del\n2002.\n\nConsiderando:\n\n1º—Que desde el año 1977, los gobiernos participantes en la\n\"Conferencia Intergubernamental sobre Educación Ambiental\", llevada a cabo en\nTibilisi, antigua URSS, acordaron asumir la educación ambiental como un asunto\nprioritario, e incluirla en todos los niveles del sistema educativo formal, así como en\nla educación no formal y en los medios de comunicación colectiva.\n\n2º—Que en la \"Cumbre de la Tierra ECO-92\" se elaboró\nel documento \"Agenda 21\" y en su capítulo 36 señala el compromiso adquirido\npor los gobiernos, de fomentar la educación, capacitación y toma de conciencia en\nmateria ambiental.\n\n3º—Que la Constitución Política en su artículo 50 establece el\nderecho de toda persona a tener un ambiente sano y ecológicamente equilibrado.\n\n4º—Que los artículos 6º, 12, 13 y 14 de la Ley Orgánica del\nAmbiente Nº 7554 obliga al Estado y municipalidades a fomentar la participación\nciudadana en la toma de decisiones y acciones tendientes a proteger y mejorar el ambiente,\npor lo que debe fomentar, junto con instituciones públicas y privadas, la inclusión\npermanente de la variable ambiental en los procesos educativos, formales y no formales con\nel propósito de relacionar los problemas del ambiente con las preocupaciones locales y de\npolítica nacional de desarrollo, incorporando el enfoque interdisciplinario y la\ncooperación, utilizando para ello, entre otras formas, la participación de los medios de\ncomunicación colectiva en la formación de una cultura ambiental hacia el desarrollo\nsostenible de los habitantes de la Nación.\n\n5º—Que en los artículos 108,109, 110 y 111, del Reglamento a la\nLey de Uso, Manejo y Conservación de Suelos, se emiten las disposiciones generales sobre\nla educación ambiental y la divulgación en el ámbito ambiental. the National Parks Service Creation Law, No. 6084 of August 24, 1977; the Wildlife Conservation Law, No. 7317 of December 7, 1992; the Organic Environmental Law, No. 7554 of November 13, 1995; the Forestry Law (Ley Forestal), No. 7575 of April 15, 1996; the Biodiversity Law, No. 7788 of April 23, 1998; the Regulation to the Law on the Use, Management and Conservation of Soils, Executive Decree No. 29375-MAG-MINAE-S-HACIENDA-MOPT of March 21, 2001; and the General Regulation of the Ministry of Environment and Energy, Executive Decree No. 30077-MINAE of January 16, 2002.\n\nConsidering:\n\n1º—That since 1977, the governments participating in the \"Intergovernmental Conference on Environmental Education,\" held in Tbilisi, former USSR, agreed to take on environmental education as a priority matter and to include it at all levels of the formal education system, as well as in non-formal education and in mass media.\n\n2º—That at the \"Earth Summit ECO-92,\" the document \"Agenda 21\" was prepared, and its Chapter 36 indicates the commitment made by governments to promote education, training, and awareness in environmental matters.\n\n3º—That the Political Constitution, in its Article 50, establishes the right of every person to a healthy and ecologically balanced environment.\n\n4º—That Articles 6, 12, 13, and 14 of the Organic Environmental Law No. 7554 oblige the State and municipalities to promote citizen participation in decision-making and actions aimed at protecting and improving the environment; therefore, they must promote, together with public and private institutions, the permanent inclusion of the environmental variable in formal and non-formal educational processes for the purpose of relating environmental problems to local concerns and national development policy, incorporating an interdisciplinary approach and cooperation, using for this purpose, among other means, the participation of mass media in the formation of an environmental culture geared towards sustainable development for the Nation's inhabitants.\n\n5º—That in Articles 108, 109, 110, and 111 of the Regulation to the Law on the Use, Management and Conservation of Soils, the general provisions on environmental education and dissemination in the environmental field are issued. Therefore,\n\nTHEY DECREE:\n\nArticle 1º—To create the Ministerial Commission on Environmental Education (Comisión Ministerial de Educación Ambiental, COMEA), which shall be coordinated by the Office of Environmental Education (Oficina de Educación Ambiental).\n\nArticle 2º—Said Commission shall have the following functions:\n\n1) Coordinate environmental education actions carried out nationally by the Ministry of Environment and Energy (Ministerio del Ambiente y Energía, MINAE) through its various units.\n\n2) Develop and support the Ministry's Environmental Education Program.\n\n3) Promote training and the exchange of experiences among MINAE officials in environmental education, at the national and international levels.\n\n4) Carry out other tasks assigned by the Office of Environmental Education.\n\nArticle 3º—The Commission shall work in close coordination with all directorates and units that comprise MINAE, for which their directors and/or coordinators shall provide support and collaboration to carry out the various functions of that body.\n\nArticle 4º—The Environmental Education Commission of MINAE shall be composed of:\n\n1) A coordinator from the Office of Environmental Education of MINAE, who shall coordinate it.\n\n2) The person responsible for environmental education from each of the following units comprising MINAE: Directorate of Geology and Mines (Dirección de Geología y Minas), General Directorate of Hydrocarbons (Dirección General de Hidrocarburos), Energy Sector Directorate (Dirección Sectorial de Energía), National Forestry Financing Fund (Fondo Nacional de Financiamiento Forestal), National Meteorological Institute (Instituto Meteorológico Nacional), Costa Rican Office for Joint Implementation (Oficina Costarricense de Implementación Conjunta), Civil Society Office (Oficina Sociedad Civil), Gender Office (Oficina de Género), Press and Public Relations Office (Oficina de Prensa y Relaciones Públicas), National Environmental Technical Secretariat (Secretaría Técnica Nacional Ambiental), National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), and others that may be created.\n\nArticle 5º—Once the Commission is constituted, it shall be responsible for drafting internal bylaws for its operation.\n\nArticle 6º—The Office of Environmental Education, through the Commission, shall promote and facilitate the implementation of joint environmental education actions in order to use available resources more efficiently, oriented toward promoting the country's sustainable development and improving the quality of life of Costa Ricans, and to ensure compliance with ministerial directives.\n\nArticle 7º—Shall become effective upon its publication." }
