbanísticos al permitir, entre otros, que zonas altas y con\nfuertes pendientes, donde existe peligro de deslizamientos y otras amenazas naturales\npudieran ser urbanizadas intensivamente con los correspondientes riesgos para los\nasentamientos humanos que allí se constituyeran y para la preservación del recurso\nhídrico de varios mantos acuíferos existentes en esas zonas.\n\n5º—Que si bien es cierto la solución de los actuales problemas\nhabitacionales es prioridad del Gobierno, esta prioridad no puede pasar por alto la\nsostenibilidad de las condiciones en que vivan las futuras generaciones del país. Por lo\ntanto cualquier acción que se emprenda para resolver esa problemática deberá contemplar\ncon sumo cuidado las repercusiones a futuro para el Gran Área Metropolitana.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 30754\n\n                        Repeals Executive Decree number 29415-MP-MIVAH-MINAE\n\nComplete Text record: 5952F\nNo. 30754-MP-MIVAH-MINAE\n\nNo. 30754-MP-MIVAH-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC,\n\nTHE MINISTER OF THE PRESIDENCY,\n\nTHE MINISTER OF HOUSING AND HUMAN SETTLEMENTS\n\nAND THE MINISTER OF THE ENVIRONMENT AND ENERGY\n\nExercising the powers conferred by subsections 10) and 12) of\narticle 140 of the Political Constitution of the Republic of Costa Rica.\n\nConsidering:\n\n1º—That on April nineteenth, two thousand two, there was published\nin La Gaceta number seventy-five, Executive Decree number\n29415-MP-MIVAH-MINAE, whereby a subsection 4.6 is added to article 4 of\nExecutive Decree 25902-MIVAH-MP-MINAE, published in Supplement number 15 to La Gaceta\nnumber 66 of Monday, April 7, 1997.\n\n2º—That through said addition, the urban development containment ring\nestablished by the Regional Urban Development Plan of the Gran Área Metropolitana (GAM) is broken, which is the dividing line, for the most part but not\nexclusively, between low-lying or flat zones and the high zones of the Valle Central, in the\nMetropolitan Area of San José, Heredia and Alajuela and the canton of El Guarco,\nbelonging to the Metropolitan Area of Cartago.\n\n3º—That the decision to make this break is not supported\nby a complete technical study demonstrating that the previous studies that serve as\nthe basis for the location and existence of the containment ring established in the GAM have\nbecome obsolete.\n\n4º—That the breach of the aforementioned containment ring\nmakes protection zones not suitable for the development of urban projects more vulnerable from an environmental standpoint by allowing, among other things, high zones with steep slopes, where there is a danger of landslides and other natural threats, to be intensively urbanized, with the corresponding risks for the human settlements that would be established there and for the preservation of the water resource of various aquifers (mantos acuíferos) existing in those zones.\n\n5º—That while it is true that solving current housing problems is a priority of the Government, this priority cannot overlook the sustainability of the conditions in which the country's future generations will live. Therefore, any action undertaken to resolve this issue must very carefully consider the future repercussions for the Gran Área Metropolitana. Therefore,\n\nThey decree:\n\nArticle 1º—Executive Decree number 29415-MP-MIVAH-MINAE, issued on the twenty-eighth day of the month of March two thousand one, published in La Gaceta number seventy-five of April nineteenth, two thousand one, is hereby repealed.\n\nArticle 2º—It takes effect upon its publication."
